PhilippinesAdjustment of status need help please

Actually, the K1 visa expires on arrival into the US. I-94 expires 89 days later.  But the USCIS status will always be K1 fiance, even if AOS is filed 5 years after the I-94 expires.

Yes, the K-1 visa is null and void once it is used and your lawful presence in the US ends when the I-94 expires and the foreign spouse is accruing over-stay days which are forgiven when they finally do file for AOS.  Once the I-94 expires the foreign spouse in no longer legally in the US, but the chances of being deported are slim.  So for the I-485 form the status is K-1 and the expiration date they are asking for is the I-94 as that date is right under the I-94 number.  So for the OP's question the status is "K-1" and the "expires on" is the date the I-94 expires.

PhilippinesAdjustment of status need help please

so my fiance arrived on nov of last year and we got married in december.i have a couple questions about the adjustment of status.

1.where can i find his A-number?or does he have one?

2.what should i put for his USCIS status?and where can i find the expiration date, also is it the same thing as his immigration status?

thanks so much in advance for your help!

For us the ONLY place we found the A# was above the beneficiary's name on the NOA2--it was a 9 digit number in the form of XXX XXX XXX.  As stated before your USCIS status is "K-1" and it expires when the I-94 expires.

PhilippinesTime limits for K-1?

You DO realize that you are posting in the PI forum, right? That's where people from the PI get the best help, because it revolves around USEM and other peoples' experiences with the process there, not from other countries.

Do you live near such a border, and have you had issues?  Because I know of a VJ'er here whose wife went thru those checkpoints on the AZ border on a near-daily basis, and they report no issues at all.

Good advice on getting the SSN early, I recommend it also.

There can be a cost savings on not doing AOS, just getting married and filing for ROC at the 3-year mark.  But of course, the immigrant can't work those three years, and the medical has to be re-done since it will be over 1 year old.  But you avoid paying some of those AOS fees.  We did not do that, just saying it is possible.

Nope, I missed that this timeblush.png.  No I have not had any experience with the CBP near either border, but we have a plant near the Mexico boarder and one of the workers there has related stories about his experiences with the CBP in NM and he is a USC who happens to also be Hispanic.  He gets harassed all the time and he is a USC.  Of course they are about 25 miles from the Mexican boarder and there is a lot of drug activity in the area.  Just want to make the OP aware and others aware that they COULD have problems if they do not file AOS in a timely matter.  As with all things immigration related YMMV.

PhilippinesTime limits for K-1?

Hello all,
I am hoping I can get some clarification on the time limits when working through the K-1 Fiancee Visa process. If I understand it correctly, the two main deadlines are that you have are that of having 6 months from the time that your Visa is issued to travel to the States, and also that you have 90 days to get married.

My questions are as follows:
1. I read today that the date of the medical exam is tied to the K-1. Is there a time frame in which the medical expires and you won't be able to travel to the States?
2. This is probably an obvious question, but with the 90 days that you have to get married, does that clock start as soon as you enter the States, or does it start with something else?

In other words, if the Visa is issued February 1st, do we have a 6 month window from that date for her to come to the States, then 90 days from the day she gets to the States to get married? And is there any reason to think that the medical exam expires prior to the 6 month window?

Thanks ahead of time for your responses!

You should look at the visa when it is issued to see when it expires.  Ours was valid for a full 6 months from the date of the INTERVIEW.  Most of the people who claim that the visa expiration date is tied to the medical are form the PI and they also have to go thru a TB test whereas my wife did not (also we went thru the process K-1 process coming up on 4 years ago and things may have changed with regards to the validity period of the visa).  So this MAY be country specific.  Either way, there will be an expiration date on the visa.  The K-1 visa holder has until that date to enter the US.  After entry, you go to the CBP website and get a copy of your I-94 form.  You have until the I-94 expires to get married by as the I-94 is valid for 90 days.  After that you have completed your obligations of the K-1 visa.

