I sent my 129F in Sept 2011 and got approval in Mar 2012. If you forgot something they will send a RFE (Request For Evidence). I got one and had about 3 months to respond with the requested evidence. Got the RFE in Feb, sent everything back and had approval in Mar. As long as you respond promptly it doesn't add much delay. If you get one don't panic and don't rush though, make sure to send exactly what they ask for so you can be approved. Welcome to the waiting game, try to relax (you won't but try lol), it's a long process but I've found it's not so bad just really frustrating and hard not to panic because it's so important.

Have your legal marriage in Canada and then apply for the CR1. Have a "real" wedding later in the US if you so desire. Avoids any risk of being accused of fraud for marrying in the US without declaring intentions to do so.

I'm American and my fiance is Canadian and coming here. While he's never been stopped when visiting they always ask him is he SURE he's not coming here to get married. Personally I wouldn't risk getting married in the US, too much potential to cause problems down the line.

Talk to your vendors. As long as you are giving a reasonable amount of notice and still want to use the same places most will let you change the date. Not sure how many deposits you've put down but I'd talk to the big ones first (ex: the reception hall). When I put down my deposit on the hall I made sure to ask if I could change the date if necessary to another open date and they were fine with that. Then I'd recommend not rebooking a date until you at least have an approved NOA2 in hand. Go for the big vendors with large deposits first, and worry about ones that have smaller deposits (ex: cake baker) last. You may need to settle for a Friday wedding, etc in order to get an open date that works for as many of them as is possible but you should be able to keep from losing desposits on all and having to start over.

Yeah don't bother to start assembling until you have NOA2 (approval) at the earliest. If you filed in March 2012 assume at least 5 months or longer for NOA2. Even if it was the very beginning of March and you only wait 5 months (instead of longer) NOA2 won't be there until end of July or early August. Then it will take at least a month for USCIS to send it to the NVC and for them to send it to the consulate. By that time you'll have someone back in the office to fill things out for you.

You're engaged so having a registry is not unusual. As the others said don't bring it up but if asked be honest. Something like you thought you'd be done sooner so set up a reception and then just had a non-legally binding ceremony since you didn't want to cancel, lose vendor deposits, etc. I'm sure you're not the first to do this and won't be the last. I may very well find myself in the same situation if my fiance's passport, birth certificate, and police records take much longer.

That pic is the best. It will wait patiently in it's little box until it gets picked up to be worked on. the VJ date is an estimate of when that will happen. It doesn't take them long to process the actual individual cases, so once it comes up they look at it a few minutes and then send the response. You'll be approved, denied, or get an RFE sent to you in the mail roughly sometime around that date.

Yes, I submitted every airfare receipt from every time we ever met (from the first time in 2007 through the most recent before filing). I think there was only 1 we didn't have still. It was a ton of them. The problem was all the receipts were emails. Nothing in the original instructions says emails aren't acceptable proof.

You're welcome for the detailed list. Don't think everything on there was necessarily needed but at the point we were RFE'd I wasn't taking chances and went right into overkill mode. I took the keep it short and simple, bare minimum approach in the first place and when we got the RFE went a full 180. Wasn't going to risk a denial or further delay.

I think it only took like 2 weeks to have an approval after I sent back my RFE. I doubt there's any truth to the wait longer to respond takes longer to process theory. My guess is it's like the original petition, how much do they have coming in for RFEs to sort through and respond to has more of an impact. Best you can do is respond promptly, but I wouldn't hurry too much since you need to make sure you send everything they ask for.

If you are refering to a divorced spouses ability to draw benefits based on the ex spouses contributions then your friend is in for a suprise. As soon as he married he is no longer able to claim more . So he can wait the extra years ( which he may have to do because he is also unable to collect until the ex is at least retirment age ) but when he married the benefits from the ex die. In the mean time your friend isn't building up anything for herself. No schooling , no work , no time towards being a USC. And if she is unable to get suffient time in toward benefits in her own "account" she will hit old age and not be able to get medicare to cover medical expenses which would more than wipe out the gain of collecting off the ex. And unless she is his wife he can easily show her the door and trade her in on something younger in a few years and there isn't much she could do other than head back home. It seems she is buying into his greed and risking her own stability.


