We haven't received the NOAT from the transfer on 08/09/2013. What should we do? We do not know where the case has been transferred to or what is going on with the file. What do you guys recommend we do.

Ok Guys, I have said this before and I will say it again. The case processing according to the record that has been made available by members is like this:

1. Approved Expedites

2. August 6th Transfers

3. August 8th Transfers

4. August 9th Transfers

Now if you want to see where you stand on your adjudication for NOA2, check your dates. You can update your transfer dates in this thread for June Filers or you can post it to your comments in timeline for everyone to follow. Don't be selfish cause this is for YOU also to check so please update. Do not change your processing center if you were transferred.

 

Furthermore, like I have tried to explain before, if background checks are needed by DHS from other agencies, it will be a longer wait for the adjudication. Also, agents pick up files in bulks. Some are faster than others. The faster ones work on more case load and the decisions are quicker than the slower ones and also the newer ones. So, be patient and let the adjudicators, the decision makers, do their work and keep your fingers crossed. I think the Comprehensive immigration reform is coming. The speed at which the processes are moving shows that either new people have been hired to do the work or they have been advised to move fast to hand the case and work load after the CIR passes. So, good luck to all

Does anyone know if Guatemala would be considered a "high fraud" country?  Was there something special about the way they processed those transferred to TSC on Aug 6th? (extra scrutiny)  Our case was transferred to TSC on Aug 9th... just wondering (and waiting).

 

Guatemala is not considered a high risk country. But, they do a background check for gang affiliations. So, it is a 50/50.

What would cause someone to be flagged?

 

Criminal offenses for the petitioner, deportation for the beneficiary, high fraud country beneficiary, previous petitions by both, etc.

The August 6th transfers TSC who are flagged in an initial scan will go through a detailed background check with different agencies like DHS, DOS, FBI etc. Also, beneficiaries from a 'high fraud country' have a background check also. These petitions will take the full 5 months of processing even if they get transferred. So, with me fallling in alll these categories, I have to wait. But, I wish you all - All the Best!

This is my guess after going through list that received NOA2 after VSC to TSC transfers. All the ones responding with "received NOA2" are 6th August transfers. Check it out in the timeline for the ones approved.

Middle East and North Africaeasy couscous recipe?
Ingredients

4 tablespoons (1/2 stick) unsalted butter
3/4 cup chopped shallots
3 cups Homemade Chicken Stock, recipe follows, or canned broth
1/2 teaspoon kosher salt
1/2 teaspoon black pepper
1 1/2 cups couscous
1/2 cup pignoli nuts, toasted
1/4 cup currants

Directions

Melt the butter in a large saute pan, add the shallots and cook for 3 minutes over medium heat. Add the chicken stock, salt and pepper, raise the heat to high and bring the stock to a boil. Off the heat and add the couscous. Cover the pan and let it sit for 10 minutes.

Add the pignoli nuts and currants to the couscous, stir and serve.

Homemade Chicken Stock:

3 (5-pound) chickens

3 large onions, unpeeled and quartered

6 carrots, unpeeled and halved

4 celery stalks with leaves, cut in thirds

4 parsnips, unpeeled and cut in 1/2, optional

20 sprigs fresh flat-leaf parsley

15 sprigs fresh thyme

20 sprigs fresh dill

1 head garlic, unpeeled and cut in 1/2 crosswise

2 tablespoons kosher salt

2 teaspoons whole black peppercorns

Place the chickens, onions, carrots, celery, parsnips, parsley, thyme, dill, garlic, salt, and peppercorns in a 16 to 20-quart stockpot with 7 quarts of water and bring to a boil. Skim the surface as needed. Simmer uncovered for 4 hours. Strain the entire contents of the pot through a colander, discarding the chicken and vegetables, and chill. Discard the hardened fat, and then pack the broth in quart containers.

Yield: 6 quarts

No, this has to be from the petitioner. The petitioner can use a co-sponsor. You, as a non native US person cannot sponsor yourself based on a job. You can though show funds and sponsor yourself. I don't know how much the funds have to be. But, maybe someone else will come along with a more experienced outlook towards your situation. So, good luck!

