K-1 Fiance(e) Visa Process & ProceduresSomething seems strange!

So I know its early days but for fun I thought I would look at the other I129Fs in my group by checking the receipt numbers around me on the USCIs website (a trick i learned on here) and it seems like my case is different to every single other I129F received that day at CSC.

Basically my group looks like this -

WACXXXXXXXX14 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX15 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX16 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX17 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX18 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX19 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX20 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX21 (OUR CASE) - The I129F PETITION FOR FIANCE(E) was transferred and is now being processed at a USCIS office.
WACXXXXXXXX22 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX23 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX24 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX25 - On April 22, 2013, we mailed you a notice that we have approved this I129F PETITION
WACXXXXXXXX26 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX27 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX28 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX29 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX30 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX31 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX32 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX33 - On February 7, 2013, your Alien Registration Number was changed ...
WACXXXXXXXX34 - On February 7, 2013, your Alien Registration Number was changed ...

Why has 19 out of 20 cases had their Alien registration numbers changed and ours has not? What does it mean by "was transferred and is being processed at a USCIS office" ?

If anyone can help answer this it would be much appreciated, Im starting to worry and feel rather left out!!

K-1 Fiance(e) Visa Process & ProceduresNOA2 Recieved, no packet?

I'm kinda new to this. My fiance was doing the majority of the footwork and it's time I stepped up and get the rest taken care of.

We received our NOA2 last Friday! But I didn't get back the original documents I submitted yet, so I can't send the packet to my fiance for the K-1.

Is that common?

Whats next?

Congrats! You will not get your documents, they will send it to nvc then to the embassy wer ur fiance is.o

K-1 Fiance(e) Visa Process & ProceduresPlease help! I'm still in INITIAL REVIEW after they touch our paper.

We sent our petition on Sep 26 2012 and got out NOA1 Oct 18 2012.

Today I checked and it says
"On May 2, 2013, your Alien Registration Number was changed relating to your I129F, PETITION FOR FIANCE(E). Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance."

and our paper is still on INITIAL REVIEW.

What does it mean???
They reset our date?? We've been waiting for almost 7 months! Does it mean we are going to wait for another 7 months again?

Dont worry i have the same problem before too but after 2 days i was approved.

K-1 Fiance(e) Visa Process & ProceduresSocial security number K-1 automatic

Dear members,

My fiancé came in 2 weeks ago and I would like to find out some information about obtaining a social security number. When we filed the DS230, we checked the option to receive the social security number automatically and avoid a trip to SSA ( DHL will share the information with SSA). But after researching VJ a little, it seems like that is not going to happen since she came in on a k-1 visa. I would like to apply for her SSA since an I 94 has a limited time, but don't want to create any problems, especially if she already has a number assigned to her and we just haven't received it yet. Please advise if any of you have any experience with this issue. Sould I go visit SSA or just wAit?

Thanks so much

Get thee to the nearest SSA office serving your area from the time period of after two weeks of arrival up to two weeks before the I-94 expires. A K-1 visa holder is "legal alien allowed to work" for the purposes of getting a SSN. I wish you well as this is one of those things that is hit and miss. Your hopes of avoiding a trip to the SSA may turn out to be several trips to the SSA office, but let's hope your local office knows what they are doing. I would recommend you take notes of your visit like time of day, date, and who you speak to. Then if you have problems e-mail the main SSA office with your report and hopefully they can help you. If they look you up in the SAVE database and cannot find you, thank them for their time and leave with your application and try again in a week. If you let them put in a request with DHS you will be on the USCIS' time table. If after the second attempt you still cannot be found in the SAVE database, have teh SSA worker look you up by visa number rather than lastname. If the lastname got screwed up at the POE you may need to make an INFOpass appointment to get it all straightened out.

I hope it goes smoothly for you,

Dave

K-1 Fiance(e) Visa Process & ProceduresWorking ablility

Hello everybody! I had the same question. But now, I wonder what is the benefit of asking for a SSN if anyways the fiancee needs the EAD to get a job? And also, Does he/she need to change the name in the SSN after the marriage?
Thank you!
Sandris.

