Honestly, I'd advise the CR1 for 3 main reasons:

1. When SO get's here he can start working the day he arrives (if he chooses to)
2. The cost is A LOT less.
3. The time is NOT much longer for a CR1

First, sending the petition Fedex is a fool's errand. This is a 6 month+ process, why do you need to get it there overnight? Send it USPS regular mail, with delivery confirmation, anything else is a waste of money. If you simply must get it there overnight, only to sit and wait a few days to be opened...read the instructions. There is a separate address given for Fedex and UPS deliveries. Stop, take a breath, read...follow instructions.

Hi all,

I just sent off my I-130 packet - haven't even gotten NOA1 yet, is it too early to send my husband to Nigeria to get his Police Certificate? He lives in Senegal. I have heard of some being told to get newer police certificates adn we REALLY can't afford to have him go to Nigeria twice. BUT being the very proactive person that I am, I am trying to get all my ducks in a row and have everything ready so we can "fly" through NVC. Also, a note on LingChe's NVC Shortcut says that Police certs are required from any place SO has lived more than 6 months at since age 16 - REALLY??? He did import/export business between many many places, so does he have to get one from EVERY place??

It's not hard, really. You just live without all the "stuff" that isn't needed.

Here's what my budget was back then, take home pay was about $1600.

Tithes - $175
Rent - $500
Food - $500
Electricity - $150
Fuel - $100
Insurance - $50
Phone - $50
Garbage p/u - $20

The rest was for extra fun money (or if something unexpected came up) that we saved up.

Of course we always got a rather large tax refund so that's when I bought clothes and things for us all.

I included 3 affidavits - two from people who attended wedding and one from my mom who took care of my kids while I was in Africa.

Sounds like your education was excellent. You understand the meaning of "or". good.gif



But if you read the general instructions you will see it doesn't say BC or PP it just list documents. The only "or" is PP or statement from US consular officer

I sent in color copies of my birth certificate, passport before married and also my new passport with my name changed. My reasoning for was because if you read the instruction under, "What Documents Do You Need to Show That You Are a U.S. Citizen?", you will see that only on #4 does it say, "or", which to me says that you need to submit everything that you have in 1-4 (or 5). But that's just my interpretation, I analyze every single word, punctuation marks and grammer style.

Only beneficiary NEEDS to be there, but it's a good idea for petitioner to be there also and since US & Canada are neighboring countries it would be a real good idea.

I agree DON'T expect less than 60 days. I have a spreadsheet that I set up that is based on the longest averages in the "Immigration Timeline" section which for California is the one on the last 6 month section and it is 145 days from NOA1. I have this set up for every stage. So right now I don't expect SO to have his visa in his hand until May 11th of NEXT YEAR. I congratulate those who get through quicker but stay focused on MY TIMELINE so I don't get discouraged or disappointed. Now I do update the timeline each day, checking the "Immigration Timeline" section to see how things are doing - and it is getting MUCH faster. Originally when I put this together I though I was sending in I-130 at the beginning of January and I didn't anticipate him to have visa until JULY NEXT YEAR. I sent the packet in nearly 2 months LATER than I thought I would and he's expected to get visa 3 months EARLIER. That's a 5 month positive move in just 2 1/2 months.

Here's my timeline as of today.

Step 1: Mail I-130, done 2/23 UPDATE: USCIS received packet on 2/25
Step 2: Receive NOA1 letter (average 31 days anticipate receipt 3/26)
Step 3: Receive NOA2 letter (average 151 days anticipate receipt 8/23)
Step 4: NVC processing (average 167 days anticipate complete 2/6/2010)
Step 5: Consulate processing (average 94 days anticipate complete 4/27/2010)
Step 6: Interview (a few hours anticipate date 5/11/2010)
Step 7: Visa in hand (average 8 days anticipate receipt 5/19/2010)

I sent SO a list of questions that are on the DS230. One of those questions is his fathers full name. I asked him for this because on the I130 we only put his fathers first and last name and I thought maybe his dad had a middle name. WELL it turns out we used his middle and last name on the I130. So do we just continue to just use his middle and last name or do I use his full name? Our marriage certificate has his dads middle and last name, the birth certificate the Nigerian embassy gave him had his dads middle and last name (wrong date - had his birth date in 2006 instead of 1966 - thankfully the Senegalese marriage offical just whited it out and wrote the correct date). He is going to Nigeria to get his police cert and birth cert, so do I wait to see what his birth cert says?

In this day in age we need to operate on a worst case scenario. Unfortunately that means that some will scrutinized much more closely than others all because of the actions of some extreme individuals. On one side of the coin I agree it is NOT fair to stereotype, but on the other side I appreciate the government taking an active role in protecting my safety.

Example: I live on an island and because the ferries here were once a terrorist target we have police dogs passing by every car wanting to cross the ferry and some cars face searches, a friend of mine was also detained because she made a cell phone call to tell her husband that Homeland Security had a helicopter and boats following the ferry crossing and they picked up her call. I don't think it's fair that I am subjected to search but I am also grateful that the government is there protecting me and my children. When I was a kid there was a terrible white supremist group terrorist group that was here and was holed up evading authories, it was terrifying even as a high school student to have that going on. Now on the anniversary of SWAT taking out a few of the group, many white supremist visit the island and our security is on high alert and if you fit a certain profile you WILL be treated very differently - even if not part of that group.

No governmental agent will EVER admit to that, BUT if you look at data here on this site you can definitely see the bias - not just toward muslims. My husband is living in Senegal which is 96% muslim, even though he isn't muslim I anticipate slow down in processing. He is also Nigerian which is a BIG red warning flag to US officials so that will be another slow down. He is also over 40 and never married - another red flag. I am a white woman and the US has a very LONG history of "saving or protecting" it's white women from black men so yet another red flag. Anyways, my point is there are certain unspoken...well maybe not unspoken but definitely unwritten rules of red flag warnings that officials will take into account when processing ANY visa. Unfortunately, the masses suffer for the bad behavior of the few. While I don't like it, I also understand it - an ounce of prevention is worth a pound of cure.

February 24 is actually the notice date on my NOA1, the received date is February 16.

When I sign into my profile and look at my case portfolio there, it shows last update 26 February...could that be the first Touch? Or is that just when they entered my information online?

If not and you have no other options... I would go ahead, fill it out including your children and write an accompany letter stating that each child has plans to be on their own. If your one has a letter about job corps and a date of admission, include that. If the other has an acceptance letter from the college or a scholarship letter or student loan docs(to prove you arent the one footing the bill) include that.

Im just grasping at straws here for you. Maybe someone with similar experience can come along with more help

Per the instructions:

"If you included the income of your spouse listed in 21c, or any child listed in 21d, or any depenent listed in 21e, or any other relative listed in 21g, each one of these individulas must be over 18 years of age and must complete Form I-864A."

Please note that if their income is included then they must be counted in household size also.
