Beginning December 19, 1997, "agencies that provide means-tested public benefits to immigrants may enforce Affidavits of Support against their sponsors" until the immigrants become U.S. citizens, can be credited with 40 quarters of work, leave the United States permanently, or die.


Benefits being received by USCs do not have any impact on the fiance. The above information is in regard to means-tested benefits for the non USC - not the case here.



That part I understand, but I had heard (don't know if it is true) but I had heard that your chance of getting a visa when the USC is on some type of assistance could cause a problem. They said that immigration will think seeing as me or my children are getting benefits then he will end up getting benefits. This is why I asked. Hope I am not aggravating anyone with all my questions, I am sorry if I am. I just like to be well prepared waaayyy in advanced.

No, an I-864 is not binding for 10 years. Except by coincidence, when one of the events that releases the obligation happens to occur at the 10-year point.

Otherwise, the obligation could last for less than 10 years or it could last for more than 10 years.

When signing an I-864 it is saying to the USCIS that you will be responsible for the financial support of the immigrant for 10 years, a big thing to ask of a co-sponsor.

What are the events that can release it earlier?

Ok so when we have the AOS what is the co-sponsor reliable for. For example; right now I am on disability, food stamps, sec 8, and my kids get Medical Assistance. When he comes out here I know that I will have to for sure get rid of the food stamps. But will I have to get rid of the Sec 8? I have asked the housing authority if it is a state means tested benefit and my worker said no, for some reason I don't think she knows what she is taking about. Also, will this cause a problem that I am currently on some type of government and state services for him to get his visa?(even if I have a co-sponsor who makes the rerequirments. Will I have to take my kids off of the Medical Assistance?

Can anyone help me? I have been reading about the co-sponsor responsibilities. My fiance is from Dominican Republic and we are getting a co-sponsor, I want to know what what is the difference between I-134 and the I-864? I know I-134 is not binding, but when is each one used? Example- Is the I-134 used when we go to the Santo Domingo counslat? and the I-864 used at the interview for Adjustment of status? How does this work I am so confussed. Thank you, WJR.

I would have to say that I am not sure if my advice was good either. Only because I can not remember what the question was. Also, the advice that was given by my lawyer was pertaining to my fiance not of myself. I am just trying to help and seeing as your concerned about your record than my answer would not help. We answered the questions in Part C correctly (nothing checked) on the I129f although a record exists for other crimes ... would that effect an approval?

You have to be more specific on what the crime is. Although I can not think of question C right at this point because I have already sent in my petition, it would be best to put down any thing the person has been arrested for, even a driving offense. It is best to be truthful and specific than to try and hide it and they find out later. They will think you tried to lie to them. I am not an expert but this is what my lawyer had told me when I had a similar situation. WJR

Since NVC's automated email checking thing looks at the subject line (I'm assuming) before it responds to tell you whether your case has arrived, I was wondering if it matters how you put the case number in.

Whether it's WACXXXXXXXXXX like the online notification does or
WAC X-XXX-XXX-XXX like it shows on the NOAs.

Or if it even matters at all.

WJR: It appears Morocco is currently crossing it off of the list. All of the people in our forum (Middle East) have said they did not ask for the I 134 at the interview. But most are taking it on the off chance they try to trip us up. :yes:

My fiance and I are going through the same thing. We hired an attorney and received an RFE 2 months after filing. He tried to blame it on IMBRA etc. We just received the RFE today by snail mail. I have no idea why they did not send it to the attorneys office but we are SO HAPPY that USCIS sent it to us. We are now wishing we would have never hired this attorney either. He even posts on his web page that they DON'T receive RFE's. Unbelievable isn't it?

My US Citizen fiancee has filed a K-1 visa application over 3 months ago, via an attorney. However, 2 months later, we got an "RFE" notification!!! Again, it is being "handled" by our attorney, but we are both unhappy how long it is taking for our information to get back to USCIS.
My question is: how easy/hard it would be for us to dismiss/change our attorney and would it slow things down even more?
Your advice is much appreciated!

My NOA2 date is 08/25/06 and I have seen any updates to the status of my case since 08/31/06. I am now seeing people with NOA2 dates in September indicating they have received an RFE or NOA2. Is it worth calling the CSC to inquire why there is no evidence that my case is being reviewed? If I call, any suggestions on how to navigate the system to get answers?

