Bad consequences are exactly what my fiance and I endured when he tried to visit me for 6 months during our k-1 process. He did not have proof of strong ties (mortgage, job (they'd want at least a letter stating your expected return date signed by boss or HR and pay stubs for proof), current utility bills). You've only listed things that will be a red flag to them. So the consequences for us were NO VISITS until he had the k1. In order to see each other for that entire year (yes it took a full year from file date to k-1)I had to visit him. The officer even told us he could ban him for 3 years right then and there if he wanted to. Ridiculous I know, but they do have that authority.

If she's going to visit you, it's going to likely have to be for shorter increments and she's going to have to show strong ties to Canada plain and simple. The request for a 6 month visit is what sparked off the whole interrogation for us. Yes, Canadians can VISIT for 6 months, but being your fiance is a red flag to them and that goes out the window.

I understand that others have had no issues visiting (haven't heard of anyone going for 6 months tho) during the process, but your/her situation sound too much like ours and I'd hate to see anybody else go through what we did.

You'll want to be able to prove strong ties to your home country if asked at the US border.

The letter from employer (printed on company letterhead, signed by your boss or Human Resources department, and dated) should state at the least:
*insert name here* is an employee in good standing at *company name*. He/She will be visiting the US and is expected to return to work here on *date*.

Or something like that.

Also, include proof of home ownership or rental lease, most recent utility bills, phone bills (land line) and/or anything else permanent you might have.

The more the better. Be prepared. Be honest. Be confident.

We had big problems with this and my hubby is from Canada. It's no easier than any other country as far as visitation goes. In fact, my hubby was denied entry twice and was unable to visit me throughout our k-1 wait (I had to go there, otherwise we'd have not seen each other for an entire year).

Your best evidences are going to be the employer letter, utility bills, landline phone bills (cell phone bills weren't solid enough proof of strong ties in our experience), proof of home ownership (if she has a home) or not as good, but better than nothing...rental agreement, the bank statement(s) will be good.

In our experience, my hubby only had a couple of the above and it wasn't enough for them. It seemed that the employer letter, home ownership and bank statements would have been better proof of strong ties (which he didn't have). Other than lack of these things, he had no reason to be denied entry.

Denials are rare, so she'll probably be fine. I just like to add my 2 cents to warn people to be overprepared. I wish we had been.

Actually it's 1 shot for those of us who were immunized as children. If you're an adult who has never been immunized or has no proof of immunization (or lack of antibodies; verified by titer) then it's 2 doses.

The CDC recommends waiting at least 4 weeks before conception. Some doctors are more conservative and will recommend waiting even longer.

You're actually worse off if you don't have the vaccine, conceive a child and THEN get measles mumps or rubella (or chicken pox too, but unrelated to mmr) while pregnant. Adult cases of these diseases is much more severe than when children get them. Plus as already stated these diseases can cause serious birth defects if the mother contracts them during pregnancy (or is pregnant too soon after being immunized).

We also thought we'd sail right through, nothing weird about our case. It took 11 months from file date to his entry in the US from Canada. Our consulate was Montreal which does have a history of taking longer than Vancouver, but the majority of our wait was for the noa2 actually, filed through CSC.

I hope it works out for you and if not that you're able to get dates moved or money refunded. I do understand the frustration of your life plans being in the hands of government employees. It's not a good feeling.

This exact same thing happened to us in June 2007. We were given the same misinformation by the same misinformation line at the USCIS. I knew a girl at the time that had recently married her Jamaican hubby, he came to the US for the wedding and stayed during AoS and they got away with it. At the time I had no idea this was wrong. I didn't understand why there were fiance and spousal visas though, so I called USCIS two different times and got the same answer both times that my fiance could come to the US with me, we could get married and that the US allows for spouses of american citizens to remain in the US during AoS. We were stopped at the border, questioned, he was fingerprinted and his picture was taken. We were told he needed to prove strong ties to Canada so we went back to retrieve the papers they requested. We were once again denied and given yet another list of papers to bring. We did this the next month and were denied yet again and told that if he tried again he'd be banned from the US. We were in total shock during this whole thing. We knew nothing about immigration. Hadn't found VisaJourneys yet. Other websites did NOT explain the process well at all. Plus we had been told by USCIS people themselves that it was ok. How were we supposed to know that they were clueless. The people at the border were no better at explaining things. They TOLD us to bring back paperwork and then threatened to ban him for doing so. It's really ridiculous and I felt the same frustration you are feeling right now.

Anyway, long story short, we also had our wedding planned, honeymoon to Disney was paid for and ALL of it was cancelled. It was awful and one of the worst times of my life. We were devastated. We filed the k-1. In order for us to see each other for the 11 months it took from filing to interview date I had to visit him. It was difficult for me. I have 2 kids, a full-time job and was going through a bankruptcy (post divorce aftermath). I was flagged, so everytime I returned to the US after visiting him, I was pulled in for questioning. It ws always fine, but one of the times my kids were with me, they were terrified and all of our bags were opened and contents thrown all over our vehicle. Nice treatment, huh?