If it's just Social Security he won't be entitled to anything from his ex once he remarries (http://www.ssa.gov/r...2/divspouse.htm). For a pension there should be a qualifying domestic relations order (QDRO - http://www.dol.gov/e...s/faq_qdro.html) or anything he was awarded isn't legally enforceable anyways if the ex remarries or dies. If there's a QDRO then it should be paid regardless. If it's alimony payments ordered from the divorce then they will cease when he remarries. I could be mistaken (not a lawyer!) but it seems likely that they have nothing to gain and everything to lose.

Honestly it doesn't matter, they can ask for anything they want, especially if they got a hit on any background searches they did on him themselves. The background check must be run through CPIC (national search not just an Ontario one) and it sounds like the one you provided wasn't. He needs one from the RCMP.

Make sure he gets his finger prints taken at a place that can do electronic submission, processing time is 3-4 business days vs 4 weeks (plus mail time for both) if not. Reason for request is to get a K1 visa issued. If he isn't in Canada anymore and won't be anytime soon there's a process for out-of-country requests but prepare for a long delay.

The answer will be approved or denied. If you sent acceptable proof of everything they requested you should be approved. I've not heard of them bothering to send a second RFE for the I-129F.

We're all impatient, hang in there. The process seems longer every day into it you get. The closer I've gotten the harder it's been but there's not much you can do but wait and try to stay sane. As CANbirdUSman suggested use the wait time to get ready for the next step. Even after you get approval there's about a 1 month delay to get the petition through the NVC and to the embassy/consulate. Use this time to do some research in the Canada forums, look into Packet 3, and start gathering the documents such as long form birth certificate, police records, passport renewals, etc that you may need for the next step. You'll probably want to hold off on the financial (I-134) stuff until closer to an interview date (if it's old they'll make you get recent data) but there's a great deal of stuff you may potentially need to prepare depending on your circumstances so get it ready so you can mail Packet 3 back as fast as possible to make up some of the lost time later.

I would wait at least two weeks before calling. As you've already noted they have up to 60 days but for my RFE it took less than 2 weeks and many others who I've talked to had recent RFEs had a similar timeline. It can vary and take 1-2 months though. When they make the decision they will update your case status on the USCIS website so I'd just monitor that rather than bothering to call. If you signed up for text and/or email notifications you may find out that way (I actually got the txt msg of status change) but those can be unreliable (not everyone gets them even if registered properly). Hopefully they will send you an approval soon!

Congrats! I'm also going through the Montreal consulate (I'm the USC). I'd be happy to help you with any questions you have and a good place to start would be the Canada forums as things vary by consulate/embassy at this stage of the process so others from Canada would be best able to help you. For Montreal you will need to gather the docs for Packet 3 as the next step. The consulate website is here: http://montreal.usco...sas/steps.html. Shows all the steps in the process. Long form birth certificate, police records, etc. For the I-134 you'll want to wait at least a month before your fiance gets employment, banking, and other financial evidence so they aren't too old by the time you get to the interview. If you search for I-134 you'll find tons of detailed posts on this. Long story short he needs to make at least 125% of the poverty line, plus a bit for every dependent. You can also have cash assets to overcome but you've already stated you're not in this position. Worst case you will need a co-sponsor for the I-134 and I-864.

If you haven't already filed the I-129F there's no way you'll have approval and be through the process to have a visa by Dec 2012. NOA2 in Nov-Dec if you filed tomorrow, 1 month to go through NVC and get to the embassy/consulate, and then you need to send back all the docs to the DOS, get the medical, have the interview, and get the passport back with the visa. If everything went perfect you're looking at Feb-Mar 2013 to have the visa, any bumps will add delays. I made the mistake of setting a wedding date (not til I got NOA2) and am wishing I hadn't (may not make it, it will be close). Personally I recommend not planning a wedding until you have the visa in hand.

The first responder is spot on with the EAD. Wait til the AOS to get it. With processing times you are unlikely to get it with a meaningful amount of time to work on the I-94. Waste of money and effort.

