We started talking on the internet in July 2012 and because of her work and school she said she wasn’t looking for a relationship.

October 2012 randomly met in Colombia and we had an amazing weekend.

November 2012 I came back to Colombia to see her again.

We decided to get married.

January 2013, I-129F sent to Texas.

February 2013, another trip to Colombia to be with her.

Going back to Colombia in April 2013

And Possible a couple more trips between April and our interview.

My question is.... can I go ahead and file for a fiance visa now while his annulment is still in process? I heard that I can file and have his annulment lawyer's certification included with my fiance visa petition paperwork?

I suggest not because i know annullment in the philippines takes a long time. Just in the safer side to wait for the decision before filing.

I researched it if my fiance will filed for lost / stolen passport in saudi arabia, they need to have a police report that there passport is stolen/lost. And also it will not work bcause they know the company has it so they will call and confirm. But one thing my fiance said, his company is very linient in terms of family so i might call his boss for his passport. Gudluck!

I emailed US embassy in saudi arabia if they have any advise on how my fiance can borrow his passport from his company, they only said just be sure to have the passport during the interview. No help at all.

I know during naturalization, there's an option to change your name, which is a nice option for those who want to change to an American first name. But wouldn't it be simpler to change it from the beginning? That way my fiance wouldn't have to change his name on all his documents (like SSN, bank accounts, marriage certificate, passport, driver's license) later.

I've read that he might be able to during the k1 visa interview or the POE but can't find much details on the process.

I haven't filed my k1 petition yet. I wanted to see how would be the simplest way to change his first name. I think a court order name change in his country before filing the k1 seems a bit of hassle (petition, hearing, publication, etc), so I'd like to avoid that. If there's an option to change it some time during the K1 process, I'd really appreciate if someone could point me to how. Thanks.

I dont think you can do that. When i was naturalized i change my first name. After i got the court order i went thru all the process from banks to SSN.

Hey all! My fiance and I just got out NOA 2 and are trying to obtain a police record from Canada. We are having difficulty doing this in a timely fashion. My fiance has determined that in order to get the police record from Canada he will have to make a trip up there. It seems that Chileans need to apply for a visitor's visa to enter Canada which could take up to 2 months. Now here's where things get complicated...

My fiance has dual citizenship with Italy. He obtained that through his brother who lives in the EU. My fiance has never lived in Italy nor does he have an Italian passport at the moment He was thinking about applying for the Italian passport because with that he won't need to apply for a Canadian visitors visa. He can just go to Canada, get the police record and come back to Santiago. My question is would obtaining the Italian passport mess up our K1 application (or even our AOS for that matter)? I never mentioned it on the I-129F and was told it wasn't necessary since my fiance didn't even have an Italian passport. So if he were to get it now, I don't want that to mess things up somehow.

If he never lived in Italy the he doesnt need police clearance. They need police clearance where you lived 6 months or more but since he didnt lived there he doesnt need one.

Regarding police clearance, you fiance doesnt need to travel to canada to get this clearance. Did he consider going to the canadian embassy instead? My fiance lives and work in saudi arabia now and a philippine citizen but we need police clearance so he did go to the philippine embassy and he was able to get one without going back home. I hope this helps.

I'm new to this website (which has been so much help btw) and I apologize if I post this in the wrong section as well!

My fiance and I are waiting on our 2nd NOA and he just had a quick question about the type of work he would be able to do once he is here in the US and has his AOS/EAD. He wanted to know if he had to do a specialist job like with the H1b visa, basically something an American couldn't do. Or can he work anywhere, in an office for example? I've read here that certain government or federal jobs he would be unable to do?

He can work whereever he wants after he gets his employment card. But he cant work in any govt positions because u need to be a us citizen to work in any govt positions

Hello All,

My fiancee and I are for reasons of the economy, not eligible to complete the I-134 or I-864A forms to prove financial support. We are looking for any possible alternative. I became aware of "INA: ACT 213 - ADMISSION OF CERTAIN ALIENS ON GIVING BOND." It reads,

"Sec. 213. [8 U.S.C. 1183] An alien inadmissible under paragraph (4) of section 212(a) may, if otherwise admissible, be admitted in the discretion of the Attorney General (subject to the affidavit of support requirement and attribution of sponsor's income and resources under section 213A) 1/ upon the giving of a suitable and proper bond or undertaking approved by the Attorney General, in such amount and containing such conditions as he may prescribe, to the United States, and to all States, territories, counties, towns, municipalities, and districts thereof holding the United States and all States, territories, counties, towns, municipalities, and districts thereof harmless against such alien becoming a public charge. Such bond or undertaking shall terminate upon the permanent departur e from the United States, the naturalization, or the death of such alien, and any sums or other security held to secure performance thereof, except to the extent forfeited for violation of the terms thereof, shall be returned to the person by whom furnished, or to his legal representatives. Suit may be brought thereon in the name and by the proper law officers of the United States for the use of the United States, or of any State, territory, district, county, town, or municipality in which such alien becomes a public charge, irrespective of whether a demand for payment of public expenses has been made."

Does this mean that we could post a bond with the Attorney General that would serve as our proof of financial support and ensure that we are not a burden to the state? If anyone knows or has experience in this regard, please do let us know. We are open to any other suggestion as well!

Not to be an alarmist, but if US Government budget sequestration is not resolved, as I understand it there is a chance that Federal Government employees may be furloughed 20% or more between now and the end of September. If that happens, USCIS employees may be reduced to only working four days a week. US Customs and Border Protection sent out furlough notices to its employees already. If USCIS is the same, that could mean a delay in processing by 20% or more due to the furloughs. I'm writing to my Congress persons to fix this and keep USCIS fully employed. I hope I'm wrong about this!