At the interview, they knew about the 3 border denials...all the info was in the computer. The guy said it's common for that to happen, and deleted all of it.

We had our wedding in July 2008, went on our Disney honeymoon and are currently USCIS-free, until time to lift conditions. You will get there. It's a long road no matter which route you choose (fiance or spouse visa). You've already been given good advice here. You won't find better information anywhere else and that includes attorneys. I wouldn't waste the money. Do a ton of reading on this site...get to know which posters give accurate info and which don't.

I wouldn't call back and I wouldn't try to "correct" his birthdate. You already said you can't possibly do that anyway. My dad went through his entire life (and still is) with his last name mispelled on his BC. My grandma never corrected it and neither did he. We have always had a slightly different last name than the rest of his family. You're best bet is to consider his birthdate in December, not October and just leave it at that.

Non-contested divorce makes no difference. It's the date that your divorce takes place in court. My ex husband and I wrote out the divorce papers ourselves, didn't use a lawyer, just signed the papers on our court date. That court date is the date our divorce became final. People from other states have talked about divorce decrees and that they take a while to get. I did not receive anything called a divorce decree. The papers we all signed in court that date are stamped, notarized and served as my "divorce decree" and I had no problems during the process whatsoever in that regard. There are definitely varying laws and process between the different states.

I have been separated for quite some time from a previous marriage (married waaaay young, deployed to Iraq with my Marine unit and decided to stay married during the deployment to better provide for her), so I know that obviously I need to have that wrapped up which will not be a problem and should be wrapped up by the end of December.

In the meantime I've met "Kitten" from Toronto and we have been in this long distance relationship for the past 8 months and I have flown up to Toronto and she has flown down here quite a few times.

Against all the sense in the world, we've decided to get married and have her move down here to live with me. Hopefully I don't get someone to reply to this in a snide way and judge me for what appears to be a irrational decision, because we have spent a lot of time discussing this and we aren't a bunch of teenagers. Helpful advice please!

What we need to accomplish:

1. Speed. (of course, right?)
2. She needs to have the ability to earn an income in the US.
3. She would like to be able to fly back and visit her family in Canada.
4. She does have a BA. (not sure if that helps anything at all?)



I work in law enforcement with the US Federal Justice department, so I cannot have anything go wrong that would affect my career as well. I am also with the US military, with the Marines, so if I can get any added benefits from that, please advise.

If you need any more information from me I will get it to you asap.

No snide comments here. I was in the same type of situation...except reversed. I'm from just outside of Toronto and my wife is a US citizen in MN. We went through the process about 7-8 years ago and lots has changed since then.

You probably can't do much until your divorce is final. Then you will likely want to apply for a K1. The bad news is that noting about immigration is particularily fast. Kitten won't have any problem going back to Canada for visits. I go back all the time. Her K1 will allow her multiple entries to the US.

She will need to go to Montreal for her immigration interview.

There is a Canada section on the VJ website where you can find lots of people who have gone through or are in the process of going through immigration. They'll have more recent info than I have.

Best of luck to you and kitten. It may take time but it'll pay off in the end.

Just to clarify, a k-1 is a ONE TIME ENTRY visa. It will NOT allow her multiple entires into the US. Once you activate it at the border, she won't be able to visit Canada until she receives her AP (advance parole).

She would be able to visit you during the time you're waiting for 129-f approval and the interview as long as she's able to prove strong ties to Canada (as already stated). She will have 6 months after the k-1 is issued to use it. Once she uses it to cross into the US, it's done. It cannot be used again. You must marry her within 90 days of her entry or she becomes "out of status". Then you apply for Adjustment of Status to get her green card, once you're married. Along with AoS you will file Advance Parole (which allows her to visit Canada while waiting for the green card)
and EAD (employment authorization document) which allows her to work.

So basically, there will be a timeframe that she will be "stuck" in the US. From when she enters, until she receives AP.

I'm also from Wisconsin and know that we have a waiting period before you can remarry. It's 6 months (unless that's changed since 2007).

I really can't add my advice/opinion until knowing these answers.

Not always. At some consulates, if the U.S. petitioner does not also show up, the visa can be subject to a 221(g) or outright refusal.

It is always a plus when the petitioner can attend, even if he/she is not allowed into the interview or even on the consular premises. The petitioner can hand his/her passport to the interviewee, who can then show it to the consul. This lends solid credibility that can be the "make or break" factor in visa issuance, regardless of whether the consul ever says anything about it.

From my readings here, I would not treat a New Delhi interview casually in any way.

The dates in some of those timelines are obviously screwed up. One member wrote that they got an RFE 10 months before their NOA1. Others have changed the format they use for entering the date, using one format for the NOA1 and another for the RFE. You have to take those numbers with a little skepticism. This is "user error", and not a problem with the timeline system.

Most RFE's are sent several months after NOA1, which probably means the petition was being adjudicated at the time, and the adjudicator determined more was needed. When an RFE is sent very soon after the petition was received it probably means that something obvious was missing from the package, like a required form. It's also possible that they didn't get an RFE, per se, but the entire package was returned to them. This would happen, for example, if they forgot to include the payment. The timeline system doesn't really give you a way to record when something like this happens, so a member might just enter it as an RFE.

