Why?!  The old paper I-94 form had less information that was hand written.  As long as the information on that form is correct, I would say that that is the new look for the I-94.

Do we need it? The instructions say only if you are self employed, which I am not. Aren't they interested in current income, not last years income?

 

They want to see consistancy which the tax transcripts will show along with your current income proof.  You will need the tax transcripts, the last three years worth, for AOS and ROC so it is best to have them on hand.  Most people follow the instruction for the I-864 form when completing the I-134 as it does state that the Embassy/Consulate can use those requirements.

 

We had three years worth of tax returns (transcripts), about three months worth of pay stubs, a letter from my bank, and a letter from my employer.  We had not problems with the aConsulate in Almaty.  Where will your interview be Astana or Almaty?

There are some blanks that I have left and I need to fill it , "NONE" or "N/A"...

Is it okay if my fiance' filled it in by hand for me?

 

On any government form that an original signature is required white out should never be used.  Strike out the incorrect information so it is still readable and write in the correct information and I would initial it.  Otherwise how does the person looking at the form know who or when the correction was made.  IMHO I would just redo the whole form and get it right so you do not have to worry if the peson looking at your case will want a new form or not.

Depends on the Consulate/Embassy as to what they require.  If you read the instructions for the I-134 there is a statement that the Embassy/COnsulate may follow the guidelines for the I-864 which IS required for when you file for AOS (Adjustment of status).  There is also the debate that for teh I0134 you may only need to meet 100% of the poverty guidelines, but for the I-864 you MUST meet 125%.

 

The wisdom here on VJ is to complete the I-134 as if it were the I-864 as you will need to file the I-864 soon after getting married.  So it is recommended that you include the employment letter, letter from your bank, tax transcripts from the last 3 years, and a few pay stubs to show current income.  Make copies so you can resend this information when comleting the I-864.  Note that the instructions for the I-134 is for only the first two items unless self-employed.  Tax transcripts are free from teh IRS and you will need them for the I-864 so why not include them and pay stubs are easy to copy so again why not include them.

 

You only are required to submit a letter from your employer and a letter from your bank per the instructions.  The purpose of the I-134 is to show that the intending immigrant will not become a public charge.  But as I said before, each Consulte/Embassy is different and the PI is one of the more strict on income issues and evidence.

Gross income must be 125% of $17,850 for a family of two in HI or $22,312.50.  You can make up the difference with 3X  the value in assets if a spouse is the beneficiary--otherwise it is 5X. The asset must be readily converted to cash and not cause a hardship if sold--i.e. the only car and the only home are usually excluded as usable assets.

K-1 Fiance(e) Visa Process & ProceduresCan I enter the US on ESTA with a K1 in my passport?

You can travel to the states with a K-1 visa in your passport and ASK to be allowed in on the ESTA instead of the K-1. The POE officer will make the decision whether to let you do that or not.

 

What you want is risky though, because if they chose K-1, your 90 day clock to marry will start ticking. And remember, K1 visa is a One-time entry visa.

 

But what if they cancel the ESTA eligibility of this person and only the K-1 visa is valid.  I am sure if you have two visas active you could pick, but I bet they will cancel the ESTA once the K-1 is issued.  Also, you will have to be very aware of which visa they use at the POE and what if they say you have to use the K-1 and not the ESTA.  Rememebr that your fate is in the hands of the CBP person you encounter when entering the US.  Use the K-1 or go back home might be your options.  I would use the K-1, get married and file the AOS with AP and it should be in your hands before travelling in February.  That is the safest IMHO.

It just sounds weird to me that she was not given any paper, that does not happen - for all refusal they would give a paper indicating why the visa was refused.

Also other thing that sounds weird to me is, if she knew she was going for fiancee visa why would she be talking about work visa outside the consulte with other ppl?

 

 

That is because Google translate does a very poor job of translating Russian to English or English to Russian for that matter.  So the OP took what his fiancee typed into Skype and pasted into Google translate is my take on this.