A couple of items to think about are the adjustment of status (AOS) and filing for a SSN.  You can file for a SSN based on a valid K-1 status which the SSA takes to mean until the I-94 expires, however; the SSA will not process an application for a SSN after day 74 or so (about 2 weeks before the I-94 expires is the cut-off.  Some SSA offices will give you the full 2 weeks and others will cut you off a few days earlier so that is why I say about 74 days instead of 76). The SSN is one of those things that is nice to get early, but it is not required.  Also apply in the name that is on the K-1 visa and the I-94 form to minimize problems.  The filing fee for AOS is $1070 and your spouse cannot work or re-enter the US without the employment Authorization document (EAD), Advance Parole (AP), or the GC (filing for them is free when filed with or after the I-485). So the sooner after marriage you file for AOS the sooner your spouse can begin their new life in the US.  There is not time limit to filing, but after the I-94 expires your spouse will be in the US illegally and accruing over-stay days.  This is forgiven when the GC is approved, but there can be issues if your spouse is near one of the US boarders and is stopped by the CBP at a check-point,  Best to file AOS ASAP after marriage.

Good luck,

Dave

PhilippinesTaxes / Proof of income

Filing jointly for 2013 and California does not allow for use of the federal form 2555 so I have to claim my fiances income in 2013. My specific question is what proof of income do I use for tax purposes? A letter from her employer stating income earned is enough?

I have not filed CA income taxes, but most states that I have filed with start with "Line 1: Enter Federal Adjusted Gross Income" so by default you have either taken your husband's standard deductions or have excluded his foreign income to arrive at the AGI amount.  Then you begin to complete the state return by adding back in income from sources that the Federal government lets you deduct but state does not.  Then you subtract income and enter deductions for things that are state specific.

You really need to have some proof for your federal return in order to substantiate your claim.  For my wife I had her HR department e-mail her stating what her income was in the local currency.  I then went to the GOA website to get what they use as the average conversion rate to convert that into USD.  I then put that on the 1040 as her income.

Ok... What is the best and fastest way to ship documents to Manila?

Best and fastest is for you to book an airline ticket and hand carry them to the PI--it is not the cheapest by far, but you control the out come plus you get to see your SOgood.gif.

PhilippinesAirline Information

I agree with you about Korean Air. I myself have flown those same flights from Atlanta to Cebu and Manila. Unfortunately, when you try to book from the USA a one way flight from Manila to Atlanta with Korean Air you get a pop up message about Philippine law only allowing that booking within the Phil.

Maybe I can find another carrier with similar layover llike Korean Air who will then fly direct into ATL. Because as you said the new international terminal there is great and customs is fast and easy to for someone flying their first time.

Thanks again for your help!

This might be a case where a good travel agent may be able to help.  The PI law is to prevent fraudulent use of a CC to purchase airline travel.  Maybe a travel agent can over come that because you are sitting in front of them.  Have you tried to purchase a RT or is it due to the fact that the origin of the flight is in the PI so you must purchase it from the PI.  You could also try calling Korean Airlines and see if they can help you overcome this problem.  Air Astana in Kazakhstan has similar precautions for airline ticket purchases.  One is to call your credit card company and get an authorization code that you give to the airlines or you just show the CC upon check in.

Good luck,

Dave

PhilippinesVisa number?

I haven't booked any international flight yet asking for a visa number. But in case they do, it's the 8 alphanumeric characters printed in red, on the visa. Typically, it's 1 letter followed by 7 digits.

If you want to enter the information about your ability to enter the US, you have to enter the proper document type--i.e. visa or GC--and then enter its number.  I think it helps during the boarding process, but I am not sure.  I did enter this information when my wife travelled on Lufthansa and again for my MIL when she visited on a tourist visa.  I still do not know what use it is, but it is available on some airline's websites.

The number the airlines ask for when trying to book a flight online? Is it the red one or one of the other numbers ?

Thanks

The RED number is the visa number.

PhilippinesCheapest way to bring my computer to the US?

You could just pay for a second checked bag--$200 on most international flights.  I paid for an over weight bag to bring stuff to my MIL.  Unfortunately, BA could not get me to Almaty and I had to fly Aeroflot and Air Astana, both charge by the kilogram over 23 kg.  It cost me the $50 BA charged and another $190, but that was still cheaper than using FedEx.  A tower would fit in most of the roller bags I've seen people use for carry-on.  It will be an issue to get it into the overhead bin.  If it is too heavy you might get lucky and get it gate checked and it will not cost you anything--one way I've seen people scamming the checked bag fee.

