Danyel y Miguel,

Ignore my previous post and see if the following make sense.

Do you think it is a good idea to add a column for the I-129 people with a column of I-130 sent date and Service Center? It might be also good to add column for service center for I-130 people.

Because the I-129 sent date is not same as the NOA I date. My notice date on the letter is 2/27/08 and I didn't received the letter until 3/3/08 and I won't be able to send the I-129F packet until 3/4/08.

Even though I sent the I-130 and I-129F together, I plan on sending a new packet with all of the same documents specifically for I-129F to my designated service center.

For Example

Name I-130 Sent Date NOA 1 - Notice Date I- 129F Sent Date Service Center

Jigs 2/19/08 2/27/08 3/X/08 California

What do you think?

Thanks,

Jigs

sounds like a good idea! i'll update it in the morning, im tired right now, just got in from work tongue.gif

I believe you can send I-129F in at any time as long as your I-130 has not been approved. Me personally I would not waste any time as it seems to only help promote slowness within the system.

Just my opinion.....

Good luck

hello!

I see that you have the similar times as we. We mailed I-130 on 02-11-2008, NOA1 was on 02-20-2008, and we received NOA1 by mail 02-26-2008, from California Cervice centre.
Now we are preparing documents for I-129F.

Do you now, maybe, about fees for I-129F? I reed that now is no fee for I-129F if you have NOA1 for I-130.

I'm happy for this site, becouse we wanted to do everething by ourselfs, and I see that you need more and more informations, and here I think you will find everething you need for.

yes thats true, if you file for I-130 then when you go to file the I-129 its free smile.gif

when the "last updated" changes on your status, thats a touch tongue.gif so yep. we've officially been molested haha

so what is the IRS Pub 519???? dont know if im dealing with that yet cause i dont know what it is haha

Hmmm....not sure if I like the gov't doing that! wink.gif LOL.

As for IRS Pub 519 http://www.irs.gov/p...p519/index.html , it's the tax guide for "Aliens" (nice, huh? They call our spouses that....sheez).
Be prepared to file as a married couple for your 2007 taxes if you were married before the end of 2007 (i.e., 12/31/07) b/c both the USCIS and IRS don't see eye to eye.

The foreign spouse can be taxed for wages earned in the US. I think for most cases, it's simple. But it can be tricky as in our case. We both have our separate careers in our respective country - she claims her tax home as Canada and I claim it here in the US. *BUT* I have to file as 'married' - probably 'married filing separately' b/c of our two independent incomes. However, there is an option to file jointly that you can elect to do - in our case, it's not so advantageous b/c it would be based on our 'world income' which is non-trivial. So I'm a bit paranoid as to whether or not I need to prove to the IRS through her work/finance documents that all her wages are purely Canadian-only....? Anyone else experiencing this part yet?

Anyways, I'm still searching. There's some useful tax info on this forum and site, but I'm almost tempted to file (for the first time in my life) with a tax professional b/c our situation isn't so clear cut...esp. since the IRS publications are so well-written! [note, sarcasm]

yea thats one thing im worried about, i filed single in 2007 not knowing there was a way to put him on my taxes without a SSN. I'm really hoping that doesnt effect my petition to get him here. I've already filed, & recieved taxes and what not so i dont think theres much i can do to change it, and like i said im just hoping it doesnt make a big difference.

Well I'm a new one to join the February group. My husband and I were not prepared for the long journey we were about to begin when we decided to apply for his visa. So, the I-130 was sent Valentine's day (isn't that sweet:) and the check was cashed and I received our NOA yesterday (Feb 26).

Now we wait. Is everyone moving to step #2 and applying for I-129 right away or not?

I'm glad to be on the journey with all of you!

Spring

not everyone here is going to apply for k-3. I personally am not. it seems by reading all over the forum that the k-3 is being cancelled. its not a FOR SURE thing, (meaning it hasnt been posted on the USCIS website) but if you take a gander around the site and read, you'll find alot of peoples were cancelled. because the CR-1/IR-1 is seeming to be approved quicker than the I-129 and therefore they cancel it. apparently the only thing the k-3 now does for you is slow you case down. soooo thats why I'm not going that route.

if i were you i'd read up around the site a little and make your decision. IMHO.

Thanks for the well wishes! Hmmm...like two peas in a pod! However, I'm the US Citizen. wink.gif

I'll definitely keep you (and everyone else) updated. As for filing, IMHO do it ASAP! (Maybe others would be willing to comment pro/anti?) From our perspective (not to scare you), our wedding ceremony date has moved around a bit due to concerns with immigration - it's still in flux! In fact, we're approaching it from both sides - I'm also applying for the Canadian PR concurrently (yay! I just had my med exam performed by the DMP today!) just in case since the ultimate goal is to be together after the ceremony.

