Removing Conditions on Residency General DiscussionDivorce within 4 months after getting 10 year GC

This posting is for my friend who got his permanent GC this June 2013 and he is in the situation where his wife (Citizen) wants the divorce asap now.

He said that she called the USCIS that the marriage is fraud, but from what I have seen they were living as a couple and I have not seen any issues in their 3.5 years of marriage. They went to cruises, visited places, hang around with me with no issues. They were on the same lease, joint bank accounts, joint phone bills, joint 401(k), joint everything. 

 

Now,  Is he going to be in trouble after getting divorce? I feel sorry for him, but I don't know what to say or state?

 

 

The only affect on him is that he will have to wait at least 5 years instead of 3 years before he can file for citizenship.  She needs proof that now she feels the marriage was a fraud given that she just completed the ROC with him and stated that the marriage was entered into good faith.  In fact, the USCIS could go after her, no likely, for perjury as she did sign the I-751 form stating all information was true and correct and now she is saying that it wasn't.

 

Have him get out of there ASAP and get on with his life,

Removing Conditions on Residency General DiscussionMy experience - Traveling IntL with Expired GC/Extention letter

I was able to get in the plane with no problems at all. I was flying with AA and the employee who gave me my ticket seemed to know about the extension letter. So no issues at all.

 

The immigration officer was a different story. I was able to get into the US and I did not go thru secondary inspection. However he did tell me that my green card was expired and look at my letter with a weird face. Then asked ?why would you travel with an expired GC?? then I told him it was for work. Then he asked me what I did for work abroad. I answered him and he asked for more details. He would interrupt me every time I was answering his questions and he had an ugly/angry face the whole time.

 

I guess that was my experience. I was able to come back and did not go thru secondary inspections. I just had a rude Immigration officer. 

 

You missed a great oportunity to get a dig into the USCIS.  When asked, "Why are you travelling on an expired GC?"  My response would have been, "Well, if the USCIS would get their Sh!t together and approve my application in a timely manor I would not HAVE to travel on an expired GC."

 

Glad it all worked out in the end for you.  I am also glad my wife's GC has already arrived and we do not have to have this experience.  Maybe he just needed his cup of coffee. mellow.png

My husband and I are supposed to do the ROC conditions next year (07/2014). Well last year, I was diagnosed with a illness similar to leukemia. While I was working we did make the income requirement. However, since being fired due to my illness; now my doctors are suggesting that I take disability to help out with the income.

 

Will this affect us for when we do the ROC next year? We just want to know all of our options. While, it is good for us in certain aspects, we are not sure how it will effect us concerning the immigration ROC. Any suggestions and advice will help.

Income proof ends with the AOS.  For ROC it is about the co-mingling of your two lives into one.  Joint bank accounts, credit cards, and financial statements. Joint tax returns and a common address are what is typically used to show that the marriage is bona fide and was not entered into to circumvent immigration laws.

Removing Conditions on Residency General DiscussionAdress change before filing I-751

Hello everyone,

 

As I am getting ready to put together the package for Removal of Conditions, I have come across the following issue:

We just bought a house. We have not moved in yet, but we want to start changing addresses.

I came here on K-1 fiancee and then did AOS and I'm now a LPR. For that to happen, my husband, the US citizen, filed Form I-864, Affidavit of Support. Ever since November 2011 we have not had any other pending cases or approved petitions.

My 90 days window begins around August 11 to file the I-751.

I was just on the USCIS website trying to change the address online thinking that the USC doesn't need to report that.

But I found out that apparently he has to file I-865, Sponsor's Notice of Change of Address, within 30 days he is legally required to notify them.

 

Now, can I still change the address online for myself? And then, my 2nd question: Can we send the I-865 form for his address change in the same package as the I-751? Or does it have to be separately mailed? I am sorry if this has been discussed before. I am trying to catch up with everyone, but it's been a while. blush.png

The beneficiary completes the AR-11 on-line and I would print out the confirmation page so you have a record of changing your address.  The USC competes the I-865 form and mails it in.  I would change the address before mailing in your ROC application.  Also make certain the dates on previous residences match up.  We bought our house in April, but did not move in until August.  I used the date that we spent the night in the house as the date we moved, but I could have used any date from April to August.

Hello All.