 

OP: Your finacee was denied the visa for a reason she is not telling you and you need to talk to her about the interview process.  It maybe something she didn't do right or it might be because she cannot speak English very well or some other reason she is embarrased to tell you.  IMHO, if you want this relationship to succeed, you need to careflly and slowly explore why the visa was denied.  Once you have that infomation you can see if you can overcome that and try again.  I would recommend that if you try again, you get married and go for the spousal visa (I-130).  I could be as simple as she got scared and did not show up to the interview.  I would look here before I would jump to the "she scammed me" train of thought, but then I tend to give people a couple benefits of the doubt. 

 

Explore why the visa was denied with her and see if this can be fixed.

K-1 Fiance(e) Visa Process & ProceduresOriginal signature needed or copy is fine?

Hey guys just have a question my fiancee and I are ready to send the papers to USCIS. My fiancee completed G325A and also her letter of intent along with her signature on it. I was able to print both pages today. My question is does her signature need to be original or a copy of it is ok? The reason I ask is that if we need originals it will take 2-3 weeks from Ukraine with he live signature on it.

Original signatures are required.  You can spend more money and use FedEx or DHL and have it in a couple of days (3-5 actually as it depends on how long it sits in customs), but it is pricey.  We spent $100 each way for sending the interview papers to each other.  One thing you will soon realize is that this process is both money intensive and time consuming.  You still have the medical exam fees to pay, the visa interview fee to pay, and the adjustment of status fee to pay (at $1070).

Okay, thanks for these replies, they make complete sense and were as I thought.

 

I ask your patience while I ask another question....

If I come over there on my tourist visa in January and we petition for the fiance visa once I get there, do I have to return to South Africa in order to complete my visa and do the interview? Or can that part of the process be done here?

Obviously it would depend on how long it takes for the petition to go through as I cannot stay for longer than a 6 month stretch on my tourist visa.

You will have to return before the tourist visa expires.  The K-1 visa is issued at the beneficiary's country of residence after an interview at the Embassy/Consulate.  At least you can spend the first six months or so with your fiancee.

I have met and am going to be marrying a wonderful American lady. I have, however, not completed the process of divorce of my past relationship. I am thus in the process of divorce, which should be finalized in the next 7 weeks (first week in December). Is it possible for my fiance to petition for a K-1 visa before I have received my divorce papers, or will these be needed? I understand that the petition for the visa takes about 6 months, which is quite a while, so I wanted to know if we could start the process now as I my ex-wife and I have already signed the settlement agreement and it is just a matter of it walking through the court process and waiting for our court date to get the papers.

 

Also, I wanted to know if there would be any problem with me traveling over on my tourist visa (I have a new 10 year visa) for the months before the K-1 visa is issued.

 

Any revelations of this would be greatly appreciated.

 

You must be free to marry which means not only the divorce is finalized, but any other laws that restrict getting married again must be met--i.e. a 6 month waiting period like the state of Texas has.  So you must follow the laws associated with where you get divorced which I would assume would be South Africa.  You submit an intent to marry statement with the I-129F which says that you are free to marry and will marry your fiancee within 90 days of arriving in the US.  If you are not free to marry than you just lied and signed your name to it--very bad i the eyes of the USCIS.

I have read many recommendations to keep this response short and sweet and that the size of the space provided is indicative of the response they expect to receive. However I'm assuming the burden or proof is stronger regarding Ghana, so I'm frontloading with an attached narrative of our relationship explaining how we met online, the name of the website where we met, our shared interests, how we've evolved into falling in love and when I proposed.

 

I personally would rather keep it simple and write just two or three sentences and just say see attached chats, emails, phone logs, etc. but I have a feeling Ghana is expecting more.  What is the consensus regarding stating the details of how we met online and putting an emotional response into this letter when dealing with a difficult consulate? Could this be causing more harm than good? 

 

 

For the form I would keep it short and simple as the K-1 petition is approved or denied here in the US and they may not care which country the beneficiary is from.  You can include that statement with the package say before all your proof of bona fide relationship you will be sending and that will be reviewed by the person at your Embassy/Consulate.  Just rememebr that this is a two stage process.  The first stage is the petition approval that says you are a USC and are eligible to petition for a finacee visa for the beneficiary.  So this stage is more about you the USC.  The second part is the actual visa to come to the US.  This is where you need to overcome the idea of visa fraud.  This is where you need to show that the relationship is legit and not for the purposes of obtaining a visa to come to the US and get a GC.