:unsure: Welcome to our own private hell my friend. My N0A1 date is 10 August and I haven't heard tiddly.. no RFE, no N0A2, no touches. NOTHING!!!! You can't call CSC directly but you can call the 800 help line. But they won't offer you any help... at least they didn't offer me anything but more frustration. I called them two weeks ago to inquire about my petition. It took over 40 minutes of listening to different recorded messages as I navigated through their phone system. I finally got a live person, but she wasn't helpful at all. She told me that my case was not yet 6 months old and that I shouldn't call them back until then. She said that CSC had 6 months to process my petition and that CSC worked the cases as they got them. I told her that many petitions had already been approved that had gone to CSC well after my N0A1 date. She didn't care. She told me that she didn't have CSC information and didn't know how CSC operated. She told me that she could only tell me that I was not yet beyond the time allocated to USCIS to process my type of petition. She said that I could write a letter to CSC with my questions or if I felt that I had a grievance to file against CSC then she could give me an address to send my complaints to. All I want to know is WHY are September petitions being approved when there are still March, April, May, June, July and August petitions still waiting. No one can tell you why. Everyone online here at VJ tells me to be patient and my time will come. That's easy to say when you already have your N0A2 in your hand. I don't know if my case is lost, misplaced, in name check, or is just gathering dust in some corner. I would guess you feel the same about your petition? Is there anything unusual about your petition such as you having several divorces... your fiance having divorces... Is this your first K-1 petition or have you submitted a

Sorry.. I meant to say 11 including myself. I'm sick and tired of this because people are now getting approved in September.. and the way it's going they'll be approving October before they get to us. I also thought name checks were for NVC to do... but apparently CSC can do them too... and then guess what? When you do finally get to NVC and NVC wants to do a name check too... then the process starts over again. NVC doesn't usually accept the CSC name check. One guy waited 7 months at CSC because of name checks. When his application got to NVC he had to wait another 7 months for another name check. Someone needs their arses kicked for making this process suck so badly. Oh.. by the way, do you have anything odd or unusual about your application that might be holding it up? Such as prior submissions of a K-1 before this one? Many divorces? Criminal record?


Not that I know of, I have a divroe that was completed on Dec 16th, 2005. Other than that I do not have anything else. What about you?

the WAC number was taken off your noa1, so that means your in the system and all is good.

why dont you see if the lawyer has the paper noa1? i dont even know how much you need the paper copy, but im sure they could resend if it has been lost in the post.

that notice you got was the NOA1, that means that they received your case and cashed your money order. So everything is going fine... just slowly.

I do not think that was his NOA1 notice, but sounded more like the receipt notice from the mail service used.



wjr- Hvae you received in the mail a letter from the Department of Homeland Security confirming receipt of your case? (this is the NOA1) It usually arrives by regular mail in 2-4 weeks after submitting the petition. If you have not received it by now, there is a problem. Can you verify if the money order has been cashed? with personal checks the offical case number is printed on the back - not sure if this will work for money orders.

Ok here is the deal, We sent our petition out on Aug 15th, then we receive an email from our lawyer saying that the USCIS has received our petition and this is your receipt number WAC XXXXXXX. Now I have just finished calling Western Union to find out if my money order has been cashed, it was on Aug 25th. So should I still be worried? :unsure: Who filed in August 2006 for K-1 and still don't have their N0A2 approval? I filed on 2 August and got my N0A1 on 10 August. 105 days and still waiting. NO touches. No RFE. I called the 800 number and they told me to not bother them again until 6 months had passed. I have no idea if I'm in name check, lost in limbo-land, or just being totally ignored. I'm happy for all those others in August who've gotten their N0A2's and even a little bit happy for those who are now getting approved in September. But it does tick me off that I'm early August with no known issues with my petition, having sent in everything they could ever possibly want or need, including the kitchen sink... and since I've gotten no RFE's about needing additional evidence, my conclusion is that I'm lost in the system somewhere... maybe under a pile of other applications, who really knows and I can't find out because my application isn't 180 plus days old yet. And still more who filed after me are getting their N0A2's. Heck, some of those who filed at the same time as me in early August were approved in 40-50 days and already have their embassy interview dates. I know there must be others in August who are in the same boat that I'm in... and misery loves company... so I'm asking who's left from August?


