my god, what have I done? I seem to have turned a serious question of concern into a weird thread. Sorry all! Just want to get through this horrible process with a little assistance from those who have more knowledge. I'm not sure where to find more info on this waiver. And when it should be submitted. With the 129F? Or will calling them solve this? I just dont want to get half way through this and have someone stop the process for more evidence.

It didnt occur to me until I reread it that it might offend. I didnt mean to undermind anyone who has only actually met their fiancee a few times. I for one know how quickly you can fall in love when the ingredients are perfect. I was simply trying to backup my case that she isn't that type of person. Alibaba and those like him erk me when they doubt someone who is close to my heart. I dont know about you guys but its sometimes hard hearing people say "Oooohh" when you explain your relationship. Anyway, cheers all!

Gotta find out what that form is that should be filed to say I had a previous case at one time. Off to investigate.

Thanks for your concern, but I can assure you that this is no "greencard" case. She could care less where we live, as long as we're together. I know this relationship has nothing to do with residency. In fact, the Russian woman I married wasnt even interested in citizenship. That love just faded. my Sasha and i shared everything for a year. most people here who are applying for a fiance visa (K1) do so with only a short visit or two to the fiancee's country. In fact, I'll bet most havent spent more than a few weeks actual time with their fiancee. Sasha and i lived together here in Williamsburg. Once again, thanks for the concern....but really, there's no doubt about her intentions. She's just as miserable without me as I am without her.

I'm sorry but I think this will be lengthy. I'll try to keep it as short and simple as possible. Thanks! A little over 2 years ago I married a Russian wooman who was a working student in the States. We decided it to be best for her to return to Russia after the marriage to complete her degree. Our marriage sadly failed after beginning our CR1 process. She just kinda disappeared on me. We abandoned the process while the case was at NVC. Little more than half way. That was well over a year ago. In that time I actually met, fell in love with another woman, who surprisingly is also from Russia. Maybe this only sounds surprising to me, but what are the odds? In Virginia? Anyway....my divorce is finally just now completed. That's a whole other story. My new love is Alexandra. Sasha. We have spent many months together and love each other like crazy. She returned to Russia recently and we dreaded that day because we had no certainty of her being able to return. I've never experienced being in love with someone while finalizing a divorce, but the agony of not being able to marry Sasha because my divorce wasnt final was killing us. She had to go home and we had only one choice. A K1 visa. As soon as I have the divorce certificate in my hand the first packet can go out. now, I have some questions....Will there be any problem with our case if they see that I had abandoned an old case for a different woman, my spouse? or will the divorce documents be enough to satisfy?
Also, I have great tax history for the past 3 years and doubled the poverty level of income. However, for the first 7 months of 2006 i did not work due to an injury. I was forced to live off of my savings which dwindled quickly. Now, i'm working full time again. I'm a waiter and a bartender and my bank account says I'm broke as a joke. especially after surviving 7 months of no work. For 2006 I'm not going to meet the needed earning requirements. Now the IRS. They issue your tax info in January. So that means that as of October 2006 my last 3 years are 2003, 2004, 2005. But that step of our process (Af of Sup.) will not happen until sometime after the new year. So, by then will the embassy want 2004,5,6?? because my last year is not going to look so hot. Though we both know I'm more than capable and make plenty for both of us. Paystubs are good, but the bank statement and first half of '06 Tax History look poor. Can anyone shed some serious light on this puzzling ache in my head??? Thank you all so much for reading through this. I cant believe I'm going to do this again. At least this time I know its for the right reasons with the right person. We've learned everything about each other. Have a year of history together under one roof. This cannot fail us...

Thanks guys. At what point are the I-485 AOS and I-765 required? I thought these were done after the visa holder arrives in the U.S. Adjustment of status, work, etc. Correct? But there is no required IV fee bill, right?

When i was in the process of a CR-1 two years ago, i remember there was an IV bill fee of close to 400 bucks. Cant find that description anywhere now. Anyway, I'm starting a K-1 visa now for my fiancee and was wondering if that fee will be part of this eventually. Also, the process for a K-1 visa seems a lot easier than the CR1 or K3...and maybe even faster. Seems to be lots less paper work and fewer steps. Am I safe to assume this? I cannot seem to locate a good timeline with exact details from an experienced member. A couple of years ago "James" listed a fantastic step-by-step process that included every little detail, including his personal shortcuts. Is there a similar one for K1? Thanks alot for the help.