 

I would still keep it short and to the point on the form and include the long explaination with all the phone records, e-mails, and chat logs as those will be forwarded to the Embassy/Consulate (hopefully) without even being looked at.

K-1 Fiance(e) Visa Process & ProceduresWhat kind of binder/packet do I need to buy to mail out my I-129F

I'm assembling all of my material to present with the K-1 petition and plan on going to Kinko's tomorrow and buying a nice binder/folder to separate all the categories and make the petition look very organized and easy to go through.  I read they take the thing apart and put it back together and sometimes items get lost so I want to make it as easy as possible for them to read through my petition.  Anybody have any suggestions?

 

For each stage I have used one very large clip to hold it all together with the check on top and very easy to read.  Then the cover letter and all the supporting documents just like I was filing my tax return.  Do not waste your time or money on fancy binders as it will be used by some USCIS' child for a book report.  Spend more time and effort making sure the information is correct, all documents are there, all documents needing signatures have them and the date signed.  Organize it so it looks professional and that you care, but do not make their job harder by putting it into a binder or by using staples.

I know ,to travel outside the country she needs a travel document, but what about inside the country ?

IF she has a government issued ID you can use that--I.E. DL, Learner's permit, EAD and GC of course once you receive them. Or you can use the passport. I would taske the I-94 out and 1)make a copy of it and 2) keep it in a safe place. TSA only checks that the ID name and the boarding pass name match. They are not there to enforce immigration law as that is not their jusidiction. That falls to a CBP employee. My wife travelled with me to several locations using her passport before the GC arrived. No problems at all. My MIL travelled with us to NYC using her passport with no problems.

The reason for Darnell's questions is it helps us to better give you advice.

 

Question #1:

 

Where is your fiance currently living?  (US, Italy, Mars, Moon, England, Egypt, Moscow, etc)

 

Question #2:

 

What passport does he hold?  (Italian or EU, Nigeria, Morroco, Canada, Mexico, German, Russian, Romanian, etc)

 

Question #3:

 

What is the airspeed velocity of an unladen swallow? (The correct answer from "Monty Python's the Search for the Holy Grail" is: "IS that an Africian swallow or European swallow.")

 

Based on the answers to the above questions, we can tell you whether you need a K-1.  Just realize that a K-1 will take a long time to process.  Your best course might be to have him come to the US, get married in SF, and have him return to Italy and you join him there.  If and when you want to return to the US with him, you file for a spousal visa using the I-130 form or if Italy has DCF (Direct Consular Filing) you can file for your spouse that way.

Hi all,

 

I'm sending off my k-1 petition today (hopefully!!!) and I just noticed a line saying to prove my U.S. citizenship, as the petitioner, I need to send a copy of my birth certificate front and back, or a copy of all pages in my U.S. passport. I'm a bit unsure of this as my birth certificate only has a front page, and I only photocopied all pages in my passport that had information on then, aka not the blank pages. I don't want to get an RFE if neither of these are complete. Any tips?!

This is an OR requirement.  You send in a copy of the BC front and back (mine had bleed through from the front to the back so you knew it was a copy of the front and back) OR you send in a complete copy of your passport--that includes all the blank pages. FYI the pages in your passport are numbered so they will know if any are missing and less than the number in the standard passport.  You get to choose which one to send it.

my fiancee ( petitioner) had her changed couple of months ago. her new name was the one we use for all our process except for her passport which is still on her former name. we have the proof of legal name changed documents. do you think its going to be an issue on the embassy? our interview will be next month.


another issue i found out just today is, while i was re reading for 100th time our noa2 i found out that they mispelled my petitioners name. they lack one letter. her name is ysabelle. but they spelled it as ysablle, minus the E. do you think its going to be an issuea as well? im starting to get paranoid here lol.