DON"T PANICK, I filed on Aug 15th got NOA 1 Aug 17th, I have not had any touches or nothing either. Relax I am trying to think positive and your starting to get me worked up......lol. Anyways, if this help any not sure if it would pertain to you or just me, but, my lawyer said that my file should be approved this month sometime. If the I-129F applicant is a USC, has met their fiance in the prior two years in person and provides all of the required documentation, it makes no difference if the applicant is male or female.

At the interview, age differences can certainly come into play.

So maybe I haven't even been waiting a bit as long as others, but I am confused by seeing that a lot of people who applied for their K-1 through the California Service Center received notices of approval about 2 - 2 1/2 months after the receipt date. Did you all do something special like contact your senator? Or just luck and maybe they are just doing a great job out there? I know we have enough evidence so I'm just wondering if I need to be working harder.

So happy!!! I just checked the website this morning but it had not updated. When i went to check my mail box I had a letter from the CSC saying i was approved. I guess CSC isnt doing emails. Amazing how you can go from hating everyone at CSC to loving them with 1 little letter. :) Good luck to all those that have not recieved their NOA2s yet.

Let me rephrase this, it is a God given right to make a decision for your life give it right or wrong. You have the right to marry. God did not say you can only marry if you are not on welfare, he did not say you can not start this process if you are on welfare. Every human being has the God given right to pursue happiness no matter who it is with, where they are at, or what their situation is. You are correct in saying it is a benefit to us due to our citizenship, but it is our "right to choose" if we want to be with a person from another contry and to start this process. My point to all this is; if someone is on welfare, it is not our place to judge, ridicule, or say that they do not have a right to marry anyone from another country, and sure does not give anyone one the right to knock a person down just because they are not living the lifestyle we are, or "WE" think they should be. I can not believe how our world is now adays. It completly disgusts me to know that so many people enjoy hurting another. I am willing to bet that any person who is below poverty guidelines is going to do what ever they possibly can to be with the person they love. I had a friend of mine that lived in china for a few years and when he came back to the united states .He discovered he had cancer . Went to the VA hospital had the operation and chemo things. His family was on welfare for about a year. sometimes it is needed. Now he drives truck and his wife who is from South Africa works teaching school. She has a masters degree by the way. Now while I understand at times there are a certain class of people who will not work there are others that cannot work. Maybe this person she is bringing over will some day get her off the welfare rolls. Many times there is a lot more hustle in immigrants than native born americans. That said she does need a co-sponser to make it through this process.

Let me tell you all something. Merry Xmas!!!!!! It is my honest and researched opinion that while there is nothing wrong with being on welfare staying on welfare has a more crippling effect than arthritis. It makes no sense for someone who is on welfare at the current time to be considering an immigrant K1, K2. CR1 visa, unless it is for unscrupulous reasons. The facts will show that the original poster of this subject was seemingly asking for a friend, so it is fair to assume that the person who is actually on welfare has not seen this post, but has posssibly received some feedback from the person who is a memeber here.
Perhaps in my desire to be humorous I failed by insinuating that the lady in question was a single mom w/ 3 kids with diffferent last names. Perhaps if we had more history on the person instead of only second hand information to make inferences from we could better judge. My response was based opn the age old idealogy that a stupid question sometimes garnishes a stupid answer. It makes no sense to anyone that has been through the process and realizes the substantial cost involved with the process to believe that someone receiving either state of federal aid would be in a financial position to complete the process. So oin summarizing my original response it was just a stupid answer to a stupid question, but a question nonetheless. So a good answer might be; I hope said person has substantial financial resources to ado the expected financial obligations that bringing a beneficiariary to this country takes. The fees alone can total into the thousands with transportation costs, passports, documentation collection and such and a decision of this magnitude should definetly be thought through in a thorough manner and with much consideration given to both the financial and time consuming process.
In closing let me say that I wish we had more information and facts on the "petitioner". Perhaps knowing how long she has been on the welfare rolls, age of her children, marriage history, medical history and placement in her schooling would clarify many things and allow me to make a better inference of her situation than from a question without any substantial background knowledge that led me to make my immoral response.
I really just thought it was a stu[id question and gave an intended as humorous response as such.

I am on disability and have two kids, I was on welfare for 2years before I received my disability. I attend school so that I am able to get a job that my "physical situation" will allow me to support myself, my kids, and my fiance. There is no problem with a person being on welfare if it is needed. And unless you "KNOW FOR A FACT" that she is on welfare just because she does not want to work......then I suggest you shut your FU!!!! mouth. Hi - having gone through the same thing for the past 2 years (divorce) and also being that I live in Wisconsin - I can honestly tell you that you have to wait. I got married in another country and they would not allow us to marry until I showed them the divorce certificate and they asked if I knew if my state had any restrictions on remarriage. When I said that I didn't think so - they looked it up on the computer and she said that there is a 6 month waiting period after it's final. She said that had I not waited that we would not be allowed to get married.

