We got our approval from the US on January 14th, 2009 after 132 days, and the pressure was on. We were expecting a baby less than three months later and praying for a quick interview date. We called Senator Kennedy's office, and they were very helpful (we had tried our congressman's office and they were less effective). We explained our situation and that not only were we hoping to have the baby here in the US, but if we didn't I would incur serious economic hardship (this is true, I would have needed to take an unpaid leave of absence from my job, my fiance-at-the-time didn't have health insurance in Brazil and I did here, etc..). The people at Kennedy's office contacted the Consulate in Brazil where the people are very nice and much more understanding than the USCIS here in the US. They got us into an earlier interview date, which was a month and 4 days before our due date - if all went well, we might make it just in time!

I went to our interview in Rio (I was taking no chances), as did my fiance-at-the-time's daughter. We had gone over all our papers with a fine toothed comb and it's a good thing - they make it confusing (we felt very bad for the couple that didn't realize that you had to pay at Citibank beforehand and got sent away). Our interview took about 10 minutes, we were all present, the Consul asked us about how we met, etc., complimented me on my good Portuguese no0pb.gif and told us congratulations. Our interview was on a Tuesday and, going against all recommendations, I had three plane tickets lined up for the following Monday evening. We paid the express service for them to deliver our passports with visas as quick as possible, and they arrived Monday afternoon hours before our flight!!!

We had a long, but very happy, 8 month pregnant plane trip from Rio to Boston (contrary to many people's misconceptions, there really isn't much problem traveling while pregnant, but you do need a doctor's note for most airlines after 36 weeks, sometimes earlier - we had that). We also had a notarized letter from my step-daughter's father, giving his authorization for his daughter to travel out of Brazil (without this they wouldn't have let her leave the country).

Our port of entry was Washington D.C. and it was a pretty nice and fast experience, though we just barely made our connecting flight! We did see a woman getting a hard time because she had left the country an excessive amount of times during her last four years in the US - when you are approved to live here make sure you still follow the rules!

We got married the day we got to the US!!!! It was a simple, beautiful service at our local town hall. We got my wife and her daughter on my health insurance plan and 9 days later our baby arrived 2 and a half weeks early!!!!

Wow! What a trip!!!

We are all very happy and healthy with our beautiful, baby girl born March 19th, 2009.

I will still and will always maintain that some parts of this visa process are fair and some are very unfair - mainly separating families with children and pregnancies. I believe, and will always believe that this should be grounds for an expedite! That is putting humanity before business (unlike the way USCIS currently is in which you can pay to have a business visa expedited but not a family visa!) After all, getting an expedite doesn't mean you are given any more guarantee on passing your interview, you still have to prove you have a bonafide relationship.

Well folks, I'll keep updating from time to time, and my heart and thoughts are with all you good people on Visa Journey!!!

Nadya, you CAN speed it up!!! If you request an early interview, they try to accomodate you if they can. I am most certainly going to try. If you don't ask, you don't get. At this stage, what do you have to loose? They can either say yes or no. Wisedom come to has done it so why shouldn't you be able to ?!

blush.gif Oh, I wish I had my interview but the case only arrived at the Embassy today! DHL shipped it around England for 3 days!!! wacko.gif The mind boggles. But I booked my medical for 17th this month. Since we are hoping for the wedding mid May, I need to get the interview by the end of this month!

So pleased for you though! You really deserve for everything to speed up now after all the waiting you've been through.

I've straightened out my timeline ... though I'm guessing on the exact date of the approvals. I'm judging off the dates that our files got to the NVC ... I actually never got NOA2 letters from California blink.gif And according to the USCIS site, our case is still pending tongue_ss.gif

Thanks to everyone for their welcome and support. Seems like we have a lot of people here unfortunately. Reading your experiences has helped my spirit. If I figure correctly, we are about 4 weeks in ... which hopefully means we are at least 1/2 way through this. Our goal was to have an interview on April 20th ... and if we get out of AP within 3 weeks, we can still hit that date.

