K-1 Fiance(e) Visa Case Filing and Progress ReportsJanuary 2013 filers

USPS tracking has been stuck at "Arrival at Post Office" in Dallas from January 07, 2013, 3:34 am
Does this mean it's delivered since it's going to a PO Box (which I assume is in the post office)? Or will it change to delivered when it's actually delivered? Haven't gotten any notification from USCIS yet either via SMS or email. How long does it usually take them to send a notification out after they receive it?

I sent mine December 1, 2012 and i got my NOA1 DEC 10. Just wait a week or two, if not call them after 30 days..

K-1 Fiance(e) Visa Case Filing and Progress ReportsGetting my representative involved

So I received my NOA1 on September 5, 2012. Fed up with waiting, I contacted my Congress woman's office. Her immigration person contacted USCIS on my behalf and was told the following: " Your constituent's case is currently under review by an Officer and can expect a response within 45 days". Sooooo, if they add another 45 days to the nearly 5 months I've already waited, it should give the rest of you an idea of what can be expected of the CSC.

Sucks but what can I do but keep waiting? At least glad I contacted my representative.......

Sorry to be a date buster. Your supposition is that 5 months has passed when you hit the Feb 5 date. Unfortunately this is the absolute beginning of the 5 month period (personal previous experience working for the government :crying: ). So your full 5 months is up on March 4 2013. I am Sept 4 and this is actually good news as this means that adjudication is only around 15 days behind schedule; if you wait the (stated within) full 45 days. Hopefully speeding up, if trends repeat themselves, we will see responses and NOA 2's late February.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCSC July Filer Contacting Congressman

With all due respect, I don't think you understand the reason for our frustration.

The people we talk to when we call USCIS are in a call center. They are not retrieving our files and diverting time away from the processing because they are not the people working on our files. Calling is not delaying the processing of applications in anyway.

The reason we are all upset is because of the lack of information and blatantly false information. When we July filers filed our petitions, we were told there was an average of 5 months for processing at CSC (though it was very common for approvals within 3-4 months). I patiently waited for a decision for 5 1/2 months before I tried to inquire on what was occurring as I had heard nothing and had not received an RFE. We are upset because many of us are at 7 months with no word since the day we filed. We would be fine with waiting if we would be given an accurate estimate of expected approval, reasons for the delay, or even a small update on our file, such as they are waiting for X paper from Y office. But that is not the case. No one will even pull up our case or tell us why it has not been approved or if they have even looked at it. No one will tell us truthfully when we can expect a response. If we call we are told "Wait __ weeks and you should have a response." We then wait, and when we haven't received a response, we call and are told to wait more and that we should hear within that time. Many of us have no problem with being patient or waiting our turn. But we are sick of being told excuses and contradicting information. We just want an honest timeline or answer as to why there is such a delay. They are clearly not on July 18 applications - it is a line they are told to say. And if for some odd reason they really are stuck on July 18 after two months, that is very alarming.

And that is the other reason why we are upset. There is clearly a dramatic decrease in the number of applications for fiance visas being approved/processed at CSC in the last few months. Movement appears to have almost came to a complete stop. CSC has not stated the reason for the sudden drop in processing or the cause. If we were given a reason from CSC, or if it seemed that they were actively working to process applications and rectify the delay/backlog, many of us wouldn't upset.

With all due respect.. I do understand the frustration. My original K1 petition was sent to the Texas lock box Aug 14, only to wait 14 days to get the whole thing back. Reason: the I129f was incorrect?? So my attorney and I looked and found a "newer" form that was said to be the "most recent." The difference between the two -- absolutely nothing; except the adopted date and revision date. AND the original I129f I used showed on the USCIS website as being acceptable. Could I have complained, griped, cried, called everyone under the sun and let them know? Sure, but instead I returned the forms and hoped for the best. Now I hope for a speedy processing and NOT to receive an RFE, but rather an approval. The process still must proceed and follow normal procedures.. Can I change it? NO... Did I get into this for the short term gratification of brining someone to the US OR am I in it because I have found (for me) the most amazing woman on the planet? (I hope you all feel the same about your fiancée) I also realized that we were in a presidential election, 4 major US holidays and a number of other factors that I must wait through. I accept that this WILL slow processing times. But as I said before I am in it for the long haul NOT instant gratification. I think it amazing that microwave popcorn has become too slow for many in our society. So all I am saying is change your mindset.. Look to the positive that you will be together.. NO matter how long it will take. Spend your energies on the positive and the good.. NOT on the feeling of woe is me when things at USCIS -- CSC -- VSC are taking longer than we would like. Does the system need fixed? I would agree YES. But, work to change it in a positive way and through the right channels.