 

For the K-1 visa the petitioner (USC) has to prove they are a USC, that they want to marry the beneficairy, that they are free to marry the beneficiary, and that they and the beneficiary have met in the last tow years.  That's it for the USC petitoner.  Once the petition is approved by the USCIS, it moves to the National Visa Center (NVC) and is assigned a case number based on the Embassy/Consulate where the beneficiary is a resident.  Now is where the differences come in as each Embassy/Consulate does things based on their experience and the country they are in.  Your petitioner will need to provide an affadvait of support to show that she can keep you off of means tested benefits while you are in the US.  You might mention the error of her name at that time as you show them the support documents from her.  The name that is the most important is yours as it will be used to gain entry to the US, so it must match the name in your passport.  I am assuming that she will take your name upon marriage, so she should wait until after teh marriage to change her name in her US passport and at the SSA and all the other legal documents.

 

WIll her name change be a problem?  Not as long as she can show that she is still the same person which it sounds like you can.  WIll her misspelled name be a problem?  Again, no as the visa will bein your name. You should try to get this corrected at the interview or  during the AOS phase.

K-1 Fiance(e) Visa Process & ProceduresExtension of K-1 visa

The visa is typically valid for 6 months after it is issued. There are cases where it is tied to the medical and then it expires 6 months after the medical--that appears to be the case more times than not in the PI which is most likely due to TB.  So you would want to get an interview for some time in teh January/February timeframe.  The approved petition can be extended by the Embassy, but I have not heard about the K-1 visa being extended.  You can drag your feet and give them the information they request by late November early December and get an interview by maybe January with the holidays and all.  Just make certain that when the visa is issued that you check the expiration date as that is the date the beneficiary must enter the US by or the visa is not valid. 

 

You just got teh NOA2.  Now the packet must go to London which will take 2-4 weeks and then you submit your information.  You can delay this a few weeks.  We are now in the late December or early January timeframe.  Interview will be scheduled, but I am not sure how fast London is.  I think you actually have a good chance of getting the visa in February which should be good until August.

K-1 Fiance(e) Visa Process & ProceduresI-94 Question!!?

Hi everyone,

 

I'm sort of panicking a bit... I've just looked up some information that I need for drivers license and for AOS etc... and the I-94 is something that appears everywhere, but it doesn't look like I have one? When I came through POE, I handed over my sealed envelope, gave my fingerprints, handed in my customs form, have the photo taken with the webcam-looking thing, and then the officer stamped my passport and wrote in it. The whole process took around 5 minutes...

 

Should I have received an I-94? Does my stamped passport with the VISA inside count as the same thing? As far as I can tell, the I-94 is to state admittance with an expiry date, and that is evident on the stamp in my passport.

 

Any help would be appreciated!

I have my I-94 in my front right now, it is the small paper from the plane that u need to fill up before you go through the immigration.. they attached that to your passport nxt to your visa..

 

The I-94 went electronic around the first of June anybody entering the US after that date does not receive an I-94 nor do the flight attendants run up and down the aisles going "USC or visitor", "USC or visitor", "USC or visitor" and hand out the I-94 to all visitors.  All they do now is handout the customs declaration form which every family must complete.  Follow the link posted by Nich-Nick to get a copy of your I-94.

K-1 Fiance(e) Visa Process & ProceduresBoarding Passes

My boyfriend is coming to visit me next week and we haven't submitted the I-129F yet so I told him to hold on to his original boarding pass for this trip.  Will that, in addition to the passport stamps and itineraries for previous trips during this past year, be enough primary evidence of having met within the 2 year? I threw out all our previous boarding passes, not thinking I would ever need them.  

 

If not, is there any way to get old boarding passes?  Can I request a copy from the airline? Or is that overkill since we'll already have one.

Overkill depends on the Consulate you will be going thru.  For the petition to be approved, you only need to meet once during the past two years before submitting the petition.  For the visa to be approved, you may need to show a very strong relationship and more than one visit would defiantly help.  You can go to the airlines and ask for a copy of old boarding passes.  Some will only let you get the last year.  It might not be a bad idea to show more than one trip to visit.  We had three in the last two years and included evidence of all three visits.  If you still have the itineraries, you could use them along with the passport stamp.

Hello everyone, 

 

First time poster. I've been lurking on this site for a while now. 

Basically, I'm applying for a K-1 visa using my current citizenship. 

At the same time, I'm in the middle of naturalizing in my country of residence. 

 

Time-wise, I will have to get the K-1 visa under my old citizenship, get the passport for my new citizenship, 

and at some point after, renounce my old citizenship (requirement for naturalization). 