It's just that the SSN has become a psuedo national ID number. Try getting on your spouse's employer's benefits without it. Try getting a bank account without it. Try filing a tax return without it. Hell, try going into the library in Harrisburg, PA without it (when I refused to give it they were at least civil about me not giving them my SSN, but it amazed me how many people put it down). There are a lot of things having the SSN make easier, and since you are going to need one sooner or later, why not get the process going now rather than later. That way if you have problems getting the SSN you can deal with it now rather than later when you are trying to get it so you can start working. Image you wait unitl the EAD card and get a great job offer a day after the EAD arrives. You run to the local SSA office only to be told they will not give you a SSC without the GC and give you some excuse. You then spend the next several weeks trying to the get SSA to issue you a SSC. In the mean time the job is offered to someone else who has a SSN and work authorization. Too bad for you.

Good luck,

Dave

K-1 Fiance(e) Visa Process & Procedurescan i go visit in this scenario??

i just got my NOA2 approved last week. im thinkking its going to be a minimum 8 more weeks before i have my interview and can move a few days after...
i want to make a short 2 week trip in about 3 weeks time. (im the beneficiary, going to Houston)
should i be ok on my ESTA ? its just a bit of a weird situation because i now have my A number (printed on NOA2)
am i likely to have problems? or will i just be asked a few questions and aslong as i answer truthfully i should be ok ? Everything here is legit, obviously i am going to return to UK so i can have my interview, then pack the bags again and fly out on a one way.
Thanks in advance for all your thoughts

You SHOULD be fine, but we can never know what kind of day the person you will be dealing with at CBP will be having. You might want to take along a bit of extra proof of your ties to the UK as to CYA. (So the A# was on your NOA2. HMMM Would you mind telling me if it is written on your Visa when you get it? I was hit on the nose for mentioning that the A# was only on our NOA2 when it was written on someone's visa in the UK subforum. Thanks)

I wish you good travels and smooth sailing,

Dave

K-1 Fiance(e) Visa Process & ProceduresPOE different from the forms

But my final destination will be LA I will not go to WI because he will be living in LA.
And in the interview? No problems too?

POE is the first place you enter the US and go thru immigration. Not all final destinations have an international airport. Think MT, ND, SD, ID, IA, NE, ETC. They do not care what you do after entering the US as long as you get married within the 90 days. They usually don't ask about the POE at the interview because you have not purchased the ticket yet because they recommend that you do not purchase the ticket until the visa is issued--and you can tell them that at the interview.

Good luck,

Dave

K-1 Fiance(e) Visa Process & ProceduresThis is probably a very silly question, but...

I know this won't make much sense now... but! Make sure you keep NOA2 in a safe place because it won't be needed for the rest of the K1 process, but IT WILL be needed later down the road. USCIS charges about $500 for a copy.

 Plus the alien registration number is typically on the NOA2 right above the beneficiary's name. I scanned in the NOA2 so I can make a copy of it anytime I need to.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresDelay on Leaving for the US

^^^ In Manila, a K-1 fiancé(e) visa is valid for six months from the date of the medical.

:pop:

Well then the OP has a very good idea of when to get to the US as it will be 6 months from when they did the medical. Wonder why Manila is so different from the rest of the Embassies?

OP take your medcal date and add 6 months and see if that is long enough for you to resolve your family problems.

I wish you well,

K-1 Fiance(e) Visa Process & ProceduresDelay on Leaving for the US

This is news to me....so our initial interview was in January of 2012, second interview in March of 2012 and we have been in AP since. Will we hear something before the expiration date of January 2013?? I am sooo confused right now. :help:

Sorry, I'm not sure if I should just start a new post.....

You should make certain you check the expiration date on the visa when you receive it. It is up to the Embassy as to whether you will need another medical in Kenya should the first one expire and you are still in AP. If 12 months has elapsed since the medical, you will need to do a new one in the US when you do the AOS. I am just not sure if you will need a new one in Kenya if it goes beyond 12 months since the first one and you are still in AP :o .

