Correct.

Make sure that if you add a supplemental page, you list the petitioner's name, beneficiary's name, form and question numbers and A# or SSN of the beneficiary if he/she has one at the top of the page. This will ensure that the reviewers can match the supplemental material up to the form if they become separated.

One more piece of advice...schedule enough time between NY and San Francisco. It took my fiance 4 hours to get through immigration in Newark. This time of year, you shouldn't have weather delays at either airport, but if you don't schedule enough time between flights, make sure your fiance is comfortable dealing with the ticketing agents/desks to reschedule if the connection is missed.

Round-trip for visas where you aren't allowed to stay, proving that you intend to return home.

It's not a conspiracy, just get the one-way. And it doesn't matter if the reply is from an India or non-India VJ member - no one at the immigration desk cares where you came from or has a different rule book that they pull out for Indians only.

They said "insufficient proof of relationship." I think because my fiance is Indian, and in India to be "formally" engaged, you have to have a formal engagement ceremony (which we hadn't the first time). Now, we have had this ceremony with our families in attendance, his friends, etc. At least in India, thats a big deal.


There are several posts/embassy reviews for India where couples were denied because their engagement party looked too much like a wedding and the CO said that they were married.

Look carefully at your proof and make sure your not including items that would go overboard and make someone think you are married. You may want to include notarized letters from attendees attesting to your engagement. This may have been overboard, but I provided Save the Season (as we didn't know the date) cards and a letter stating where we intend to marry and who we intend to invite and their contact information. I also included with our packet 4 pictures of my wedding shower.

I don't know what embassy you will interview with from Kolkata. The New Delhi embassy is particularly hard on K1 although Mumbai seems to have its issues too.

Bottom line - if you are engaged to an Indian, they will all expect you to have family permission and involvement. If you are not an Indian/Indian couple with an arranged marriage, they will most likely want proof that your families are aware and approve. It is best to have letters of support notarized so as to relieve any doubt that they are fraudulent. Come to the interview over-prepared and make sure you submit documents ahead of the interview and in an orderly fashion. They most likely won't look at anything new at the interview and if they can't easily locate a piece of information, they won't acknowledge it even if they have it in their possession.

It really is best to read the last few years of embassy reviews for India, paying special attention to cases that seem similar to yours with respect to age gaps, religion, ethnicity, etc. Then search on VJ for combinations of words like India and denied or AP or 221(g) and read what other people have to say.

You'll get more and better help if you complete your timeline and visa type so that we can tell what process you're going through and where you are in the process. :)



Ha ha ha...I see you are the original poster! So I know your are a K1. Please fill out your timeline and visa type though so it is easier for people to tell what your status is.

Your thread has been hijacked by someone else's dilemma...I couldn't even remember what the original topic was! A marriage denial in Jamaica really has nothing to do with a pending K1 in India. It's too confusing trying to follow these stories. :unsure:

Age gap is not a reason for denial, if it were there would be a boat load of people on here not married and living happily every after. The process is not to judge your relationship, but to evaluate your relationship to determine that is is real and that fraud is not being commited. Some countries quite simply are on the high alert list.


I agree that age gap is not a reason for denial. The embassies in India have been known to put cases that have factors like age, the male being the beneficiary, different religions or different ethnicities under AR/AP. Then they sit on it until it expires and then issue a denial because the case expires. Even though it's their fault they didn't finish their review before expiration and even though they have the ability to extend the expiration date. But no, they allow it to expire and issue a denial when the real reason is never revealed to the petitioner or beneficiary. The real reason is because they doubt the relationship due to the items I stated above but they can't find any legitimate reason to deny. I feel this is highly unethical but it still happens. So, even though the might not officially deny due to age gap or anything else doesn't mean it won't be a major issue.

Being scared is good...it means you'll be prepared and if you are denied, at least you knew it was a possibility. You know what they say, hope for the best but prepare for the worst. I don't know if going through Mumbai will make too much of a difference.
I would still recommend attending the interview and getting lots of notarized letters from both of your families. I am convinced that my presence is the only thing that prevented my case from a 221(g) or denial like the others who were unable to attend.