 

I assume I can't get renounce my old citizenship before I enter the US on the K-1. (or can I? help!)

 

So can I renounce right after I enter the US, and send in my AOS with the new citizenship, despite the K-1 visa being in my old passport? 

 

 

 

Welcome to the forums.  All this naturalization from one country to another is confusing to me. Why are you doing all of this?   All the K-1 visa does is allow you to enter the US and get married to a USC and then file for adjustment of status (AOS) to become a lawful perment resident (LPR).  The only issue your citizenship would have would be on the location of the interview for the K-1 visa and how much scrunity you receive in being issued a K-1 visa.

 

The important part of your question is that once you enter the US on the K-1 visa it is no longer valid so it does not matter which passport it is in.  The document you care about after entry to the US is the I-94.  I would make a copy of the old passport bio page and the K-1 visa page just to have it.  Once in the US your citizenship does not matter except for which country you need to apply for a passport from in order to travel internationally.  You do not need a passport at all if you plan to remain in the US and never travel internationally until you become a USC and then apply for a US passport.

K-1 Fiance(e) Visa Process & ProceduresI-134 Question: Enough income this year but no tax returns yet

Hello all,

 

My fiancee will have her interview on Jan 23. The embassy requests documents (including 1-134 affidavit of support) to be mailed no later than 15 days prior to interview. But I don't believe I will have my 1040 form ready by that time. 

 

Here the evidence that I can have by then, could you please let me know if you think that would be enough?

  1. 2012 Tax Returns (1040): I did not work during 2012 since I was focusing on graduate school. I did file for taxes because I had to withdraw my 401k for a medical emergency and because I had some income from a casual job at school. The total income was $10,500 and the adjusted gross income was $6,406. Only $324 were from salary.
  2. 2011 Tax Returns (1040): I had a full-time permanent job during that year and I made well over the poverty line.
  3. Possibly 2013 W2 Form: I currently have full-time job that pays well over poverty line.
  4. Letter from Employer: I have had my job since September 2013 but it is a full-time permanent job.
  5. Pay-stubs for the last 3 months

Do you think that would be enough? I'm really trying to avoid having a co-sponsor as much as possible.

 

Also there is some chance that I can get 2013 tax returns by the interview time (but not 15 days before that) - unless IRS delays the filling time this year. Do you think it is a good idea to send 2011/2012 tax returns before the interview and then have my fiancee present 2013 tax returns during the interview?

Due to the government shutdown, the IRS is not accepting income tax returns until, I think I heard, January 28, 2014.  You just need the employment letter, bank statements, and paystubs to show current income is sufficient to meet the 125% of the poverty level.  Actually, if you read the instructions for the I-134, there is no place where it says you are required to include income tax returns.  Most do because they will be needed in order to file the I-864 for adjustment of status (AOS).  I would go to the IRS website and order a tax return transcript as it is a complete tax return and also very hard to fake.  Too many people get an RFE for a form 1040 because they forgot the W-2 or a schedule or something else the USCIS is looking for to consider it a COMPLETE tax return.  Plus you will have the 2013 tax transcript by the time you file for AOS.

So I went looking through existing threads and found this,

I believe it was posted around April of this year, by the very helpful Nich-Nick

I was wondering if this is all the same, or have things gone up or down in price, or any additional fees?  Is this like...EVERYTHING we will be required to pay to USCIS/London embassy themselves? (I know it's not including passport photo fees and travel etc)  I just don't want to be surprised with a fee I didn't expect at the embassy and not have enough money with me to pay it, or something xD

 

Also am I correct in thinking that work authorization and advance parole actually DO have a fee, but if you apply for them with AOS, the fee is waived?

 

We've already done/been approved for I-129f, so minus the $340 for us, and I also need to get myself a long certificate (as mines one of the short ones) which is another £10. tongue.png woo

 

Depending on your medical history and vaccination history, you may have to pay a civil surgeon in the US to complete the I-693 for the AOS and those fees vary.  Also do not forget about the ROC fees of $590 and any costs in sending original signature documents back and forth--that was $200 for us.

K-1 Fiance(e) Visa Process & ProceduresWhat if I didn't get employer letter for I-134

I work at a bank as full time employee and at a store as part time . I mentioned both jobs in I-134 form for fiance . I have got employer letter from my bank but couldn't get from my other job . Is it necessary to get letters from both jobs or one is enough.

