Not us...hang in there! Our NOA2 is dated 7/13. I contacted my congressman's office and found out that we are in the name check stage. Neither of us has any record of any kind nor have been involved in any FBI investigations so I'm assuming it's my common name holding us up. The USCIS people told me the same thing when I did the RFE trick. Have you tried that yet?

Do you really think you need to be calling already? Most likely they'll tell you that you need to be patient, they're working on June 18 right now (yea i know they're really not) and that your case is still pending.

There are many people calling who filed way before you being told this so I'd just sit tight for a while. You have no need to worry yet.

She wants a man for life and another short term superficial individual. Fighting for her, if you will, was exactly what she wanted.

I don't know your exact situation and we are all different. For me, quitting was never an acceptable option.


That is so touching. I just had to comment. And what a wonderful story of love you have to tell your grandkids some day!

True love is something you can't just give up on. When you have it, you know it and you don't just let it slip away. Maybe in the case of the OP it wasn't and that's perhaps why it was easy to move on right away without any mourning period. Sad, but it happens.

I'm confused. I'd guess that when you send back the RFE info they'll continue processing your case and give you a decision. Maybe the 60 days statements were just their way of putting you and your congressman off for a bit, then they looked at your file and decided what they wanted from you and sent an RFE and the 60 days is not an issue anymore.

My question to you is this...did you have to ask your congressman again, or did the USCIS tell THEM that they were sending you an RFE since you had the congressional inquiry going already. And in your signature it says "service inquiry". Is that from YOU asking USCIS for an inquiry or are you referring to a congressional inquiry?

My congressman sent a congressional inquiry on my behalf so that's why I'm wondering.

My situation is very similar. I'm the USC, 11 years older than my fiance. We started seeing each other while I was separated but not divorced yet. Filed the i-129f 6 months after the divorce though.

Yes, calling does seem to generate a "touch" and no calling doesn't speed up your case. The person you talk to looks up your case and it has nothing to do with the person who's actually working on your file.

How did you get an expedite on a k-1? I didn't think they offered that.

Hmm, I have been told my file is in security checks also (they used the terms extended review and name checks as well on the other 2 occasions i called). I have NO criminal background whatsoever. I don't even have traffic violations, nothing, nada zip!! My fiance doesn't either. I'm at the same stage, awaiting noa2.

I guess my point is that while it's possible that's why yours is being held up, there are also others (me) who are held up that have NOTHING in their past record as well.

Also, I didn't think something like that on the petitioner's part was of concern to them since you're already here. If you had a domestic abuse history I can understand why they wouldn't want you bringing someone into the country to abuse. But a car accident. Idk. Was it a drunk driving offense? Not sure if that would be an issue.

I think what they were trying to point out is that the 4 copies LOOK very similar (questions are all the same) but each copy is for a different department, which you can see on each one I think at the bottom. Copy is a bad word, because they are indeed each different.

So you shouldn't just fill out one of them and make copies because then you wouldn't have one for each dept. If you look real close at them you'll see what I mean.

I sure hope not, because I didn't make copies either. We didn't find VJ until recently. I really wish we had this information back when we filed because Lord knows the USCIS site sure isn't helpful.

On the other hand when I read about how organized and thorough people on this site are it gets me paranoid wondering if I messed something up.

I'm sure you'll get more opinions on this, but I wouldn't sweat it too much. There's nothing you can do about it at this point anyway. Maybe for piece of mind, print a copy of the blank i-129f and try to remember exactly what you wrote on it. If you look at it there's really not much you could say at this point, "hmm wonder what i wrote there" . Whatever you answered then would be the same answer now.

I called for IRS transcripts, but the prompts would only give me 2007. It says 2006, 2005 and 2004 are unavailable. Could that be because I filed married those years?

I was married in 2005 and 2006...do I need to give them my ex's w-2's or just mine? Obviously he's not sponsoring my fiance but I want to be sure I do this right.

My copies are from H&R block and say "Copy only do not file" in a big watermark across them. Is that ok? I don't have any originals because they always file electronically for me.

Is that all I need? 1040's and w-2's? Someone said something about a 1099, but I don't seem to have that with my taxes. Not sure what it's for.

Yes, bring all of this and make it as recent to your trip as possible! You need to prove strong ties when you cross the border and I would add a letter from the doctor on their letterhead with a phone number for them to verify if needed. We found out that proving you're trying to immigrate legally means nothing to the border officers. They want to see the strong ties and in your case the reason for your visit being to assist with an ill relative will probably enhance your chances of getting through. You ARE allowed to visit during the k-1 process but prove the strong ties.

