We just received an email back from OLUInquiries@uscis.dhs.gov... the fastest response we've gotten via email as of yet. They said our case is currently on it's way back from the National RECORDS Center to California Service Center. USCIS sent our papers to the wrong location. 

 

Does anyone know how long it takes for this correction to be fixed? How much time does it take now to get back to CSC then to NVC?

We sent in a scanned copy of our Approval to NVCresearch@state.gov as well... and called USCIS and NVC and Dpt of State what seems like a million times. Our local congressman has been contacted as well. Did you have USCIS put in a service request to the Vermont Service Center to try and track the documents? Apparently it takes forever and isn't very effective, but we're trying everything at this point. 

 

What's strange is that the Department of State said it really shouldn't and doesn't normally take more than a month, and that 2 months should raise some concern. After I asked if our papers were lost or had been sent to the wrong location, they replied with "it's possible"...

My fiance and I were approved on July 10th, 2013. It is now September 14th, 2013 (over 2 months) and NVC has still not received anything from USCIS. Is this normal? We fear that our documents have been lost. 

 

 

- USCIS put in a service request to the California Service Center and told us to wait 30 days to get a response... in the mail. 

 

- NVC said they have not received anything and told me to contact USCIS. 

 

- Department of State said they cannot help us as we do not yet have a case # since NVC hasn't gotten our documents. They told us the papers could be lost or sent to the wrong location and that this should not take more than 1 month. 

 

- USCIS then said that the max. processing time for papers to go from USCIS to NVC is 90 days, and that we can't request that they resend them until it has been 90 days. 

 

- Local congressman said they are looking into it and will mail us a response. 

 

 

Is this happening to anyone else??

First time post-er here!

My questions are fairly straight forward.
I am the petitioner in a currently pending case for a fiancé visa for my Nicaraguan Fiancé.
Our I-129 F was accepted on October 31, 2013 and is still under review with USCIS.
1) are the estimated wait times (5 mo.) fairly accurate with USCIS? It's been almost 4 months and we haven't received any Requests for Evidence so far.

2) How long does it *usually take from the time USCIS approves the petition for my fiancé to be given a visa interview appointment?

3) is there any way to know what documents, vaccinations, fees, etc. my fiancé will need to have prepared on the day of his interview? If possible, I would feel much better to go ahead and get those documents and things ready now in hopes to avoid much more delay once we are contacted by NVC or the Embassy in Nicaragua.

4) I'm a full-time student, therefore my job and salary is pretty limited. Will this cause a pr

I have burning questions.

My fiance and i are yet to file for the K1 visa.
We have been going on for a yr and a half (since June 2011) and met in person 27th Dec, 2011, exactly a yr ago when he came visiting in Nig. We got engaged then. He left Nigeria on 1st Feb 2012. We haven't seen since then. It seems like eternity... We miss each other so so so so much and due to work commitments, he couldn't visit this yuletide.

Now, i am considering applying for a tourist visa, early next yr, to go visit him. We all know that if i apply for visiting visa, saying i want to visit my fiance, they could raise eyebrows thinking i intend staying back...

My questions are, let's say i am granted visa under the tourist category, and since going as a tourist means i don't 'know' anyone there and not mentioning him may seem fishy to them afterwards, will it affect our K1 filing when the time comes?
Secondly, I am being optimistic about it, but 'if' i am not given, will it have any effect when the filing starts??
Please, answers are urgently needed.

Given what I have read about getting the K-1 or spousal visa from Nigeria, it might be better if he came to visit you again rather than spending the money on trying to get a tourist visa to visit the US. You can try, but remember that you must show very strong ties to Nigeria and that Nigeria is considered one of the top visa fraud counties in the world. So you will have an up hill battle and remember that the visa fee is not refundable.

Be sure that she has some type of writting device--i.e. pen or pencil as these are in short supply on the airplane. If she cannot fill it out on the airplane, there are tables usually with pens where she can fill it out after landing and de-planing.

Search the forums and you will find soneone who mailed off the I-129F packet and the USCIS received it 2 days after they met two years ago and it was rejected. The instructions are very very very specific that you must have met in person within the last two year. Not two years plus a day or a month but WITHIN the last two year or 730 days. No exceptions that I know of. If you have the time and money go ahead, but you will be more ahead by meeting again and re-filing like the OP.

Hey Guys,

My fiancée petitioned for the K-1 visa back in November 2012 and we haven't heard any information on our case at all.
He called and they told him they would call him back...they eventually did but with no information at all. They just said to wait another 45-60 days...this was in January.
All the USCIS site says when we enter the receipt number is •Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283.

When I tried calling the number they told me they couldn't tell me anything about the case at all because I wasn't the petitioner.

Anyone have any advice on this? Is it normal to not hear anything for 4 months after NOCA?