K1 applicants already have a harder time in India than marriage applicants. Your age difference is very unusual in India. Have you considered getting married and going the marriage visa route instead of the K1?

If you do the K1, you will need to provide a lot of evidence of family support and you might want to consider attending the interview.

If you are not of Indian descent, do some research on VJ because you will mostly likely be denied with a K1. There are several recent stories of visa denials for K1 out of New Delhi.

I had a similar situation with my now husband. From what I understand, in having gone through this process, your plan would work. I have a friend who did the same thing last year with his now wife from Brazil. They had the religious ceremony in Brazil but not legalized ceremony, so in the eyes of the law she was still his fiance. When she arrived in the US they had their legal ceremony and reception for American friends and family.

As for the tourist visa, she can do that also. However, it may make things more complicated. You coould not then file for the K-1 but rather for a spousal visa. I honestly haven't done any research on that and don't know if she would be required to return to her country while the spousal visa is considered. In my opinion, it's better to do the K-1 and just have all of your documentation. If you are then denied, then go the other route.

My experience was surprisingly very smooth. Everything went along very close to the indicated timeline, despite delays with snail-mail and not receiving some notices at all. It is nerve-racking, but definitely doable. I hope you're encouraged, you've already accomplished the hardest thing, finding the person you want to spend the rest of your life with...everything after that is worth it to keep her!

K-1 NOA2 received today. I was On my way home from work this morning when I received a text and email saying my case status had changed. The email said we were approved on April 13, 2011. I checked the website and sure enuogh is said approved. Then in the mail I received the NOA 2

I sent in our package on Nov 30, 2011 and had a NOA 1 date of Dec 6, 2010. The NOA 2 has a validity period 4/13/2011 to 8/12/2011. What does this mean exactly? Does it mean she has to be interviewed by 8/13/2011? Or actually enter the use by 8/13/2011.


K-1 Packet mailed Nov 30, 2010 -------- NOA2 received in the mail April 18, 2011 ----------139 days
NOA1 date Dec 6, 2010 ---------NOA2 date April 13, 2011--------128 days.



The NOA2 does have an expiration date which means you need to have your interview before then. On other forums, people have said that many embassies automatically extend it if they are very slow at scheduling the interviews or if there are extenuating circumstances (like when the Egyptian consulate was closed). That being said, you still have to do your part and get your paperwork together so that you can turn it in as soon as you get Packet 3. Many petitioners don't even wait for Packet 3,especially in countries with poor mail service. They just print the instructions for Packet 3 off of their consulate's website and turn it in as soon as they have confirmation that the consulate received their case (if you go this route, make sure you write your case number on your cover letter).

Dipu and I have been “arguing” for weeks over this recipe stuff. He doesn’t understand why anyone would use a recipe…a cook should just cook. And if he were going to turn in a recipe, it would be for cheeseburgers because that’s what he loves. Sooooo, I’m turning in two of my favorite Indian dishes and my Dipu’s favorite too :D

Chicken Tikka Masala
Ingredients
Marinade:
1 cup plain yogurt, whisked until smooth
3 tablespoons Ginger-Garlic Paste, recipe follows (or 1 tablespoon grated fresh ginger and 3 cloves garlic put through a garlic press or finely minced)
1 teaspoon kosher salt
1/2 teaspoon freshly ground black pepper

1 pound boneless, skinless chicken thighs, poked with a fork, and cut into large bite-sized chunks

Sauce:
2 teaspoons olive oil
3 tablespoons butter
1/3 cup Ginger-Garlic Paste, recipe follows (or 6 cloves garlic and 2-inch thumb ginger minced)
2 serrano peppers, minced (seeds removed if you don't want it spicy)
2 tablespoons tomato paste
1 teaspoon garam masala
2 teaspoons paprika
8 Roma tomatoes, diced
1 1/2 teaspoons kosher salt
1 to 2 cups water
Oil, for grilling
1 tablespoon dried fenugreek leaves (optional)
1/2 cup heavy cream
Minced fresh cilantro, for garnish
Cooked rice, naan, or crusty piece of bread, for serving