Realize that at 20 kg you have 3 kgs for your other stuff, so you are going to pay.  It is up to you to decide what and how you pay: 1) sell system in the PI and purchase new in the US, 2) strip it down and put it in your luggage and reassemble in the US, 3) ship it via FedEx , 4) check it and pay the additional baggage fees--i.e. extra bag fee or overweight fee, or 5) try to take it as a carry-on and maybe get it gate checked.

Good luck,

K-1 Fiance(e) Visa Case Filing and Progress ReportsTax Break: Get Married Dec 31???
Getting married before the end of the year is like having a kid at the end of the year for tax purposes--you get to claim the deduction for the whole year. You will need the SSN for when you file the taxes and depending on the SSA office near you that may or may not happen, but as long as you are getting a refund or pay the taxes due you can file for an extension until the SSN comes in.

I am planning on getting married the 30th of December as it is one year after I proposed. The Fiancee is arriving this Sunday so I cannot wait. And I will be filing my taxes as married filing jointly as it reduces my taxes by some $8500. I would check out the difference between filing single and married filing jointly for you tax bracket, but you are going to find that filing as a married couple will benefit you finacially, plus it is one more piece of evidence for the AOS packet.

Good luck and congrats on your fiancee arriving.

K-1 Fiance(e) Visa Case Filing and Progress ReportsQUESTION #10 AND 11----FORM DS-230
Actually it asks for your permanent address in US where you intend to live and who lives there... So what is the address where you will be residing once you enter the US? And who currently lives there? Are you going to live at your Mother's? This has nothing to do with the sponsor. It has to do with where you will be sleeping each night once in the US.

If you are going to live at Julie Public's house then you put her address down and say that the person living there is Julie Public. Question #11 has to do with where the GC is to be mailed IF different than #10. So you are living with Julie in Timbucktoo, IN, but you want the GC mailed to Nowherespecial, OH, so you put that address in #11 and tell them who is living there.

Good luck,

K-1 Fiance(e) Visa Case Filing and Progress ReportsAOS Processing TIme
It depends on which local USCIS office your files goes to and whether or not you have an interview. We filed to the California Service Center and it went to our local office in Denver and the EAD card took 46 days and the GC took 96. Bio appointment was 34 days after sending in the AOS.

Hope that gives you some idea. I would expect to wait 90 days for the GC, BTW interview was on day 87.

K-1 Fiance(e) Visa Case Filing and Progress ReportsNOA2 Received Today!
Typically it takes about 2 weeks for it to go from NVC to the Embassy. Then the process is Embassy specific. Our Embassy was so efficient that my wife did not have time to get her medical done before the interview date, so we had to reschedule the interview for the next week. Received a day that they do not do interviews on, so rescheduled again for the following week. Had interview and passed. Which Embassy are you going thru? As that will help as those who have been thru that Embassy can tell you what to expect as far as forms, procedures, and timeline.

Good luck on the next phase and congrats on getting thru the first part.

K-1 Fiance(e) Visa Case Filing and Progress ReportsGood websites for International airlines
You can try this. I personally used either Travelocity.com but now I am using Lufthansa.com as they are within a few dollars and I know I am going to be booking the flight on Lufthansa anyway. I always expect to pay around $2000 for the cheap flights and more than that for peak periods as I am going half way around the world. Remember that roundtrip tickets are usually cheaper than one-way--so most of us that had a K-1 buy the RT and cancel the return leg.

K-1 Fiance(e) Visa Case Filing and Progress ReportsOne-way ticket or round-trip ticket?

Oh, thats possible?! That'll be awesome!!! Flexible return flight :) sounds good :) Thanks for ur advice :) Appreciated big time!!! God bless :)

Keep in mind that you will not be using the return flight. You are just playing the game the airlines use in order to get as cheap of a ticket as possible. Should you opt for a RT, just remember to cancel the return leg before its scheduled departure otherwise there is a slight chance it will bite you should the airline sell the seat and not change the name. USCIS has accussed others of leaving the country and the burden of proof is always on you to prove USCIS wrong. There were a couple of threads on VJ about this issue.