Yes, Joe got the letter and he was going to write you yesterday, but he couldn't come on VJ.. It was an error. The same I had yesterday morning. if he wrote it's good, if not he will do it today then.. Well, about your timeline and USCIS is stil pending.. wow! About us, I checked the USCIS site and saw our approval, told about it to Joe, and in 15 minutes he got an email about approval. And our lawyer got original of approval letter from USCIS and Joe got a copy from USCIS. I read it somewhere that you will need it when Ksenia comes into USA. Maybe you should call to USCIS and figute out where is your NOA2 letter?

Steve, about interview on 20 April, I think you need to change date because here it will be great holiday, Easter ( 19 - 20 April ). I am sending you the site with holidays wink.gif

We got two as well, and both were dated after the AP started. They won't change the number, I didn't have the bit of paper with the AKL number on it, but still had the medical while in AP.

Hi to everyone, here reporting to "AP DUTY", well my Noa2 was approved on 02/27, and my petition arrived at NVC on 03/04, I thoght I was gonna fly thru it, since it's my second time around, but I was wrong; I'm not stuck on AP and this morning when I called they asked for my figrl's e'mail address (tht was a first) and then the response was the same as usual, and since I read from page one, I know I should be expecting to be @ NVC for the regular 50 days ( which I'm really not counting on), but hopefully be out of there soon, in the meantime, just wanted to join this great group of people and make it a pleasent wait.

It's unpleasant, but it happens and it can happen to everybody.. well, let's wait here.. we are in AP one month ( 4 weeks) , but we found out about it in one week after getting our case at NVC. It takes less than processing at USCIS. As for us, to make our time shorter, we have started gathering our documents over again and even I have a medical interview in two weeks. Just making ourselves busy smile.gif

I can see how it makes sense to do both a local police clearance in country (e.g. Ukraine) as well as checks in the US (e.g. FBI, Interpol). The former will verify that you don't have any criminal record at home on domestic charges. The latter will vett that you aren't on any radar screen for international terror, drugs, etc. I'm ok with the system demanding that level of scrutiny since ultimately it does make us all safer. I'm even ok with different stages of the process (USCIS, NVC, etc.) apparently repeating checks and doing them at random - if it helps to weed out bad guys, that's fine by me. What I'm not ok with is the lack of openness and communication. Would it be so hard for them to TELL US what they're checking and how long it will take? What's with the big aura of mystery to this thing? That serves no useful purpose for national security or the integrity of the immigration process. All it does is frustrate and worry petitioners who are doing their best to play by the rules.

I see in your post 2 assumptions that are unfortunately quite common: (1) Expecting that hiring a lawyer will expedite your case (2) trusting anything a lawyer tells you, especially regarding how they'll help you speed up your case. You're quite right about one thing: "luck was on the opposite side". NVC AP really is just a matter of luck - random chance. Hiring a lawyer hasn't helped you, or hurt you in this regard.


I just made my nightly call to NVC. Still stuck. Day 47. This time she asked for something new --- my fiancee's email address.
The usual dialog goes like this:
Case Number Please? Me: "BNK........."
Name and DOB of Beneficiary? Me: "......"
Name and DOB of petitioner? Me "....."
Is your phone number still ...... ? Me: "Yes."

What was new tonight was "We have your email address on file, but not your fiancee's. Would you like to add that to the file?"
Me: "Um... sure, ok. Here it is......"

After which, the usual patter of "How can I help you today?"
Me: "I'd just like to get status on my case please".
Them "Well, I see you are still undergoing additional processing. Unfortunately there is no timeline for this processing. When it is completed your case will be forwarded to the embassy in Bangkok"
Me (under my breath): "!@#!%!" (out loud) "Thank you very much"

Just curious - have any of you had that variation before (asking for email address)?


well, we hired a lawyer for some reasons, first main reason was time. My fiance doesn't have time for it. He works too hard and very busy all day long.. in order to avoid mistakes and time in filling we decided to hire a lawyer. He explained us that the whole process of K1 takes 7-9 months.. and it's fine.. we knew it. Any lawyer or even congressman or senator don't help in speeding this process wink.gif It's clear like sunny day smile.gif Our lawyer was surprised to hear about AP at NVC. He sent them an email with explanations.