That is very typical. This is the main reason it is called the mis-information line. They will tell you to wait 30 days before you call again. You can try to call back and ask for a tier 2 supervisor--you will need to be persistant. You really have no need to worry as the K-1 is now currently taking 6-8 months and you are currently in month #4 or about half way thru the wait--unless things pick up. They will not discuss anything unless you are the person named on the petition or application or that person gives permission for the USCIS to talk to their representative.

I would find something constructive to do with yur time so you are not always checking the status of the petition and driving yourself crazy.

We filed september 13, 2012. So its been about 7 months now since we received the NOA1. Would be nice if they updated things more often on the website, as it would help a lot when having to plan a wedding. Its no good leaving it until 90 days before the wedding.. especially booking in the summertime, as everyone books around then and it will be hard to set a date in 90 days of arriving! Will be tough trying to find a wedding venue!Would have been nice if they gave 6 months instead of 3 months to get married. 3 months is cutting it a bit fine!!


If you include the validity period of the visa, which is typically 6 months, then you actually have about 8 months from getting the visa in your hand until you must marry. You can enter the US from the time you receive the visa until it expires and then once you enter the US you have 90 days to get married. The problem is that most people want to enter the US ASAP after the long wait for the visa, and who can blame them. My wife came 3 months after the K-1 visa was issued as she had things she wanted to get done before leaving.

I-864 legally binding between the sponsor and the US government. I-134 not legally binding, but has income information to see if the petitioner meets the poverty guidelines required for the I-864.

You will be lucky if you receive notification that your petition is approved.  You can go on-line to see if your petition is touched and that will tell you someone scanned the bar code.  Other than that you will not hear anything until your petition is approved or they request more evidence. The on-line and electronic notification system is in beta testing mode as it is very unreliable.

K-1 Fiance(e) Visa Case Filing and Progress ReportsAnother update of my case but the same information

First off you need to understand the way the K-1 is processed.  It is done at a service center which is usually California or Vermont.  Texas and Nebraska fill in when the other two fall behind.  Now you have to understand how the electronic system works as it is used for all kinds of petitions and applications.  So for a K-1 the computer screen has a place for you to fill in the updated information which is VSC, CSC, NVC which does not apply for a case transferred as a K-1 is not usually transferred.  So they have to over-ride the computer system to insert something--i.e. it is like all the USC that have to answer the A# question, what do you put in there.  So they put in that it has been transferred to the local office when in fact it has been sent to TSC for processing because VSC and CSC are taking there own sweet time processing K-1s.  This has happened in the past and will happen in the future.

 

You all are the "lucky" ones to have it happen to first.  Is this a good thing--we'll see.  TSC may or may not process them faster, that has yet to be determined.  All you can do is wait and see.

  • We have met and known each other ever since 2006, when my fiance was an international student in (university name), the same university I attended in 2006

For my RFE response, I elaborated further by saying that we began dating, established a relationship, traveled to other countries together, and kept in contact after she moved back to her home country. Also, I added that I visited her in her home country, and she visited me in my home country between 2010 to 2012.

 

Did you send any of that proof?  Do you have that proof to send in if you did not before?  As was stated earlier, you can SAY anything you want, but you need to back that up with actual proof.  An airline ticket is good, but the passport stamps shows you actually travelled.  You say you met in 2006 is good but did you show that you both attended the same University?  By proving that you are truthful in everything you state goes along way to establishing your credibility.  It is up to YOU to establish beyond any doubt that you two met within the past two years.  Lay it out for them in steps.  Airline ticket or itinerary, passort stamp, receipt for an item purchased in the same city, a photo the twop of you in front of a well known landmark with the date.  I guess we have it easier as we both need visas to visit the other's country so we could include them. 

 

What ever you state back it up with evidence and then IMHO you should be okay.  I would include proof that you visited her country and she visited the US between 2010 and 2012.  Again, you stated it so they will want actual evidence that proves this statement.  It is just like the I-864 form where you state your income, but you have to have documents that back up that number--you cannot just make something up. Same goes here.  If you say she visited the US between 2010-2012--PROVE it.  You state that you visited her country between 2010 and 2012--PROVE it.

I got notification of an RFE being sent out on May 10 and May 13, 2013, and I just received the hard copy RFE in the mail today. The RFE is asking to submit information regarding the circumstances under which the petitioner and beneficiary met to establish the relationship. Also, the RFE is asking to submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition. I provide them with a copy of my bording pass for both flight and I have no idea what to send.

Think of it like presenting evidence in a court of law.  You show a plane ticket.  Great did you actually go.  Now you show a passport stamp. Great you did buy the planer ticket and you did actually go.  Now you just need to prove you and the beneficiary met in person while you were in the beneficiary's country or the beneficiary was in the US.  This is where a couple of photos would work nicely.  Otherwise you need to come up with receipts in the same city.