Sorry for the bad news. But in the meantime - I'd apply for the K1 visa.

I had an attorney do our paper work. but i believe they ripped me off. just make sure u have copy of emails, phone bills, letters and as many pics u can live without. and one more thing how did u write your letter of intent? it best be 2-3 pages long... they want to know everything from the day u met to the present time. tell about your trip if u went to see him. what u did together. his family, friends ect... and how u r doing without him and how u get through everyday life knowing he isnt there and what u both have planned for the future.... how he asked u to marry him everything. if u think aobut something put it in and it wont hurt to write yours and then help him write his to make sure it some what is the same.. like dates and all when special this happend and what not... i am waiting for the letter saying my paperwork was sent to morocco and then wait again and plan our wedding... so how long have u known each other it will be a year for me and its been 10 months since is seen my hun. i just want this all over... my petition was filed on april 5 and the pocessing time is back on march 20th so maybe it wont be sent to morocco then until my file date comes up not sure our gov. does what the want so its just wait and see...lol.... hope this helped and take care hope to hear from u soon.

I am new to this sight. I have filled out the initial forms (I-129F) for the K-1 visa, and am in the process of making the copies of my passport, photos, phone records, and all of that jazz. My fiance Fran has filled out his biographic information form (G-325A) with his signature, and will be mailing that to me shortly. When I receive his part, I will mail everything in exactly as asked for. I am builing a strong case with all of the necessary evidence so that they can't possible ask for more. Can somebody please tell me how long of a wait we are in for? Will they accept us if we give them everything they ask for?! We will mail our papers in to the Texas office. Can somebody please give me a little bit of encouragement and tell me that it will be ok...

my petition had copies of my phone bills in it for proof of relationship i also had an attorney do mine wish was a waste of time and lots of money, but i know they want to see eveything possible, send all the pics u can live without, more info. hopefully less b.s. oh.... and on your letter of intent i was told by my attorney for my fiance and i to rewrite it and they want the whole story from who u are to when u met and when u seen each other for the first time to what u did when u were together and if u met his or her family everything make a stronge case for u and your fiancee.... when u find your soulmate u have to do whatever u have to, to share your lives together... best of luck everyone i just reseved my notice from the NVC it was dated Sept. 18 and its being sent to casa, morocco very soon and i cant wait to see my love again.... no more sitting in from of this pc. my chair has a implant in it....lol...

don't need phone cards or phone records for initial filing of I-129f. that's the type of evidence you use at the interview for proof of ongoing relationship. save it for the interview.

i had gotten attorney and now i wish i wouldn't of. this website is so wonderful. my petition date is april 5th 2006, and i dont feel it was any faster. people say it would be and thats y i took my money to pay for a attorney and not a trip to see my fiance. Now if i could do things different i would of done it myself.. all i can say the attorney helped with was they put the petition together and told me that our intent letter should be everything from who u are to when u met and how and when u seen him/her y u want to marry your fiance.. about his/her family your family.... they advised me it should be at least 2-3 pages long... show everything that has to do with u and your fiance... best of luck.... i am waiting for my packet from NVC... cross your fingers... and it does all depend on where u have to send your petition.. and really i believe they do what they want anyways....

Sorry if this q has been answered before, but what are the pros and cons of using an immigration attorney to handle the K-1 visa process? Is one really necessary? Can I save several months of processing time with an attorney to justify the cost (assuming I do everything right by processing the paperwork myself)?

For all that are frustrated by the stupid locked I-134 form on the USCIS website.

I downloaded form I-134 from the USCIS website, and found that I could not type on the lines like all the other forms available on the USCIS site, for some stupid reason someone locked the form before posting it to the site. So I printed it out and started filling it out by hand, my writing is OK, but I prefer to type in the answers and print the form out completed, it just looks neater.

So there I was hand writing the form looking at the example form here on VJ for guidance, and realized the form date of the example form on VJ is the current one and started wondering how the example form was filled out. I then clicked in the fields and discovered that I could erase the sample info and fill in my info and print the example form out with my data.