You have to show proof of ongoing relationship. You can take frames out of the CDs and DVDs that show family gatherings of her with your family and vice versa and pictures of both of you with friends and family. Date the pictures as they were taken. Submit these with proof of chat logs, emails, phone conversations and hotel receipts and plane tickets. This would do the trick.

How long have you lived in turkey? The fiance visa is for someone who cannot get married in a foreign country due to circumstances. If you have lived in Turkey for more than 6 months continuously, you are eligible to get married and file a DCF on I-130. Please check online with your embassy to make sure that DCF is available (Consulate in Ankara will process U.S. Citizen petitions for spouses and children in Turkey and Iran). Once the petition is granted and visa issued, you will have to establish domicile in the US and have him follow. You can use your parents as co-sponsors for Affidavit of Support. Also, if you were to get married and file for I-130 in the US, it is down to a 6-8 months of wait and takes a little longer than the fiance visa. Good luck on whatever you decide to do.

Did he declare the child with you in his last application? If not, he could be hit with misrepresentation and that is a lifetime ban. So, you need to find out what was filed and what was disclosed before you start this process. Wish you all the best!

Wow, thanks for the quick answers....and although anything could happen it does make me feel better to see some positive responses. 

 

We don't know what was on the I-94 because it is missing from his passport...it could have been anything. He was honestly flabbergasted to hear that such a thing ever existed...just not paying attention. 

 

But he stayed from June 2004 until April 2005 thinking it expired when the B1/B2 validity date expired, which was in June 2005. 

 

I suppose I should ask if anyone knows what the process might be from here...if we just wait to see what happens first or if we should prepare for a long and drawn out process of rectification.

There is definitely no ban for overstay. But the CO could hit your fiance with a misrepresentation ban which is a lifetime ban. It can be waived with an I601 waiver. But, it is almost a 1 year process. But, it is entirely up to the CO's discretion. Wish you the best of luck and hopefully the CO rules in your favor.

Regarding the I-94, it is a piece of paper that you receive at the airport which shows how long your entry is good for. When you depart the US, the airline takes it out of the passport and send it to the CBP sorting facility where it may or may not be entered into the system.

Now the CO might just want to see the kind of Visa your fiance received 10 years ago. They might just want to pull up the last visa application that your fiance submitted at that time just to make sure that he hasn't lied in that regarding kids and marital status etc. Ths information might only be available by inputting the last Visa Number into the computer. So, don't stress too much and have faith.

I have just been informed by my fiance (US Citizen) that NOA2 has been received and approved. I am moving house this weekend and i need to inform the USCIS of my change of address in the UK. How do i do this? The AR-11 form seems to be for people that have already made the move to the USA but i am still in the UK

Hello

I am reading through the step by step K1 visa guide (i received my NOA2 mid December) and i have got to the section:

- What to send to your fiance(e) once the I-129F is approved (Receive NOA2)

One of the things on this list is an I-134 form. The USCIS website doesn't tell you where to file this form as it depends on where the non US citizen resides and which form has been filed. The form we have filed so far is the I-129F and I live in the UK

Does my fiance need to complete this and collect all of the evidence and send it to me to take to the interview or does he need to file this himself in the states?

Please help!

My Fiance has requested 3 years Tax transcripts/returns for me to take with me to my interview but the IRS have only sent him 2008,2009 & 2010. If my interview is in April will i need his tax return from 2011? He just tried to request this on the IRS website but they said 2011 isn't available.

Sorry i'm not sure how the whole tax thing works in the states so please forgive my ignorance! :)

On 26th March i was accepted at the embassy and was given a K1 visa which expires after 6 months. The expiry date will be 26th September 2012. My flight is booked for 18th September but i have just had a horrible thought that when they say that you have to get married and file for adjustment of status it has to be done before the 6 months are up. Is this the case or do you have a further 90 days from the point you enter the USA? If so do i have until the 18th December to get married and file for AOS?

Any help greatly appreciated
