Hi everyone! It's been almost 2years since I received my GC!!! Now it's time for me to file the ROC! And before we do that, I need you guys for opinion! If our evidence is good! Here's our list:

  • Copy of the statement of our Joint Bank Account

I got my letter saying the petition had been sent to Montreal with a date of 3/22. After 3 weeks of nothing I started calling. They didn't mail Packet 3 until 4/19 according to the DOS. My fiance still hasn't received it. Hurry up and wait seems to abound in this whole process.

hi evilsquee.....unfortunately you can't book an interview until you receive notice that your packet 3 contents were successful....and you receive notice of packet 4, which gives permission to book medical and interview. sometimes interviews take a while to book as they only release a certain amount of dates and times at a time....this itself can take a while. dont worry about passing the end date on your I 129F...I dd....and it happens. i sent the consulate an email and they replied with an okay....with no expiry date.....i think you have a year to get things rolling from the initial date of the I 129, but don't quote me. i also had to get passports renewed and got them back within a week! you also need to register with dhl for your visa return....all this info comes in your packet 3 instructions.

check out more on this site....particularly the pinned posts on the first page of this regional discussion....they contain loads of info to help you out.

good luck....and take deep breaths yourself...you'll need it when completing the forms online....I found this the most frustrating part!!


I know we need to wait to book the interview until they send Packet 4, I saw on the forums you could book as soon as you confirm it's been sent though. There's nothing in packet 4 that you'd need to wait for it to arrive via mail is there?

For me the most frustrating part is getting my Canadian fiance to actually get stuff done promptly, he works too much! @___@';;

Because her son is a US citizen and they are not allowed to be issued visas. He is required to enter the USA on a US passport.


The denial sucks but at least it seems fixable. Hopefully it gets sorted out soon!

I wish, but I can relate to being a nervous wreck! I'm trying not to freak out about getting that far without time running out on our I-129F. Montreal just got the petition 4/19 and it expires 7/13. Complicating matters is the fact that my fiance put out to have his passport renewed (he paid to expedite!) on 3/20 since it wasn't going to meet the time requirements for expiration, and so far still no passport. Once you submitted your Packet 3 were you able to schedule an interview fairly quickly? As far as the nervousness, deep breaths, don't panic, and hopefully the worst is behind you. Thanks for the great review, hopefully my fiance will be getting his medical there soon. Right now we're waiting for his passport to get back (he had to renew it) before sending in packet 3. Can any of you tell me approx how long it was between when you sent in packet 3 and when packet 4 was sent and you could schedule the interview? About how far out was the interview from when you scheduled it? What about the medical exam, how long was the wait for that? Any estimates are greatly appreciated!

Thanks guys good to know they extend the petitions automatically since I was getting worried. I will have him look at the police report he has now again with me. Maybe I can get him to scan it. I do have concerns over his background check having a hit on his name as it's fairly common and I recall reading a headline about someone with the same name murdering someone a few years back (think it was in Brazil luckily). Still if you google it there are lots of Canadians in his area with the same name so I'm being prepared just in case. The waiting sucks pretty bad.

We went for the full RCMP one because record or no they can ask for it. He doesn't have one but figured better safe than sorry, had enough delays already and would be just our luck. That and I asked him to get it and the first one he got he said wasn't for CPIC and was Ontario only. Same for the birth cert, told me he had it and I realized he didn't have the long form and had to explain what that was. Good times precious memories. Can you get a CPIC one same day? Or do they still mail it? Tempted to send him to get it (third time is the charm?) since the RCMP one may be awhile to receive. Any one who has detailed instructions and approx time to receive it I'd be grateful as I'm not familiar with Canadian processes and my fiance is loveable but clueless...

Congrats! Now you wait for the NVC to send the petition to Montreal. While you're waiting you should get all the documents you need for the interview so when the consulate gets your petition and sends Packet 3 you're ready and can respond right away. If you need a passport renewal, long form birth certificate, and/or police records still this is the time to get them. The beneficiary should also make sure they have all their medical/vaccination records and get required vaccinations that they are missing. The following links should help:

If you need a passport renewal explain that the passport is required for K1 visa processing so you can get married in the US to your fiance and that the I-129F petition for a fiance visa will expire and that you need the passport to send back the required documentation in order to schedule an interview and medical exam. Since there is processing time for the Packet 4 (the info needed to schedule an interview) to be sent and wait times for the medical exam and the interview if you don't get the passport soon you may not have it in time to finish the K1 visa processing before the fiance visa petition expires. Additionally explain that without the passport you're also unable to travel to the US to see your fiance, assist with wedding planning, etc. A copy of the approved I-129F is sufficient to qualify for expedited processing. While the consulate will extend the petition expiration date this will avoid delays which we all hate.

