If you're in any country and wish to enter an American Embassy or Consulate, you must first show identity in the form of a passport.

Not true. Perhaps it is in their guidelines, I don't know - however I went to the Calgary Consulate at least 4 times and never once showed my passport (and neither did my Mother or my Husband who went with me at different times).

Furthermore - it would be really tough to show your passport at the Consulate/Embassy if you were applying for a Passport.

Hmmm... I thought that you were only permitted inside without a passport if you've lost it or for other emergencies. If you can enter a U.S. consulate in canada casually, without one....that's news to me. And I'm sorry for giving bad info. I'm only speaking from my experience in approx. 5 European US consulates.

K-1 Fiance(e) Visa Process & ProceduresK1 after divorce
I think it would have been just as easy to say you must both be free and able to marry at the time of filing.

K-1 Fiance(e) Visa Process & ProceduresQuestion and guidance
I think the waiting for a divorce could be even worse than the USCIS wait. My divorce took a very long time.

K-1 Fiance(e) Visa Process & ProceduresI have a few questions.
1. 1 unless you are self employed, then send 3.
2. should be included in the duplicate packet you send to her containing your entire I-129f kit.
3. Yep. read #2.
4. A new letter of intent to marry with a date much closer to actual interview.
5. I believe your case will be sent back to NVC.

I think it's up to you. If you feel ready and have accepted all possibilities, then do as you please. Good luck to you.

K-1 Fiance(e) Visa Process & ProceduresG-325A Supplements
When you print the G325 on your printer, it should print all 4 pages. But notice they are all different. Only the numbering on the bottom of the pages are different. They all need to be signed and submitted. So, you should be sending 8 total. 4 for each of you.

K-1 Fiance(e) Visa Process & ProceduresWhat to expect after NOA1 and before NOA2 is received???
Create a portfolio on USCIS's website. And use the receipt number from your NOA1. add it to your portfolio and you will be notified each time something has changed with your case. Other than that, expect to wait anywhere from 4-6 months. Good luck!!!

K-1 Fiance(e) Visa Process & Proceduresgoing to interview and lacking some requirements
I don't really know what I'd do. If I have to wait for a new interview date or wait through a review, either way its waiting more time. So, depending on what you're lacking, I might try the interview at the originally scheduled time. If you're missing something like an original birth certificate from the petitioner or a few paystubs, it may just get overlooked. I guess it depends on what you're missing. I read in the past that someone was missing some documents at their interview. The interviewer granted the visa but withheld it until the documents were sent to the embassy. I wish I could remember where that thread was. Anyway, good luck. Either way, you will probably have to wait longer. So, why not try. Unless of course it causes a longer wait. Dang, sorry I can't help so much here.

I dont think you'll have any issues. It will be at least 6 months before you have an interview. could be a few months more than that. By then he will have enough paystubs to offer for the interview.

What is the procedure when the application is being reviewed? What are they actually reviewing on the 129f?
It seems like they just sit there and read the application and documents what are they really auditing the application agai

I mean what do they have to base it on if they are just reading an application? What does the NVC do with the application

this is a silly question but I was just wondering .....maybe it is the accoutant in me.......hahahah

But seriously....the petitions obviously sit around for a very long time. Finally they are reviewed. Thoroughly. I believe NVC simply forwards the approved petition to the foreign embassy. but not before they organize it and prepare it for one final review. I think....

K-1 Fiance(e) Visa Process & ProceduresForgot to send some proof of relationship with I-129f
Dont just send it. Wait for the RFE. It shouldnt pause your process much. They will hold your file until you return the requested info. Then hopefully a quick approval from the time you send it in. If you send it now, it could get sent back to you, lost, buried or even sold in China for small children's organs....just kidding. Wait for the RFE. you'll be just fine. wink.gif

K-1 Fiance(e) Visa Process & ProceduresConsequences
You can call as often as you wish. its the same gamble you take when doing business with anyone in customer service. Always afraid to piss someone off for fear they may possibly sabotage your merchandise or service. They most likely wouldn't do anything to your petition. The worst that could happen might be them giving you bad service manners. You can simply say that its been very long since you sent the petition. Perhaps you just dont remember. They will check for you. Good luck. Sorry you've waited so long for the first notice.

K-1 Fiance(e) Visa Process & ProceduresCan you file a I-129F and marry the person while waiting?
If you abandon the K-1 now, you will have basically wasted the last few months of waiting. And not to mention CR-1 and K-3 visas usually tend to take longer to process. If you love each other so strongly, waiting out the rest of this K-1 won't hurt you. You're like halfway there now. Don't throw that away. :clock:

K-1 Fiance(e) Visa Process & ProceduresEngagement ring
QUOTE (pushbrk @ Nov 5 2007, 11:16 AM) <{POST_SNAPBACK}>
QUOTE (moxcamel @ Nov 5 2007, 08:09 AM) <{POST_SNAPBACK}>
I'm not sure where the impression that engagement rings are necessary keeps arising. There is no formal requirement for it, and in fact many cultures (such as FSU countries) usually don't even have engagement rings, although this is changing in the bigger cities as western cultures gain more influence. While a CO might express curiosity or interest, it would (IMO) be an abuse of authority to read anything into the lack of a ring. And since anyone can just throw a rock on their finger, I highly doubt it strengthens the impression of an ongoing relationship either.