Good luck,

K-1 Fiance(e) Visa Case Filing and Progress ReportsOne-way ticket or round-trip ticket?
Whatever is cheaper is what I would do. I purchased a RT for the fiancee and had the return date within 90 days after her arrival just in case we did not get married. After marriage I made certain that I canceled the return leg as there have been stories of USCIS claiming that the return ticket was used by the former fiance(e) and then they had to prove that the fiance(e) did not actually leave the country.

For us a one-way is anywhere from $1000 to $7000 more expensive than a RT ticket. I used the $1000 I "saved" to pay for the AOS fee.

Good luck and congrats on geting the visa.

K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2011 Filers!!!
Travel within the US requires a government issued ID in which the name on it matches the name on the ticket. If you are using your home country passport as your ID, just remove the I-94 and keep it in a safe place. Since you have fulfilled the requirements of the K-1 visa the expiry date on the I-94 is of no concern as it is going to be expired while your AOS is being processed. You can be detained by immigration people should you be in a state near Mexico, but other than that there is no problem with an expired I-94 on a K-1 visa especially if you have filed the AOS and can produce a copy of the NOA1. If you file the AP/EAD with the AOS it MAY arrive before your travels and you would have no problems--ours took 46 days from sending off the AOS package, but that was last March. I would just have a copy of the NOA1 ready just in case there are problems, but the TSA person is checking ID not immigration status on domestic flights.

Enjoy your trip,

Dave

K-1 Fiance(e) Visa Case Filing and Progress ReportsTraveling to the Philippines with old name on passport

Hi guys,

We're going to the Philippines end of April. We're still waiting on my green card, but I have the Work Authorization / advanced parole card, and my name on there is my married name (with my husband's last name). We haven't renewed my passport yet because that doesn't expire until 2017, but we will renew it once I get my greencard.

I know we will have to carry a copy of our marriage license with us, but other than that, would there be an issue? And in the tickets, my name should be what's on the advance parole card, right?

Thanks for all your responses!
Queenie

You tickets MUST be in the name on the official government issued ID used for international travel--i.e. your PASSPORT!!! You use the passport to travel just like before. You must make certain you have all approapriate visas based on your home county and the country you are visiting's requirements for your home passport. The only thing the AP or GC does is allow you to be re-abmitted to the US without having a visa in your passport. The marriage certificate is to help the airline people understand that your passport is in your maiden name and the GC is in your married name. If they cannot make the connection they will not let you on the airplane because you do not have a recognized re-entry document to get back to the US--so that is why most recommend you take along a copy of your marriage certificate.

Have a good trip,

The wife received hers the next day, but that is the Consulate in Almaty which seems to be one of the best organized Consulates the US runs based on other's comments here on VJ. Have you check to see if anybody here has a review of the process at your Embassy as this is very specific to how each Consulate/Embassy does business. We can give you estimates, but only someone who has been thru the same location as you can give you more factual information. I can give you the standard USCIS speele of "wait 30 days before calling us."

K-1 Fiance(e) Visa Case Filing and Progress ReportsPort of Entry to the USA
You've posted this twice. Maybe the MODS can combine this with the one in IR-1/CR-1 visa forum. I hope you are checking both as I will answer here.

Her POE will be the first airport she lands at that is on US soil (or has preclearence). If she is landing in say LAX then has a connecting flight to MSP, LAX will be her POE and I would leave pleanty of time for her to get thru customs and immigration. You could fly to LAX and meet her, spend the night and fly to MSP the next day if your schedule will allow it. That way you get to see her sooner and help her navigate the airports in the US and that leaves plenty of time to get thru the whole immigration mess. My wife had a direct flight from Frankfurt to Denver so there was no connecting flight. We did that rather than have her go thru O'hare again.

Congrats on gettng to this step in the process,

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow to get a Social Security number on the K-1 Visa.

Dave
I see what your saying but we want to get this SSN before his EAD is even filed. We will file the EAD with AOS but want to get his name on things before we are even married and so want to get the SSN before we are married. And we can't file AOS or EAD until after we are married. So is there any reason we can't do this?
At this point we are not wanting it for employment purposes at all so it doesnt' matter if there is something on it that says "not valid for employment" or similar.

