You don't have to have letters. You have cellphone bills, photos, cards...

Chat logs are a good idea, maybe a sampling showing a period of time, to show the on-going relationship. We had greeting cards, phone records, some emails, chat logs, and pictures. If you've had subsequent visits to see your fiance, include other boarding passes hotel receipts etc. as well.

Don't send a ton of stuff though! Not only is it costly, but they'll never go through it all!

We just filled out the forms that came in the packet 3... no one at CIB told Ashraf he needed to fill out any additional forms. I pulled up the DS158 and it doesnt look familiar to me at all... not to say that things are not constantly changing in Egypt... but we didnt fill that out for the interview. I filed with California and I am miserable without my fiance. He was living here 8 months out of every year for the past five years and we have been together for three of those years. He was here on an H-2B visa and we planned on getting married this year when he came back. Unfortunately there weren't enough visas this year and so now we are stuck waiting on the fiance visa. We couldn't get married before because we had to wait for his divorce papers (which we have now).

they dont ask for everything up front because they dont need everything up front. When you send it to the csc or vsc they only need the i-129f petition packet, but when you send things to the embassy (this is after they have received your approved petition packet from nvc) then you send in financial information as well as medical, police, and other things.

were you supposed to send in the fiances birth certificate or divorce papers, etc.? I don't remember haha. You need to send in everything that is required to send in. If they don't ask you for certain papers in the first packet, yet you send them anyways, and they ask for these same papers in the third packet, yes you still need to send these in with the third packet. you have to follow all directions unless you want to get an RFE.

why didnt you read the guides, they are VERY helpful. did you even read the guides when you assembled your packet? you were SUPPOSED to send the g-325a biographic information. did you send it for both YOU AND YOUR FIANCE? no you were not supposed to send the i-134. you dont need that until you tgo to the embassy.

yes there are other fees DOWN THE ROAD. right now no more fees, but when your petition is approved then you need to pay a visa fee (you need to look up this fee as it pertains to your countries embassy) and you need to pay the medical fees as well as possibly a police report fee depending on the country you are applying for.

I think you really need to read the guides, as all your questions have been answered 100 times before haha.

My fiance called and says that his paperwork that he received from the consul says that he is supposed to bring a court paper showing that he is paying support but such a document doesn't exsist. He pays support for his children but it was a verbal agreement after his divorce and not written. If his ex-wife writes something and signs it saying that he is paying, will that be sufficient. Did he read the instructions incorrectly? Does he really need that ??

I would have a divorce decree, but as a state law in wisconsin even with a divorce decree I cannot get a marriage license for 6 months following the date of the decree. I'll be very sad if this is the case, tack on another 6 months to the already long process...boo but I did also just read on another site that someone said you have to wait the 6 months as well because technically you are not "free to marry"

Ok, I met my fiance online. She was living in Brazil, but had lived near me for the previous two years first on a work visa as an au pair then on a student visa. I wont go into the details too much but we met, and talked for about 4 months before deciding to bring her back to the states on a tourist visa to see if the magic we had held true in person.

She will be going back to Brazil on Dec 7th and we are going to file for a k1 visa. My question is, what constitutes a complicated case? I'm previously married, divorce will FINALLY be over in a few weeks and I have a son. She has no previous marriages nor children. She was denied an extension of her student status due to a clerical error (the address they had for her residence was wrong) but has since been able to get a tourist visa. She filed for an extension of her tourist visa to get another 3 months here a couple of months ago but have heard nothing back yet (she is technically 1 month overstayed right now). Will this have a negative impact on our filing if they deny the extension, or if she moves her flight and leaves immediately after we receive a denial would it negate the fact that she was here past her intended stay?

Also, aside from dated pictures of us together what forms of proof would be considered good in respect to our ongoing relationship and intent to marry? The wonders of the internet have eliminated any sort of telephone bills, and while she is in Brazil we do most of our conversing through skype so that we can hear eachother and see eachother. What can we do while she is here physically with me to further prove our time together and intent? I plan to take a trip to Brazil in April to see her and meet her family face to face finally, but this is going to be after the k1 is filed.

Wisconsin law also requires you to wait 6 months after a divorce to be able to legally marry, but I am sure the k1 is going to take longer than that to process. Can I file it immediately after the divorce is final, or will they deny it based on that 6 month period?