Directions
For the marinade: In a large bowl, mix together the marinade ingredients. Add the chicken and toss to coat. Marinate at least 30 minutes, or in the refrigerator up to overnight.
For the sauce: When you're ready to make the curry, place a large skillet over medium heat and add the olive oil and butter. When the butter has melted, add the Ginger-Garlic Paste and serrano peppers. Saute until lightly browned around the edges. Add the tomato paste and cook until the tomato has darkened in color, about 3 minutes. Add the garam masala and the paprika and saute for about 1 minute to draw out their flavors.
Add the tomatoes, salt, and 1 cup water. Bring to a boil, turn down to a simmer, and cook until thickened, about 20 minutes. You may need more water depending on how much liquid the tomatoes give off.
Meanwhile, fire up your grill. When it is nice and hot, lightly brush it with oil. Place the chicken on the grill, shaking off some of the excess marinade. Cook until it's charred, about 2 minutes on each side. (Don't worry that the chicken will still be a little uncooked, it finishes cooking in the sauce).
Pour the sauce into a blender or food processor, or use an immersion blender, and process until smooth. Pour back into the skillet and bring back up to a boil. Add the chicken and fenugreek leaves, if using. Take the heat down to a simmer and cook for about 10 minutes. Add the cream and stir through. Garnish with minced fresh cilantro, and serve over rice, with naan, or a crusty piece of bread!
Ginger-Garlic Paste:
1/2 cup cloves garlic, whole
1/2 cup fresh ginger, peeled, cut into 1/2-inch slices
1/4 cup canola oil
Throw the garlic, ginger, and canola oil in a mini-food processor and let it go until it forms a semi-smooth paste. There will still be tiny little pieces in there, but overall, it should resemble a paste.
Save what you don't use in a small glass jar. It should last in the fridge for 2 to 3 weeks. It's a delicious addition to marinades, pasta sauces, stir fry sauces, slow-cooker recipes, gravy etc.

Butter Chicken (Indian Chicken in Tomato Cream Sauce)
Ingredients
Spice Blend:
1 tablespoon garam masala seasoning
1 1/2 teaspoons ground ginger
1/2 teaspoon ground cinnamon
1/4 teaspoon cayenne

Sauce:
3 tablespoons butter
1 large onion, chopped (about 1 cup)
2 teaspoons jarred minced garlic
1 tablespoon tomato paste
1 (15-ounce) can tomato sauce
1 (14 1/2-ounce) can diced tomatoes in juice
1 skinless rotisserie chicken, boned out and pulled into 1 1/2 by 1/2-inch chunks
1 (10-ounce) box frozen peas, placed in a colander and run under hot water to thaw
1/3 cup heavy whipping cream

Hot basmati rice, for serving
Naan bread (you can get at Trader Joe’s)

Directions
To make the spice blend: Stir the ingredients together in a small bowl and set aside.
To make the sauce: Melt the butter in a 12-inch nonstick skillet over medium heat. Add the onion and cook, stirring frequently, until the pieces just begin to turn gold, about 5 minutes. Add the garlic, tomato paste and spice blend, and cook for 1 minute, stirring constantly to prevent burning. The spices will be fragrant. Add the tomato sauce and diced tomatoes and stir will. Add the chicken pieces, spoon the sauce over the top and bring to a simmer. Turn the heat to low and cook, uncovered, until the chicken is warmed through and the sauce is flavorful, about 10 minutes. Stir frequently. Remove the chicken to a serving dish and cover to keep warm.
Shake any excess water from the peas. Add the peas and cream to the sauce in the pan, stir well and heat through. Do not boil. Spoon the sauce over the chicken. Serve with rice and warmed naan bread.
Variation: If you prefer shreds of chicken to whole pieces, remove the skin from the chicken and pull the meat into large chunks by hand. Add to the pan along with the garlic, tomato paste and spiceblend. Cook for 3 minutes and then add the tomato sauce and continue with the recipe. Serve over basmati rice or with naan.