Cochran, I too use money orders when mailing a payment for something. Never use checks. Either with my card or moneyorders. I sent a money order with my package to VSC on the 14th of this month. I have also noticed people mentioning dates stamped on the back of cashed checks along with their newly assigned case number. Your post got me thinking and so I decided to research a little. If you call 1-800-999-9660 you get into Western Union's Money Order Customer Service. they have options for checking the status of money orders and tracking. I would imagine that the money order you purchased at the bank has something similar. If you kept the receipt portion of the actual money order, there will be a "check" number and a phone number. My advice would be to call that number. You may even be able to talk to a real person and ask them if there is a receipt number from USCIS attached to it. To my surprise, when I called Western union, VSC has yet to cash mine.... :(
Its been more than a week since they received mine and have not cashed the money order?? Oh well...... Anyway, hope this helps you.

I would take the Originals of any/all documents you made photocopies of. You can leave them with your SO along with your I-134 and supporting documents. in fact, its usually a good idea to have an exact copy of the entire packet you submitted with the I-129F. (If you made one) Take this to her and she will have everything the embassy has plus originals (Birth Certificate, plane ticket stubs, divorce decrees, etc.) Like it was mentioned earlier, you can at least save yourself alot of money for postage by delivering everything she needs yourself. If you were applying for a K-3 or CR-1 visa you would need this NOA2 for the next step at NVC. But since you're pursuing a K-1, there's really no need. NVC simply organizes your packet and forwards it to Moscow. Not sure I really helped, but good luck!

Once you have learned that your case has landed in the embassy, you should contact them immediately. Since approved petitions don't stay in NVC very long, it would be very difficult to catch it while its there. And most of the time, its on it's way to the embassy by the time you find out. And keep in mind, that anyone who fills out a I-134 will also need to submit a G-325A Biographical form with passport style photo. At least this was the rule a couple of years ago. I'm pretty sure its still the rule. Look into this, it may save you some time and RFEs. Hope this helps. And if I'm wrong, please excuse me.

The date on the postage is what matters. like Devilette told you, before Saturday is fine. Get it certified, so you can track the delivery and find out when it was cashed. Also you will have your receipt number stamped on the cancelled check for your records. Though I can foresee many unhappy filers who will send the wrong amount in the coming week, but even then its an easy fix and shouldnt take much time away from progress. I think it's all in how you present your case (relationship). There are some redflags in large age gaps, but it seems to be only an issue if the woman is the foreigner and much older and/or wealthier. Usually if the man is the USC and he is a bit older than the woman, its looked at as normal in this journey. Just what I've noticed. As stated before by Pushbrk. Jakey, how old or young are you? if I may ask. Be careful how you present yourself to and your relationship to the officials. I truly don't want to offend, but you probably dont want to correspond wiff dose peeps dis way. Especially if you had to submit anything written as attachments or in a cover letter. Knowwhatimean? It just screams out..."hey! I'm a minor". just trying to help you out a little. Good luck.

I'm sure we'd all feel as frustrated as you are now. I'm sorry about your bad news. Have you tried calling back to CSC? Perhaps they have more helpful info. this is one of the reasons we all make copies of our entire K-type packets. if the case was approved and maybe misplaced, it could be of some help to have a backup. Anyway, try calling CSC and find out when exactly it left, if it DID leave. Good luck to you and no matter how angry you feel, try not to let it show too strongly when talking with those officials. Whew!!! Man oh man. I just had the scare of my life! I know this thread has been dead for a while but I was suddenly sick to my stomach to hear about this J-1 2 year rule thing. Never heard of it before. I recently began our process for a K-1 visa. My Sasha had been in the States for the past 2 summers (2005, 2006) working. I have been reading old posts about people that need to wait 2 full years before filing for a K-1 visa. I cannot seem to start new threads with my PC. For some reason I can only add a quick reply. Windows closes when I try to begin my own thread. So anyway, all morning I've been pretty nervous. She's only been back in Russia since last September. I started looking through her photocopies of visas from her passport. Thank God I made several copies of our completed K-1 packet. And on her Visa it says clearly that "The 2 year rule does NOT apply Russia". Oh god I really hope that this means we are in the clear. Why is Russia exempt from this and not other countries like Poland?? Anyone shed some light on this for me? And can anyone tell me why Explorer closes each time I try to begin my own thread?? Help....