As for the comment following yours.. I do have sympathy and condolences. God knows I wanted to see my girl here for Christmas 2012. I was even told originally that processing only took 90 days.. WOW was that idiot wrong. So my sympathy and condolences because the two of you are not together yet. Is that not what we all want? To be with our fiancée as soon as possible, and begin our lives together.... But, my sympathy or condolences will ever be offered for a lack of patience.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCSC July Filer Contacting Congressman

Seven months now and no NOA2 or even an RFE. I'm tired of calling USCIS only to be told, "We are processing July 18" (as they have been saying for the last two months !! despite many August and September petitions being approved) and to "Wait ____ weeks and you will hear something" and then after waiting ____ weeks, calling and being told the same thing again. Speaking to a Tier 2 agent has done nothing - in fact, they have often contradicted what the previous agent said. The online system doesn't let me put in a service request (because "my petition is not outside of the normal processing time" per the so-called July 18 processing date) Those few July filers who were able to do a service request received service request responses of "wait more," so service requests are useless.

So today I decided to contact my state senator's office and they are going to inquire on my petition. My NOA1 dates is July 26 and it has been 214 days.

Perhaps this won't do anything - perhaps it will. At this point what can it hurt? The only other option is wait...and wait...and wait.

Maybe if all of us July CSC filers contacted our congressmen it would put pressure on CSC to finish the July I-129F K-1 applications.

I may be flogged and hung out to dry, but what happened to patience? AND a handful of August and one September approval hardly equates to "many."

Instead of continually contacting USCIS, congressman, God and who knows.. Concentrate on the positive.. that is your fiancée!! Work on your relationship, plan for the future.. work on yourself.. save money, get in better health and physical shape. All of which will make the time go by quicker.

Besides, I would think that every time someone calls in, stopping the process to find where one petition is, causes a slow down for everyone.. Not just yourself..

K-1 Fiance(e) Visa Case Filing and Progress ReportsAPPROVED!

We are approved! As of 45 mins ago! Our case had been updated late in the evening (10pmish) for both our approval and our RFE review thing. SO they do work after hours! (I've read that some people take cases home to work on them)

But they are working. Soon soon soon!!

QUESTION:
Now our case is sent to NVC where I can call in a few days and get a case # and send in my ds230 and then it'll go to the consulate in Vancouver, and then I can book my medical and interview, correct?
Is this correct?
And also, me as the beneficiary have moved since we filed...how do I go about contacting someone to change my address?
THANKS!!

Congratulations!!

Pass on down the good vibes and hopefully CSC will put on the afterburners...

My fiance and I are sooooo excited to see today that our I-129F petition has been approved by Vermont!!!

I had filed first week of September 2012 and Received the email confirmation of NOA1 by Sept.7, 2012 and today i had checked my email I got the confirmation stating the petition has been approved February 28th, 2013 (seemed like the email was a few days delayed as I believe the hard copy has been received in the mail today as well, I'm currently with my fiance in Brazil and my father messaged me telling me something came in the mail from USCIS)

K-1 Fiance(e) Visa Case Filing and Progress ReportsNEW reason for delay at CSC - 48,000 files damaged

So I requested help from my congressman a few weeks ago to inquire about my case. Today the aide called me with an update.

Apparently the USCIS congressional liason at CSC told him that 48,000 files were damaged when the pipe broke a couple of weeks ago. (Remember CSC was closed for two days for a plumbing problem??) They are saying that my case, July 26, was included in that pile. However, they haven't reviewed my file to see if it was damaged and if I will need to send in everything again or not. According to my congressman's aide, that is what is causing a delay now. When I asked if I needed to send a copy of my entire I-129f, he said no, wait until CSC gets to my case.