Good luck and may you find yourself out of AP soon,

Dave

K-1 Fiance(e) Visa Process & ProceduresDelay on Leaving for the US

Hello VJers,

I hope you guys can help me with my inquiry. My interview is scheduled this August. If I get lucky and have my visa approved, I was planning to leave as soon as I can so I can be with my fiance. The thing is just recently, I had to deal with a big emergency in the family that requires me to be here in the Philippines maybe up until the end of the year. If I get my visa this August, will it still be good for use even if I leave around January time? Does the visas have like an expiration date that I have to use it before? I know this is another set back for us but its really necessary for me to stay here for awhile until my family issue is fixed. Thanks for your help!

The validity of the visa will be the shorter of the period of 6 months from the date of the interview and visa issuance OR to the one year expiration of the medical. SInce MOST people have the medical done and then the interview the validity of the visa is 6 months from the issue date after the interview. So you could post-pone the interview to give you additional time if your medical is recent. Once you receive the visa it is a good idea to see when it expires so you enter the US before that date. For us the wife had her interview and picked up the visa two days later, the expiration date was 6 months after the interview date when they approved her visa as she did her medical 2 weeks before the interview. So unless you did a very early medical or are placed in a long period of AP, your visa should be good for 6 months after the interview which would mean you could wait until February to enter the US. If you should post-pone the interview and arrive in teh US and then when you do the AOS the medical is more than 1 year ago, you will be required to do another medical with a US Civil Surgeon in the US, but I would not let that determine your course of action now. Do whatever is required to meet the family obligation and then get yourself to the US and deal with the immigration issues as they come up.

Good luck,

Dave

K-1 Fiance(e) Visa Process & Proceduresafter marrying my fiance...can i claim him as my dependent?

If you are married you will have to file married filing jointly. He cannot be your dependent. You will need to get an ITIN number since he doesn't have a social security number. Married filing jointly is beneficial because you will get an additional exemption filing for your husband.

I have never liked the advice of getting an ITIN since your husband is eligible to receive a SSN. The ITIN is for those that have a need to file a US tax return and are not eligible to get a SSN--it does not say that you failed to apply for a SSN or have yet to receive it, but that you are INELIGIBLE for a SSN. You have unitl April 15th of 2013 to file a tax return for 2012. That shoul dbe plenty of time to get married within the 90 days and file for AOS and receive the EAD or even GC before then.

You have a few choices with your husband's income. 1) file a tax return as married filing jointly and have him be declared a prementant resident for tax purposes. You file a letter that both of you sign with your taxes. Then you take his salary in the PI and convert it to US dollars. 2) You can file as married filing jointly and not claim permentant resident status and then the income is not claimed but falls into the foreign income exclusion. 3) you could file as married filing seperately if his income levelis such that this is a valid course.

I would look at the tax consquences of each and file accordingly with the added knowledge that for AOS and ROC the USCIS likes to see jointly filed tax returns. SO there is the tax issues and the immigration issues to look at.

Good Luck,

Dave

K-1 Fiance(e) Visa Process & Proceduresmarrying at exactly90th day

i jst have a question,, when i get there in the US can we marry at exactly 90 days of my stay? on my 90th day we will marry? or like 85th day? coz we have to adjust our status right? would it be alright to marry on 90th or 85 because we want to save money first before we get marry.. is this going to be a problem or no?

Typically the K-1 visa is valid for 6 months. Why not use most of that time to plan the wedding BEFORE entering the US. Then after entering the US get married. Remember that they state that you must get married within 90 days which to my mind is actually the day BEFORE the I-94 expires. I would not wait until the end to find out. If you use 5 months of the visa's valid period and 2 months after arriving in the US, that's 7 months to plan and save for a wedding. The problem is most people on the K-1 rush to enter the US and then they only have 90 days to plan, save, and get married in.

This is one of those drop dead deeadlines that you cannot miss. If you fail to get married within the 90 days after entering the US, you will not be able to AOS and will be forced to leave the US. Period. No discussion. No appeal.

It sounds like from your questions you do not know much about the process. I would take the time to read the guides here on VJ and learn what it is you are getting yourself into and what is involved in the two to five year journey (time frame varies based on beneficiary's country of origin, sex, and level of fraudulant visa applications, your time frame maybe closer to the minimum or the maximum depending on your situation).

Good luck,

Dave

K-1 Fiance(e) Visa Process & ProceduresIs scanned Affidavit of Support acceptable?

Hello Everyone,

I am an April filer, and I have not received my NOA2. I am just trying to prepare for the later stages of this process. With that said, I am wondering if it is necessary to submit the original affidavit of support or if it is acceptable to submit a scanned version. The reason I am asking is because my fiancee is in Nigeria and sending mail to Nigeria is very unreliable, and he might not get the documents. The alternative is to use UPS, which is ridiculously expensive. Is there any information about this on VJ ?

Thanks in advance for your help!

All signatures MUST be original so a scanned copy or a photocopy is not acceptable. Given that the mail is unreliable and you are going thru one of the hardest Embassy's in the world, might I suggest that you hand carry the documents as this is the most reliable method of them arriving, plus it will help show the IO that your relationship is bona fide. We sent all documents via FedEx at about $100 per shipment and about 8 days for them to clear customs in Kazakhstan.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresPOE Processing

Nope. She will be behind security lines. Lots of people go through the POE with very little trouble. The questions for K1 applicants at POE are basic. Name, when are you planning on getting married,etc..... Not a full interrogation, (unless something very weird or odd going on)
It will be nerve racking yes, but your fiance should have no problem....
Edit: Oh yeah, they tell you to make sure to get married before the I-94 expires. Also, make sure you do not lose the I-94, you will need that for filing I-485...Posted Image

I scanned my wife's passport with the visa and then scanned the I-94 front and back so I would have it for AOS. She also had an exit stamp in her passport from her home country that I scanned. I just want to have these items just in case they are lost. The only way to joint her at the POE is to be on the same flight.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresAPPROVED! do i call the NVC? or the consulate in Manila?

they also going to send you a letter telling you about the steps they have done for your petition.
when they received it,the case number and the date your petition left the NVC.

Oh. That is not what happened to us. I called after about 7 days and received the case number over the phone and was told that the file was already at the Consulate in Almaty. The Consulate e-mailed my then fiancee with the packet and all information including the interview date. NVC never sent me anything. They just send it off to the Embassy/Consulate after assigning a case number.

Congrats on your approval and good luck with the next steps,

K-1 Fiance(e) Visa Process & Procedurespassport expiration

My passport expires on 01/24/2017 will that be ok to send in?

Not sure what you are asking, but I sent in COPIES of my passport which expires in 2018 and copies of my wife's passport which expires in 2020. As the other posters have said, you need to send a complete copy of your current passport and copies of anything in an old passport which helps prove your case.

K-1 Fiance(e) Visa Process & ProceduresG-325A Residence and Work History

Hey all, I didn't get any responses last time so let's try this again.

I taught English in Spain for about nine months in 2010. It was through a federal program where they give you a STUDENT visa to come teach rather than a work visa. Your "pay" is actually one government grant that is dispersed in monthly increments. Seeing as there are no taxes paid on this money, it doesn't really count as a job, right? Should I list this in my job history?

Also, as far as listing foreign addresses go, how much do you translate? For "rue" and "calle" do I just put "street"? The name of the school I worked at is prefaced with "Instituto de Educacion Secundaria", do I translate that to "Secondary Education Institute" or leave it? The little things...

Thanks, hope someone out there knows!

Are you going to claim this on your resume in the future? I do not see why you would not want to list this as a job. Since it was a FEDERAL program, I am sure the USCIS can get a record of it. Not having to pay taxes is not a criteria I would use as to whether something is considered a job or not. You performed a service and was compensated, in my mind that is a job. Be thankful you are not dealing with the FAA as what they consider compensation for hire can really make your head spin. I translated all addresses into their English equlivant and used Roman letters for addresses and company name's (not something you have to worry about).

