IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding AOS/IV Fees
QUOTE (Malrothien @ Jul 16 2009, 05:39 PM) <{POST_SNAPBACK}>
I've spent the last 30 minutes reading the NVC wiki information. For payment of the AOS/IV fees online, it says that you must pay via a bank (no credit cards), however, I only have a bank in Canada (as I've lived with hubby since 2005 here). What should I do about this?

Any chance you can start an account down here?

IR-1 / CR-1 Spouse Visa Process & ProceduresIs it ok to send / despatch AOS and DS-230 through USPS?
I saved the cash and just went with Priority. I printed the postage online so I got free delivery confirmation.

Although I would recommend sending the AOS and the DS230 in seperate package - just my preference though. Avoid all possible mix ups is my motto.

We sent in two (not notarized) from people who attended our wedding, one was a hired witness so didn't know either of us and the other was a friend of my SO's. We also included a notarized letter from my mom who did not attend the wedding she verified that she watched my children while I was in Senegal and she had looked at the wedding certificate and it appeared valid. Hi, I am petitioning my wife but I am worried about being denied because I don't have three years of tax returns as I have not been working for three years. (I am 20)
Is it possible to send 2 years of tax returns and all my paystubs for the last year? I have been with my current company since July 2008.

I only sent 2008 returns and 4 months of this years paystubs and we did just fine. You do have to fill out the part on the I-864 that asks for the income amounts for the last 3 years.

Is it true that I need to wait on the 1st or 2nd week of the month before I get a schedule? Can the operator schedule something for me? I just really want to know how much more time we need to wait. Keep calling NVC. As soon as it is scheduled they will tell you. You'll get the email the night after interview is scheduled. The operator can't schedule.

IR-1 / CR-1 Spouse Visa Process & ProceduresStupid Question
QUOTE (MrsGrieves @ Jul 19 2009, 11:27 PM) <{POST_SNAPBACK}>
Ugh, I knew I shouldn't have gotten as excited as I had. I saw five months on the USCIS site but I didn't realize it transfered somewhere else.

Maybe a little more information would be helpful. I met my husband while he was in the US on a J-1 Intern Visa. He does not have the two year residencey requirement. We just married on July 9th, and are waiting for our marriage certificate to send the I-130 in. The company he interned with back in Pittsburgh has filed for an H1-B for him, and he'll have news on that approval later this summer...end of August/beginning of September. My original question in the K-3 forum was about wether or not applying for an I-130/Cr-1 would have any impact on his H1-B, or vice versa. We considered waiting for the news on the H1B but I know even just another month or two to file could potentially delay our processing far longer than a month or two. So I'm curious if there are any issues with filing a CR-1 while an H1B is being processed and just doing adjustment of status later on down the road, after his first 90 days on the H1B. I don't know how sure of a thing the H1B's are, but I know there was no cap issued this year. The earliest he could be here, in that case, is October...but his company likely can't bring him till January. My biggest concern with waiting until January, is if by the time January comes around, the company doesn't want to or can't bring him over at that point. Then we'd be even further behind...and I don't know if my heart can take all this waiting just piling up!

Thank you for the tips and guides you posted, everyone. I've read the main CR1 guide but its all kind of jibberish to me...I'm still getting used to all the abbreviations for everything. There doesn't happen to be a key of all the abbreviations around, is there?

5 months is a possibility we sent in our I-130 on 2/23 and our interview is just 2 weeks away - so 5 1/2 months for us and we are going through Africa which is under a bit more scrutiny.

For the affidavits I sent the originals and kept the copies for myself. I also sent the original translations and the certificate of translation. I paid a language school to do my translations so I also sent along the bill I paid.

IR-1 / CR-1 Spouse Visa Process & ProceduresORIGINAL DOCUMENTS
What I did (for the USCIS level ieI-130) was make color copies of everything, take them to the bank along with the originals and then the bank certified the copies as true and accurate and in my possession.

For the NVC level (ie I-864 & DS-230) I sent originals and in my letter stated I wanted the originals back and I would provide them with clean copies. Our interview is in 16 days - so we'll see if they will do that!

Most likely not things from the I-130 app.

If you request your original marriage/birth certs from the I-864/DS-230 then you MIGHT get them back at the interview.

Still waiting. I think those 10 people who already received their NOA2 must be special such as military spouse, government offical or expedited case due to illness or something like that. I know that my case is normal so I guess it gonna be at least 5 months from NOA1.

Nothing special about my case at all and got NOA2 just 23 days after NOA1.

23 days. Wow! I guess you got very lucky or maybe someone working at USCIS either VJ member or from the same country as you are or something like that.

NO, I don't know anyone! February just seemed to be a good month, especially for CSC. I am doing all the tracking for those who filed in February and the average wait between NOA1 and NOA2 was just 36 days. Shortest being 10 days.

Our shortest total time - from day I-130 sent to day visa in had was just 125.