 

If the job a the bank has sufficient income to meet the poverty requirements of the I-134 then you do not need a letter from the other job.  If, however, you need to include that income to meet the poverty requirements then you need to get one from the other employer.  If you look at the instructions for the I-134 under supporting evidence it clearly states under "B" that you need a letter from your current employer.  I guess I do not understand why the store cannot give you such a letter--it is not that hard to write a person's name, position, job title and salary on company letterhead.

Another option which I took is, once you arrive, rather than cancel the ticket - postpone to a much later date - up to a year away. That way you can always use for a trip home. I travel back to the UK several times a year since I arrived. 

 

 

 

 

I thought of that but you will always have an unused leg unless you go back home and stay permanently.  I did book the return leg for 89 days after my then fiancée arrived as a just incase things did not work out.  I cancelled the return leg and have kept the confirmation number of that cancellation even thought I doubt I need it now, but I will keep it until my wife gets her citizenship.

I am so sorry, I cannot find to what topic I should post this,

I would like to know how much money I can bring in to the US,

Can i bring all my savings over there? and if i declare it, would i be taxed?

I was planning to bring more than 20,000$ if they will allow it, 

The thing is i don't like asking for money, and not used to that,

as I believe I won't be able to work until after a permit has been given,

and I doubt I will be able to find the job that I like right away..

Will this be enough for a year?  I am so uncomfortable without savings,

and I don't think 10,000 will fit.. 

 

 

 

As others have said the limit before having to declare it is $10,000.  I would highly suggest you either wire the money to a US bank account--your fiancee's for example or get it in a certified check you can use to open a new account in the US.  Do not carry that much cash with you as it might easily be separated from you and then you are out all that money.

Hello all,

 

Since it's my first post, I'd like to say that this site is god-send. I would have never been able to do this K-1 business without this community. I've been poring over posts and it's all been really helpful. So, thank you.

 

With that said, I would just like someone to review the documentary proof I have. Here's the deal, my fiancee and I met in Japan in May 2011 while I was there working as an English teacher. She got a J1 work visa and she moved to California January 2012, and I soon followed ? quit my job, left Japan in February 2012. We moved in to an apartment July 2012 and lived there until her visa expired June 20, 2013.

 

So here goes:

 

Proof of having met in the past 2 years:

- 5 color photos between the dates July 2011 - May 2013

- page from my passport stamped with arrival and departure in Japan, and my Japanese work visa

- page from foreign fiancee's passport stamped with arrival in the US, and her US J1 visa

- a copy our lease agreement with both our names as tenants

- copies of a year's worth of monthly rent receipts with both of our names on them

- a copy of our car insurance declarations page with both our names on it

- text messages from 3/2012 through 6/2013

- 2 hand-written letters from foreign fiancee (these are good-bye letters from when she left Japan for America, then again when she left America for Japan)

 

Proof of ongoing relationship:

- Printout of email flight confirmation showing future visit to Japan in September 2013

- Copy of engagement ring receipt

- text messages sent since her departure on 6/30/2013

 

So what do you think? Hopefully this is enough. Anyone have any thoughts about any of the items I plan to submit?

Oh, and I am wondering, when can I get my SSN? I just arrived here a week ago. But we were thinking to apply for it after we get married so I can use his surname and no need for me to file for a name change.



Go and get the SSN NOW!!! If they cannot verify your immigration status in the SAVE database have them look you up by A#. If still not finding you, ask for a supervisor. If they are totally brain dead LEAVE. DO NOT let them do a verify with the USCIS as that will take weeks and your I-94 may expire before that happens and then you have to wait for your EAD card or GC in order to get the SSN. After you leave, write an e-mail to the main SSA office on their website listing the SSA office you visited, the date, time and whom you spoke to and what they told you. You should get an e-mail to take back to the local SSA office to educate them on the procedures for issuing a K-1 a SSN.