The HR department just emailed me about the letter from employer that I requested they write for me. I had written it out exactly how it's supposed to be stated, but they are saying the $ amount I put in the letter is less than what my salary actually is. I had time off during 2007 without pay and that's where the difference must be coming from. I got MY figure from my w-2.

My question is, isn't it more important that the $ amount in the letter matches my last w-2? If it's different won't they wonder why? Or should I just go along with them putting the higher amount in the letter and risk an RFE to explain that?

Am I worrying too much? Do they look at it that closely?

it all depends on the operator i called one time and didnt get touch but operator was a real $!$%&!8 and i called different time and got touched and i know operator was realy nice and punched my case number in and it showed a touch for that day. but here is where the problem is beginning. i never got alot of touches before noa-2 in fact. if i go to web site right now it will still say received and pending it was never up dated when it got approved. i called to find out why and operator told me i was lieing about having my noa-2 in my hand when she was talking to me and finnally got so mad she hung up on me hehehehe score one for the little guys

And when you do find it - you'll have to dispose of it once you have a replacement. The passport process is very quick right now in the USA. A colleage applied for his and had it in less than two weeks and he didn't even pay for the expedited service. Good Luck!

Anybody out there knows how my fiance can obtain a new passport before his trip.

We wanted to see each other so much and not to forget that his plane ticket is nonrefundable as well as our round trip tickets which I have just booked. :-(

We need miracle...
I was so excited about the trip days ago...
But I feel like crying out loud just now...:-(

Oh Lord..he can't get his new passport if he lost it because they are so strict in PI..they have to process his Passport for 15 working days..that is how the DFA in Philippines does when a person lost his/her passport..


Where did he have it last? Has he ever used it?

Don't panic - that never helps. My boss had a trip planned from US to the Netherlands and could not find his passport the day before. He was able to take his itinerary and his birth certificate to the local visa center, which in his case was Chicago. It took most of the day, but he was able to get a replacement that very day and fly out the same evening.

Thanks to everyone for all of the suggestions.

He has sold all of his belongings and what he is bringing is already here.

He will continue to work as long as he wants - yes the exchange rate is awesome and he has no bills right now at all. The friends that he is staying with will not take anything for his keep. They are very awesome - so all of the money that he is making comes right to me. He has a company car which he will be able to use as long as he wants. His company has been awesome and actually, his company is a distributor for my company and he is good friends with my boss. That makes it nice when he visits and has been able to come here on "company business" and spend all of the time with me. In fact, one day I had to work and he just came to work with me and learned more about our product that he sells for us in the UK.

I know that we are very fortunate and I don't take any of our time together for granted because I know there are so many of you out there who havn't seen your loved ones in so long. I hope for all of us a speedy journey.

Once he is retired, I think that he will go crazy waiting. We were hoping to have everything complete by the end of January. crying.gif

When he came over for Thanksgiving, he was grilled by immigration. They asked him why he was coming in so often. He just told them that he is here to see friends, taking care of some business and also coming here for Thanksgiving. He hadn't been grilled like that before. He is only worried that it will not happen in the three months and that he'll have to go back. He is also worried what will happen if we're not approved. Not sure why we worry so - I don't think that there will be a problem.

I just want this process to be overwith so we can be together. We have everything situated in seeing each other until after Jan 15 - 31 - when he plans to retire. Just not sure what to do after that.

Some people come from countries where it is not easy to get a visa. There is also the financial hardship and the risk of not being admitted to the US. If he tried to enter and was turned back then what would his circumstances be? Would he find it easy to get affordable accommodation back in the UK again if he had sold his property? A lot of people rely on work for their income and are not retired and so would have a problem in that circumstance.

If he has sold his house what address has he used for the Consulate to contact him with Packet 3 and would he be maintaining that address should he come to stay with you. In the unlikely event he encountered a problem with name checks and got put into administrative processing would he manage to find somewhere to wait it out in the UK?

It's unlikely that you will have problems but it is best to be prepared for the worst.


He has made arrangements with the people that he sold the house to - they are collecting his mail and he is staying within a mile of his old house so he can collect his mail. If he was turned back, he would just stay with the friends that he is with a little longer. His retirement is around January 15th but his company will let him work as long as he wants.

I know that this has been asked before and I have searched the forum and cannot find the answer to this question:

I am at 140 days of my I-129 and still waiting for my NOA2. My fiance is going to retire in January 2008. Can he come and live in the USA with me at that time and then fly back to England for his interview?

He has already sold his house, his cars and is ready to move here as soon as he retires? He would like to come at that time. How long can he stay on a visitor's visa if he cannot live here? Any help would be greatly appreciated.