 

I'm preparing to send my documents and application (I-751). However I'm becomming actious and nervous and have a few questions. I thought I was well prepared but as I read other threads I'm beginning to notice I may be missing some key stuff.

 

1) My wife received her 2 year green card October 20 2011 however we did have joint checking, savings and credit cards until mid 2012. I dis enroll her in my health insurance back in july 2011.

 

2) The meat of our documention started mid 2012. But again I do have dental and medical bills etc.dating before October 2011.

 

3) I also made her the beneficiary to my life insurance, but never applied for life insurance for her. Is it too late to do this now? Is it necessary? I wanted to make sure she was covered if something happened to me but never thought about the reverse.

 

4) The apartment is in my name. However she and my step son are included as residents, We are in the process of buying a house. in fact we close August 15. I am going to include my spouse on the title. The loan is in my name.

 

5) Purchased a new car July of 2012.She is on the paperwork and an owner.

 

6) my wife is a nail tech and we have documentation of her apprentership program and practical license exam. She have her license soon.

 

7) Her mother came to visit last year for the summer. We have docmunation of trips we took together.

 

What are our thoughts? Do you see any red flags?

My wife was added as a beneficiary on my health insurance and life insurance right after we married.  We got a joint bank account and CC about 3-4 months after she received her GC.  We filed joint taxes and she was on my investments as joint tentancy.  I also sent in a copy of her learner's permit to show the same address.  I did send in about our several trips together and her Mother visiting the US and our trip to NY together.  I sent in the bank statements and fiancial statements to cover every quarter from when she was added to when we cashed them in or to the filing of the petition.  She was never on any utility bills nor was she on any lease or the title of the house.  We were approved with no interview.  You do what you can to show that you are combining your lives. Are you listed as an emergency contact for your step-son?  That would be a good indication that you are combining the two familes.

 

I do not see a 6 month gap in her GC and starting to combine things as a big red flag as it takes time and effort to do these things and there are other life events happening all the time.  Others may say that you should have done this right away--maybe, but like us, you waited a few months before doing so.  I could have opened a joint checking and CC account many months before I did as we had her SSN about 3 weeks after she arrived and we were married.

Hi, everyone . It's been a month after my i751 interview . Today I received a mail from USCIS said : This is in reference to your pending application with US Citizenship and Immigration Services. The record shows the biometrics are needed. You are instructed to report any application support center listed below to complete a new set of fingerprints on 8/5/2013.
I have a question , why do they ask me to do the biometrics again ?

How long has it been since the first BIO was done?  It might be that it is beyond what the USCIS considers the validity period for the first set.

thank you very much for your kind wishes. I'll do my best to explain what happened. My fear is that wouldn't the explanation  make it look like i'm trying to cover something up? (which i swear i'm not)

 

some ppl suggested i just present what i have and don't say anything until i have to. (ie, after getting RFE) 

 

I'm just stressed out and didn't know what the best approach is in my situation.....

 

 

Your choice as to what to do with the explaination--give it at the beginning or wait for the RFE and give it then.  IMHO, you should be up front in the beginning.  Send in what you have and an explaination as to the difficulties with the marriage and that the two of you have decided to continue with the marriage rather than getting a divorce.  A divorce does not mean you cannot get approved for ROC.  To get approved for ROC you have to prove that the marriage was entered into in good faith by two people and not for the benefit of the immigrant to obtain a GC.  Given that both parties come from different cultures, problems should be expected.

Removing Conditions on Residency General DiscussionSending copy of foreign passport with I-751?

If your wife has no international travel plans for the next year or so and wants to become a USC, she can let her passport expire and apply for a US passport after becoming a USC.  The only thing her passport does now is allow her to exit the US and enter another country.  She is not required to have a valid passport to live in the US as a LPR or even as a USC.  If she renews her passport it will only be valid until she becomes a USC (assuming she wants to get citizenship).  The earliest she can apply for USC is in one year being married to a USC.  So you can tell her to relax and she does not need a valid passport unless she decided to do some international travelling.

 

About your proof.  Is she listed as the beneficiary on your employer's benefits and are you listed on her employer's benfits is she is employed?  Joint taxes and financial statements are the #1 and #2 items you need.  Beneficiary of any retirement accounts, wills, power of attorney, medical power of attorney, listed as emergency contact on any children are other things that can show co-mingling of your lives.