As I said, get thee to the SSA office nearest you after arriving and waiting the two weeks just to be safe. Apply for the SSN using the K-1 Visa, I-94, and foreign passport--you may want to take a long the BC just to be safe. Fill out the SS-5 form and wait. Take notes about your visit--day, time person's name did you ask for a supervisor and that person's name, etc--this is for the e-mail should you get any ####### about not being eligible for a SSN. If they say they cannot verify your husband's immigration status and want to to an inquiry with the USCIS, tell them you would rather not and leave and come back a few days later. That verification will take a month or more. After getting the application submitted, you can come back a few days later and get a printout of the actual number and begin using it--the card will arrive in a few days--just make certain your husband is receiving mail at your address. That one bite us as the USPS sent my wife's SSC back as she was not on the mailbox.

We filed for AOS with a SSN and put that on the application so I know what you want to do and have done it.

Good luck,

Dave

K-1 Fiance(e) Visa Case Filing and Progress ReportsHow to get a Social Security number on the K-1 Visa.

Wendy, he will need to apply for AOS before he can have an unrestricted SSN. Having said that, there are two options: He can get the SSN with employment restriction - which when he becomes a full-time resident can be replaced by another card with the same number but without the restriction, i.e. his SSN will not change and he will not end up with two SSN as a result. Behind door nbr 2 you have the ITIN option. The ITIN is a nine-digit number - very much like the SSN - and it serves the same purpose as the SSN for bank accounts and other endeavors.

Once he becomes a resident he can then apply for a SSN, his ITIN bearing no prejudice on the latter.

You may want to read some more about it on the page below:

http://www.irs.gov/b...96,00.html#itin

Good luck!

I always cringe when I see this advice. As a K-1 you can get a SSN usually after waiting 2 weeks so your entry is entered into the system (there are some who have gone in the next day and had no problems getting a SSN). As long as the I-94 has more than 2 weeks before it expires you can get a SSN using the K-1 visa, the I-94 and your foreign passport. The ITIN is for those that cannot get a SSN or are not eligible. Since you are eligible for a SSN I would not waste the time on the ITIN and waste it on getting the SSA to give you a SSN. If you have problems you can e-mail the main office listed on the website and they usually give you an e-mail you take to the local office to straighten them out.

Having a SSC with "Valid for work with DHS authorization only" only means that you have to show the GC or EAD card to prove you are eligible to work. Since the GC is a List A item for the I-9, why not just show your employer that rather than having to show them the SSC and then the GC and a DL. I have never used my SSC to prove I am eligible to work, I always use my US passport so no one has seen my SSC which has written on it "NOT FOR IDENTIFICATION FOR TAX PURPOSES ONLY" and you can see that we now do not pay attention to that.

So have you husband go to the local SSA office and apply for the SSC sooner rather than later as this is one document you need in order to have less hassles in the US.

K-1 Fiance(e) Visa Case Filing and Progress ReportsMarried before expiry date on I94 obviosly...But

Hey due to my Fiancees work schedule and some other minor complications with plans etc, we have left things to last minute, my I-94 expires July 24th. Tomorrow we will get our license and just do a civil thing before the 24th. But my question is does the certificate and stuff have to be filed and in their office before the 24th or do we just have to married before the 24th? Can anyone please verify?

Thank you

Married before the I-94 expires. So the marriage certificate's date of marriage must be on or before the I-94 expires. Now by fiing and in THEIR office, I am assuming you are talking about the AOS you need to file after getting married in order to get the GC. Technically, there is no time limit to filing the AOS if you get married within the 90 days. However, your wife will be accumulating over stay days and could find herself in trouble with immigration should she have any run ins with LEOs who check her status. She could be detained and hauled in front of an immigration judge who most likely will order her to file AOS ASAP and may give a deadline to file by. So the safe bet is to file AOS ASAP along with EAD/AP. She cannot leave the US or work until receiving the GC or EAD/AP. Keep in mind that processing times for the GC are anywhere from 3-6 months with the time approaching the 6 month mark of late.