Cajun Burgers – Cajun to celebrate my hometown and burgers for my Dipu!
This burger recipe is filled with delicious flavor. Not only do the patties have a Cajun flare, but there is also a mild spiced barbecue sauce to accompany it.
Prep Time: 10 minutes
Cook Time: 10 minutes
Total Time: 20 minutes
Yield: Makes 4 1/4-pound burgers

Ingredients:
1 pound ground beef
1/4 cup barbecue sauce
1 egg
3 green onions, chopped
3 tablespoons dry bread crumbs
1 tablespoon Cajun seasoning
1 tablespoon prepared mustard
1 teaspoon Cajun seasoning
4 slices Cheddar cheese

Preparation:
Preheat grill for high heat. Mix ground beef, egg, bread crumbs, green onions, mustard, and 1 tablespoon Cajun Seasoning in large bowl. Form mixture into 4 patties. In a small bowl, combine 1 teaspoon Cajun seasoning into barbecue sauce. Lightly oil grill and cook patties for 5 minute per side, or to desired doneness. At the end of cooking, place cheese on patties and serve over burgers topped with seasoned barbecue sauce.

Hey, sorry I went silent for a couple of weeks. I was obsessing over Igor's List and decided I needed to take a step back. So I went AWOL for a little while for my own sake. Congratulations to the Decemberites who got their NOA2s.


I'm with you on the obsessing part. Even though I know I'm in the Eastern time zone and CSC is in the Pacific time zone, I still check my case status every morning when I wake up. Why would I do that? It's not like I really believe that there's some super-dedicated little man hiding in his cube furiously approving petitions as the cleaning crew vacuums around him so that people like me will wake up with a surprise in the morning. I know before I even hit the Check Status button that it's still going to say Initial Review. But every day, like clockwork, I check it. And it doesn't even make me feel better. :bonk:

Can anyone send me a sample letter of intent for the interview, or tell me what needs to be included? Is it the same as the letter that was sent with the I-129f? Does the benificiary also need to write one out at this time?


My attorney said the letter should clearly state both of your full names and where you are from/live, the date you met, how you met, how many times and when you have physically seen each other and why you want to get married (the mushy stuff). You should also clearly state "I and engaged to and intend to marry Mr./Ms. ..."

My fiance (the beneficiary) and I both sent notarized letters (signed with your full name, address and phone number) with the application and I will be sending another notarized one indicating that it is still my intent to marry and spend the rest of my life with my fiance and some more mushy stuff with packet 4.

I will email you a copy of one of ours...but don't make fun of the mushy stuff :D

I am curious, those whose applications have been touched since submitting and those who are getting the NOA2, were these sent to the CA or VT service center?

Our application shows it hasn't been touched since the NOA1.

Is the VT. center behind?

I keep getting the feeling that we're in limbo here on the east coast. :(


A bunch of CA got touched one week in March when they were digging through the boxes to expedite Japan. I haven't seen any trends from VT showing the same thing, but that doesn't mean it didn't happen.
The VT center is about a month behind in approvals than CA, however, they have the same relative # of approvals in 2011, so hopefully VT will catch up soon. The same thing happened last year with CA when they stopped working K's for a while.

I just read a pretty informative interview with a Director at the VSC whose wife is/was a K-1 adjudicator. If you haven't read this thread, the interview is pretty interesting. I recommend posts #1 on Page 1 and posts #76 and #78 on Page 6. Bear in mind that the interview took place in the fall of 2009 but it still seems pretty relevant.

Sometimes I check the next available interview date in Montreal and it's in 2 weeks, and other times I check and it's 4 months (I just checked again and currently the next available time is 2 days from today!). It's so all over the board, I wouldn't stress about it just yet....let's get those NOA2s from VSC first!


