IR-1 / CR-1 Spouse Visa Process & ProceduresConcern about the interview
QUOTE (MaxOnline @ Mar 19 2009, 12:03 AM) <{POST_SNAPBACK}>
Are you kidding me? getting divorced for such a ridiculous reason shows how much your friend and her husband are reckless about a sublime thing like Marriage... and she'll get Denied!

LOL So where did you pick up your marriage nirvana? I'm wondering..... if you shouldn't write one of those self help books for the rest of us.

As for the OP's question. I'm pretty sure she can say it was family based interference which they outgrew with each others true love for each other, and she better have a lot of proof of how they stayed in contact. Best of luck for them. I can't imagine a long distance relationship for 10 years, or maybe they're together... but anyway, it sounds strange and if I were the consulate I would definitely need answers.

Peace,
Mariah

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat is the usual wait between NOA1 and NOA2?
After you register at uscis a touch is when you log in to your page and the "last updated" heading has changed from the date you got your noa1 to any later date and so forth, each later date you see is another 'touch'.

I've seen people here get approval in as little as 2 months, but that's only step one in the process. Best wishes to you and yours.

Peace,
Mariah

Seems utterly ridiculous that they EVER took more than 30-90 days for a name check. Thank goodness they considered it a priority, and best wishes for everyone still on their list.

IR-1 / CR-1 Spouse Visa Process & ProceduresFalling in Love
I grew in love for him slowly. At first he was so simple and sweet in his expressions and demeanor while practicing his english. Then he was so honest, he didn't say things like most other men I've know. He didn't give up on me, when I decided that a growing relationship wouldn't work between us. Really his voice just made me feel peace more than I had known in too long. And my heart seemed to be defrosted just for him and my mind came in line from there. We had to be patient and we had to be careful to understand each other. We still do, and I hope we continue to grow this way. Plus, he's so cute, so fit, and his lips are so delicious, and his hands are so big and gentle and tender. Oh I miss him.

Oh yah since I saw Sonia's post, my husband recieved his DS 3032 request for agent paper while I was there on Feb 26th! Imagine how long this process would have taken if we had waited for him to get that paper to proceed! Thanks to Allah for this forum and all the people who post and support each other.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC Scheduling Interview Date for April 2009
I called NVC before I left for visit with my husband on Feb 18th and they said I didn't get a date, so I just waited to call when I got home yesterday and the nvc guy said oh we sent you the mail on March 3rd that your case was scheduled as of Feb 27th (so much for them only scheduling on 2nd week of month). So they emailed the appointment letter to both husband and I on March 3rd. His interview is on April 22nd at 8 am. He's calling for appt for his medical exam tomorrow. The appt letter gave a link to a new improved dov.state page which lists pdf files for each consulate with info about the how to get the medical exam.

Congrats and good luck to all of us.

IR-1 / CR-1 Spouse Visa Process & ProceduresHow do you deal with ignorance and prejudice??
So far it's pretty strange as I live in a small town and everyone I've told seems supportive. However, my ex husband and his family have been subversive and were trying to tell my daughter scary things, it took some time but after going over why I chose him a few times, she said she agrees with my decision and she is looking forward to welcoming him to our home (of course they've been getting to know each other through webchats as much as possible too). As far as what the ex's say, well I can't control I just keep calm and level and hope to live a good life which is all the pudding necessary. We'll have to see how it goes with the more general population once he's here and working.

IR-1 / CR-1 Spouse Visa Process & ProceduresHave I done this wrong?
I put a request in for an original document on November 17th or so, and one month later they mailed my app off to cali where it was approved in 20 days. I've seen people who put in the 129f with their 130 and are still waiting more than 6 months to be processed. So, I think you're ok. But then it probably wouldn't hurt if you called them either...... best wishes.

IR-1 / CR-1 Spouse Visa Process & Procedures? Naturalization ?
I believe it's that when you arrive on IR1 it's 3 years as a permanent resident you can apply for naturalization.
Likewise, if you remove conditions from CR1, then it's 3 years as a permanent resident until you apply for naturalization.