For proof of urgency print the NOA2 approval and the NVC notice that the petition is being forwarded to the consulate in Montreal to show visa processing should have begun (if you have that). Print the Packet 3 instructions (http://photos.state....ket3-k1-mtl.pdf) and bring those too in order to show that the birth certificate is required and that you can't schedule an interview etc until you have everything listed.

You can just get a CPIC record or if you think there's a reason that there'd be a hit on the beneficiary's name (such as a conviction, etc) then get the RCMP one instead. Someone with the same name as my fiance murdered someone so we're getting the RCMP one just in case to avoid potential delays later.

Make sure to get your finger prints taken at a place that can do electronic submission, processing time is 3 business days vs 4 weeks if not. Reason for request is to get a K1 visa issued from the US Consulate in Montreal (foreign travel). Bring the NOA2, NVC letter, etc as proof just in case. My fiance went in to one of the places that does the electronic fingerprinting and they had all the required forms, etc there.

That is the most infernal question in the world. If I had a dollar for every time that I've been asked we could have the most elaborate wedding Wisconsin has ever seen. I bowed to the pressure and set a date that seemed rather late but is looking increasingly like it will need to be changed anyways. Luckily I only booked a hall and the cake maker so far. The hall agreed to be flexible and change the date with no penalty if needed, the cake deposit was only $100 and I will be asking that vendor about being able to move the date as well now in case it's required. Don't give in to the pressure, your family and friends are excited and have good intentions but have no idea what a crazy process this is. As far as border crossing goes I've rarely been asked about the wedding date, mostly just that we're not getting married now. I respond much like you did, that we're at stage X of the process and waiting for the visa. Congrats on your engagement, hope your journey goes more quickly and smoothly than mine did!

You need to look into the fiance vs spousal visa and think long and hard about which one makes the most sense to you. It is a bad idea to plan to send her back every 5 months or so for 1-2 weeks and then have her come back so she is effectively living with you. CBP (border patrol) can and does turn people back at the border if they think they are high risk for staying illegally and/or skirting immigration (which is essentially what you are suggesting). People who are fiance(e)s or spouses of US citizens are questioned very specifically about this. While this is less common with people from Canada it can and does happen to visiting Canadians (happens a ton with people from other countries). Crossings are tracked and the last thing you want to do is risk having issues getting her a visa, whether it's as your fiancee or spouse. Personally I wouldn't risk having my fiance here more than 5 months out of the year total.

Yes it has to be submitted online. If you tried to complete it using a browser besides IE I recommend trying again with that. I know there was one my fiance tried to do in Chrome and got errors on.

You can call the Dept of State to see if the consulate has received it. For us it took about a month for Montreal to get it (it was recent, check my sig for my timeline). Don't wait for them to mail Packet 3, everything you need is online. Once the Dept of State says they have received your petition and mailed Packet 3 you can send it back. If you need help getting the number for the DOS I can try to find it if someone else doesn't post it first. Packet 3 for Montreal can be found here: http://photos.state....et3-k1-mtl.pdf. There are many documents that you may need and they take some time (especially if you need to renew the benficiary's passport). I'd get started on those right away. I can share links and tips for the passport renewal, police certificate (we did RCMP one), and birth certificate if you need them, just ask!

No, not if you are going with the items. You just make a list of your stuff in word or whatever typing program you have.

If you are not going with your stuff then you have to fill out customs forms.


I'm planning on driving up to the Toronto area to take my fiance to Montreal for the interview, then hanging out and packing up while we wait for the passport with the K1 to be returned. After that POE at Port Huron and hopefully smooth sailing. Thanks for the help, one less form to worry about huzzah!

CanadaScheduling the interview
Called the DOS today and they said Packet 4 was logged as emailed so even though Jay hasn't gotten the email we made our interview appt. Apparently a lot of those open dates were gobbled up because 7/24 was the earliest we could schedule. Gonna watch like a hawk in hopes of moving it forward but it's not looking so great.

The # to call to ask about Packet 3 (DOS) is 1-202-663-1225. As others said no need to wait for Packet 3, it takes forever or may never come. Someone already linked the Montreal website, go there and look at what's required for Packet 3 and start getting any documents you might need (ex: birth certificate, renewed passport, police check, etc). When we had sent back Packet 3 we got an interview date within 2 weeks (I cheated and called DOS, didn't get the Packet 4 email but they told me it was sent) for about 2 months out.

I sent my packet 3 in express on a thursday and got an email the following Friday that I could schedule so it goes pretty quickly!