 

For us we meet in 2003, so I mentioned that I met her in 2003 when I was visiting her country to see friends.  Now 2003 was outside the having met within the last two years, so I mentioned that we began e-mailing each other in 2006 and she came to the US in 2008 and 2009 and I went to her country over New Year's 2009-2010.  I sent in the itineraries of all trips, photos of us in front of the White House and US Capital to prove she was in the US and I sent in my visa to Kazakhstan with all the stamps to prove that I actually was in her country along with photos of us with her brother, sister-in-law, nephew, and Mother.  Not sure if there recognized the landmarks in the photos.

To appeal means you are saying that the denial was incorrect.  In this case the denial was valid. The OP did not show proof of having met within the last two years.  He did not prove he was a USC and thus eligible for the benefits of the K-1.  He and the beneficiary did not include affadavitts that they would marry within 90 days after the beneficiary enters the US.  All he sent was a completed I-129F and the payment.  He did not even include the G-325A for himself and the beneficiary.  No, to appeal is a waste of time and money as the USCIS' decision on this petition is completely correct.

 

OP:  as everyone else has stated, follow the links, read the instructions, read the guides here on VJ and if you have any questions please feel free to ask, but IMHO it would be cheaper and less time for you to refile.  Think of this as a $340 lesson and I hope you learn from it.

ok I sent original to my fiancée to Philippines and use DHL and its been a week now im a lil worried in case it was lost can she just use a copy of my W2 and just a copy of my pay stab???

 

Copies are fine for everything except those that require an original signature.  FYI: for tax returns it is better to use tax transcripts from the IRS. They are free, take about 5-10 business day to receive and are accepted by the USCIS.  If you fail to send in a complete tax return, the USCIS was send you and RFE for it but usually they do not say what is missing just you need to send in a COMPLETE tax return.  I would order your last three years worth of tax return from the IRS as tax transcripts as you will need them later.

K-1 Fiance(e) Visa Case Filing and Progress ReportsFiling Mistake. Not sure what to do, please help.

Hi everyone, I am new here..

I filed the petition for the K1 fiancee visa back in March. Being overwhelmed and rushed, I only sent the I129F, the check and a copy of my birth certificate. I know, I obviously didnt follow directions. I had asked some questions at the US Consulate in Montreal (my fiancee is Canadian) and my understanding was that we show proof at the time of the interview. Thats how I took it from the guy who was giving me info. Honestly all I want is to be married, and was trying to get the ball rolling very quickly.
I have received the NOA1 in May and I just checked my status now, it says my petition has gone to my local USCIS...... and here I thought that this was a good thing.
Is there any way I can send the rest of info without them denying us? I have a million pics, proof of traveling.... should I try calling and seeing if I can do this? I am absolutely distraught right now that I screwed up and this could take even longer.
I am so overwhelmed, any help would be appreciated.

Okay, I am in the minority here as I think given what you sent in you stand a very good chance of being denied because you did not supply proof that you and your fiancee have met in person within the last 2 years.  That is one of the fundemental requirements for the I-129F.  I would do as others have suggested and mail in the proof with the case number on every page and the envelope.  To not do so risks the filing fee being lost when the petiton is denied.  Then you get to file it all over again.  You MAY get and RFE for the  evidence of having met, but since you did not include anything in the original packet the USCIS person is most likely going to just deny your case for not following directions. 

 

At a minimum you need to show:

    1) The I-129F form and payment

    2)  The petitioner is a USC

    3) Both the petitioner and beneficiary are free to marry

    4) Both the petitioner and beneficiary plan to get married within 90 days of entering the US (signed letters of intent  by both parties with original signatures (i.e.

        no copies))

    5) You both need to complete the G-325A biographical information form with original signatures (i.e. no copies)

    6)  Passport style photos of both the beneficiary and petitioner taken within the last 30 days.

    7) The most important is that the two of you have met in person within the last 2 years

 

You supplied Items #1 and #2 out of all those required, so that is why I say that unless you can get the other documents into the hands of the person looking at your case ASAP, it wil be denied and this will be a $340 lesson.

UPDATE

 

 

Well have still been trying to find out where my package was. After placing many calls to the USPS (worst service I have ever seen. Most of them were useless. Thier most popular response "I can't help you") Well finally after filing 5 reports on Monday I got a call from the supervisor at my local post office. And he told me that it was deliverd on 7/7/13. Even though I checked online the tracking number still does have it not deliverd. I called the USCIS and talked to them to see if they had it, they said it could talke up to 10 days to get into the system, it was not in there yet. they were wonderful to deal with called 2 times and both times they were great. Well I get home today and in my mail was an envelope from USCIS?!?!?!? I open it up and there was a letter saying my package arrive damaged and they can not prosses it. They included what they got in there. Part of the envelope and only about 10% of the paper work and my check. everything was WET! and the ink was smudged. that is how the post office delived it!!!!!!!!!!!!!!!!