Good luck,

Dave

In my mind I'm imagining some couple dragging a laptop and projector into a consulate and giving a 2 hour slide show of their vacation pictures.

It would beat the person I saw when we did our AOS that had three boxes full of stuff on a hand truck. At least it would be easier to carry those then carting around those three boxes and better organized . I wonder if the IO even looked at any of it. .

K-1 Fiance(e) Visa Process & Procedurespassport

What if your passport (the one with all of your stamps) will be expiring soon (as in a couple months)? Any problem scanning/copying it anyway?

What are you using it for? Proof of meeting? I would still scan it and have a copy and then file for a new one. That way you have the stamps to prove going to that country and then photos or receipts to show you were there and together. If people would think of this process like a court of law and you have to show evidence that you two were together in the last two years how do you do that the number of question here on VJ might go down. First you show you were in the same country. Stamps in passport show you actually travelled to the SO country or they travelled to the US. It still does not prove you actually met. Photos of the two of you together in front of a recognizable land mark. Maybe a receipt or two to show the dates you were in that city. Okay now you have proven beyond a reasonable doubt that they two of you met within the last two years. Next requirement.

The wife came to the US the first two years and then I went to Kazakhstan. I used the airline boarding passes to show she and I were on the airplane, I used her tourist visas and stamps to show she actually arrived in the US and my tourist visa and stamps to show I was in Kazakhstan. Then I inculded photos of each trip with the two of us in front of the White House the first year, at the Grand Canyon the second year and of us in front of the TV Tower in Almaty. Add a couple of receipts to show date and city and we were done.

Good luck on your jounrey,

K-1 Fiance(e) Visa Process & Procedurespassport

I will add to what Jay-Kay posted. (she is absolutely correct btw)
There is another reason to copy all of the pages which isn't in writing. This is to show that you are not trying to; #1-hide anything and #2- that nothing has been manipulated in your passport. There are several super senior members who advocate this. I am of the same opinion.

   I am in this camp as well.

Let's see...front cover, bio page, emergency contact page, 28 pages for visas, a page for endorsements, back cover. If you put two items per page that is about 16 pieces of paper. $0.50 for color copies works out to be $8.00. Express mail to send package to USCIS is what $10-$20. FedEx to remote parts of the world can run hundreds of dollars. And people are concerned about making copies of all the pages in the passport. It is such a simple thing to do. I had stamps all over my passport so it made sense to me to show every page. Up to you, but I decided to copy every page.

K-1 Fiance(e) Visa Process & ProceduresPassport entry stamps as proof of bonafide relationship?

Correct. We have tons of photos together, I can prove that I have sent money through Western Union, my Skype bills, our online conversations... etc. I can prove I have purchased airline tickets to her country and also for her within her country, I can prove we had reservations in both our names at hotels. The problem is that, silly us, we never thought when we were together this past December that we would be getting married... so we didn't save anything like boarding passes, hotel receipts, nothing. Well, we have ONE hotel receipt that proves that I at least was physically there and paid for it. So my plan is to use that, coupled with the reservation in that hotel, coupled with my entry stamps into her country in August 2011 and December 2011 to prove that we have seen each other in the past two years. Will that be good enough?

Proving that there's an ongoing relationship should be far easier.

Have you tried contacting the airline to see if you can get a copy of the itinerary or boarding passes? Sometimes they will send you a copy. How did you book the travel? Find the CC statement and copy the information about the tavel arrangements to her country. Treat this like a court of law and you must PROVE that you met within the last two years because you made airlines reservations--itinerary or board passes would be best; entered her country--passport stamp; met her--photos and those receipts of hotels you have. Connect the dots for them. Fortunately my wife and I need visas to visa the other's country so the visa has our names along with the validity date and the stamps, but I still sent in boarding passes and photos should us together in front of recognizable land marks. If you cannot come up with this information, I would strongly suggest you visit her again and keep all documentation. The having met within two years is one of those they do not bend on at all.