1. You need to demonstrate an income of at least 125% of the current poverty guidelines based on your household size (i.e., number of dependents including the immigrant you're sponsoring). See http://www.uscis.gov...form/I-864P.pdf. If your income is not sufficient and you're planning to use assets (e.g. bank deposits, stock, real estate, etc.) to make up the difference, the assets must be readily convertible to cash and must be three times the income you require. For example, if your income is $2,000 short of the guidelines, you need at least $6,000 in assets to make up the difference.

2. For the K-1 consulate interview, co-sponsors would also fill out an I-134. In the K-1 process, the I-864 is not used until the AOS stage. Also, not all consulates accept co-sponsors for K-1s, so check with your consulate to make sure.

3. If you are qualifying solely on the basis of income: pay stubs, a letter from your employer stating your position and salary, and one or two years' worth of tax forms are a good start. If you need to use assets, then bank letters, stock certificates, etc.

4. Cosponsor would require the same supporting documents as above for her I-134.

If you've had personal experience with having your stuff stolen, tough luck.

but making a blanket statement about stuff will get stolen is childish. i've sent numerious packages to my fiance via courier (Bombino express) and not even once it has been delivered late, misplaced, broken, nothing.

btw, bombino express is about the best courier to india (maybe they deliver to other places too?) - they charged me $15 for 2 LB package and it reached my fiance in about 3-4 days.



I don't think it was a blanket statement at all as the problem with lost packages, documents occur in any country with any service. It's only natural in general to feel insecure when our docs packages have such a long way to travel, regardless of what courior we use. Bombino is not immune to this. They also only deliver to certain cities in India. I personally use UPS with tracking to far more locations in India (http://www.ups.com/content/in/en/locations/dropoff/index.html?WT.svl=PNRO_L1) than Bombino and feel more confident with using them even though they are expensive. So for me, UPS is no. 1.




Actualy i do have experiances with packages that were never received, n to this day we dont know where they are!
SO i rather se safe than sorry, during that time i hope to be in india for dewali! I have never celebrated it or experianced that before!

It sure sounds like an approval, but just don't party too hard and book the flight tickets until the visa is in hand. The consulate may reserve the right to reverse their decision before you actually receive the visa (this is rare to happen, but I've read of it happening once and my fiancee was warned of this even though all she had left to do was pay for her daughter's visa). If you are in a hurry to find out your case number and by chance your check is cashed, they actually right the case number on the back of your check. I went online to view the back of my check and the case numbers starts with WAC# which was the same as my case number listed on my NOA1. Just thought I would put it out there. Thanks!

I paid my USCIS fee by money order and not cheque and i dont know if the USCIS have gotten my papers and money order since the 15th of May, its been 3 weeks now and i have not gotten my NOA1.. what advices does you guys have for me please.

Does anyone knows how long its takes for the money order to be cashed and how soon a NOA1 gets available to me so that i can check if my case was ever touched or has been touched.

I GOT MARRIED AND BEFORE I DID I HAVE A CHANCE OF BRINGING MY HUBBY ON A TOURIST VISA FOR US TO GET MARRIED AND HIM TO RETURN TO HIS HOME COUNTRY OR MALAYSIA WHERE HE STUDYING BUT WE LOOKED AT THE OUR AFFECTION THAT IT WILL BE HARD FOR US TO GET SEPERATED AFTER OUR MARRIAGE AND WE ALSO THOUGHT OF A B1/B2 VISA TO ALLOW HIM DO THE AOS STUFF BUT WE DONT WANNA RISK THE BAN OF BEEN SEPERATED FOR 10 AFTER BEEN DENIED FOR TRYING TO EVADE THE US IMMIGRATION LAW SO I WENT TO MARRY HIM IN HIS COUNTRY AND WENT BACK TO U.S TO FILE OUR I130 AND THAT WAY EVEN IF WE ARE DENIED WE CAN REAPPLY OR APPEAL IF THE NEED BE AND THE 10 YRS BAN WILL NOT BE INVOLVE AND SINCE OUR MARRIAGE I HAVE MADE ONE TRIP TO SEE HIM AND I WILL BE THERE AGAIN NEXT MONTH UNTIL HE IS ABLE TO COME HOME PROBABLY NEXT YR COS WE ARE STILL EXPECTING OUR APPROVAL. Has anyone else had this recent experience with filing at the California Service Center? I sent our Packet via FedEx over night priority. By the way the address I FedExed it to was:

I know that they have received it and it was signed for too. Any Ideas as too why this would be occurring? I've read that there is an influx of HB1 Visa's that need to be taken care of, possibility that this could be the hold up? Any thoughts would be appreciated as I am getting a bit worried.

K1 is the best way!!


Visit her once for at least a week or two. meet her family take a lot of pictures , keep your plane tickets, anything that will prove your relationship. And then PRESTO..you can file your K1. As long as your relationship is genuine their is nothing to worry about. The immigration will know..they can spot the not!!! GOOD luck!!