Are there any time periods that it is BEST to file in? (do things process faster in say November vs February)

Thanks for any help, it's going to be a long process I'm sure but she is worth it. I want to make sure we have everything in order so this goes as smoothly as it can!

Once you get your NOA2 from the service center it takes a couple of weeks for everything to get to Bangkok. Then the Thai fiancee will get a packet from the US embassy. You can download the required forms from somewhere on this website so you don't have to wait.

I just tried the SAWASDEE 2 forum and no problems.

Here's our situation:

rcve RFE 7/2/07 (we had been told the wrong $$ to send by a border control officer grr!)
rcvd NOA1 7/13/07

Question 1:
and that's IT. Our case has never been touched a single time since then. I am seeing so many people that have NOA1 dates weeks after ours and am wondering if a touch means it was wanded off the shelf to be worked on and they're supposed to work on these in the order they are received then wth? How do they skip over cases like that? OR do they work on them by beneficiarie's country? He's from canada & I see that there are large numbers of applications from Canada & could understand it taking longer than other countries I suppose.


I called USCIS yesterday & inquired to make sure something didn't happen to our file and how are other cases that were received after ours already getting approved. I was given some standard text about how all cases are different blah blah blah. I'm thinking, yea but receipt dates are chronological...
Does anybody think I should be concerned? Should I just be patient & this is normal?

Question 2:
Does toronto process k-1 visas? Meaning will his interview be there if it's the closest consulate to where he lives? Or are they only done in Montreal & Vancouver?

Question 3:
Does the 2nd NOA get sent to me (the petitioner) or to my fiance (the beneficiary)?

Question 4:
Do they allow the fiance to accompany the beneficiary at the interview? Will they interview me too, or just him?

Don't worry yet. I got my first NOA 7/13 and haven't heard anything yet either. I'd relax for a while and try not to think about it too much. I have been hearing on the boards here that mine should be very soon as they are working on the vicinity of my date now so if yours is september it's going to be a little while yet.

Some people seem to have their case "touched" while others don't so if you signed up for online updates and don't see anything don't worry too much. It's not worth the stress. I've seen many posters here say theirs never got touched according to the uscis online updates, but their cases were all approved.

I called USCIS and it was a waste of time. I got the standard line saying to look online at the current processing dates and that all cases are different blah blah blah. I explained that I signed up for email updates & checked my progress online and there are no "touches" so how are cases received by you (CSC) AFTER mine getting approved and mine hasn't even been looked at yet? She had no answer for me. I have a very common last name so I'm hoping that's all it is.

Hmm, well I agree too much is better than not enough. We really don't email back and forth since talking is free on the phone and so is yahoo messenger, plus we play online games together so the Instant Messages is all we really have that is in print (besides my phone record). We don't send stuff in the mail either. Doesnt make much sense when we talk for hours every day.
I like the idea of just taking one conversation per month & printing it. Our conversations are going to sound very odd to anybody who doesn't play the games we play because we talk about that alot.

I'm just curious about what people use when they submit their Instant Messenger logs. Are you submitting all the diaglog or just the time/date stamps of when you had conversations online?
I just realized that I have every single word we've said to each other online in a log that I could print out but I don't know that I want to do that. We talk on there and on the phone every night for over 4 hours EVERY DAY. Is it really necessary? Is it really helpful? Has anybody ever had that backfire? Like the officer reads into something you said and take it the wrong way and use it against you?
I don't think we have anything like that in our dialog, but i just dont' have alot of trust in the officers based on past experiences at the us/canada border.

When I got divorced if I wanted to change back to my maiden name I would have had to fill that portion of the divorce papers in to change it. Also during court they ask if you want to change back to your maiden name. Not sure if it's the same in every state though.
I'm curious what you mean by finalized. Do you mean the official date the court says you are now divorced?

Ok, when you log in a page will appear that has your name at the top, case number and the important thing to look for is the "last updated" column. It most likely will say 12/10/07 since that is your NOA receipt date. It will change when they do anything with your file (move it, look at it if you call to inquire, work on it etc...). It won't keep a running tab of your touches so if you're concerned about knowing Every time it's touched you'll want to look every day. I'm not encouraging you to develop OCD or anything lol but once they touch it again, the previous date it was touched is gone.
Try not to make yourself too crazy about it because touches don't always mean that someone is working on your file. It is a nice consolation though that your case is at least there.\

Keep in mind that you won't receive an email every time it's touched. Only when they approve, deny or send an RFE (from what I have seen anyway). Mine has been touched several times now, but I have never received an email from CRIS so it must still be in the process. I called once and was told it was in the name check stage.