I too once entertained the idea of going to Russia and staying for a few months during the last stage of our visa process. I could have gotten alot of writing finished this way. But I decided to stay here and continue working because it would certainly look better for my income, though I'm already well over the poverty guidelines for this year. I was just too worried that it might appear irresponsible. Besides, I can make more here. Since you have a cosponsor I guess you should have nothing to worry about. And if I may give you an opinion without offending... being a writer and editor, I would imagine you could find a much better paying job to earn the minimum required by the I-134. What id this job offer you spoke about in Thailand? Can't be freelance writing. You mentioned it was a Thai job. I'm only asking out of curiosity because I find it adventurous to do such things. I had to withdraw a case that was abandoned over 2 years ago. I filed for a CR1 visa for my exwife back in March 2005. I assumed that the case would be dropped if left alone for over a year. Wrong. I had to send them letters and signatures and copies of my divorce decree. I didnt wait very long before beginning my K-1 visa petition for my fiancee. And that worried me. But everything seems to be ok. The only thing I can say is make sure the old case is terminated before proceeding with the K-1. Statistically it seems faster than the K-3 anyway and also less expensive initially. Initially being the magic word. New fees will make it expensive later. But at least your SO could be here with you wile you adjust status. That's really the biggest advantage of the K-1 I think. Since you recently submitted your K-3 application, you may want to wait until you know for sure that the case has been terminated. My old case was no longer at VSC, instead it was in a coma at NVC. So, it didnt affect my petition for the K-1. I was fortunate. Please be careful. You don't want those cases to knock heads with each other.

I've been the same as you, worried and researching, especially since I sent the petition a few weeks ago. It seems to only apply to certain J-1 visas. my girl had a J-1 visa but it wasn't for either governments' jobs, or funded by an international organization. I guess this is why she was not subject to 212(E). Working at an amusement park doesn't exactly qualify for medical training or government work, i guess. :lol:

I just found this explanation on this web page from the State dept. Still not sure "why" they have this rule, though. Unless its all in the name of National Security. Either way, I'm no longer concerned. Sasha's visa states that she is not subject to section 212(E).

I just posted this in a very old thread, so not sure if anyone will read. My fiancee is from Russia. She received visas in 2005 and 2006 for working here in the States during the summers. She returned home last September. She had a J-1 visa. On her visas there are stamps that read....

Bearer is not subject to section 212 (E)
2 year rule does not apply Russia

I'm assuming this means that we don't have any worries about waiting for 2 years. I truly hope not, seeing as I've just received my NOA1 and gotten pretty excited about getting this visa for Sasha. If the 2 year rule doesn't apply for her, we should be ok, right?? And why do other J-1 visas from other countries require a 2 year wait? Strange. Anyway, hopefully someone can help me feel a bit better about this. What a bummer if we had to cancel this petition and wait another year! :bonk:

I thought it was considered visa fraud if you use any other visa to get to "marriage". Dont know. But I do know someone here in Williamsburg that married a woman from Belarus while she was here working a few summers ago. They were able to keep her here while they filed for a K-3. She never had to leave. The problem, I think, with filing for an immigrant visa while being here, is that it seems you only applied for a tourist visa for this ultimate reason. which = Fraud. but I'm not sure.

I have been wondering about this myself. Sasha had a SSN issued to her in 2005 while she was here working. When she returned in 2006 I believe she had the same number for working again. And this year when I filled in that question I wrote "see attachment". Then I added a typed page with the explanation, including her SSN. Should be sufficient, i hope. Anyway, my question is....When she finally arrives back in the States and is issued a number, will it be that same number she was issued in 2005? I cant see any reason why they would give her a new one or give me trouble for answering that question that way. :blink:
