K-1 Fiance(e) Visa Process & ProceduresI-129F Security Checks
Hi Dan!

I am sorry to hear about your situation. You can do nothing with it.. just wait. sad.gif We heard about this " security checks" in USCIS, but we were stuck at NVC, 2 months. It's " administrative processing". I think it's the same.. they check all your background or maybe your fiancee's. They never tell you. I know it's bad to wait more.. we have relived it.. And I hope you will be approved very soon.

Nadya.

K-1 Fiance(e) Visa Process & ProceduresWrinkle in the marriage law? Please explain.
I wouldn't even think about getting married there, even an unofficial marriage and then omitting that information from Immigration (Embassy in this case). If anybody suggested that, keep in mind it's against the rules of VJ.

You don't want to start your new life with a lie.... remember, I-129F is only the 1st step...there will be other forms to file later on....

Either get married there and then file for a spousal visa, or press on with your I-129 and then get married here (civil), go to Peru after AP and marry there in Church.

That's my 2 cents.

Joe.

K-1 Fiance(e) Visa Process & ProceduresQuestion for people stuck in AP at NVC

QUOTE (Maverick64 @ Sep 1 2009, 01:06 PM) <{POST_SNAPBACK}>
I called NVC this past Friday August 28th and was told that my case/petition was received on Monday August 24th and that I am in AP. Yesterday I received a letter from NVC stating: "this letter is to let you know that within a week the petition will be forwarded to the appropriate visa issuing post where your visa interview will take place". And it has the State dept. case #. Has anybody else who is stuck in AP at NVC also received a letter like this. I thought you only get a letter after they have sent your case to the Embassy.

Sorry to hear you are stuck in AP at NVC.

At the moment this is a common occurance. NVC are holding on to petitions from anywhere between 10-50 days. The letter is something they send out as soon as they receive the petition but is sadly not indicative of your petition actually being sent to the embassy.

The time spent in AP at NVC has decreased significantly over the last few months and there is a thread dedicated to tracking the average time spent in AP at NVC.

Below is the thread. Here you will find a number of people experiencing the same thing as you.

http://www.visajourn...howtopic=165644

Good luck - keep busy by investigating what information you need to submit for packet 3. This means you will be prepared for the next stage and will be able to provide the additional paperwork as soon as it is required of you.

In our case we received that letter 3 times within a 2 week period. Valid to say that we were stuck at NVC for AP for almost 2 months before the package was sent to the Embassy.

Good luck and hang in there.

you can fill in English, in Russian or in Ukrainian, but it could be much better to fill in English.

About my interview, no one asked me what language I prefer to speak with CO. He started talking only in English.

Hi all,

yes!! my fiancee visa is approved and she is just waiting to receive it.(due to the recent typhoon/flooding in the Phil. the US embassy is closed and might have caused more delay) She is also 8 months pregnant and might not be allowed to travel. here are my questions:

1.Once she receives her k1 visa how long is it good for? because she might have to give birth in the Philippines.

2.If the baby is born in the Philippines can the baby be added to her petition. or is this what you would consider k2 (this is a whole new catergory for me that im still researching) your experience or feedback is greatly appreciated.

Thanks!

1. the visa is good for 3 months (90 days) from date of approval...you'll see the expiration on the visa itself.

2. your baby doesn't need to be added to your petition, but you'll have to register his birth right away with the embassy through the CRBA process, the baby will then be issued a US passport and they can both fly.

look for the CRBA process link here in VJ or at USCIS so you can prepare for the requirements.

good luck and god bless!

Yes, after the birth you have to register your child in US Embassy. Having US passport your child will need nothingvfor travelling, no documents. I gave the birth in Ukraine, my husband ( his father ) came to Ukraine in one month after the birth and registered our son in the US Embassy in Kiev. In one month we have got US passport for our baby. When we came here, we applied for AOS and it was approved in 2 months without interview because of our son. He is the main proof in our relations.

Of course the best it could be if the child is born in the territory of the USA, but the trip is going to be so hard and so far. It's risky.

Like I said, wait for the birth, register your child and fly back home together. I don't know about Philippines, but in Ukraine you can't live country with a child without father's permission. You have to think about it too.

Good luck.

K-1 Fiance(e) Visa Process & ProceduresMiddle Name Question.
QUOTE (dxg68 @ Oct 24 2009, 07:58 PM) <{POST_SNAPBACK}>
Like all Russian and Ukrainian people my fiancé has a long middle name. Her middle name is in her birth certificate and in her Ukrainian passport but not in her travel passport (passport that she has to bring to embassy). She believes that this is how the travel passports are issued – without people's middle name. I am working on I-129 petition to USCIS and for now I included her middle name on all forms. My concern is that later she will have to fill out DS-156 for her interview and field 7 says "First and Middle Name (As in Passport)". Then she will have her middle name everywhere else including her birth certificate but not in her travel passport and DS-156. I am wondering how everybody else handled this problem. Thank you very much!!!

We filled out all K-1 forms with my wife's middle name, but when it came time for DS-156 we used her name exactly as it appeared on her international passport. It didn't cause any problems.

Joe.

So, in our case it was C. As soon as Kiev got our case we bought tickets.

K-1 Fiance(e) Visa Process & ProceduresAm I allowed to be present at interview?

Hi all,

We just sent our paperwork to VSC, but I have a quick question. Am I allowed to go with her to the Embassy in Kiev when she has her interview? Do I actually get to sit beside her when she is interviewed or do I have to sit in the hallway or outside or something?

I know we just filed (don't even have NOA1 yet) but it never hurts to be hopeful and looking ahead!!!!

Thanks,
Steve and Alyona

In Kiev you are allowed to go with your fiancée into the section where the interviews take place. Some members here from Ukraine were allowed to attend the interview, I wasn't. The CO actually asked me to step away from the window and he talked only with my wife. There's a waiting room adjacent to the interview room and you can in fact hear everything that is being said.

K-1 Fiance(e) Visa Process & ProceduresWhat info is need for proof of relationship at interview?

Is the stamp on my Visa enough proof to show I have met her?
I sent her a complet copy of my passport, and an extra copy of the Visa page.
which has a date of entry and exit stamped on it.
also the pictures have dates on them.
also I have about 20 pictures of us together.
and 20 emails, Letters from the online dating we met on.
and 60 days of phone records.

The stamp on your passport only prooves you went there.
pictures are great and highly desireable.
emails, letters and phone records are good too.

K-1 Fiance(e) Visa Process & ProceduresFiance freaking out!

Great answers everyone! Thanks!

Gary and Alla.. I know Donetsk is a big industrial town, but, I really enjoyed the month I stayed there. People were very kind and friendly and the friends I made four years ago are still my friends. :) I especially enjoyed the walking street and the concerts in the center. Well of course I was there in summer.. winter might be less attractive.

and I was born and lived not too far from Donetsk. It's Lugansk region. I can tell all these eastern regions are great, but they have grey color in winter and early spring.

K-1 Fiance(e) Visa Process & ProceduresFiance freaking out!

OK, so here is our situation.

My Fiance had her interview in Moscow Jan. 14th. She had some delays getting her police report so except for that our paperwork was perfectly complete.

However, I am currently unemployed. To cover my bases I asked my Mom, a federal employee, to co-sponsor which she did without a problem.

So.. now we get to the point of the post.

During the interview the "smiling lady" asked my girl if we planned on having kids to which she responded yes. She then asked.. how will you support kids if neither one of you is working. Fiance responded she will get a job if she has to. Smiling lady said.. "it will be hard for you to get a job"

Fiance left the interview with instructions to send her police paper in and then they will make a final decision.

But.. now a week and a half later Fiance is FREAKING OUT that they will deny her visa because I am not working at the moment.

So.. based on the cumulative knowledge.. what do you all think? And.. any advice to help calm her down?

Thanks in advance!

Hi there.

Don't worry. She was fine and she will be approved. Of course if her background is clear ;) They just need a police certificate, they can't give her a visa without it. It's one of the main of required documents for interview.

But at the interview, asnwering questions " I will get a job if I have to " That's RUSSIA  Only we can do it, work as a horse. I hope you will take my words right ;) It's inside of us. It's our mentalitet :) But smiling lady was right, right now it's too hard to find any job here. I don't know about your area, but still. Anyway, Don't worry, everything will be fine when she brings a police certificate. It's only one missed on the interview.