After you get married, see if you can get certified copies of the Marriage Cerrtificate that day or the next to include with the package. Some states have a certralized processing system that can take weeks before the Marriage Certificate is available. If you cannot get a certified copy then I would see if you can get an ordinary photocopy to send in and while the AOS is being processed get several certified copies and should the USCIS want one you can send it in when they ask for it. That way you are not waiting for the copies and then submitting to the USCIS--one way to shorten the processing time a bit.

My fiance did recieve her "stamp" from CFO.
From what I have read here and other VJ post on the subject I don't think this is a problem. The error is in the "annotation" section of the visa which I have learned is just for notation. Other people have had similar errors in that section and they had no problems at POE.


HER name is correct and it is SHE that will be traveling. How are they going to know if your name is Paul or George or Ringo as you will not be with her and it is just the name of the petitioner. Only you, her, and the USCIS know what the corect name of the petitioner is. She may be ask about who her fiance is at the POE and she can say your first name and if pressed give the last name and if pressed for the middle give it with the fact that some nimrod at the Embassy misspelled it. This is such a non-issue. Now go pour yourself an adult beverage and relax while you wait for your fiancee to travel to you.:thumbs:

What surprised me was the fact the interviewer didn't tell me what I need to do. She just kicked me out and said I have 90 days to do something, what I don't know, I sent the consulate an email. I hope to have answers.


During this process it is up to YOU to understand what needs to be done. YOU are asking the government for this consideration so it is up to YOU to prove you qualify for this benefit. The IO saw that you and your finacee did not follow the instructons. It is not their job to help you. That becomes very clear if you have ever had the "pleasure" of calling the USCIS--we don't call it the misinformation line for nothing. It apprears you have read the guides and now understand what needs to be done. The clock is ticking.

K-1 Fiance(e) Visa Process & ProceduresFilling out forms in my fiance's native alphabet... (Danish)

I am finishing up my I-29 petition for my Danish fiance and am just wondering whether I should be using his native alphabet when recording his name on the G-325A and the I-29F forms or to sub it for roman characters. His last name includes the Danish letter ø (Mønster). Additionally, there are city names for his residence in the last five years (question from the G-325a) that include foreign characters as well (Hårup and Hjortshøj). But please note his current address uses only roman characters.

When he has to write his last name in roman characters he subs the ø for oe (Moenster). If we cannot use the ø, should we just be spelling it Monster instead of adding that extra e? Not entirely sure why he does it that way, I suppose for pronunciation purposes.

Has anyone else ran into the same problems? Any advice you may have is greatly appreciated! :luv:


Use Roman letters for name and address. There is a place to put the name and address as written in the native language and that is the only place I used cyrillic.

im totally confused about one entry to US topic , from philippines to US . my future bride is at cfo now awaiting her and her daughter sticker . i ask fianceevisa people can she land in guam or hawaii with no problem boarding her next flight to mainland US .
they say i'm making abig deal out of this , just buy her and daughter ONE-WAY ticket , thats all . i am not going to be with them for the journey here to US

First congrats on getting this far. Second, you can buy a RT ticket or a one-way ticket depending on which is cheaper. The one entry into the US is that the K-1 visa allows for a single entry and then it is no longer valid. You then have 90 days to get married or the beneficiary must leave the US. Once married you will need to file for adjustment of status (AOS) and usually you also file for advance parole (AP) and employment authorization (EAD). Unitl your spouse has her GC or the AP, she cannot re-enter the US if she leaves. Finally, her point of entry (POE) is the first place she is processed as having enter the US. Once that happens she must remain in the US until the GC or EAD is obtained. As far as connecting flights, you need to make certain that as a PI citizen she does not require a transit visa to go thru any counties on route to the US. Guam and HI are the US so as long as she continues on to the mainland she will be fine.

Hi all,

I'm a US citizen working on the K1 application for my Norwegian fiancee and I have a question about the G-325A Biographic Information form:

One part of the form asks me to list "Applicant's last address outside the United States of more than 1 year." I lived in Guam from 1997-2000 and the Philippines from 1987-1988. Is my last address outside the US Guam or the Philippines? I know Guam is a territory of the US, but I don't want to screw this up!

Answers, anyone?