How do you check the next available interview date? I've been stalking the New Delhi consulate and can't find any information in regards to dates for the K1 or K3 visas.

I don't know if this is an option in Ireland, but whenever I'm expecting a package that I know they won't leave unless I sign for it, I leave a note for the postman or package delivery man stating that I am unavailable to sign and to please consider this note my permission to leave the package. The delivery person takes the note and leaves the package, no issues.

As for Packet 3, a lot of countries put the packet on their consulate website and just let you download it and bring in the print-offs if you want to bypass waiting for it in the mail. If this is an option in Ireland, you could print it now and get all of your required documents together now and as soon as you have a case number from the NVC and confirmation that the embassy received your case, just drop your homemade Packet 3 off.

My fiance and I are doing that because India has a horrible mail system. You have to write things like "near the Dr's chamber" and "behind the apartment complex" or "the former house of..." as part of the address for the postman to be able to find you.

This is the statement that lead me to believe there might be some kind of timing variance between consulates. I didn't want anyone to read it and think that he or she would have all the way up until the interview to prepare the I-134 when my embassy states it is due prior to packet 4 being issued. I just finished preparing everything for Packet 3, 4 and the interview and mailed it to Dipu on Wednesday so that as soon as the consulate receives his package, he can deliver the goods and not wait for them to send him the packets. All he has to do is sign the forms, add the PCC, passport, photos and birth certificates. Whew...it was a lot of work!


As for the DS-230 Part I, the Delhi embassy states on their K-1 website that they require the following before a Packet 4 will be issued:

I fully realize that no advance assurance can be given when or whether a visa will actually be issued to me/us. They also require you to submit a checklist stating that you have obtained all of the necessary documents.

The DS 230 does say that it is an Immigrant visa form, maybe my particular consulate just uses it as a way to gather some biographic data. Or maybe they just made a mistake on their website...hence the importance of everyone checking their own consulate's instructions :)

SO.... Here I sit with my NOA2, and it is looking like USCIS has expedited the Japan petitions as I'm finding more Japanese filers who also were surprised with their NOA2. Is it a blessing?? Well yes because that big step is over, but no because I don't know how much this is going to speed things up.

From the Naha consulates website:

"Due to the recent earthquake, we are only able to process emergency visa cases. Unless you need to travel to the U.S. in March and have already scheduled your appointment for this week, please reschedule your appointment for a later date. Regular appointment slots will become available as soon as we are able to resume these services."

I saw a discouraging post from someone who had an interview that was scheduled in the first of April rescheduled to the END of May.

I'm curious to see how this one plays out but looks like I might still be on the same timeline as everyone else... just out of order! LOL

Time to call the sweetie, then dinner and I will be a happy Shawn (well, not that I'm not happy right now)! :)


I've been watching this trend too. It seems the CSC has taken it upon themselves to expedite Japanese filers which is great if it helps people dealing with the devastation in Japan right now. But it also has some serious drawbacks. The Japanese consulate is already burdened because of what's going on right now and the CSC is just going to end up sending them several months of additional work at once that they probably can't handle. And it puts a burden on the couple if you suddenly have to come up with documentation that you hadn't even started preparing yet. And what if the beneficiary lost evidence in the tsunami? How will he or she possibly be able to get replacement evidence amidst all of the other things their national and local governments will be working on. On the one hand, I'm very glad that the CSC is trying to do something good but on the other hand, I hope it doesn't backfire and end up making the process much harder for American/Japanese couples. Hopefully, the consulate will be very understanding if it's difficult for people who were affected by the tsunami to obtain all of the necessary documents.

Dear Decemberites: Do you know where your file is after you get the NOA2?

