I think the point that most here are missing is that all family type visas are last in line (K-1, K-3, CR1/IR1) in favor of work visas, student visas as well as visas for those on work visas to have their families join them. These are the type of visas that should be put on hold until USCIS can get their act together and get caught up on family oriented visas. But as with any governmental office and there useless unions the adjudicators only have to process just a comfortable amount of applications per day, don't want then to work too hard or be too productive. I say privatize the whole process and put people in place that understand productivity.

Oops need to change that. We filed the I-130 in January.

My wife has a son from a previous marriage who is eight and then in November we had a son who is now almost five months old.

OK so I need to file an I-864 for my wife and one for my stepson. Now what about my two kids from my previous marriage? Since I don't get to claim them on my income tax even though I pay child support do I necessarily have to show them as dependents?

Sometimes I think there should be a separate area just for I 864 questions.

OK I've read the instructions several times , but still am not clear on a couple of things so anyone with better government form reading skills is welcome to reply,

Here goes;
First do I file a separate I-864 for each person I am sponsoring (1 for my wife and 1 for her son as they are two separate petitions)

Since I don't get to declare my kids from my previous marriage as deductions on my income tax (even though I pay child support) do I need to show them as dependents? To me the wording says if they aren't on my tax form then I don't have to show them.

So depending on how you read it my dependent count could be four (including me) (my wife and I also have a son together) or six if I include my two other kids.

Any thoughts?

By the way got our NOA1 on February 16th file was touched on 02/24/08 nothing since VSC.

About a year ago my wife and I got a document from her ex allowing her to take their son out of the country. (thought things were going to go a bit more quickly) There is no expiration date on it. So does anybody know if the consulate gives an allowed times that they see these as valid?

Hoping that it will still be ok as the last one was a real bear to get him to agree to.

Do you know this for a fact? Have you seen a review from someone who interviewed at her Embassy or received written instruction from the embassy asking that you bring originals to the interview as well?

Most issuing offices will give you as many copies as you want, that is basically how it would be accomplished - IF it is required.


If you read the list of things that she is supposed to bring to the interview it includes all of the same documents that your supposed to send to NVC. As per the embassy site this is included in the KEV 3 packet.

Being as your dealing with Canada and not a former soviet country (actually two) you have no idea just how complicated these folks can make life to perform what is a simple task in a western country. Just to get married took visits to no less than four diffrent agencies each with there own fee and waiting time and two different agencies after we got married to properly register the marriage certificate.

Yes but when your literally hindreds of miles from the issuing authority which makes it nearly immpossible to get copies from them. And if the mail loses your only originals then your screwed. They should go back to the old method of bringing the originals to the interview. just too much risk involved this way.

My concern is not with NVC but rather with the Ukrainian mail service as things can just disappear for no reason. To give you an example My wife sent me a small present for Valentines day it never arrived four months later she was notified that it had come back because the post office didn't charge her enough postage.

In these type cases I think is is truly assinine of NVC to request originals when they have to know how easy it can be for such important documents to become lost.

Here is the problem my wife and her son were born in different cities in Russia they now live in Ukraine it is extremely difficult to get documents from the issuing authority with traveling there to get them and even then it can be difficult. So any thoughts? How about a notary with apostille that says it is a true and complete copy of the original?

I read Lotofpatience fast NVC method the thing I can't find anywhere is the part about the orignals of birthcertificates and marriage certificates. To request such things is crazy on the part of NVC it is much too easy for such important documents to be lost. So anybody know if they will accept certified copies??

I got a reply yesterday. Expedite denied petition will be processed in standard time period.

However I'm not going to let that stop me as I have already contacted my father physician and he is sending me a letter on my fathers condition. I fully intend to do as Sarah suggested up thread and see what happens. I really think they need to realize that I won't just go away in this situation. As my wife and I have a six month old who may never see his grandfather unless I can find a wayt o keep up the preassure for an approval.