Good luck,

For the petition I would not worry about it. Submit the evidence that you have meet within the last two years per the petition's instructions. That is all you really have to do to get the petition approved. Continuing relationship evidence will be needed at the Embassy stage during the interview. I have heard that the PI put more weight on pictures then most. However, if your finace is at the interview that would carry a lot of weight. Given the current timelines, I would file the petition now and if possible meet in the near future and take some photos. You can meet anywhere in the world. For the actual visa you will have to prove that the relationship is legit and not for immigration purposes. Since you are applying to the PI, do you make over 125% of the poverty guidelines? If not, then waiting until you do or geting married would be the better course as the IO does not have to accept a co-sponsor for the I-134.

Good luck,

K-1 Fiance(e) Visa Case Filing and Progress ReportsIntent of marriage

I'm in the same boat but I forgot a lot more than the letter of intent, I'm scrambling now to gather everything and send it but would it be best for me to send it to Vermont or to the Lockbox? I'm scared i'm just going to be denied instead of getting an RFE for I want to attempt to send what they need now before they process our application. ( Yes I know its not a guarantee)

Wait for the official RFE and instructions on how to reply. Sending blindly will not help you as the papers will never get to the right person--okay you have a very, very, very small chance, but it is not worth it. If you send the information now, you will in all likelihood have to resend it when the RFE arrives and will not have saved any time. Just relax, be patient, and respond to the RFE ASAP when it arrives.

Good luck,

K-1 Fiance(e) Visa Case Filing and Progress ReportsInterview Results

Dear All,
I had my interview today for K1 Fiance(e)today. Counselor was quite friendly, he had a very simple interview. But at the end he gave me a Blue Sheet of 212(g), moreover he said, everything is fine, all the documentation is perfectly alright and they don't anything more. On the sheet it was just written that Your case shall go through Administrative processing and no demand of further documentation was required. I just want to ask that is this okay, as Blue Sheet is usually used for the sake of demand of further documentation !

From what I've read in the past here on VJ, if you are male and from Pakistan and some other middle eastern countries, you are placed into AP for a more extensive background check. This can take from several weeks to several months. It sounds like you have a bit of waiting left to do as you enter the AP part of the process at your Embassy/Consultate.

Good luck,

Dave

K-1 Fiance(e) Visa Case Filing and Progress ReportsI would still ike to know more about Statement of Account

Thanks to everyone that response and given an advice to my previous questions that I posted. Your advice are greatly appreciated and useful. There's one more thing to know: Does it really matter if my fiancee has less than $1,000 in his account at the time of my K-1 visa appointment? Can they judge me base on the money that my fiancee has in his account at the time of my interview? Pls I need you guys help and advice. I wish everyone good luck!!!

Depends on what his current income is and how much above the 125% level of the poverty guidelines here. The more money the better as it will show that the petitioner can support you and you will not become a burden to US tax payers. Nigeria is a harder Embassy to go thru than most, so the more items you have in your favor the better.

Good luck,

Dave

Removing Conditions on Residency General Discussionalien number vs ss number

Hi VJ,

I am finally preparing the petition to remove conditions for my husband and was wondering. Does he have an alien registration number in addition to his social security number? What's the difference? He for sure has a social security number that I can put down but I am not sure if he has an A number as well and if that also needs to go on the petition. If so, where can I find it?

To answer your other question as to what the difference is.  The SSN is issued by the Department of the Treasury and the Social Security Administration as an ID number for handling your payments into and out of the social security system.  It is also used by the IRS for paying income taxes.  Several other entities have deceived that it makes for a good ID number and thus they use it too--banks, health insurance, etc.

The A# is your alien registration number assigned by the Department of Homeland Security by the USCIS.  It is used to identify your immigration file if you have immigrated to the US.  Natural born USC do not have an A#, all others that have gone thru and had to deal with the USCIS do have an A#.  For any document you send to the USCIS the A# is much more important than your SSN.

Removing Conditions on Residency General DiscussionAffidavit affirmed by two people?

Just curious if anyone did NOT send an affidavit affirmed by two people who have known of your relationship since your conditional residence was granted?