It really doesnt matter with furlough or not. At the pace they are now 1 day will matter... I know they are slow and but hate the fact that we cant do anything about it except to wait.. :(

My fiance has her interview at the Manila embassy on the 11th of April, we have everything ready except for the tax transcript for the affidavit of support. I am having problems getting them. I first went on the IRS site to get them and the site states that they are not available, I tried to call and got the same response. They were filed around the 30th of January so the transcript should be available. Does anyone know what other alternatives there may be.

Dear fellow Visa Journey,

I hope you can have me an idea if this going to trouble me or not.
My mother in law to be, who will be the co sponsor to my fiance is having trouble paying her credit card. And she has just got her working hours reduced. I know how difficult it is for her to pay her bills. My fiancee in the other hand, has just begun to work at McDonald's. So of course he can't help that much.
What I would like to know is, will it be a trouble for me if she files for bankruptcy? The first plan is to wait for me until I get there and apply for AoS and then she would file for bankruptcy if she can't have more hours on her job. But now it seems that she needs to do it soon..
And I am still waiting for my NOA2 which taking forever.. it's almost 8 months since we got our NOA1 and CSC taking it slow is not helping..
What should I do? What should she do? Is there anything to know so that I can ease my mind a bit? Is it allowed to have aunt and uncle to join the co-sponsor?

No, but I have a pending job with Dept of Homeland Security. They said that while the sequester is still going on, I'll be put in to the I think they said, "Ready pool" o "Job pool"? I just sent my fiance I-129F last week, and on April 3, 2013 we will hit our two year mark that we haven't seen each other. I can't visit him in the Philippines because of the fact that I am working a part time job, and if I leave, I will lose my job. I can't risk losing my job, because we have a kid together that I'm taking care of and providing to. I am the only one providing for our child because he doesn't have a job and is just graduating from college (& yes we're young, we're both only 19 y/o).

I know I should've asked this before I sent the petition in, but WILL THE PETITION GET DENIED because of the fact that we haven't seen each other? I didn't know what else to put on the I-129F Supplement, because I really can't leave my job and I'm barely making enough money for a month, I haven't even gotten passports yet, but I sent in my old ticket and receipt from when I flew back here, since I used to live in the Philippines. I also forgot to attach the form for Electronic Notification, but they have received my packet, so how long will it take til I get back the receipt or the NOA1?

Hi, sorry for some repeat questions. I know I've read some of these questions/answers here before, but couldn't find them again and I'm having trouble remembering the right answer to the following questions.

1. I'm asking on behalf of the beneficiary in my case, can the beneficiary schedule an appointment for the required pre embassy interview medical before we receive our NOA2 ? I seem to remember a mixed consensus on whether or not this was advisable.

2. Also, besides the medical, filled out paperwork and documentation such as passport, criminal record etc. what else can the beneficiary do to prepare for the embassy interview ? I'm especially wondering about things that can potentially take days/weeks to complete (such as a doctors appointment for the medical).



We are trying to make this process as efficient as possible and would like to anticipate next steps based on other petitioners experiences with the process. Hoping to eliminate any potential delay that can occur due to us. Thanks everyone, this site has been most helpful.


1. I dont think you can schedule for medical and interview before ur noa2. My fiance is in KSA and based on US embassy in KSA we have to wait for the actual NOA2 before medical and interview.

2. You also need ur affidavit of support, pay stubs, letter of employment, tax returns, pictures, ds 230, police clearances etc....

Ok so I have been waiting since december and I have done everything by the book up until now. I received the NOA1 on december 13th and I made a exact copy of the packet to send to my fiancee, I am going to visit her this week and I was planning on taking the packet to her but now with the current state of affairs at CSC should I make another copy? I have not received a RFE of any type and I was wondering if I am beyond that point now or should I have another copy of everything just in case?

It doesnt hurt to make another copies. Am also a december filer and they are still processing july/august so ur not beyond the RFE.! At the pace they are processing right now we still have 3-4 months more to wait.

The visa beneficiary should plan on applying for Advance Parole ASAP after marrying the USC petitioner, in conjunction with their AOS filing, then international travel is available. The real prize is the 2-year conditional GC, :thumbs:

Nope, wrong.

She can always leave the US at any time.......it's being able to return is where is gets sticky, maybe.

Once you are married, she must AOS and obtain either the AP or the GC (you apply for all at the same time, no charge) since either allows her to re-enter the US. Without one of these she could not re-enter and then you both would have to wait for about a year after you file for a CR-1 spousal visa.

The AP is about 3 months after filing and the GC is about 5.

To maintain her GC permanent residency, she must remain in the US, I believe, for at least 6 months of each year. So once she gets the GC, she can travel whenever she wants but just has to return and stay here to meet that minimum.

No am not wrong! When i filed my greencard couple yrs ago my atty told me i cant go home when my father died. But i did go home after i got my green card 5 months after applying greencard.

No! After u get married and file for AOS then u get approved in 6 months or so she will get her greencard. At that time she can go back to canada and visit her family.

My Fiance currently holds a 20-year old Indian passport (1997-2017). Since US Government has stated "The US government has announced that any citizen travelling to the US needs to hold a passport which has a maximum tenure of 10 years."

Why has 19 out of 20 cases had their Alien registration numbers changed and ours has not? What does it mean by "was transferred and is being processed at a USCIS office" ?