Removing Conditions on Residency General DiscussionTime to file for ROC - I have some worries/sleepless nights

It's time for me to file for the Removals of Conditions. We are still a happily married couple and our marriage is totally real. K1 and AOS were no problems at all. We have known each other for nearly 28 years and started dating 5 years ago. No RFEs or any other problems.

Well, nevertheless I have some worries now. First of all, my husband bought a house long before we got married and, of course, it's not paid off yet. Due to the burst of the real estate bubble the value of the house dropped CONSIDERABLY, it's totally upside down. This is the reason why we did not put my name on the title. We will try to shortsell the house next year. So that's the one thing. The other thing is that we did not file our taxes jointly. My husband has been on a Chapter 13 bancruptcy since 2009. He's got one more year to go. It seemed to me that it was better to file separately in order to protect my own savings. Whenever I tried to get advice from a lawyer or accountant the could not give me a definite answer. I have not had a job since I came here.

Now I'm worried that these two facts will not look good and could possibly result in denial. We do have a joint bank account. I have another bank account only in my name. Of course, I kick in with my money when the going gets rough. I mostly got cash from the ATM but I also wrote out a few checks and gave them to my husband. Unfortunately I don't have copies. However, we have account statements showing the money deducted from my account and added to our joint account a few days later. I also paid for some stuff in the house with my money, like a new stove etc.. Do you think this counts as financial mingling? Does anybody here have experience with not filing taxes jointly. 

Another question I have is how did you do your supporting letters of friends. Did you have regular letters or sworn in affidavits? I have a huge problem with asking favors of people. And I hate bothering anybody with having to go to a notary. Is it good enough just to write a letter and have it properly signed? Has anybody experience with that?

 

Is there anybody here who had a similar situation?

 

They mention that the Affadavitts are to be sworn statements, so I would think they need to be done by some legal type that can add that this person was sworn in and all that.  Do you have any trips you have taken together?  Do not worry about the house as my wife was not on the Deed--though you can be added to the Deed even if you are not on the mortgage, but some lenders frown on this.  It sounds to me like you have a valid reason for not filing taxes jointly.  As long as you filed as married and you show you are living together.  Do you have a pay upon death with the other spouse listed as the payee on the single owned accounts?  Are you listed on his employer's benefits as the beneficiary?  Are you listed as the primary emergency contact?  I would write a nice cover letter stating all of this and listing what you do have and that the marriage was entered into for two people to build their lives together and not to circumvent immigration law.

Removing Conditions on Residency General DiscussionDMV denied state ID

 

This worries me...  Right now my husband and I live in Oregon and he has a Oregon Driver's License...  Although we will be moving to California in September, we are in the middle of ROC and I don't think his ROC will be approved by the time we move.  Now I'm worried the DMV will not issue him a California license until he receives his 10 year green card.

 

I hate reading all these stories of having a hard time with jobs, getting a driver's license or state ID issued and/or traveling using the extension letter.  It clearly says the green card is extended for a year and that you can work and travel, yet I read so many stories like this on Visa Journey.

 

My husband is in Finland right now visiting friends and family.  I hope the airlines don't give him a hard time when he flies back home.  He has the original extension letter with him and his expired green card, so I know he has everything he needs to come home.

 

The real problem is that most people have become sheepeople and accept what the Governement employee says as fact.  You know what the facts are; you know you are right; you just have to be firm, polite, and expect them to do their job and know their own procedures.  It happens all the time. For example, yesterday my wife applied for a Banana Republic Visa and was approved (not like Macy's) and given a temporary 10% discount good at all the Gap brand stores.  The new cashier at the Gap told us it was only valid at Banana Republic, but at least she checked with a supervisor who know it was valid.  The problem is that most governement employees get promoted and still do not know their own policies or rules.  Then they make up BS on the spot and 95% of the people believe them.  I have learned from my Mother that you keep going up the chain until you find someone that can actually do their job or have a vey good explaination as to why they will not.  It is unfortunately true for companies as well.

 

I hope your husband has a smooth trip and no problems getting on the airplane.  Maybe he should just say to the person looking at the GC and the extension letter and ask them very politely, but seriously, "Are you unable to read and understand the English language?  It clearly states that the expired GC has been extended for a period of one year for travel and work."