We sent in no addidavits as we felt the fiancial evidence was strong enough.  Up to you, as this is YOUR case.

Good luck,

Dave

Removing Conditions on Residency General DiscussionPermanent resident with ROC in process, travelling to Bahamas

Hi all,

I submitted my I-751 to remove conditions on 2/10/14 and has the biometrics on 3/12/14.

We are planning to go to a Bahamas cruise in May-June from Miami, FL. US permanent residents can travel to Bahamas without a Visa (just need green card and passport).

I had the following questions:

  1. Would my Green card and NOA1 letter be accepted as a valid Green Card? (that letter extends my green card upto March 2015).
  2. Would I have a problem entering US at Miami?

All your experiences / helpful information is welcome. Thank you in advance.

You can travel using the original extension letter with the expired GC.  Please check with your airlines as they will give you more grief than CBP.  At least if they do not let you borad the airplane back to the US, you are stuck in a nice place.

Good luck,

Dave

Removing Conditions on Residency General DiscussionAddress Change i-865

Yes she has moved. That's exactly my thought about it, that they would come after me first. And I've provided all my information to them. I don't think an address change of my co-sponsor, who I have not even lived with in the past and no longer communicate with, would cause any issues.

I just want to be sure though and not risk having problems with my removing conditions process.

Also, as an adult that signed the I-864 document, her Aunt SHOULD have been aware of HER responsibilities.  You and your wife cannot be held accountable for another adult's failure to follow the rules.

I would not worry about it.

Removing Conditions on Residency General DiscussionAddress Change i-865

Wow, I was absolutely not aware till recently about a co-sponsor having to file an address change! My wife and I did do the online address change and she filled out the i-865 but we did not have our co-sponsor (my wife's aunt) fill one out. We have not been in contact with her for a while as my wife and her are not on great terms. I am just wondering if it's a big deal or not that the co-sponsor did not fill out an i865? We have already applied for removing condition. We are not dependent on my wife's aunt at all. What should we do? She is not in favor of contacting her aunt to fill one out now. Can this cause a problem for removing conditions?

Has the Aunt moved?  The form is only required if the co-sponsor or sponsor change address.  This is so the USCIS can find you if they need you to pay back any benefits the foreign spouse receives.  I would not worry about it as they will go after you first, but that is rare as most foreign spouses do not receive any benefits.

Removing Conditions on Residency General DiscussionRemoving Of Conditions

Good day VJ members , I am confused of this the time frame 90 days prior to expiration of LPR ...like for

example the LPR expires on Aug. 9 should my application be there on that day Aug 9 or 1 day before Aug. 9

sorry folks for this, so confusing. Your response is highly appreciated

You must file before the conditional GC expires.  The expiration date is on the GC.  Now subtract 90 days from that expiration date.  That is the earliest you can file your ROC.  I have read here on VJ that the USCIS has returned the entire package when it arrived a day earlier.  The USCIS takes this 90 day window very seriously.  Not too earlier and not too late.  I mailed ours at the start of the 90 day window and they received it on day 88 before my wife's conditional GC expired.

Good luck,

Dave

Removing Conditions on Residency General DiscussionRejection letter I-751 "not properly signed"?

Do I send this back to the original place I filed which is California. The reason I ask the rejection letter came from Lincoln, Nebraska.

Should we make another copy and then sign in blue pen?

US Gov. wants black ink. Use some cheap Bic style pen one with a roller ball point when you sign.

you should try blue ink. My attorney made us sign with blue pen. He stated he had a incident in past that the form was rejected indicating it looked like a copy

Most lawyers and Notaries want you to sign official and legal documents in blue ink as it was hard to scan in a copy and print it out.  With new color scanners and color laser printers, the ability to make a very good copy is readily available to most people.  So sign the document in blue or black ink using a ball point pen on a hard surface.  The only difference between an original signature and a good copy is the indentation made upon the paper when signing the document.

Did they say they would accept a properly signed document?  If so, they should have told you where to send it.  If no instructions were given on sending in another signed document then you may have to start all over again or file an appeal.  I would not just send in a signed form as its chances of getting to the right person are slim to none.

Good luck,

Dave