My boyfriend wrote them a letter full of emotions pointing out the truth: that we were no able to see each other for 10 long months. Prior to my recent trip to Russia.
And it worked!!! they moved our interview from 21 of April to 31March.
So, we are all set!!!!!!!!!!!!!!!!

60 days after RFE?!?!?!??! Today I saw that one couple was approved in 23 days and they had RFE too! WHat's going on with their rules and orders???

Yes but they we expedite case for deployment. So they almost don't count wink.gif.

I'm so sorry you are still stuck at NVC. Couple more weeks at the most (as the average seems to be about 7 weeks) and you'll be free again good.gif . Hopefully it'll happen sooner than that. Good luck.

You know, I have one thought why you are still at USCIS. I guess they sent your case to Administrative processing. Sometimes it happens too. We are stuck at NVC and you could be stuck at USCIS. wacko.gif

Well, I’m sort of hoping that the approval is just around a corner but am not holding my breath that there will be any change in our online status any time soon. After all, they still have 2.5 weeks to go till the 60 days after the RFE expires.

The only consolation I'm finding so far is that, unfortunately, there are people out there who have been waiting a lot longer than we have. I don't feel so alone. Wish I didn't have to be in this waiting game but.... Wouldn't have been if people were doing their jobs right. innocent.gif

But thanks to VSC my jewellery making is improving with each passing day and people seem to like it enough to buy it. And since I enjoy it as well… smile.gif

It occurred to me yesterday that if we don’t get approved in couple of months, I’ll need to buy all new summer clothes since I shipped all my summer stuff to Florida last year. We thought this would be my last winter here but at this rate, who knows?!

Hi to all!

With hope to come here and find out more positive news, but I see you are still waiting for NOA2 sad.gif And only you and Kristen are keeping chating on this thread.. all is gone:(
I hope USCIS will approve you this month.. innocent.gif

OMG..guys...so sorry to see for Kat & Allie , that you are still waiting. come on! Have you tried congressman?
I came back from Russia- it was winter there, here in DC, we are hitting +15 today:)
Had an amaizing time,...

but what's going on with you, guys? Why are you still waiting?

The highlight of the trip, of course, the charge in Marriott Grand in Moscow for 2 cups of coffee - 16 USD:)

Thanks for stopping by and thinking about the rest of us. I appreciate a lot since I'm the only active poster in this thread left unapproved so without you guys stopping by every now and again, I'd be talking to myself. innocent.gif

We've been saying come on VSC for ages now with no success but maybe this week it will be it. We tried congressmen with no luck as he said we are still within 60 days of RFE processing time (still got 2 weeks to go) before they'll do anything. I'm really fed up with all this bureaucracy.

So glad you had a fab time in Russia but I have to say it was brave of you to venture there at this time of the year. Couldn't drag me there before July for anything wink.gif. But you obviously had a very good reason to go. Glad you survived the chill smile.gif.

And next time go to Holiday Inn for a coffee whistling.gif wink.gif.

Glad to have you back.

Thanks Amber.

At this point I feel like I've entered Dante's Inferno last September and nobody told me what a hell this journey it's going to be. The famous saying from the Inferno "Abandon all hope, ye who enter here" springs to mind...

It truly is hell...

How are you? Has your case reached the Embassy yet?

Hopefully Joe&Nadya will be out of AP soon. Maybe they already are. My thoughts are with them... I can understand waiting all too well.

Wish other September files still left waiting would join me here.

You know, every time when I come into this thread to see good news from you.. and I am really sad about it.. why?!?! I can't understand.. and on Friday USCIS approved July filer wacko.gif blink.gif And some May filers still waiting for their turn. headbonk.gif headbonk.gif headbonk.gif

About us, Thank you for supporting smile.gif we have passed more than the half way in AP, more 2 weeks and there we will be closer.. but who knows miracles happen suddenly smile.gif

biggrin.gif you are welcome! I am glad that you kept smiling smile.gif About processing time, it takes 4- 8 months. It's long, but less than one year wink.gif

About us, yes.. we are still in AP sad.gif even we don't call to NVC during the week, only on Fridays.. I don't think that we will get out of NVC till April. Right now, we are occupied with documents for my interview.. days pass quicklier wink.gif