About dailogue, it's really nonsense to ask email wacko.gif Maybe they have nothing to talk about?!?! You have to gather so many documents just to prove your AOS or relations and over again they do it themselves.. here you have a question : " Why do I do it??" wacko.gif

I do hope that this is the cause of the review however I do feel this will trigger more scrutinizing of my finace at the consulate during her interview.


GShilobod, on your timeline, you show 2/17/09 left NVC...is this the arrive NVC date since you are in AP? Just want it to be correct because we have a member that from time to time works on the statistics of AP cases...it currently would not show up on the list. Thanks

As far as we can tell, being selected for the honor of AP @ NVC is entirely random. The fact that you're military shouldn't have any positive or negative bearing on it. It probably also doesn't have anything to do with your RFE since that was cleared up by USCIS prior to your getting the NOA2.
As to how long you'll be in AP, it seems to be averaging around 50 days, so you may as well get comfortable for a bit. I called tonight - I'm still stuck at 46 days, and she said they are having an "unusually long backlog" - that was the first time I heard that particular phrasing. That's the bad news. The good news is - this thread is a nice waiting lobby, where you can swap stories with other "victims" of the system. I'm the guy who periodically posts NVC stats Todd referred to. If you can keep your timeline accurate that would be most welcome.

If there is truly a backlog, as I have read here from someone else's post, then one would think they would suspend the random checks until they are caught up. Why create more of a backlog by conituing to pull petitions for further scrutiny??? It wasn't so much my military background but moreso my security clearance. When I initially called the NVC I did not know the background check was solely on my benficiary so I mentioned my security clearance in case the background check was on me. Mentioning that got me to a supervisor for what it's worth. I asked a lot of questions and made some statements just trying to get more info out of them. All I got was that the background check was on my beneficiary...pretty much the standard BS they give everyone else. I asked if they showed the name correction and they didn't. That is when they asked me to email a copy of my SO's passport.


I don't know that there is actually a backlog. I was told several times when I called that "various Washington agencies were looking at it." And my congresswoman's office said that it is largely an FBI background check on the beneficiary. So, I am imagining that when one's case is selected at random, the beneficiary's name is sent to the FBI in DC. They put it through their paces as time allows and later report back to NVC if they have found anything of concern. That process seems to take about 7 weeks. And it looks (unscientifically) that it is about 10-15% of K1/K3 cases that roll through NVC.

I am a former DOD/aerospace employee myself with a non-current security clearance and my fiancee is from Vietnam. I don't think that either of those facts caused me to be selected. I am just lucky, I guess... smile.gif

If you call the NVC, they will tell you exactly when they received your case.


Ok I just reread my posts that I typed in haste and didn't proofread. LOL. Before I knew the background check was on my SO I was thinking it may be me and if they knew I had an active security clearance that it may help things along. All that is irrelevant now. I'm stuck in AP.

Where did AP come from when the NVC calls it Administrative Review(AR)???


We are in AP too.. how we were said last Friday to call again next Friday.. so, on 13th FEb will be one month since we are at NVC..

About AP or AR, I don't see difference between PROCESSING or REVIEW since the meaning is the same " we are stuck" biggrin.gif

Join to us, the same we are.. and we planned too to be together in April, but even we didn't expcet it too, having a lawyer. How he said we should not be be in AP after approval from USCIS. But it's sad.. and we can do nothing with it, just wait.. it's sad..

how to count weeks? When NVC gets your letter then you start counting days or weeks.. And if NVC got your case in the end of January we are closer to it.. usually it takes 40-60 days.. read this thread from the beginning wink.gif I was advised to do it the same and I have less questions, just keeping chatting here smile.gif

Ron, thanks for doing some more data mining. We are at 47 days today, as your chart shows, and it is not a good feeling as 7 weeks draws near. The 80 and 90 day data is probably not valid but there are 12 that are more than cdneh's "record" of 53 days and less than 80. I do know that chi and cao got out last week from other posts that they have made, so that one is just a non-update.