I wanted to find out the best details I could regarding our files after they leave the service centers. So, I called my sources *(name and title withheld to protect the innocent). At any rate the reference from US Travel.State.gov is included to back up the info. :P

Mari--- Okay. Per our conversation and possibly a previous e-mail, I'm just confirming that the K-1 is a non-immigrant visa. So, although it is sent to the NVC for processing, NVC will forward the visa to the US Consulate. NVC does not interact with the petitioner(you or anyone in the US) if the visa is a non-immigrant visa. So, NVC will not ask for a fee and they will not ask for an I-864. They will only interact with US petitions for immigrant based visas.
*(This means the K1 is the Petition to ASK the US Govt for Fiance Visa. Hence, non-immigrant visa.)

Back to the K1:

The New Delhi consulate requires that the I-134 be turned in with the DS-230 Part 1 and the passport photos and the applicant statement along with a checklist verifying you have everything before the packet 4 and interview will be sent and scheduled.

I highly encourage people to check with exactly what their consulate is expecting with packet 3 and 4 so you can be prepared prior to receiving your NOA2 as it sounds like there might be slight variances between places.

Oh wow Dizzy, you did a great job on the Timeline today. That is totally organized. What's interesting about it is the balance between the two centers. OK, it's time to see some VSC Dec fam get a few today! One thing I see is that CSC is going in what appears to be a chronological order (first in line by date). This is good; it's fair. LOL but toss a Feb filer in the mix and uh-oh! Fondler AFFAIR! :angry: totally unfaithful!

I'm hoping to see VSC do the same NOW! What monthy are they currently working on? Please do not tell me August anymore...

OMG, the most bizarre thing just happened! I have faithfully checked the USCIS website for my case status every day since receiving my NOA1 (truth be told, sometimes 2 or even 20 times a day...I'm that level of #######). Every time it has had the sames message...On December 1, 2010, we received...yadda yadda yadda.

You know what it says now?

On November 26, 2010, we received this yadda yadda yadda.

Holy #######! They changed dates! That is so weird...I guess this means I'm no longer a December filer too! Oh well, try to kick me out...jus try! :rofl:

Today is the worst day ever!

Dipu has been trying to get his Delhi PCC and he took two witnesses to the police station today to vouch for him but the policeman wouldn't even entertain the witnesses because they don't reside on the same block address as him. Now he has to find two witnesses from the same block address as him with proof that they live there.

He has three roommates, but all of their identification lists an address from when they lived in another flat 4 years ago before they moved to their current flat with Dipu. He doesn't really know any of his other neighbors as he mostly keeps to himself.

What to do? I hate how corrupt and backwards the Indian government is. A police clearance certificate shouldn't be based on someone vouching for you...it should be based on whether or not you've committed a crime. If they are going to base it on interviews, then who cares where the witnesses live as long as they know you well and are willing to vouch. And to top it off, everyone seems to want a bribe...heaven forbid anyone do they work for which they are already paid! I don't know how he's gonig to find two people with documentation that he knows well enough that they will vouch for him unless he can convince his roommates to update their IDs.

Ahhhhhhhh...I feel like banging my head against a wall. Thank God we started working on this early instead of waiting until we got Packet 3.


Today is the best day ever! It is the one year anniversary of when I met the love of my life (L) and my Dipu got his Delhi Police Clearance Certificate today!

He just happened to be on his terrace a few days after the post above and he saw the police man he originally spoke with. He went across the street to talk to the policeman and explain the issue he was having and the policeman asked him why he didn't just have his landlord go to the police station to vouch for him. Dipu told him that his landlord is a doctor and would not take time away from his clinic to do that and besides, he'd still need one more witness. The policeman asked to speak to Dipu's landlord so Dipu explained the situation to the Dr who went out and firmly told the policeman that he would have to accept his and his assistant's testimony (woo hoo, that makes two people!)here at the clinic. The policeman was surprised and embarrassed to find his very own Dr yelling at him :)
Later that night, the policeman stopped by and took the statements of the Dr and his assistant personally, collected a "fee" (for which there is no receipt, wink wink) from Dipu and several weeks later...we have it! I think this was definitely the hardest thing we were going to have to get and I am so thankful it all worked out!