So I asked him, "Ok, that is the reason they are giving for the delay now What about before that? What was causing the delay before two weeks ago?" The aide got kind of huffy with me and said, "Well I'm sorry you don't like my answer but that is what CSC said." He didn't give me an answer.

He said that they are currently processing July 18. I told him that they have been quoting that for four months now, though they are clearly not on that date. I told him how I have been to many websites and monitored other people's cases, and there are a good chunk of people in August that have been approved. He said, "If you choose to believe that, that is fine. But I believe CSC." I said, "Ok, so thousands of individual people are all lying about their individual cases?" Again he said that he was choosing to believe CSC because he talked to the liason and blah blah blah. I asked if he knew when they expected to move passed the July 18 date. He said that was not a question he had asked.

Has anyone else heard anything like this? At first I was devastated to hear that my file was possibly destroyed and about the delay it would cause having to send everything in again. However, this is starting to sound like a BS excuse for CSC to buy some time considering they haven't made an official announcement.

First, I'd write off to both of your Senators and skip the Congressman.. My understanding is that Senators hold a little more clout than a Congressman.. Not sure if this is the truth but possible. In any case you have other avenues so I would use them. AND hopefully they are Republicans because I'd expect to get them riled about the whole mess. I've always had good response from my Senators.. Congressman many times do not even reply to my letters.

Second, I wouldn't believe this unless you get a direct mailing from CSC. Unless the files are all stored in the basement on the floor I wouldn't see how it would be possible.. OR maybe the sewage problem was actually fire sprinkler system blowing a gasket. Again maybe I am wrong but surely.. CSC cannot be that inept.. OK what am I saying... :bonk: Sure they are!!! USCIS and CSC have proven this!!! My original petition and entire packet was returned to me, because I had the wrong I-129f (only difference was the USCIS document approval date on the I129f   everything else was EXACTLY the same... ). The pages had all been sent through, what I believe, was a scanner. Also a number and other information imprinted on the side of each page. Anyway, I would expect that everything is digitized. If not I would be completely surprised...... On the outside... I hope everyone made 2 or 3 backup sets of every form, page and piece of evidence.. I sure did..

A few months ago I called and spoke to a tier 1 CSR at the USCIS. She calmly advised that the USCIS considers every application when arriving to be in zero month.. You heard it! Zero month.. So I said to her that they needed to change their reporting to advise of this zero month.. She replied why.. because the process typically takes between month 5 and 6 to complete and to expect to hear in 5 to 6 months.. #######??? 0, 1, 2, 3, 4, 5 to me represents between 6 and 7 months.. Now I am not a mathematician by trade so again correct me if I am wrong.. So I asked this girl if I should call the IRS and tell them I only pay taxes for 11 months because I do not count zero...   She advised that she couldn't discuss any tax information and disconnected the call.. WOW!! :wow: is something broke at USCIS or what??

If the company I work for was this inept and freekin' incompetent.... we would have been out of business years and years ago...!!!!

Question: Should we not expect that the USCIS runs like a business? That there be some type of accountability to someone, somewhere? AND people are held responsible for actions when working for the USCIS? Obviously they don't.

I will say this....It's not over yet, but we are a lot closer!!

Please DO contact your congressman/senator. It really does help them to gain knowledge of the situation we have been/are facing.

My NOA1 was 21st September 2012.

Good luck guys! Thank you all so much for your support. I'm sure i will need your wisdom as I carry on with this process!

Come on CSC!.....Your alive again!.....

CONGRATULATIONS... April 17 will go down in both our lives as a day to remember!!! Thank God CSC has finally been revived! I'm looking forward to see what the next days bring and all the approvals!

K-1 Fiance(e) Visa Case Filing and Progress ReportsFrom NOA2 to MNL case number in 8 days

I received our NOA2 on April 18. I started calling the NVC daily only 2 business days later (yeah, I'm antsy). On the 6th business day, the 8th calendar day, I received the case number for Manila, our embassy.