Good luck,

Dave

K-1 Fiance(e) Visa Process & ProceduresCopies or Photocopies

Do I need to provide certified copies of my fiancés birth certificate and divorce decree, or will photocopies do?

Thanks

Please read the instructions for the form as there is a section with the heading COPIES where it explains what is required. It states: "Unless specifically required that an original document be filed with an application or petition, a legible photocopy may be submitted. Original documents submitted when not required may remain part of the record, and will not automatically be returned to you." Notice that it says legible photocopy. They may want to see the original certified copy at some point, but a legible photocopy is all that is requried.

K-1 Fiance(e) Visa Process & ProceduresKeeping passport after K-1 interview

Yes, I'll contact the embassy on Monday morning, I can't do it any earlier now... but I wonder if anybody has been in the same situation before. Thank you :)

How easy is it to reschedule the interview for after your trip? How soon after your trip is an interview spot available? If that is acceptable then I would reschedule for after your trip. If the next interview slot is several months away, then you will have to decide which is more important, the interview or your trip. Have you contacted your Government to see if you could get a temporary travel document that allows you to go on your trip while your passport is with the US Embassy? One thing I would not do is go to the interview with the hopes the US Embassy will return your passport in time for your trip. Explore all possibilities and choose the one that meets your needs.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresIncluding document that says "Private and Confidential"

Thanks Dave. Yes we do have photographs. These are considered secondary evidence due to the ability to manipulate them with Photoshop, etc. But yeah, we have photos together in Dubai in front of the hotel where we stayed, the Dubai Mall, Burjuman Mall, Dubai World Trade Center, out in the desert, on a camel, etc. So do you think that's good enough, then?

Quite true about phots being secondary evidence, but they do confirm the two of you together so if you have documentation that places you in the UAE and your financee in teh UAE at thesame time with the phots you should have enough evidence of meeting.

Good luck,

Dave

K-1 Fiance(e) Visa Process & ProceduresIncluding document that says "Private and Confidential"

Thanks for your reply. You don't think copies of three different United Arab Emirates IDs (work permit, residence visa card, and UAE Identity card) is good enough evidence? One of them has the issue date and expiration date readily apparent on it. The other two show expiration date. I also have a dated copy of her employment contract. As far as receipts, she doesn't have checking account or credit cards, so receipts would not indicate her personally. I will try to get page from her passport, but I know she hates going to the employer as they are always suspicious and not real nice to the employees in general.

No, IMHO it is not enough proof. She could have these documents and not actually be in the UAE. Even if you prove she was there and you were there at the same time, what other evidence do you have that you two actually met? Photos of the two of you together with this information WOULD be enough. You need to prove the two of you are in the same country at the same time. Then prove you are in the same city at the same time. Then the same location at the same time. So you need proof that has name and date and location that matches up. I used a photo of us in front of the White House for our first meeting. Then a photo of us at the Grand Caynon for the second meeting the next year and finally the Almaty TV Tower and a picture of us at Medeo in Kazakhstan as well as the visas with entry stamps. No question that we met in person. You should do the same. Let there be no doubt that the two of you have met in person wihin the last two years. This is one of the main requiremetns for the K-1 and if there is any doubt then you will be asked for more information and if you cannot prodcue that then your petition will be denied. It sounds like you do not have any phots of the two of you together. Even if you get her passport stamps to prove she is in the UAE at the same time as you were, how are you gong to prove the two of you actually met? She has no receipts. Do you have receipts that show any common location the two of you were at during your stay? So far your evidence show the two of you in the same country nothing shows the two of you having actually met. I am looking at this a bit more strictly since she is not a citizen of the UAE and I see a bit of grey when it comes to they two of you having met.

It really does not matter what I think, it is the person looking at your file you have to convience and some are more strict than others.