 

So the Post office LOST IT!!!!! then they DESTROYED IT!!!!!!!!! and went and delivered it like that. I will be going to the post office tomarrow morning(it is right across the street from me) and I will be going ape ###### on whoever is in charge there.(I almost feel bad for them) I AM SOOOO PISSED OFF RIGHT NOW.

 

 

So how did it go with the USPS after you reamed them a new one?  I hope they at least gave you your money back.  That is the least they should do.

I mailed my K1 package out on June 18. I sent it priority certified mail. And the postal service LOST IT!!!!! On June 19 the package left the Rochester NY sorting facilty and has not been scaned since. I have spent the last week on the phone with them, either I get someone on the phone that is useless and is of no help at all. Or spend an hour on hold and get "we will look into it". Last person I talked to said I have to wait 30 days then they will consider it lost and will refund the postage. I told them I want the package found not a refund. There is way too much information in that package that I don't want lost out there in who knows where. And having to go though getting a new package togther again. I made copies of everything in the one I sent, But they want all the forms and letters with original signatures on them, so I would have to redo all of those again and send then off to Japan for her to sign and fill out some of it. I am soooooooo pissed off.

Anybody know of any contact numbers for the USPS where I can get in contact with someone that can help? This is turning into a real nightmare!

If I have to send out a 2nd one I will be using FedEx next time.   USPS SUCKS!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

 

 

I would go in person to your local post office and ask for the highest person there. I would have them either 1) get the post master involved to find this package ASAP--I would give them a couple of days as they know when and where it was last scanned so start there idiots, or 2) have that person write a letter that states your application in that package was lost by the USPS and include that letter along with the copy you made of the application and explain that that is why there are no original signatures.  You can then deal with any RFE by sending these off to be signed again and deal with the translations, but at least it will not slow up your application.

K-1 Fiance(e) Visa Case Filing and Progress ReportsGot I-797 "notice of action" in mail (we're approved) what is this

Hey me and my boyfriend found out online that we got approved.
a couple days later I received in the mail from the department of homeland security a "notice of action"
it says i-797 notice of action
im just wondering is this the NOA2 or am I waiting for something else to come with some instructions for us?
This thing I got doesn't really have any instructions for us it just says we are approved and stuff.



 

 

One other thing to look for on the NOA2 is the A# that should be above the beneficiary's name in the form of XXX-XXX-XXX.  That is the alien registration number assigned to the intending immigrant.  You will need this for completing the adjustment of status (AOS) after you arrive in the US and get married.  I would scan this in and put it in a safe place.

The visa is issued by the US government to allow the holder entry into the US.  Other countries could care less about the visa issued by the US.  They only care if you have the proper documentation to enter their country.  The K-1 visa is a single entry visa and once used you cannot leave and return to the US without either advance parole (AP) or the green card (GC).  The CBP person you will encounter does not care how you arrived or from where you arrived.  They will just make certain the visa is still valid and that you hand over the unopened brown envelope.  They will process you and enter your information into the system to generate the electronic I-94.  That determines your lawful presence and the time you must get married by.  Once married you file for Adjustment of Status (AOS).  There is no time limit for filing, but there can be issues if you wait too long.

I called USCIS and they told me that I dont need to update my address with USCIS after approval ( Im USC). They told me to contact NVC or DOS to change the new address but I still do not have a case number that assigned by NVC. I need to wait for 30 days that is what USCIS told me.

 

After the petition is approved, it becomes a visa application by the beneficiary at the local Embassy/Consulate.  They will receive the packets from the Embassy/Consulate and must submit the information to the Embassy/Consulate.  Yo can put your new address on any forms your finacee submits.  That is why the signature date is improtant--it is stating that all information is true and correct as of the date you sign the form.  Just have your financee use your new address and you will be fine.  You are now out of the picture (so to speak) until the visa is approved and your fiancee comes to the US.

K-1 Fiance(e) Visa Case Filing and Progress ReportsStill waiting for NOA2 in the mail? Here is what they want from us now.

I received my NOA2 notice by text on July10th.  I have yet to receive my hard copy, but the embassy in Algeria already has our file and we are ready to set up the interview.  I called tier 2 and explained the situation on Monday.  Today I received an e-mail that they are sending out another NOA2 to me and I should have within 2 weeks.   

 

Hope you receive this as the NOA2 has the A# on it and it is one of those required documents that you need to make a copy of for the AOS.  So you are okay right now in that the visa application is proceeding at the Consolute/Embassy, but you need to get a copy of that NOA2 before you can file for AOS.  I hope it does arrive soon.