If you are in a county where having the embassy case number can get you moving, as it does in the Philippines, the process can be pretty fast.

Good luck to everyone.

Same experience here only with our KEV number.. I called on the 9th day. Received the number and was told our package had been shipped.the previous day.

Scott65MaleUkraine2013-04-27 07:18:00
K-1 Fiance(e) Visa Case Filing and Progress ReportsI just spoke with my congressional aide

Some of this is clearly false information.  Other bits, I'm not sure -- some of it sounds plausible and logical.

As several posters back in March/April tallied, there are graphs that show that DACA did indeed have a HUGE effect on K-1 processing.  I strongly suspect they're just covering that up, but it doesn't really matter now, the DACA flood has slowed to a normal river, and they should be able to keep things at a normal pace, without creating huge backlogs again.  I hope!

12 months from NOA1 to visa-in-hand seems about right, imo, although I hate it and would hope that it could still go faster.  But yes, that seems likely given recent processing times.

However, that bit about appointment dates (you mean INTERVIEW DATES?) being scheduled before the petition leaves the NVC is clearly just wrong!  We have current filers right now going through the NVC stage and there is no indication of anything like what you're saying.  I haven't gotten to this stage myself, but that part of your aide's response sounds like utter nonsense to me.  I do believe there could be a backlog and delay at the NVC stage, but interviews are in NO way scheduled while the petition is still at NVC.  Sometimes they aren't even scheduled for MONTHS after the petition reaches the local consulate.  That still varies entirely by country and has nothing to do with the NVC forwarding the petition.

If I'm wrong about that, please correct me, but I can't see that NVC info being correct in any way at all.

Just FYI..  Our K1 was approved 4/17 at CSC.  4/22 arrived at NVC.  4/25 was enroot to the Kiev Embassy.  4/26 I called and received our KEV number.  4/29 package arrived in Kiev and was signed for by Embassy staff.  Expecting letter arriving to my fiancée any day.  NVC may backlog a little because of the flood gates opening from CSC but realistically not much in processing happens there.

We are waiting on banks opening after Orthodox Easter (RBA in Ukraine closed until the 7th).  Then she will pay the $240 fee and we can schedule medical and interview.  Not sure of that time frame elsewhere, but everything in the Ukraine forum hints at 4 - 6 weeks from K1 approval to VISA.  I would suggest checking your individual country forum and look at the timelines of others there.

Good Luck!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsAnyone who got their NOA2 the last two weeks called NVC yet?

Hi guys. Our NO2 was april 24th too. What fee is next and how do I pay, who do I pay and how much????? I'm a little confused by this part. Thanks.

Go to the Embassy website for your country.  Look under immigrant visa (at least is there for Ukraine) to find how to pay and where.  If all is the same, for each country, your fiancée will need to pay in his/her country and in that monetary system.

I believe that the fee is the same US $240.

Got my NOA2 April 19th and I've already called the NVC 3 times. They still don't have my files and insists that I wait 15 business days but I just can't help and be excited dancin5hr.gif  Has anyone who just recently got their NOA2 have better luck?

Our NOA2 was on 4/17 and I called on the 26th.  Found out that everything has processed and was already on its way to the Embassy.  I was also given my KEV number.  Assuming the designation has to do with the Embassy being in Kiev.

If you've gotten the number look at this thread http://www.visajourn...-to-us-embassy/.  You can get a good idea of how to track the package leaving the NVC for the Embassy.  Ours took 4 days to go from Boston to Ukraine.

PhilippinesPolice Certificate
Police certificate is REQUIRED for ALL PLACES that you have resided for more than 6 months within your finacee's home country (i.e Russia) since the age of 16 years. If your fiancee has lived outside her home country for more than 12 months (i.e Germany) than a police certificate is REQUIRED from each country as well. So for your case you need Russian Police certificates and Germany police certificates.