Good luck,

Dave

K-1 Fiance(e) Visa Process & ProceduresIncluding document that says "Private and Confidential"

As part of proof of having met within last two years, my beneficiary fiancee' gave me a copy of her payslip for the month that I was over in the country she is residing. Her payslip says "Private and Confidential". She works for a private chain of shops in Dubai. Does anyone think that I need to be concerned about this statement when I include my documentary evidence in the petition package - I mean will the US government care that it says that or should I omit such a document?

Thanks!

Photos with both of you i them would show the two of you actually in the same place. Why can't she ask her boss to make a complete copy of every page in HER passport or give it back to her? Having her entry stamps would be much better proof than the paystubs. Does she have any type of receipts that show she paid for items in Dubai while you were in Dubai? If that is all you have to prove the two of you have met in the last two years, I would go back and meet her again and get photos and receipts from the two of you. The meeting within the last two years must be proved or the petition is dead.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresCan anyone help me?

Can anyone help me please? I'm just about to start applying for the K1 Visa and I have no idea where to start. How much is the payment required by the USCIS? I can't seem to find how much the fee is. Also when it comes to the income, since I'm not earning a lot yet because I just started working, can getting a co-sponsor really help? Please help

For the PI the IO can refuse the K-1 visa due to using a co-sponsor or at least that is what I've been reading here on VJ. YMMV. So I would wait until you can afford to be the only sponsor.

Good luck and welcome to the forum,

Dave

K-1 Fiance(e) Visa Process & Proceduresincome requirements

So I wouldn't need a co sponsor cause I have no one

Please have a look at the income requirements here. For a family size of two you need to make more than $18,912. As long as you meet that you will not need a co-sponsor.

Good luck,

K-1 Fiance(e) Visa Process & Proceduresminimal income qualification for k-1

I retired 1 1/2 years ago accepting reduced pension benefits. In getting ready to file a new K-1 visa for my Vietnam Sweetheart, I just realized the minimal $24,000 per year stipulation. My pension is onlyabout $22,000 gross, but I have 6 figure 401k assets, as well as free and clear owned land property worth about 100k. Will I still qualify with the $22,000 liquid income considering my assets?...or will getting another employment be necessary?

Thanking any comments in advance. Ronn

The requirements are here. Based on what you are saying is that your household size is 3. You can use assets as long as they are 1) readily convertable to cash, 2) do not place an undue hardship on you if you were to sell them (i.e. primary residence, the only family car), 3) must be 3X the shortfall if sponsoring a spouse otherwise it is 5X. So your assests will need to be about $10,000 to cover the $2-3K you are short. A six figure 401K should be enough, but I would make sure you have the short fall in cash or easily convertable into cash.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresIts been over 2 years

Hi, I want to file a k1 visa. I live in the US and the last time i've seen my fiance has been june 2010, which is 2 years and 3 months ago. I know that it is required for it to be within the last 2 years and im now starting to worry as i should have filed it earlier. Would I still be able to file a petition? Does it matter? Has anyone been in a similar situation? Should i hire a lawyer? any help would be appreciated for some peace of mind thanks

People's petitions have been refused because the USCIS received it 2 years and 2 days after the last visit. It MUST BE WITHIN the last 2 years. This is not flexible. It is the #1 requirement of the petition that you have meet your fiance WITHIN the last two years of the filing of the petition. You will need to meet again before filing. To file in your current situation would be a waste of time and money as the petition will be refused and they will keep the filing fee. Save all the money you want to spend on a lawyer and filing the petition and go visit your fiance again. I would think you would want to visit him again anyways.

K-1 Fiance(e) Visa Process & ProceduresIs it necessary to set a wedding date?
This must be one of those Embassy/Consulate or even IO specific as during my wife's interview the question about the wedding never came up. Maybe our IO was smart enough to realize that we are applying for a fiancee visa and we both signed letters of intent that we would marry within the 90 day period.