It did take awhile to create the packet (supporting info, etc.), but one concern I had before doing so was whether or not we would even be able to visit each other while the process was pending. I talked to one of the US immigration officers in Ottawa (as well as perusing the forums here) and he assured me that as long as she showed strong ties to Canada (job, lease, bank statements, etc) that it would normally be no problem with US visitations - he actually said, "why would you jeopardize your chances of immigration?" which made sense to me. Likewise for me going the other way - I now have a packet I've "developed" for traveling to see her! Anyways, that talk pretty much sealed the deal for us sending the paperwork through. (Actually, the guy stamped a B-2 visa with an expiration date of Aug-12 on her last visit this month!)

Although after reading some of the posts here, I feel as though I should have included photos in the packet. I included a notarized affidavit, sample mail correspondence, sample travel plans between our two cities, a sample phone bill showing our numbers, beneficiary statements, and receipts and tickets for trips taken together. Maybe I'm just being paranoid?

OK, enough blabbering.

Danyel y Miguel: I also noticed that my case was "last updated" on 2/26/2008...Is this the 'touch' everyone keeps referring to?

Just my 2 cents, keep the list posted here! smile.gif

Off topic....Now, I'm trying to cope with the tax ramifications for 2007! If you think immigration laws are crazy, wait until you read IRS Pub 519. Oh vay! Anybody dealing with this yet?

Hi, well it doesnt seem like theres very many active members here anymore that went through the american embassy in caracas but maybe some of you out there can provide me with some of the info im looking for.

i currently have my I-130 sent in and am trying to figure out my best option from here. stick with this or go the K-3 route. aparently from what i read there isnt much of a difference in time anymore except when the petition gets to the consulate.

so my question is... do any of you know what kind of interview wait time frames im looking at here with this consulate? anyone know which route is faster for me to take? any advice would be great. i've searched along the timelines but most are either old or whats lookin like not up to date.

thanks!

Dont want to repeat myself, but want to confirm with some of you if you know the answer or if you heard something similar to this.
Last week I called NVC and ask about translation from Spanish into English, they told me that is not required and that this is something new started from Jan 1st. When my husband call he got the same answer. Does anyone of you is informed or had the same/similar experience?

Thanks in advance!

Dani

personally just to be on the safe side, i'd send it in with a translation. i wouldnt want to get an RFE just for not having the translation of a document tongue.gif

Hello! My names Danyel and i currently live in Michigan, My husband lives in Venezuela. I found this place by accident a couple of days ago and i've spent HOURS on it since i've found it, i've found so much useful information that i never even knew, but i still have lots of questions so i thought i'd give a lil background info on me and begin from here!

I met my husband online around 4 years ago now. we talked for about 3 years as friends, we would talk endlessly for hours and hours on end. and i'd call him spuratically. (sp?) then may 07 i started to gain different feelings for him and wanted to wonder more into those feelings, so august 07 i flew to venezuela to meet him, i stayed with him for 2 weeks and fell completely head over heals in love with him, and at the airport before i left he asked me to marry him, and obviously i said yes smile.gif Nov 07 i went back for three weeks with my daughter where we proceeded to get married. after i came home we've had some complications trying to get the original marriage certificate to me (lost in the mail, still dont have it) but i am hoping to get this stuff startly all very soon as i've been gathering all the materials to start my I-130 & I-129f to bring him here with me!

I have much respect for all that are currently going through this, its so hard to be alone without the person you love and want to be with more than anything. I'm thankful i've found this forum, its nice to know we arent alone and that there are many others doing the same as us and some that have more expierience so that we may gain some knowledge on this situation.

Thanks for taking the time to read this, and again im very excited to of joined this forum!!

*I'm sure you'll see lots of questions & posts from me as i'm eager to learn about this process!

I have the same question so don't feel bad asking. I assume it is the benificiary's information because they had to choose us/someone to represent them. What bugs me is that I sent all of this stuff with the I-130 to uscis and can't understand why we have to send it again to NVC. Don't they forward it to each other? So annoying!

what i dont understand is how im supposed to have him get the police clearance and birth certificates to me to send to nvc and then go get the police clearance AGAIN to bring to the interview!

ok so im a little confused and hopefully you guys can help me with this. i was reading about what documents im going to have to send to NV C with the ds-230. all the paperwork im sending is his correct? (the beneficiary) so i need to send HIS original birth certificate and etc? and this is what im confused about.... i thought that the police records and birth certificate were supposed to be things we brought to the interview not sent to the nvc?

could someone please clarify if im going to need him to get the police clearence for nvc or for embassy? because i thought that was something we'd be bringing to the interview.

True, it needs to be notarized on Form I-864A, this form is for when your co-sponsor lives in the same house as you. However if they do not live in the same house as you then it does not because each I-864 is completed by both people seperate.