Hope that helps,

Dave

PhilippinesCan my fiance ( Petitioner) purchase an airline ticket for me?
Yes. With e-tickets it is very easy. Just have your fiance book the ticket and give you the booking number you will use. I sent the entire itinerary to my wife when she came on a K-1 visa and the two times she came as a tourist via e-mail.

Either postpone her arrival a month or so and get the off base living situation cleared up or have her stay with your Mother and see if you can meet her to get married before the 90 days after her entry into the US is up. She has 6 months to use the K-1 visa to enter the US on. I would suggest she remain in her country until things are settled on your end in regards to living arrangments, but the baby's birth abroad would add another wrinkle to the problem. It might be cheaper to have the baby in her country and then get a passport of the child as a USC and bring them both to the US before her K-1 expires.

Good luck,

Dave

Philippinesany other docs needed to bring AT POE?
You might want to bring some of those pieces of paper with the picture of a former Embassor to France or dead presidents on them--CASH. I know airport food is not the greatest, but it is better than nothing if you happen to have a long layover. Our layover in Frankfurt is 7 hours and it is nice to be able to buy something to eat. Also you can pay for the excess weight charge of your baggage should your flight pans change. I was booked on British Airways which charged me a flat $50 for my over weight bag. The flight from London to Almaty was canceled so I had to go via Aeroflot and Air Astana each charged by the kg--it cost me an additional 180 BP which is still cheaper than shipping via FedEx. Having cash will help in an emergency.

You've got everything else covered.

Good luck and enjoy your trip.

Philippinesusing wipe out or touch and go

is it ok to use a wipe out or touch and go if there is some mistake on the form ?

If for some reason you cannot print out another copy, the typical method for making corrections on government forms is to use a single line to cross out the incorrect information and place the correct information next to it. White out can be used by anybody at anytime which could cause the document to be rejected as the USCIS employee does not know when the correction was made and what was correct and whether you actually signed the document before or after that correction. Of course the same can be said for marking out anything and that is why printing out another copy would be your best course of action.

PhilippinesAirline tickets: can I buy a round-trip but only use the return?

just booked my flight yesterday 1119 from mnl to ict (delta). the march dates are like more expensive (additional 300+). april 1 was like 1400 while april 2 was 1119 so i picked that one lol. just checked again to see if round trip was cheaper but nope.

I would love to find a ticket for JUST $1400 RT. That is usually the price of one of the legs. I've looked at flying west insead of east and the prices are even higher. At least there is not much of a difference in price unless it is over Xmas. Then you pay another $500 per ticket. That's what I get for finding a woman who lives half way around the world. I hope this year it is just paying to get the MIL over here rather than the two of us going to visit.

How expensive it is in th eeye of the beholder.

Have a good trip,.

PhilippinesAirline tickets: can I buy a round-trip but only use the return?

Is it doable to buy a round trip but only use the return? Its cheaper by 400 bux. Or do you have to use go to the destination first before the return is activated?

Fare from manila to us us almost double than the fare from us to MNL. Its nuts.

You must use the tickets in the order of the flights listed. To not use the inbound causes the airline to cancel the rest of the ticket. In your example, if you buy a PI to USA and USA to PI and do not use the PI to USA leg then the USA to PI leg is canceled. This is to prevent what you are trying to do as the airlines would have to change their pricing structure. Very rarely are two seats the same price, unless purchased together. Why are one-way tickets usually much more than round-trip and why are combined tickets cheaper than putting the legs together yourself?

Good luck,

PhilippinesNVC

Hi visa journey! Can anybody answer my question.... I called NVC today may 7, 2012 to ask if they receive my aprove petition from USCIS.. The NVC said, they received my aprove petition already but they didn't yet send my aprove petition to manila consulate( my fiancee's country).. The NVC give me a case number.. My question is, can my fiancee buy a visa now while waiting the aprove petition from NVC to arrived in my fiancee's consulate country? Is that ok or i need to wait to arrived my aprove petition from NVC to my fiancee's country. Any suggestion? I want to be ahead of time as soon as possible.. Thank you..