A little off topic.

As a beautiful woman working as a waitress, my wife was getting hit on quite a bit because she didn't wear her rings to work. She didn't want them getting dirty or lost. It became such a bother for her, I suggested we buy a cheap ring for her to wear to work. Even the smallest cubic zirkonium looks like about a full carat, so now her customers think she's married to a real moneybags. The Chinese don't really wear rings either.

The ring is quite attractive. I think we paid about $6 for it.

Ahh yes! But I'll bet she noticed a slight decrease in her average income wink.gif tongue.gif

I've noticed there have been some long delays from CSC to NVC. What's up with that? I really hope this gets cleared up quickly and doesn't spread to VSC. Best of luck to all those in limbo.

K-1 Fiance(e) Visa Process & ProceduresRFE FOR CRIMES NEVER COMMITTED!!!!
I read your post once again. Because I just felt so confused the first time. Is it simply because you answered certain questions differently the second time filing? Do they think you are trying to file again by answering them differently to avoid denial? I mean, you ARE but its not fraudulent. If its an RFE, there must be a solution that can get you an approval. At least its not a denial. I think that all evidence you can gather to support your claim that he is clean as a whistle, should be sufficient. I cant imagine that you'd have to pay out thousands to a hotshot lawyer to send the same evidence that you would. or make the same phonecalls that you would, etc. Damn! I just don't understand. It must be a mistake. I mean, I'm sure you know EVERYTHING about each other's background, so there's no possible way he has anything he's keeping from you. He filed twice! Just dont get it. They are such idiots there. I'll be watching your progress closely and hoping for you all the time. Hang in there.

K-1 Fiance(e) Visa Process & ProceduresRFE FOR CRIMES NEVER COMMITTED!!!!
Oh my, Mirla... sad.gif I'm very sad for you right now, but I must encourage you to remain as strong as you have all this time. I really hope that someone can help you. I have no idea how this can be happening. I wish I understood this process more. I hope you find a resolution quickly. You deserve an approval right now. If you keep fighting you will win. but I'm concerned with Patrick giving up. You gotta keep him active with this. He's the only one who can change this. Good luck, I'll keep my fingers crossed for you that you will find someone who can assist you.... wink.gif

K-1 Fiance(e) Visa Process & ProceduresCan I extend the marriage period?
Everyone here took the words out of my mouth. I was a little surprised to read the original post. You definitely need to be sure that you both love each other enough to commit to a marriage. that 90 days isnt really a "trial" period. though, you are free to change your minds. take some trips to visit her. Don't rush. And remember that you shouldn't have to "make" things work. Either they work naturally, or they don't.

K-1 Fiance(e) Visa Process & ProceduresQuestion for those whole filed in December
Well, most federal buildings shut down between Christmas and New Year's. I dont mean they shut down as in the working hours are closed. But they are very lax during that week and some agencies even use those days to do some in-house work. but I'm betting we'll still see some activity out of them during the holidays. We might only lose a week or so from that month.

Sounds like you need to resubmit, but make a breif coverpage explaining the special circumstance. That as listed on page X of the I-129F instructions you are to file to CSC....

This can hopefully ensure the package doesn't get returned to you again. Best of luck!

Sounds like USCIS did a major SNAFU if you reside in the US and filed at CSC.
Get your senator or congressman involved!

I currently reside in China. My last place of residence in the US was Idaho and according to the USCIS website I should therefore apply at the CSC.
Everywhere else I looked said the same thing. It even says so on the application.

Would submitting it again do anything, or would I just meet the same problem?

Yes, submit the petition again with a copy of the letter you got and a new cover letter addressing it. I-129F petitions cannot be filed at Consulates abroad.

You did file an I-129F petition, right? Your fiance will later submit a K1 visa application. If you submitted a K1 visa application, then you blew it. Visa applications are indeed submitted at Embassies and Consulates abroad but for K1, only after the I-129F petition is approved and the Consulate contacts the beneficiary/applicant.

I think what he's saying is you must have sent them the actual Visa Application instead of the I129f, or with the I129f. They dont want that at this time. And it cant be filed with CSC. That step is for the consulate.

K-1 Fiance(e) Visa Process & ProceduresOverStay
Hmmmm.....well, if you're looking for honesty I'd say there's a small chance of approval. depending on the circumstances they may work around it. But that would be after a long thorough background check. They dont take too kindly to overstayed visas. Never been through that before so I cant really give you definitive answers. But from what I've seen in the past, its not good to have this on your record. Good luck.

That is one of the strangest cases I've ever heard of. I have no idea why this is happening. Based on the info you've provided, it would seem very harsh. I'm sorry you have gone through this for so long. I will watch this thread closely as I'm curious to find out more....

No, it will not cause additional delays. Some people never receive their first NOA. The second one is the one that really matters. Keep an eye on that check. When its cashed you can get the case number from the check. I've seen many people wait more than a month for their check to be cashed. It shouldn't happen to you, though. Hang in there. And some people wait several weeks to receive their NOA1.