It's California state. The person who helped us at DMV actually did go verify with her supervisor to ensure that they couldn't issue the ID.

 

I will try to make an infopass appointment, but I don't know if we have time. The RFE is due Sept. 19th. and it takes weeks to process the ID alone.

I would go to another DMV office.  It sounds like both do not know what they are doing.  They want to see the expired GC and the extension letter which IS what you showed them, but for some reason they must not be able to read.  Either that or they want you to have an unexpired GC.  If you go to the CA DMV website and scroll down to applying for an ID card and then follow the link to the types of ID required for date of birth and lawful presence, they will accept the GC and the I-797.  I would not bother the USCIS with this as this is a problem of untrained DMV workers.

Are either of you listed as beneficiary of the other's employer's benefits?  Are either of you listed as emergency contract for the other?  Beneficiary of any retirement accounts?  You might want to get a few affadavitts to help your case as the joint evidence is pretty weak IMHO.

Hi all,

 

I was finally able to access my husband's status online and saw this notice: "On June 10, 2013, we ordered production of your new card. Please allow 30 days for your card to be mailed to you..." (10 yr GC was approved April 29).

 

Today is June 28th and still no card. I know it hasn't been 30 days yet since the card production ordered, but - what the heck? Is anyone else waiting this long for their card to arrive? 

 

Is the Card Production notice the only one we will get, or do you also get an update when the card is actually mailed? I have now signed us up for email and text updates.

 

Just wondering when would be the appropriate time to FREAK OUT...

We got an e-mail that said our petition for ROC was approved and the card was in production on June 21st. Then an e-mail that the card is being mailed on June 25th with no tracking information. Than an e-mail on teh 25th that the USPS has picked up the card and the tracking number was viewable on the USCIS website only. Than an e-mail that the card was delivered on the 27th.  We received the GC yesterday and a letter in the mail from USCIS that the petition was approved.  I would be a bit concerned and call them the moment the 30 days are up if you do not receive the card by then as things are going pretty quickly right now.  I never received any text updates, only e-mails.  Have you checked the on-line status lately?

Hey guys,

We've finally submitted i-751 packet few day ago and received NOA already. The problem is:
my wife dosen't have any bills in her name or other things like lease and auto insurance. We submitted
copies of few credit cards, she doesn't use them much and thus no statements were sent in her name. We also
sent copies of our family health insurance showing myself, wife and baby's insurance cards, plus printout from insurance's
site showing all three names there. We've also submitted paper showing my wife listed as a beneficiary on my retirement account. About
20 pictures of us with baby and relatives, some from before and after the marriage, also our baby's birth certificate and finally chat log for about
7-8 month of time. I think this is not enough, please let me know what you think :wacko:

The one thing I would look for is tax returns at least filed as married--jointly unless filing seperately gives a tax advantage. Do you have any joint financial information? Every situation is different and no one can say whether you have enough or not enough except for the person that reviews your case. If I was the IO, I would like to see a bot more financial risk taking by having joint accounts, but that's me. Did you have any trips together taht you could show? I would just sit back and relax and wait to see what happens.

Quick question please :)
I am getting my I-751 together, and on the instructions it says to include a fingerprint card. is this what you get when you go for your Biometrics appointment? I know they take your fingerprints, and picture. but just confused that it says to include with application. which means that i would need to send in the application and wait for the boimetrics appointment.

You are reading the section under the EXCEPTION for provideing a copy of your permenant residencancy card for government employees residing overseas or active duty military. So provide a copy of the front and back of your GC OR follow the rules under EXCEPTION which includes the finger print card if you are living overseas as military or a government employee.

Si man. I was going to include the AR-11 confirmation and the I-865 NOA1. Now whether it twists the knife or not, I will leave that up to the USCIS to determine :lol: . Why do they want you to file within 10 days when they cannot get it correct in 17 months!?!:wacko: It would apprear that they now have the correct address and let's hope they actually use the address we put on the petition.