About planning the wedding. You typically have 6 months to enter the US after receiving the K-1 visa and then 90 days to get married. That is a period of almost 9 months. Once the visa is in hand you can begin the planning and find a nice place and then have the fiancee come to the US so the timing works out. It took my wife three months to get things in order in her home country before leaving for the US.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresI-129F - describe how you met (Question-18)
No such thing as over kill. put "see attached" then on the paper put "I-129F question 18" at the top of the page. I used a couple of paragraphs to describe why I was visiting Kazakhstan, how we met and then how we are where we currently are as there was a 3 year span between meeting and corresponding via e-mail and then meeting again. I put as much detail as I could to show two people meeting, then "talking" to each other regularly via e-mail, meeting a couple more times and deciding to get married encluding the proposal. In our case we met four times before filing--2003, 2008, 2009, and 2010. I would paint a picture of two people who happened to meet and fall in love and decided to spent the rest of their lives together. Be specific, to the point, and try to keep it under a page--think of it as a resume as you want this person to feel that these two people belong together. It may not be a requirement for approval of the petition, but this file follows you throughout the process and someone reading it will see a truely ligitamate relationship and the rest of the process goes smoothly--at least that is what I believe and so far it has for us.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresAffidavit of Support I-134

On question 11, how long do I put that I will support my fiancee for? I'm putting that I will be providing room and board and health insurance. Should I put anything else? Thank you.

We did not check either box and put in the blank space below:

N/A (K1 filing with intended Permanent Residency).

K-1 Fiance(e) Visa Process & ProceduresExtending visit

Thanks for the quick and positive reply. It's only my second trip to the US, do you think they're likely to grant me less than the 90 days?

No, you should get the full 90 days. My MIL received 90 days on her first visit. I just want you to be aware that they sometimes MAY reduce the time, but that is usually for people who have visited several times within the past few months and it looks like they are not just visiting the US.

Since you have a K-1 pending, it may come up and that may cause them to reduce the allotted time. Just bring proof of ties to your country and do not lie. Do not offer any information, but always answer truthfully.

Good luck,

K-1 Fiance(e) Visa Process & ProceduresExtending visit

Hi guys,

Would be grateful for any advice you can give. I plan to visit my USC fiancé in mid November for 2 weeks however due to changes with my job I may be able to stay longer but still within the 90 days permitted under the vwp. If I changed my return date once I was there would this be likely to cause any problems with our pending K1? Thanks in advance for any help you can offer.

It will not cause any problems. Of course you are assuming that the CBP person will grant you the full 90 days. They may decide to grant you only 4 weeks or some other amount of time. Just make certain you leave before the date they enter and you will be good to go.

Have a nice trip,

Dave

K-1 Fiance(e) Visa Process & ProceduresImp Q's regarding I129F form

I had few Q's regarding the I-129F if anyone can please help out on those :

1. What does Q 8B and Q 9 mean.? What info we need to fill out. Is it required if you acquired your Naturalization in USA ? I am assuming you mean the for the alien fiancee--IF that person has a social security number enter it in line 8 and IF that person has a pervious alien number (A#) enter it in line 9; otherwise put "N/A"
2. What needs to be filled out for Q 16 .? Can someone please clarify what alphabet to fill out if the fiance is in India.? How is his name written in his naitive language. For my wife it was: ???? ????????? If the name uses latin letters then leave it blank
3. What would be considered an perfect reply for Q 18.? Can you please provide me an example for it. A short description on how you met, when, where and the reason behind the meeting.
4. What place to send I-129F form and by which service.? Is USPS Express service recommended or any other.? For USPS use the Dallas lockbox address. For others use the Lewisville, TX address that is mentioned within the intrustions and do not forget to put the ATTN: I-129F as it mentions in the instructions.
5. Passport size for photos. ? 2" x 2"
6. What are the best evidences to show proof of an ongoing relationship.?
7. Finally how you recommend to put all the papers together, ? Do I need to clip it and put in any folder.? Put them in a folder and bind them with something that can be easily removed as they will organize it to suit teh person reviewing the case. Do not leave it loose as items can be lost.

I would greatly appreciate your kind reply.

Good luck,
