I had few Q's regarding the I-129F if anyone can please help out on those :

1. What does Q 8B and Q 9 mean.? What info we need to fill out. Is it required if you acquired your Naturalization in USA ? I am assuming you mean the for the alien fiancee--IF that person has a social security number enter it in line 8 and IF that person has a pervious alien number (A#) enter it in line 9; otherwise put "N/A"
2. What needs to be filled out for Q 16 .? Can someone please clarify what alphabet to fill out if the fiance is in India.? How is his name written in his naitive language. For my wife it was: ???? ????????? If the name uses latin letters then leave it blank
3. What would be considered an perfect reply for Q 18.? Can you please provide me an example for it. A short description on how you met, when, where and the reason behind the meeting.
4. What place to send I-129F form and by which service.? Is USPS Express service recommended or any other.? For USPS use the Dallas lockbox address. For others use the Lewisville, TX address that is mentioned within the intrustions and do not forget to put the ATTN: I-129F as it mentions in the instructions.
5. Passport size for photos. ? 2" x 2"
6. What are the best evidences to show proof of an ongoing relationship.?
7. Finally how you recommend to put all the papers together, ? Do I need to clip it and put in any folder.? Put them in a folder and bind them with something that can be easily removed as they will organize it to suit teh person reviewing the case. Do not leave it loose as items can be lost.

But the photos was not digital.
It was printed but that was also sent back.


How were the photos placed into the file you sent? If they are 5" X 7" and loose then they sent them back because they would not fit in the top two hole file folder they use. Keep the photos and be ready to submit them again but this time tape them to an 8.5" X 11" piece of paper or a some other holding device that gets them to 8.5 " X 11".

K-1 Fiance(e) Visa Process & ProceduresREMITTANCE PROBLEM WITH USCIS - K1 VISA

Does anyone in here had experience with this type of letter coming from USCIS?

I am helping a close friend of mine on petitioning his fiance to be able to come and get married here in the US. We sent 2 set of application, I129F and I212. The I129F is for the fiance petition and the I212 is for the Permission to Reapply for Admission into the United States After Deportation or Removal. She was here and was deported 11 years ago.

I believe they accepted my I129F, but they sent back to us the I212 with this note:



We sent the application together with the check so I dont know if the check is really the problem. It is a cashier's check and under the petitioner's name. Should it be HER name then, the beneficiary?

Two things come to mind 1) Check not payable to U. S. Department of Homeland Security, and 2) wrong amount for both applications. Here is what the USCIS recommends for filing fees:

Fees

  • Checks must be made payable to U.S. Department of Homeland Security. Read the form instructions for additional details.
  • We suggest that you use a separate check or money order for each application in the package and biometric fees. If a single check is submitted for multiple applications and one of the applications must be rejected, then all applications will be rejected. The Lockbox can not accept overpayment and make partial refunds.

So both petitions have been rejected unless you only included the fee for the I-129F. Using a personel check is better as then you can see if the check was cashed or not. When you receive the application back with the cashier's check, you now have to deal with getting your money back.

Well I have sent packages to Chile through USPS and once it stops scanning in the USA that means it has been sent internationally. When I ask why it hasn't been updated or why I have no idea where it is I am told well we cannot track it internationally once it leaves USA they can track it through their postal service. Which means u pay extra to have it tracked and once it leave USA u cannot track it anymore which is ridiculous. When I had my fiance go check they couldn't use that number either. It arrived on time no problem but tracking with USPS is HORRIBLE! Use FedEx they are a million times better and it showed me every where it was scanned and the times. My package arrived on time. I believe it was supposed to take 5-7 business days and it took the full 7 but it arrived. I've sent several things with USPS and it always arrives the only problem is their tracking is horrible. If it is past the 3-5 days ur fiance in USA can claim it as lost or something like that. I had to do that once and it had been sitting in the post office in Chile for like 2 weeks.

I like FedEx for international delivery as you can see it go from place to place until it arrives in customs at the destination. For Kazakhstan that is one big black hole and you only know when the package is delivered. Some times they update the status when it clears customs, some times they do not. It is much more expensive than the USPS international mail, but you do get what you pay for IMHO. Most of the items I have sent arrived in 3 days. The one time it was longer was due to customs and a Kazakh holiday.

Im always getting confused on the taxes cuz I havent filed taxes before. Im still young, been out of the country. But anyho, forget about that and just to answers this just if I was anyone :)

I have a job now that doesnt make the 125% over poverty line. I plan in the next upcoming months to get a job that will make that much. (I can).

So I have two scenarios for you...

What if I get the job that makes enough money, BEFORE taxes are filed. Will that even matter cuz by that time I will probably have only been working that job for a few months?

Or what if I get the job right after taxes are filed? What could I do to prove my income? Cuz by the time my fiance gets to the interview, I will have been working at the job for more than 7 ? 8 months. (When I get that job, is when I will send the I129F paperwork.) What would I, Should I, Could I do for both of these scenarios?

I do realize that I can get a co sponsor but right now thats becoming really hard to get. I think Ill probably have to get one because of my situation,but I just wanted to see if I have other options, and plus i want to show I have more money coming in even if I do have a co sponsor for better luck.

Any info would be very very very greatly appreciated!

First,it is CURRENT income that matters. So having a job now that pays more than the poverty level is okay. You just have to prove that level of pay via a letter from your employer and pay stubs. As for the taxes, as a USC you are required to FILE an income tax return any time your income--that is world wide income--exceeds the levels listed by the IRS. Also, for the instructions for the 1040 form there is a place that lists the condiditons of who must file a tax return. Check it out. If your income was less than that level and you were in fact not REQUIRED to file a tax return then you will need to write a letter explaining why you did not file a tax return. It might be easier to just file a tax return for the last three years that shows you owe no taxes. After doing that get a tax transcipt from the IRS for your last three years to cover the USCIS requirement.

Go here to order your tax trascripts. If you are in a real hurry, you can have them faxed to you and then you can fax them to you fiancee in the PI. I ordered a copy of copies at different times during the process and it took about 5 business days to be received. I would just make certain you have the last three years for the interview. If you have the letter from your employer and recent pay stubs, the tax return becomes less important, but it is still required.

I would look for a route that does not go thru China if it was me. The extra money is worth removing the uncertainities of going thru China. I could go thru Moscow if I wanted, but I only do that if the other flights are canceled and I have no choice--you need a transit visa to go thru Moscow even if you are just stoppng over (things have changed as of 12 Sept. 2012 and I have not really checked on the new requirements). I understand about a 7 hour layover, as Lufthansa has a 7 hour layover in Frankfurt when traveling from Almaty to Denver, but we get to avoid Chicago :yes: . Is there not another route you can choose?

Could somebody tell me how much time I will be able to stay in my home-coutry after my K-1 visa is issued to me? Half a year or 3 months? Do I need to move to the USA in half a year period or in a 3-month period? Thanks a lot for your replies.



Check your visa when you receive it and look for the expiration date. You must enter the US before that date. As others have said, it is typically valid for 6 months--my fiancee's was and she had to wait three months to get everything in order before leaving.

The sponsor must make 125% of the poverty guidelines listed here for their family size. Family size is the sponsor, the beneficiary, and any persons claimed on the sponsor's income tax return as a dependant. Assets for a spouse are taken at 1/3 their fair market value. If the beneficiary is not the spouse than assets are taken at 1/5 their fair market value. Any combination of assets and income can be used to get above the 125% level. If not able, then a co-sponsor is required--some Embassies/Consulates do not accept co-sponsors or have a higher income level if a co-sponser is used. You might want to check your Embassy/Consulate to see what their requirements are.

A# is a number from your green card...


True, but it originates when the USCIS assigns your immigration case a number in their system which becomes your alien registration number. The same A# is written on the K-1 NOA2 just above the beneficiary's name and is then placed on the GC. You will notice that the OP is just filing the K-1 visa petition so they have no A# if the petitioner is a natural born USC or the beneficiary has never been to the US except on touris visas. The issue is that the beneficiary did have a visa to the US before and may have an A# issued. If so, then the OP should include that A# on the petition to speed the process along as USCIS can find the file of the previous visa easier. If no A# was assigned then the OP should put "N/A" in the space (I just realized I said leave it blank and you should never leave anything blank on these forms--if it does not apply it whould be "N/A" or "NONE").

The A# is your Alien Registration number associated with your immigration file with the USCIS. It is NOT the passport number. Do not put the passport number in that field or it will screw things up. The A# is issued when you get an immigration visa to the US. K-1 visa's are also issued an A#. A natural born USC has no A# and leaves it blank. If you are a Naturalized USC then you have an A# and should put it in the blank. Check his old visa to see if he was issued an A# before. If you cannot find it or there is no A# then leave it blank.

Make sure to put YOUR A# on the form and they can find your old immigration file and see what your name looks like in Russian. To my mind the native alphabet is the alphabet used by the country of your citizenship which in this case is the USA.

They only care about the USC's tax returns as it is the USC that must fill out the I-134 and I-864 where income levels are important and the USCIS uses the tax returns as one form of proof of that income.

My fiance is a student and his interview is scheduled for his this month. The school visa is renewed every 6 month. He whet in november to have his visa renewed cuz it expired on 15 . So now they r telling he as to do new approval he has payed all is school fees for one year. His visa expired on 15 of november . The school has his passport. They say they will put a special pass on it but may take two weeeks to get it back. My question is if it not ready b4 his interview can he still do his interview even if he doesnt have a valid visa / or will the special visa pass they wnat to put on there be enough.

Let me see if I understand this situation. Your fiance is currently in the US with a student visa that expired on the 15th of November and is trying to renew it--correct. He has his K-1 interview in his home country coming up--correct? The school has his passport and will put a new visa in his passport--correct?

He needs his passport to travel back to his home country of Malaysia for his interview. Assuming he passes the interview and receives his K-1 visa he can use that to enter the US and then he has 90 days to marry you. Once married you both file for AOS, AP, and EAD. When he receives his AP or GC he can travel, but is stuck in the US until he receives either the Advance Parole (AP) or Green Card (GC). He will be able to work with the Employment Authorization Document (EAD) or GC also. I would get the passport back from the school so he can travel for his interview. The visa from the school is not needed once he has the K-1. He can enter the US on the K-1. Having both visas is not needed. The US Embassy is going to keep his passport until the put the visa in it if approved. So he will have to wait for the K-1 before getting the passport back in order to travel to the US.

Lets say we get married in march 2013. What needs to happen before she can go back and visit her parents for December in Ecuador? Like what does she needs to have done? What would be the last thing she would need? And is there enought time?



File for the GC, AP, and EAD ASAP after the marriage. She can travel on the AP card or the GC. One would hope 9 months would be enough to receive the GC, but there are some people waiting for almost a year. The AP should arrive in about 3 months and she can travel on that.

It is all about the documentation. I can state I have $50,000 worth of "stuff", but I have to PROVE that to the staisfaction of the USCIS or they will not accept it. Just the same as proving your current income is as stated by supplying pay stubs and a letter from your employer. Why is it that these items are asked for? They are accepted as proof that the income you put on the form is true and correct. So how do you do it for assets? Apprasials from a legit source. All this is used to show that the intending immigrate will not become a burden to the US taxpayer. So the USCIS has set a minimun amount of money the petitioner must meet--125% of the poverty level. This can be met with current income from a salary, income from a business, investment income, cash on hand, property--not the main residence, cars--typically not the primary source of transportation, and other assets to make up to the magic 125% level. The USCIS outlines rules for using assets if you choose to do so. You can also get the help of a co-sponsor.

Yes, you need to get a proper valuation from an authority in the area of teh asset that USCIS will accept. Otherwise they will reject the value.

You will need tax trascripts from the last year for your self and the co-sponsor. The co-sponsor may want to provide tax transcripts for the previous two years as well. The co-sponsor needs an employment letter and copies of the most recent pay stubs to back-up the income claim. The co-sponsor must make 125% above the poverty guidelines for his/her household size plus the intending immigrate. The poverty guidelines can be found here. If income is not sufficient, assets that are readily convertable to cash and do not cause an undo hardship if sold can be used. Assets in this case would be valued at 1/5 of their market value--if used by the co-sponsor. If you have enough assets to cover a household size of 2 (you and your fiance(e)) they will be at 1/3 the fair market value. Proof of that market value needs to be included if using assets--i.e. appraiser, blue book value, etc.

Hi VJers! You probably get this question all the time, but here I am once again going through multiple threads and not finding an exact answer so, if any of you guys could help me, I'd much appreciate it.

Yesterday my K1 petition papers were touched, and my fiance (the petitioner) got a message saying i had been assigned an alien number. Now, we planned on spending new years together, so i bought a ticket to be there after christmas for 5 days. I was not sure i could travel, but i read this forum http://www.visajourn...-you-can-visit/ so i've been getting prepared to show ties to my country, i asked for a certificate at work, got my pay stubs, a copy of my work contract, a copy of our NOA1 and some bank statement hoping that would prove that i'm not gonna stay (because i'm aware of the risk of being denied entry)

Now back to the question that originated this post... will the fact that apparently now i have an alien number affect me when i try to enter the US since it of course, doesn't appear in my passport? I have a tourist visa valid till april 21st 2015, been to the US several times and never overstayed.

Bring the strong ties to your home country. You can travel with a pending K-1 visa, however; there are never any guarantees to being allowed entry to the US except for USC. The CBP will ask you questions about why you are coming to the US, when you expect to leave, and they will have access to the pending K-1 application so whatever you do do not lie or fudge the truth at all. Having the K-1 in progress actually can help your case for entry and leaving as you have to be in your county to complete the process. I think you will be fine, but it is always better to prepare for the worst and not have to deal with it than to be surprised.

You fill one out for yourself and one for your finacee. If you are not a USC by birth then you have an alien number from your process of becoming a USC. Your fiancee will be issued an alien registration number when your petion is approved (it is usually above the beneficiary's name).

Yes, they do. At least, at JFK. It is valid for 90 days. Many people mention that on here. I need to know what other POE do that.



Please check the dates of those discussions as JFK back in 2008-2009 time frame did just as you said, but the DHS and the USCIS changed those rules and now the K-1 is work authorized only with proper authorization from the USCIS not the CBP. At the POE you are inspected by the CBP and they look at the visa issued or GC by the USCIS and they determine who gets to re-neter the US, not USCIS. Same for working, the CBP may give you a stamp in your passport, but it is the USCIS that gives you that authorization via the GC or EAD. This whole issue really comers down to the fact that in order to get a SSC you must have a reason and for the K-1 the USCIS states you are an alien eligile to work so SSA will issue you a card--nothing more. It is to say time rather than havng to wait for teh EAD or GC and then applying for teh SSC, you can get the SSC and apply for the GC in parallel. You need both to legally work. Once you get a SSN in the US it is yours for life. The determinating document on work eligibility is theI-9 form the employer must fill out to hire you. Please look at it and see what documents are listed in List A verses those listed as List B. Compare that list to what you currently have and you will have your answer.

Our friend's SO enter the US with Marriage Visa. But the agent at the entry port stamped the expiration date of the visa only 30 days out, not 90. How do we correct this issue?

If they arrived on a K-1 then the I-94 is what is stamped and it should expire within 90 days as that is how long they have to get married. If they arrived on a CR-1/IR-1 there is no I-94 and they should have been given an I-551 temporary green card (GC) stamp that is valid until the actual GC arrives. What this SO is says makes no sense. How did they enter the US as there is no "marriage visa"? The K-1 visa is a non-immigrant visa, hence the I-94, for the purposes of getting married and then immigrating to the US and the IR-1/CR-1 is an immigrant visa, hence no I-94.

So i asked my Human Resource department for a employment letter and they said they cant do that and gave me theworknumber to verify my employment, i did that and was able to print out a page that verify my income but it doesnt show my annual income. i just got hire on november 19 and i need to show to them that i can support my fiance now but how can i do that when the work number website only verify my income for one month?? But i have a job offer letter when they hired me and it shows my annual and pay rate so can i use this to show proof im working since they wont allow to type me a emplyment letter??



You need to tell HR that the US governement REQUIRES a letter on company letter head that lists the following items, name, date of hire, position, annual salary, and whther the position is full-time or not. My employer was agreeable to providing two letters, one for the K-1 visa and one for the I-864 at AOS. It is your job and your information and they should be accomodating since it is the US government that requires this. You just need to be a PITA until you get something from either HR or your supervisor.

I have a few questions for the I-134. My father has offered to be our co-sponsor and makes well above the poverty guidelines for our household size. My mother (who is married to my father) also works but will not be listed as a co-sponsor. They file their taxes jointly.

Here are my questions:

1. Should my father list my mother as partially dependent on the I-134? Again, they both work and they file their taxes jointly.

2. Will there be any problems because they file jointly but only my father is the co-sponsor? No

3. Because my father's income is higher than the poverty guidelines for our household size, does he need to list his bank savings, mortgage, life insurance, etc. on page 2 or can he just list his income? No need to list assets if income is sufficient.

4. If he just lists his income, are the paystubs and W-2s/ tax forms the only supplement documents he will need? I would use tax transcripts from the IRS

I would recommend that your Father get tax transcripts from the IRS. You will also need proof that he is a LPR or USC--Birth certificate, US passport, etc. You will also need your tax return from last year. USCIS expects you to file a tax return every year as a LPR or USC.

On the I-129F, when asked "Where will you and your fiancee live in the USA?" I just placed my permanent address. I may actually move from New York to Philadelphia for about 6 months until I may hopefully be able to bring my fiancee here and move back to NY. Do I have to let this be known to anyone?


Given the processing time for the I-129F you may move 4 or 5 times before your financee arrives. You put down what is current at the time you sign the form and then when she arrives and after you get married you complete the AOS with the current address you are both living at when you file the form. After the AOS is approved, both of you will need to inform the USCIS of any change of addresses via the AR-11 form for your wife and the I-865 for you as the sponsor of the I-864. This needs to be done until she becomes a USC for the AR-11 and satisfies the requirements of the I-864 for you.

The only car and primary residence falls under the undo hardship clause--assets cannot be used if converting them to cash causes an undo hardship on the sponsor. Besides assets are taken at 1/3 their fair market value for a spouse and 1/5 for everyone else. So unless this ring is quite expensive it is not worth paying to have it appraised.

So you need assets of $60,000 to cover no income if sponsoring a spouse.

Hello Visa Journey Members..I would like to know if anyone here has been granted visa(K1) and then fiance did not want him or her to come to the states due to her financial status and then asked the visa to be cancelled? I would like to know and thanks very much for any help.The said Visa will expired on the 18th of June and the Fiancee said she will called the NVC and USCIS so that the visa should be cancelled.Thanks



The different senrios for this situation are:

1) Petitioner requests to the USCIS that the Visa be revoked.
2) Beneficiary does not come to the USA before the expiration date printed on visa. Visa is now invalid
3) Beneficiary comes to the USA, visa is used and no longer valid, receives I-94 and does not marry the petitioner before the I-94 expires and must leave the US.
4) Beneficiary comes to USA before the visa's expiration date, beneficiary and petitioner get married before the I-94 expires. They file for AOS and continue their lives together.

Too bad you went thru all the time and expense for something other than senrio #4 and took the USCIS' time that could have been used for someone elses case.

It would be nice to know where in the process you are. For the petition sent to the USCIS we included the G-325A for both of us, a letter on intent to marry from both of us, a copy of my entire passport and a copy of my BC to prove I am a USC, boarding passes and stamps from the passport to show I visited her, and her visas and boarding passes to show she visited the US within the last two years, a completed I-129F, and a check for the fee made payable to: "US Department of Homeland Security."

What we sent to the Embassy is what they asked for and your Embassy may be different. We sent the DS-156, DS-156K, medical report, another letter of intent from both of us, my last 3 years worth of tax transcripts, the I-134 form. You can sign in black ink it is just that lawyers want you to use blue.

We did two letters of intent so it would be dated closer to the interview date. Original signatures means an actual signature--typically in blue ink--verses a copy. My wife sent her information to me via FedEX and then I sent all required information back to her via FedEx--total cost was $200.00 but that is the price we chose to pay for this process. Signatures are the only things that need to be original, everything else can be a copy and it does not need to be notorized as notorized only tells the person looking at the document that the signature is rue and correct. Very few notoraries do a certified copy anymore meaning they do not attest that the copy is a true and exact copy of the original. Without that statement notorarizing a docment is not worth the price and the USCIS will accept a normal photo copy.

I read that some will sign in blue ink so they can tell its original. Do you recomend to do this? I wonder if anyone has got an RFE because of blue ink?

Have not heard about an RFE for signatures in black ink, however; most attorneys have you sign documents in blue ink because back in the day of black and white copiers it was easier to tell if the document was a copy or the original. Now days with good color laser printers, I dare you to tell the different between a copy and the original.

K-1 Fiance(e) Visa Process & ProceduresProof of Meeting when you can't travel to mexico

Allow me to explain my situation. I am a member of the armed forces and we all know that mexico (particularly Nuevo Laredo) is a hotspot for cartel violence. My fiancé is from Nuevo Laredo and currently holds a B1/B2 tourist visa so she will actually be coming to visit me in the states for the first time. My command will NOT let me travel to mexico to meet her because it is very dangerous down there. There in lies the problem. As primary evidence of our meeting within 2 years, I'm supposed to have airline stubs and a passport stamp indicating i have traveled to her country and meet her. But she does not want me to travel there for reasons i have already stated. What else can i provide as concrete proof that my fiancé and i have met? Would a picture of us with the days newspaper suffice? Could i submit a statement of why i couldn't travel to her country with my I-129F package? Im grasping at straws folks.



NO where does it state the USC must go to their country to meet. You can meet in a country that neither of you are a resident of but are just traveling to. All you have to do is PROVE that you two have meet within the past two years. Use her tourist visa and I-94 when she visits you in the USA. Use HER boarding pass and itinary when she visits you. Take photos of the two of you in front of known national landmarks here in the good old USA. We used my wife's tourist visa, I-94, boarding passes when she came to the US and we also used my visa, boarding passes and photos of use in both countries.

is it okay to have plans before the visa petition interview? Like buying ticket, because it is cheaper if we book ahead of time, right?
will it affect the decision of giving you K1 visa?

For us, I can book the flight tomorrow or 6 months from now and pay very little difference except for the time of year premiums like summer and Xmas. After the visa is in hand you can wait up to 6 months, typically, to enter the US. While your purchasing your tickets, you might want to purchase a lottery ticket too. IMHO both would be a good bet to throw your money away. Either that or spend the money for a completely refundable or reschedulable ticket, thenwhen things go south you are not out the money.

I am very aware of what the instructions say. My mother and brother did this and mailed it and then sent me a message on FB.

I said ummm great but did you write the check out to blah blah and that's when I found out.

If the package was still in their possession I would of course say write it out properly.

So I am stuck with it going to the lockbox as is. So I was hoping someone had maybe also made this mistake and either got it back or it was cashed or something else.

I can guess what will happen like anyone can. I am just wondering if I am panicked about nothing or if I need to send a follow up check with a reference to the first package or wait for a deficient notice or something else.

To further explain the detail. I am in the Philippines for close to a year at this point.

I filled out everything except the check as it must be drawn on a us bank. I sent the package back to the states to my family so they could fill out and affix the check and mail it on to the lockbox.


All you can do is wait and see if the check is cashed or the whole petition is returned, This is one of those "Well I did it this way and...." topics which depends on the person who gets ahold of your petition and what their procedure is. My guess is that they will stamp the back of the check and accept the petition. I have heard that some people who wrote the check out to USCIS had it accepted and some have had it rejected. All you can do is wait. Calling will not give you an answer either.

I am in the Philippines this past year so I filed from here. Had my mother put a check in the packet for me but she mistakenly made the check payable to:

US dept. of homeland security
Instead of
US department of homeland security

I tried calling uscis but its not routing me to a person.

I am wondering if anyone else had done this and it was still cashed or was it returned deficient ?



It very clearly states in the instructions to make check paybale to "U.S. Department of Homeland Security" so I would do as instructed. You may want to re-read the instructions to see if you missed any other little detail that will affect your petition.

Why not stop or go into PR? It is a US territory just like the USVI and has the same risk IMHO.

OP: Given all the time and expense of getting the visa, I would not risk it. Vegas is nice in March as the "oven" has not been turned on just yet. The Grand Canyon is also nice and not too many people this time of year, but it might be a bit cool for you. As others have said there are plenty of places to go on a honeymoon that are in the US. Hawaii is another nice place, but pricey.

As long as the life event--marriage, divorce, birth of a child, adoption, etc--occurs before the end of the year--i.e. December 31,2012--you can claim that event for the entire tax year. Get married on December 31st you can be considered married for the entire year and file your taxes as married filing jointly or married filing seperately. If you have a child born on December 31st you can claim that child as a deduction for the entire year. Same for your child and your marriage.

I see no post stating if they have K-1 visa , did I miss a post? at anyrate my above post clears that up.




First under the profile it states a K-1 visa; second, under the profile it is mentioned that they have rceived their NOA2; and third and most important, very few people from Nigeria get issued a tourist visa and they do not belong to the VWP. So by deduction this person will be travelling on a K-1 visa which will be in the passport, so a RT ticket is not required, but is usually cheaper.

What are the instructions for YOUR Emabssy. Each embassy is different. SInce Strong_always went thru Egypt I would say that is the correct answer. You need to be careful when getting answers during the interview stage as not all Embassies do things the same way, so you really need to go to the Embassy you will be having the interview at and see what they require. For example, in Kazakhstan there is the Consulate in Almaty and the Embassy in Astana and they do things differently and they are in the same country.

Hi All,

My fiance and I submitted our initial K1 petition before the Christmas break. I am the sponsor, UK nationality so going via the US embassy in London. Although we are early in the process we are trying to plan our wedding later in the year (end of August) and had a question about a possible problems that we thought we should check.

1. If we arrange the wedding for August but dont have the Visa in time, can we go ahead with our plans, me fly in, get married in the US and then I would have to leave presumably. Would we need to advise them we had got married during the process and would there be a problem coming into the country without a Visa yet in order to get married whilst still in the process to obtain one.

Not sure if there is any other complications we might not have considered yet, although I am trying to look through the vast quantities of info to cover everything, so any advice welcome.

You must still be able to get married to use a Fiancee visa. IF you get married you would requre a spousal visa and startng all over again. Do not make any wedding plans until the visa is in your hot little hands.