We received a letter from the USCIS. Upon opening it there was another envelope inside with our old address and a yellow sticker on it from the UPSP to return to sender as our forwarding order has expired--we moved in August 2011. Along with the letter reminding my wife to remove the conditions on her GC was a nice letter mentioning that we are suppose to file an AR-11 form with the USCIS within 10 days of moving. H3ll I filed it back in July 2011 to tell them we would be moving in August and I have the confirmation I printed from their website with the confirmation number. I also filed the I-865 form to change my address with them for the affadavit of support.

It looks like they are sending out reminder letters, but they cannot get teh address change completed from KY to CA. Must be two seperate computer systems :lol: .

Just thought I would pass a long our latest contact with the USCIS.


17 days until we can file the ROC.

I have got a good job offer in another state and my wife might not come live with me for like 8 months till i have everything stable so how will immigration see that ?

During the I-130 process the USCIS will look at your marriage. SInce you have been married for more than 2 years you will receive a 10 year GC when/if the petiiton is approved--cannot tell from your timeline whether it has been approved, but you are in the US so I will assume you have been approved and have a 10 yr GC. I would live your lives and if asked by immgration tell them why you are dong what you are doing. Would anybody who is commiting immigration fraud want to put the spot light on them by living in two seperate locations? Would you really worry about this if you did not have a petition pending with USCIS? I have known several couples who live in two seperate places due to jobs or school commitments. Does it make their relationship any less legit? As long as the two of you do things like a couple then you should have nothing to wory about. Having the 10 year GC only means you have to renew it every 10 years and maintain your LPR status, not worry about being married. All that is behind you. Now if you go for citizenship based on 3 years of marriage and 3 years as a LPR then the USCIS will look at your marriage again. You could wait to closer to the 5 years as a LPR to lessen the scrunity the USCIS will place on your marriage.

hope everybody is doing well..I am a little confused about when I should submit the i-751.According to USCIS I should submit it within 90 days before the green card expires.so my question: should I submit the i-751 form 3 months before the green card expires or even earlier than that (for example: a week after second anniversary)?
If anybody went through this and can give an guide would be great

USCIS likes to confuse people by using the word "anniversary". This "anniversary" has nothing to do with marriage. It is the date of you becoming a LPR which is printed on the GC. You can file 90 days before that date. No sooner and no later than the expiration date (USCIS must have received and accepted it before your GC expires).

If you have an interview, have her fly back to the US and join you for the interview. Her presence at the interview will go a long way to prove the marriage is legit. Bring the tickets and all that to the interview to show that she had to leave her studies and travel to the US just for the interview. To me that will cover the other items you are lacking. Surely she can take a couple of days off to travel for such an important part of your lives. I rrealize this is not cheap to do, but think about what the cost will be if you have to redo a spousal visa.

Hello nyc123, I couldn't have found this post in any better time, I am also on the exact same situation & afraid of Bangladesh LAW (no law should I say). I do know with the expired GC & NOA1 letter any country in the world won't deny you a boarding pass but Bangalesdh is out of this world (worst way). I am planning to make an infopass & get I-551 satmp but finding it difficult how to explain the situation to USCIS that NOA1 is no good for Bangladesh. Please let me know how things go at your end.



I have a question that you may or may not know given all of this. Let's say you go to all the trouble and get the stamp in the passport, will the airline recognize the stamp any more or less than the expired GC and extension letter? If the employees are looking for a GC or Visa then what you are showing them is not what they are looking for--using your reasoning that they will not understand the extension letter so therefore they will not recognize the stamp as the GC because they do not know what I-551 means, it is not a physical CARD.

It sounds like you would be better off going to your bank and get a couple of $100 bills to help them understand the situation :blush: . I will take my wife's expired GC, the extension letter, and enter the information of the airline's website and take our chances with the airlines as I do not want to deal with the USCIS for something that IMHO is just as suspect to an airline employee as the extension letter. It sounds like to only way to guarantee a smooth trip is to have the new GC in hand, but I realize changing the dates of the trip is not a possibility. I would just explain to the USCIS at the INFORPASS appointment that you have concerns about the NOA1 being accepted by the airlines and if they would be so kind as to give you the stamp for your peace of mind. That's what I would do IF I was going to try to get the stamp.