I have a feeling that NVC has a rule that says after 7 weeks, they have to wrap it up and move it on...let's hope it is really true!

Joe&Nadya - I don't think that's right. The link you provide will give estimated wait times for visas in the specific consulate selected. That has nothing to do with the wait times at NVC in New Hampshire. On the contrary, previous analysis indicates that the NVC waiting time is not correlated to which consulate you are working through.

Todd - I think you're right, I do believe that NVC cases are being released consistently at the 7 week mark, give or take a few days. Most of the 'over' records are undoubtedly just folks who didn't update their VJ timelines (!@#$%@!#$ why won't ppl do that?? headbonk.gif )

Yesterday when I did this, I also pulled fresh data for cases that had both NVC In AND Out records - I wanted to post that too, but it was getting pretty late. I'll try to do it tonight when I get home from work.

Well here's something depressing. I played around with the stats some more. This time, I looked for all cases that were received at NVC since Dec 1, and HAVE NOT yet left NVC. I weeded out those cases which already got a Packet 3, have Interview scheduled, or even have Visa granted since those just mean the applicant didn't bother to fill out the Left NVC column.

Still ----- that leaves a shocking number of cases that entered NVC and apparently have not yet left... some for 70,80 even 90 days. OK, so probably some of these are still just records that the member hasn't bothered to update since they recorded arrival at NVC. But it makes you wonder... could there be many cases routinely exceeding the ~50 day estimate of max time at NVC?

See attached table. Who ARE all these people? Shu&Cary 90 days? Evelyn&Alec 86 days? Yikes.

On this list, we (Thantita&Ron) are at 41 days. That means about another 10 days till we're released if the track record of recent posters here is right, but I'm getting worried that maybe it could be still much longer wacko.gif

I passed my 2-day medical exam last Feb 17&18 and just today (March 4), Ive had my interview appointment at USEM (of course biggrin.gif), and you know what? My K1 VISA IS APPROVED !!!
So to all my stuck @ NVC family, thank you so much for all your help, encouragements, suggestions/ ideas and prayers..Keep on believing, dont lose your hope smile.gif

I'll be travelling in just a few days now, and if there aren't any posts we might fall off the first page. I am sure, sorry as I am to say it, there will be new people who've no idea getting stuck at NVC is even an option after just getting approval, and it's quite a nasty shock to find out it can. If anyone comes looking, I'd like them to find this thread.

There's a lot of information here, in amongst the banter, and I can only speak for myself but it was nice to have company while we waited. When we were first here there were only a few of us, and there really wasn't any sort of idea with regard to length of time, and we have seen an average develop. Some get out sooner, and thank heavens no one has been here longer. I'd like to see everyone get out of jail in less time, and perhaps over time this new bit about subjecting cases to extra scruitiny at NVC will get streamlined and may take less time.

I'll still hang around. There's a great many aspects to this journey I'm not much help on, but I can certainly say I have a little experience here wink.gif

Does the NVC mail a letter to you with a NVC case number, for you to call and track? Or do you have to call the NVC and acquire the case number yourself?

you may call NVC first. If they received your case from USCIS they can give you the case number over the phone. in the next coming days or weeks, you will receive a notice that they got it and assigned you a case number. but then again, you may call so that you keep yourself posted while waiting for the mail to come in.


as for us, we found out our case # on the phone and in one week we got the mail from NVC.. but all time we called them and of course we are still keeping calling them.. and get letters by mail. I hope you will avoid AP innocent.gif