Or are you asking about paying for the K-1 VISA. If that is the case you still have a few more hoops to jump thru before the K-1 is approved. First, there is the medical and all the forms to be filled out. You will need to get a police report for your fiancee of every place she has lived since the age of 16. Then you have to complete the I-134 affidavit of supprt form will all the supporting documents. Then there is getting ready for the interview and submitted more evidence of on going relationship. Then there is the interview and waiting for the visa if approved. I would goto the PI subregoin of VJ and read on the next steps in the process for your Embassy.

Good luck,

Dave

PhilippinesTraveling internationally with a Green Card...

Here's something I've been wondering, maybe people here have some experience.

My fiance will arrive in the US in August. Once we are married, and she has completed the AOS, and has her Green Card, I'm curious how, if at all, it affects her ability to travel internationally.

What I mean is, let's say we can to go to Japan. For a Filipino, it's a rather complex visa for her to get. If she's holding a LPR status in the US, does that change anything for her? I assume she's not entitled to the same benefit as a US Citizen (just show up, granted 30 or 90 day visas in most countries) but is there any benefit to her being an LPR of the USA? Does it simplify her getting visas to go travel?

I'd love to take her around the world traveling, Europe, Scandanavia, but am just wondering if getting her travel visas will be easier with her having her Green Card here...

Curious anyone's thoughts.

She travels internationally on her passport and must follow all the requirements the country of intended vist places on her as a PI citizen. When she applies for a visa to the country she intends to visit, she MAY have an easier time of getting the tourist visa as a US LPR verses just a PI citizen. Another point is that her tickets must match her government issued ID used for international travel--so her tickets must match the name on the PI passport. The only thing the GC does is show she is a LPR of the US and can gain entry to the US without a visa.

The only way she will have it easy to tavel is to become a USC and then the two of you will have the same visa requirements throughout the world.

Philippinesflights
Sometimes the cheapest is not always the best option. When talking about a couple of thousands of dollars or even one thousand, saving fifty to one hundred or even two hundred should be weighed against travel time, layovers, and POE for the immigrant. I would love to do the ALA to LHR to DEN as that layover is 2.5 hours. However it costs $5000. So we end up doing the ALA to FRA to DEN with a 7 hour layover but no connecting flights or POE except for the destination. Just remember that if the POE is not the final destination the immigrant will have to go thru immigration and customs then navigate to the connecting flight all in the allotted time. This process is expensive and to cut corners here could make the whole entry into the US an unpleasant experience.

If we did not have a direct flight, I would have met my fiancee at the POE, spent the night and then the two of us together would have travelled to the final destination. So don't just consider the money at this very important statge of the journey as you are talking about your future lifelong mate.

Good luck,

Dave

Philippinesno verifixation letter or employment letter

Hi VJ members, my fiancee cant have an employment letter or verification letter is it because it is against on his company policy to provide that information and must be gotten thru a third party online vendor. Is it okay without that? Is that can affect to my interview in US EMBASSY MANILA?

As long as the last year's tax return shows income above the 125% level and you can provid paystubs showing the income, you should be fine. I cannot speak about the Embassy in Manila. Why not try to get the employment verification thru the third party just so you have it?

Good luck,

Dave

PhilippinesHow to travel with 2-year GC

hello everyone I've been here in US for about a year and have my 2-year green card. We are planning to travel to Florida this October and hopefully in the Philippines next year. I wonder what should i do since my Philippine passport show my maiden name and if we are going to buy ticket under my married name? Is anyone went back to Phil or other states? How the re entering US go?

You MUST purchase the ticket to match the government issued ID used for international travel. That is your passport. For domestic travel you can use either the GC or passport for ID and again the name on the ticket MUST match the ID being used. For international travel you will use you PI passport and are subject to the same visa requirements that someone from the PI is with a few exceptions (the US GC may get you a visa easier than just someone from the PI). Upon return you will use your GC to gain re-entry to the US. You may want to carry a copy of your marriage certificate to help the airline people make the connection between married name on the GC and maiden name in the passport.

If you file for ROC before leaving for the PI, the NOA1 will extend your GC validity for 1 year. Just do not miss the biometrics appointment or interview should you have one.

Enjoy your trips (it is very easy),