We will be traveling back to Kazakhstan in August and I doubt my wife's 10 year GC will be in hand given the processig times. We are going to use the extension letter and the "expired" GC to travel on. Of course we will be traveling on Lfthansa and they should see this all the time--of course they use local help in Almaty and they may or may not be properly trained, but they should be able to call someone who is. I would expect Turkish airways to be the same. I figure we will hand them the GC and see if they even notice that it is expired and then show them the letter and explain that it is still valid for another year. I hope all this worrying before you leave allows you to have a smooth experience. Can you enter the US travel document on-line with your reservation so they can verify it before you travel? I did that with Lufthansa when my wife had her visa and came to the US and then again when she travelled using her GC. I think they check its validity long before your flight and if they is an issue they may contact you. Just a thought since you after getting no where with the airline.

I will get wife's passport stamped with I-551 & be less worried. Anyone knows how much does it cost & how long will it take them stamp wife's passport? Our flight is on January 25th Friday & I am hoping that we will get the I-551 before our departure date.

I still believe deep down that I-551 is really not required but I am traveling to 3rd world country (Bangladesh) & those idiots have no proper education to even read or understand the extension letter. Thanks all for the help.


You should get the stamp that day for no cost. I would still call the airline to make certain that the stamp will also work. Maybe you can go on-line and complete the travel document section and put the GC number in and the airline will be able to verify that. Lufthansia has the ability to enter the visa or GC information for your entry ino the US and it saves a bit of time and efffort at check-in.

Given that you are going to a 3rd world country the stamp may also not be something they are trained on, but hopefully a supervisor is. Unfortunately the airline people are trained like drones: GC, US visa, okay you are good to go. Expired GC with an extension, well we have never seen that, sorry but you will have to.... and that is the last thing you want to hear as you try to board a flight back to the US.

The POE officer has every right to examine the applicant's document and card like expired green card, passport with stamped I-551, confirmation letter of the pending case of the renewal green card and better to bring along the marriage certificate too. It's not the airline employees' job to decide if one has right to enter into U.S. or not.


The point I was trying to make is that if the airlines does not let you on the airplane yoou will never see a CBP person who has a computer and knows the GC has been extended. Most of the problems of traveling with expired or extended documents is that the airlin does not want you to arrive at the US and be denied entry as they will have to fly you back and sometimes at their cost. So they do everything then can to make certain each passenger can enter the US, thus THEY check the immigration documents before you are allowed to board. That is where the probelm will arise due to untrained airline personnel.

I am U.S Citizen & my wife is the green card holder. Her card expired 6 months ago & we are on the pending list of " Removing Conditions on Residency" with Vermont Service Center .Our return ticket is already confirmed via Emirates Airways. We have received the 1 year extension letter & we have the expired green card also. I am wondering on our way back to the U.S will the customs at Bangladesh airport inquire about re-entry visa to US? My wife passport has the the CR1 expired visa stamp along with the expired green card & extension letter. We will also carry the biometrics appointment letter (wife took finger print already). Any feed back is extremely appreciated.

The issue is not the US CBP but the airlines and whether they recognize the extension letter. I would call the airlines and expalin the situation and see what they say. It is the airlines that will decide to let you on the airplane or not. CBP will look you up in the computer and see that your GC has been extended for one year and that it is still valid.

I am sending in a statement for each quarter that we have a joint account. It took us a few months to get the joint account established. So I am only seding in from the first date we are on the statement together to current month. If you have time to file your 2012 taxes and get a transcript then I would do so. Are you listed as beneficiary on his employer's benefits? Is he listed on your employer's benefits if any? Do the two of you have wills or power of attorney? Do you own any property together? Car? You just need to show that you are combining your lives like most normal people and are taking risks with assets and money. If your statements are like ours one per quarter will still be quite a stack of paper and I printed on both sides.

I am soon due to need to apply to remove the conditions of my temporary permanent card. I know what forms to use, the fees etc.

My question is should I anticipate further problems because I was in overstay to begin with?

We have plenty of evidence to support that my case was unique and a very pressing health care as reasons, but I was wondering if we have to face all the questioning again so we can prepare for that.

That said, we have been happily married and enjoying our life here as productive members in the USA, and have affidavits to support that.

First, one little nik-pik: It is not a temporary permanent card, it is a conditional residency card but for all intents and purposes it is the same as the 10 year GC except it expires after 2 years--it indicates you are a LPR of the US.