And if they US lets her visit her fiance for a week it shouldn't be a problem to go back and wait for the interview and proceed as planned.

Whoa! Hang on a sec Jeraly. This letter is the employer letter that goes along with your fiance's affidavit of support that HE will need to get from HIS employer. I believe you are looking for a letter to take with you when you come to the US for your honeymoon following your UK wedding right (so they don't give you a hard time at the border)? Then you're returning to the UK to wait for your K-1 visa interview correct? I'm still a little confused on your plans, correct me if i'm wrong.

If so, I would say definitely on letterhead, signed original by your employer. Make sure you have the date you are leaving the UK and the date you are returning. It it has been long term employment maybe stating the length of employment might help (if not, i'd not say that). That should be all you need. I'll see if I can find any other info on it and let you know.

My fiance was not so lucky, he has been told he cannot cross the border until he gets the K-1. They didn't feel he had strong enough ties to Canada (free-lance work & living with parents as he had given up his apartment when we were told he could come visit me as much as he wanted by one border officer but that wasn't the case with the next 2 officers we encountered on subsequent trips). Long story but it seems that most are more fortunate than us so don't worry.

Call and use the RFE trick. I have called twice and each time the person I talked to looked my case up for me. At least it's reassurance that it's not lost somewhere.

I was just reading a post elsewhere on VJ about the outside agency that is contracted to work on processing USCIS immigration files. I'm starting to wonder if that's how some May/June/July filers have been left behind while they work on August and I've even seen a SEPTEMBER that was approved already. Someone there is WAYYY behind with a few boxes of our files.

Mine says something like "facts and findings" meaning final judgement. We did our divorce ourselves (can't remember the term for that) but I filled in all the forms, submitted them, paid the fee, we went to court, the judge said you both agree to these terms, we said yea, he signed it and that was it. Yea mine was the same with a stamp of the judge's name and some sort of official looking flat circular stamp with the date of the divorce on it. I asked them to notarize it (which puts that raised stamp on it) and they looked at me like i was nuts but they did do it. Not sure if it was necessary but it made me feel better lol.

I'm still wondering what the "decree" is though. That term is not on my papers anywhere. I asked for a decree at the courthouse and they said this is it...my pile of papers that I fileld out stating who gets what etc that the judge signed.

Does everybody get that or is a decree more of a one page certificate type thing?

To answer your question, no the foreign fiance does not need to be employed.

It is on the US fiance to prove and provide support. (affidavit of support form I-134...this comes into play later when the petition is sent to the US embassy in the foreign fiance's country after USCIS approves it).

I was told by my congressman's office that my petition is in "exended processing" and that if I haven't received an answer from USCIS within 45 days to let him know so he can inquire with them again.

I have read somewhere on VJ that "extended processing" has to do with the name check stage. I read on the FBI's website that most of these take 72 hours but if they receive a "hit" (meaning a name SIMILAR to yours appears in a case somewhere they have investigated at some time) they have to manually look it up to make sure it's not you. Then it can take much longer. Also that the officers assigned to the manual looking up of our names are also working on many other issues so our "case' (the real petition doesn't go there), can sit on their desk for months just collecting dust.

Anyway, I believe that is why some of our cases are taking so long and why they move on to the newer cases (august, september now) while we feel ours is ignored. They work our cases AFTER the name check stage. I was told by USCIS one of the times I called that my file was in the namecheck stage and once completed would then go to an adjucator. It makes sense, it explains alot actually when you think about it. It really sucks for those of us stuck there for no real reason.

Possibly the FBI needs to be investigated to see why they are holding us up for so long. How many of us that are held up like this really have a reason to be?

Not us...hang in there! Our NOA2 is dated 7/13. I contacted my congressman's office and found out that we are in the name check stage. Neither of us has any record of any kind nor have been involved in any FBI investigations so I'm assuming it's my common name holding us up. The USCIS people told me the same thing when I did the RFE trick. Have you tried that yet?