1. No, just the copy (all of it) is fine no need to notarize. Or tax transcripts as already suggested.

2. If you meet the income requirements it doesn't matter if you have 4 cents or 4 million.

3. I had no problems, but I "bank" at credit unions. Ask to speak to a manager. Or skip it because your mom makes enough income so assets aren't required. You only need income above the poverty line plus some per dependent. If your mom is co-sponsoring and makes 150K a year that's far above the typical 20-30k a year that's usually required. I don't have all the details but you can find that easily by just doing a quick search (I see these numbers on VJ at least once a day). You don't even need to list the other assets, they are there for people who may not have employement income but who have savings and you don't have to document them if they aren't needed.

4. You'd need documentation proving the assets and appraisals. Again don't bother. You don't need her assets, your mom's income is more than enough.

It's hard not to overthink things and get all kinds of paranoid when you're so close to the end, hopefully this puts your mind at ease and saves you a ton of unnecessary work and the delay that getting all this stuff would have added. Good luck!

As others have noted no she's unlikely to be authorized to work this summer. It's one of the disadvantages of the K-1 route. Yes you can apply for work authorization after entering, but with processing times being so long by the time they process it the authorization won't be valid anymore. It's also free to file with I-485 for the AOS vs a fee if you file after K-1 entry so save yourself the effort and the money. Best bet is to get legally married quickly and then file for AOS as soon as possible so she can get work authorization as quickly as possible.

I find myself in a similar situation, except I didn't schedule anything until I had NOA2 and I only booked my hall and cake maker so far. The date was 1 week shy of 6 months out and I figured that would be enough time but with things dragging on it's looking like I'll probably need to reschedule. The hall I made clear that I may to do so with prior to signing a contract, the cake deposit is only $100 and if it's a total loss so be it. At this point I have no intention of picking another date until visa is in hand... my thoughts to you is work with your vendors, ask for which dates they have available going forward, pick the one that will save you losing the most money, and ask for a "soft hold" on that date, namely that they'd be willing to let you move it with no penalty however if they get a call asking about that date from someone else you will decide whether to "hard book" the date or release it so they aren't out business. This is what I'm going to try with my vendors if I need to reschedule.

The problem is all that says is the following:
My Petition Expired – Can It Be Extended?
The I-129F petition is valid for four months from the date of approval by USCIS. A Consular Officer can extend the validity of the petition if it expires before visa processing is completed.

Figuring out how to reach a CO is the hard part, or at least it has been for me with Montreal. Email is my last hope, all the phone calls are "look at the website" or "call this number" which then gets you another person who says "look at the website or hire a lawyer." So helpful X_x

I have RA too and find it unlikely that they will know or care at the medical about it. If they ask be honest, but it's such a common condition and as others have said it's the petitioner's finances and income they look at not yours. Mostly they are looking for big things like TB.

I have been reading this forum for a while now. about 6 months. but this is my 1st time writing a post. I just my my account the other day.

anyways, I have been going through this process for a while now. I 1st started back in feb 09. now we are waiting for her interview date. also doing my financial support information. I have a man in IL that is helping me out, (i Paid him of course) but he sent me a list of things that i need to send to my fiancee.

Please send to your fiance:
1-134 (Sign)
2- Employment certification
3- Your Birth certificate
4- Tax year 2006,2007, 2008 +W2
5- Bank Statement
6-Letters, photos, phone bills (Evidence of relationship)
7- Write a letter to US Consulate in VietNam, in detail how your first met, (Love Story both of you ).

I have all of these except #7. i am not sure what I should all say in the letter. I am about 3 pages long atm and well i dont know if i went into too much detail or not. basically i was wondering if someone could take a look at it.

Philippines07-15 Pink Slip!! Now how long does it take?
She got the Pink slip on 07-15!!!!!!!

Does it take longer then 2 weeks to get the visa?? Anyone hear of anyone taking longer?

I am planning on flying out there on the 30th and planning on flying back on August 6th together.

Is it too early to plan the flight even though the pink slip was granted and Visa approved? She lives in Davao. Not sure if that matters? unsure.gif