Second, you just have to prove that your marriage is legit and was not entered into in order to avoid US immigration laws. You do this by supplying evidence that you had two seperate lives before the marriage and now have combined these lives like a normal married couple. For the USCIS that means monetary risk and responsibility. Joint bank accounts, joint residence, joint tax returns, joint assets and joint liabilities. Most typical married couples have this covered in their day-to-day lives. The over-stay was forgiven when you filed for and were granted the conditional GC.

Mailed ROC package on February 26th, arrived in CSC Wednesday the 27th. Checked bank account and check already paid the 1st of March. Maybe CSC is working on ROC rather than other things. I did put that the contents of the package where for Form I-751 on the outside of the envelope. I also waived the signature requirement for the express mail package. I also typed the information on the check rather than writing it with my bad handwriting :lol: . Now we will wait to see how long it takes to get the NOA1 and the Bio appoitment.

Hi everyone!
I'm starting to fix my ROC packet. I can file on 3/17 but probably will end up waiting until the end of the month since I am not ready.
I just have a couple of questions!

1. Fee is still 590? YEP
2. Can I use a PO box as my mailing address since I will be moving twice throughout the process? Given what you said in the other thread I would strongly recommend using a PO box as the mailing address
3. How should the packet be assembled? In paperclips? Stapled? Should I get an accordion folder? Just want to know the best way to organize it I used one big clip to hold everything together including the check
4. How did you mail it? USPS priority or express mail? I used express amil and put "USCIS-- Form I-751" as part of the address
5. Heres what I am gathering so far:
G1445 I did not include this as it staes in the instructions that this is for the lockbox facilities and the main service centers do not have the electonic capabilites yet
I-751 form - still waiting for my husband to mail me the signed form
I have about 15 pics of us in various trips- should I put captions on the back? Since our photos were digital I printed them and put the information on the front. You may want to put a couple of photos per page and copy them and put the relivant information under the photo
2011 and 2012 tax transcripts- still waiting to receive it Were you married in 2010? If so, you might want a tax transcirpt, if not--never mind.
POA (he's deployed)
His orders? (Not sure if necessary) Not a bad idea if they request an interview and he is still on deployment you can state "Hey, I told you he is deployed and that is why I am alone at this interview."

Joint bills- how many should I send? each month for the past two years? We had no joint bills, but I sent information for every quarter for CC, financial statements, and back accounts

6. Anything else I need to send in the packet? I know a photocopy of my GC is needed right? Did everyone make a cover letter? I sent in a cover letter stating it was a JOINT application and listed all the stuff that I included. I also typed the information on my personal check and signed it. Application received and 2 days later check cashed and today we received the NOA1.

Hello vj members, I need help or some info any reply is so much appreciated. We sent my I-751 and got my NOA already I am now waiting for my bio appointment schedule, my husband is leaving tomorrow to the Philippines because we are buying a property, he can't purchase the land without me because he is not from the Philippines so I need to be there for that. My questions would be.: is there a faster way to leave the US , before bio appt? Will I need to get an info pass if I leave before i get my biometrics letter appointment? I really need some info, so vj members please help me. Thank you!

BTW my green card will not expire until May 18th, and I am not planning to stay over in the Philippines that long, if I can leave early and don't have to wait for my biometrics appointment I should be back in the US before my green card expire, I will be buying a round trip ticket if I am allowed to leave. Sorry it's quite long. Thank you again.


Our bio appointment is for one month after the NOA1. The letter arrived about 5 days after teh NOA1. Yours should be in that time frame. You have two choices 1) leave the US and return in time to make it to the bio appointment, or 2) reschedule the bio appointment. The bio appointment is for the ROC petition. It has no bearing on your current GC. You have an extension letter that makes your current GC valid for an additional year. You can travel on the expired GC and the extension letter. Your concern now is should you reschedule your bio appointment, your ROC may be delayed. You can see if you can do a walk in if you know you will be out of the country when your appointment is scheduled. My guess is you can go to the PI and conduct your business and return in a couple of weeks and be fine.

I tried searching and read the USCIS documentation to no avail as to who requires to file for another set of biometrics

Out 90 day window opens May 15th and I am trying to get everything in order to file ASAP.


The application fee is $505 plus $85 for the biometrics fee. You are paying them for another round of finger prints and photo.