I would put the PI as the last address outside the US. I would also start in 1988-89 when you moved back to the US and list where you have lived up to present time, especially if it all fits in the space. IF you moved a lot then start with the present address and go backwards until you hit the 5 year mark. If you still have lines available I would put those addresses on as well. If you really want full disclosure then put all addresses until you get to the PI that way they see the PI and Guam. Just add a paper with the title of the form, your name, and the format of the additional information asked for. Since it was so long ago I would not worry about it too much.

Another thing I need help clarifying. I currently renting an apartment with a roommate. My lease will end in July and I will be looking for a new apartment for just me and my fiancee. So I'm not sure what to put for where it ask where will my fiancee be living when she gets here. Do I need to wait to finish the forms until I get a new apartment that I know I will be at when she gets here? Can I temporarily use my parents address and then correct it later after filing?



You put the information on the form that is true and correct when you sign the form. If you want to use your parent's address then you can do that. The bigger issue is being able to receive notices from the USCIS as they do not forward most items they mail to you. Here is an example for you to consider: you decide to put your parent's adress on the form and for some reason at the end of May they decide to move to another state. Did you know that was going to happen? No. Will it matter? No. Just make certain if you still have not received the final NOA2 that you have access to the mail until you do. The USCIS will have the most current address when you file for AOS later in the pocess and also remember that once she becomes a LPR to inform the USCIS when she moves using the AR-11 and when you and any co-sponsors for the I-864 move using the I-865 form.

I know it is a bit late now, but I was able to use a smaller font for long addresses, so it was readable and complete. It does help that I have a copy of Adobe Acrobat Pro :) .

Hi, all. I'm about to start the application process for a K-1 visa and am currently a bit nervous about my capacity to provide proof of the ongoing relationship. I've been living with my fiance in the UK for the past 2 years so I at least have a tenancy agreement with both our names on it, but a) he's a bit camera-shy so there aren't a lot of pictures of us and b) we don't exactly email or MSN message each other a lot seeing as we live in the same house. (The recent MSN logs I do have are rather... personal in nature, so heavy editing might have to be involved if I did send them.) Could I call on someone to sign an official statement? Should I just postpone sending off my I-129F till I've built up a backlog of documentation? Any help would be appreciated.



For the I-129F the only requirements you need to meet are 1) you are a USC--proof with US passport or US birth certificate, 2) the two of you have meet within the 2 years before filing the petiton, 3) both of you are free to marry, 4) both of you intend to get married to each other within the 90 days of the beneficiary's arrival in the US. Period. Now for the interview at the Consulate/Embassy they will want to see that the relationship is bona fide. Since you are going thru the UK, that proof does not need to be volumes and volumes. We had a few , maybe 10 photos, of us together, phone logs and e-mails. Compared to what I have read others have submitted, we had very little of the ongong relationship evidence--this is where I think quality out weighs quanity. You are living together which is better than most K-1s where the USC is in the US and the beneficairy is in their country. Those that have been thru the process from the UK can tell you better on how the interview is and what they are looking for.

K-1 Fiance(e) Visa Process & ProceduresI-134 Help: Bank can't provide deposit information on account verification letter

Hi folks, I wonder if anyone else has dealt with this problem.

The instructions in our Packet-3 from the Hong Kong Consulate clearly said they want form I-134 to be submitted. Instructions for I-134 ask for:

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:


1. Date account opened;
2. Total amount deposited for the past year; and
3. Present balance.


I called the bank and their account verification letter doesn't have deposit information, and suggested that I send statements. Further they said that this letter is fairly standard and deposit information is not normally requested. Does anyone know if this is necessary? And if I have to send statements do they need to be notarized? And if entire statements are required it will be between 100-144 pages that I don't know if I really need to send!!! Ugh!


Take the letter from the Consulate to the bank to show them what is being asked of you. If they refuse to give you such a letter I would suggest you mention that your money will be leaving with you and going to a bank that believes in customer service. It is amazing how that threat will get you to the top dog at that branch or even a phone call to the local headquarters to resovle this issue so you keep your money at their bank. If you have to carry out the threat then you print out your statements for tthe last year showing the deposited amount and submit a letter as to why you had to do this and get the new bank to also write a letter about the account being opened etc. You must remind the bank that YOU are the customer and if YOU want a letter with this information it is up to them to provide it to you--they may charge you, but that is just a small amount compared to al the other fees and expenses of this process.
