as long as you get the letter from the court saying that your arrest is sealed and for you to send it in, then you should be ok. that is what the interviewer had told you, for you to get a copy of the letter from the court. however, once uscis has received the letter from the court which you will send it in, they still will have to make a decision on your case. it depends on what you was arrested for. good luck.

one member said that he had file 2 weeks before his gc expired. ok, what if your roc package was lost in the mail. next thing you know, as far as uscis is concern, you didn't meet the dead line. i am right when i had said, you should file the roc 90 days before your gc expires. or, within the 90 day period. i didn't say to file before the 90 day. i said, you should file 90 days or within the 90 day period. uscis wants you to file 90 days brfore your gc expires for a reason. there are alot of reasons why uscis wants you to file 90 days before your gc expires or within the 90 day period. the member who file 2 weeks before his gc expired was lucky that his package wasn't lost in the mail. so what i am saying is correct when i use the term, should.

First I am so very sorry for your loss.

In relation to your status. Had he passed prior to filing you would have filed with a waiver. As you have already filed I would make an INFOPASS appointment and let them know he has passed and that you need to change it to a waiver filing. You should be RFE'd for the death certificate and have 86 days to supply it. The reason for letting them know is as with divorce if you are divorced while the ROC is processing then you have to change it to a waiver filing and if you don't and the card gets approved on a joint filing when it should have been waiver you can encounter problems later (like with USC).

I would book and INFOPASS and try and speak with the people who produce the death certificates to get it sped up for immigration purposes. Hopefully they understand.

Again I am so very sorry for your loss, my thoughts are with you.

hi everyone, i hope everyone is doing fine. my wife has her 2 year greencard and she still has about 6 months to go for her to roc. we are planning to go to the philippines on vacation. we had just came back from the philippine consulate in new york to have her marry name in her current passport. it will take about 6 weeks for my wife to have her new passport. we would have to send the old passport with her maiden name back for her to get the new passport with her marry name. my question is, will we have a problem going and coming from the philippines from the united states becaused in her old passport, it has the point of entry stamp in her old passport. if i understand it right, it has on one of the websites that you have to keep your old valid passport while holding a greencard. if this was true, why didn't someone tell us from the philippine consulate of new york. i hope someone can help me becaused i don't want any problems. thank you everyone.

just send a copy of your gc, front and back and explain in a short letter that you had forgotten to send the copy of your gc with your 1-751 application. what i would do is to send it by overnight express. it might cost you some money but they will get it the next day. its up to you my friend. good luck.

USCIS WANTS TO SEE A TRUE MARRIAGE. They want to see in most cases the wife with the same last name of the husband. cHECKED OUT THE USCIS INSTRUCTIONS OF SENDING OUT THE 1-751 PACKAGE. This is called evidence and its better if alot of documents were in both or under the same last name. You can do what you want but i would try to have your wife with the same last name of yours on your lease.