Additional cost of the medical she wasn't expecting,

I have setup a surprise going away party for the kids (invited all their friends)

What you and your wife could do, is once you recieve notice that your case is at the Montreal Consulate, send them an e-mail stating that your wife is X weeks pregnant and due to health concerns and risks for herself and the baby travelling so late in the pregnancy, is it possible to have the interview moved forward. Also mention that this can be confirmed by her physician. The other option is to still inform the consulate of her due date and risks of travelling near her due date so that your not scheduled at that time for an interview and have to go through the hassel of having to cancel and re-schedule. The time lines are close for the two of you, but keep your fingers crossed, you never know.

I know that USCIS will not expedite cases based on pregnancy etc.., but once the individual consulates have the case, it is up to them if they will expedite or schedule interviews around a request if someone's health could be at risk. It is a possibility they will try and accomodate the request.

Good Luck and congrats on the 2nd edition good.gif

Thanks smile.gif. I hadn't thought of the issue with having to re-schedule, that would be a real pain. Currently looking at the possiblilty of her moving to Vancouver in the mean time as well (I am in Seattle).

IR-1 / CR-1 Spouse Visa Process & ProceduresThink there is a chance?
Look at my spreadsheet.

There are 5 people who have spouses in Canada.

NOA1 Dates................ NOA2 Dates............. Interview Dates
2/7 ..............................3/7 (28 days)...................8/7 (153 days)
2/9...............................4/17 (67 days)..............??????? (still counting)
2/27.............................3/19 (20 days)................8/19 (153 days)
2/28.............................3/21 (21 days)..............??????? (still counting)
3/3...............................3/25 (22 days)...............8/19 (169 days)

Even if you were to get NOA2 TODAY and it only too 153 days to interview you are looking at December 23rd.

The February Filers were for some reason VERY blessed receiving NOA2's VERY VERY QUICKLY! Both CSC and VSC are over 100 days again.

This is just my PERSONAL opinion. Plan for your process to take the longest time, that way if it happens quicker you will be joyful. There is NOTHING worse than putting your hope in something only to find out your estimates were way off. I realize it's nice and all to hear, "There's always a chance" but DON'T count on that chance because looking at the stats there really isn't any chance at all.

Make plans to be with your wife for delivery in Canada.

My guess is not. You haven't gotten NOA2 yet or gone through NVC. Montreal takes at least 2 months to schedule an interview.

According to the stats here (for the last 90 days) on this site from NOA1 to Interview in Montreal takes 396 to 437 days.

Okay I understand,

So it looks like i will have to send only two more forms...the I-864 (AOS) and then the DS-230 (Application for Immigrant Visa and Alien Registration)

This is just getting a bit confusing to me.

So Imaisha.....was i correct on that at this point it should take a few months longer?

Thanks for your response smile.gif

Chris, how long it takes at this stage is totally dependent on your individual position. I had all of my packages prepared and ready to go before getting to NVC and it still took 37 days for them to complete it. You'll have to do some research on how to acquire the police reports and other certificates and how long those will take. It also depends on how prepared you are financially and if you have the appropriate documentation to hand for that as well. I also don't know how long the wait for an interview in Sri Lanka will be. Some embassies are busier than others. Maybe someone else has some experience with that one in particular. Best advice, get started on preparing your packages now, you don't want to lose any more time. Best case scenario you could be done in 3-4 months. That's a best case. It could obviously take much longer...

Thank you Imaisha for your help,

I sent the AOS packet to the NVC today, overnight USPS......

Now I have to have my wife send me the birth certificate, police records and passport photos then i can send the IV packet off...

Do you know if a certified copy of the birth certificate and Police records can be FAXED? or would that be considered photo copying?

I think I may just take a wallet size photo of my wife and just try to enlarge it and make it like a passport photo.....its the same format as the passport photos, just smaller...

Again, thanks for your help.

I feel like the process is going a lot faster than i thought, I just submitted the I-130 about 2 months ago and now I am pretty much done smile.gif

You need originals for the interview. I've been told that you can send copies with the DS230 and then you'll be told to bring the originals. BUT I waited for the originals because I'd rather not get an RFE. I keep track of the people who filed in February and right now the average wait after the last package is sent is 24 days to case completion. So, if you were to send everything off tomorrow, your case would be complete approximately July 17th. Which would mean then that August would be the earliest you would be contacted about a September interview. But it is possible that you may have to wait another month depending on the availability of interviews in the embassy.

HTH

Whidbey I am sorry for your loss.

But, I have a problem in understanding why a child would not know when their parents were born, and I am sure an interviewing officer would have equal difficulty in understanding that. I have no wish to be argumentative, perhaps it is something as simple as a cultural difference, but I suspect it is running a red flag up the pole.

:dunno:

Thank you, I did not know them, I didn't meet my husband until years after they had passed. In Africa it's not unusual at all to not know birthdays. Many don't know their own birthdaysm, their names can even be different from what they are called and what is on their birth certificate, so getting matching documents is sometimes tricky. It makes this process.....interesting to say the least. The CO's are typically aware of the culture they are in so it's not that big of deal as it would be say for someone here in the US.

PS. familyguy - I don't know what your pic is in your signature but my internet filter does not like it - LOL!! Everytime I open a page I get a warning. smile.gif