Here is the brochure from USCIS which details the speed at which one can naturalize. http://www.uscis.gov...ticle/M-476.pdf

It is much faster if applying for naturalization as a military spouse.

IR-1 / CR-1 Spouse Visa Process & ProceduresNVC received NOA2...What's next?
I didn't wait until the DS 3032 was generated, I emailed it asap. For us it was generated on the same day they accepted it.

Just thought you should know that....

Best wishes.

ps However, you do have to wait for the AOS fee bill in the mail before you can get online to pay, and you do have to wait for the DS 3032 to be accepted until you can pay the IV bill.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding current I-130 form and options
The general idea is that you are maintaining a residency there in US, while having extended visit to Syria. So if you aren't keeping a place for yourself you should see if your brother would let you use his place as a point of residency for your mail and so forth.
I'm not sure but I think you want to have a place to say you'll be living when you and hubby return so that they'll mail his physical greencard there. So hopefully you're brother would be ok with you using his address if you don't have a permanent address. If you are changing addresses then you'll want to send in the change of address form to USCIS.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion regarding current I-130 form and options
I personally think it will be helpful for your case at the interview and approval level to be living together. It will be a little annoying to do the sending papers back and forth, but if I were you I would make sure I had all the papers you needed from your brother already filled out and signed and have the copies of all his financials, so that when you get to that stage at NVC he could just add a few more recent proofs when you mail it. You can send things express to NVC via aramex. There is the DS 3032 that you can email after you get your NVC case number and if you let the AOS package be delivered to your brother (US address) he can call you with the info so you can pay online and scan you a copy of the front page letter that you mail in with your AOS package to NVC

ps, I agree that the filing you already made is fine doesn't seem beneficial to attempt to change now, I've seen some people who had DCF's take forever and timeframe seems similar to USCIS filing anyway.

Best wishes..

IR-1 / CR-1 Spouse Visa Process & ProceduresAny October Filers Out There?
I forgot I added to this post before, but yes our file was transferred from VSC to CSC Dec 22 and got approved 21 days later. I'm now almost through with NVC and praying for a timely interview date smile.gif People who got transferred to CALI be ready for a speedy approval. If you are going with CR1 then you should get your cival documents in order. Namely, Original marriage certificate, Original birth cert for benificiary, Police Clearance, and also photocopies of the passport with biographic page. Also having the beneficiary fill out the DS 3032 and IV 230 as best they can, at least sign and mail it to you if you will be their agent, will help speed the process through if you are doing it yourself through NVC. Good luck All, it's going to happen sooner than you think, be ready!!!

Peace,
Mariah

IR-1 / CR-1 Spouse Visa Process & ProceduresAny October Filers Out There?
Hi, I sent my papers in 9/29/08 next day and got my NOA 1 dated for 10/3/08 by the 7th. I think I had one touch when I asked them to return an original translation of my marriage certificate (which was promised in Nov but still have yet to receive) so I could also file 129F, however my case was transferred from Vermont to California on Dec 22, and they've been touching regularly since then....

I don't know if both our names are in the system since I'm a 3 time mid-east traveller and his brother has a tourist visa as a business man..... I'm really wondering if we'll get approved quickly.

I'm thinking I'll have to make that 4th time soon and visit again this month or next.

Best wishes on a speedy process for all visa applicants this year.

Peace,
Mariah

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed I-864 Info help Really Bad!!!!
Also wanted to add that they ask for your adjusted gross income right below in line 19 on the 184EZ and that is not to determine your eligibility, that is to verify your tax information. It really doesn't change your real income when you get deductions for tax purposes.... that adjusted gross income is for taxes.
MsMariahFemalePalestine2009-04-30 17:31:00
IR-1 / CR-1 Spouse Visa Process & ProceduresNeed I-864 Info help Really Bad!!!!
Really when filling in the annual income I put my gross income. It isn't net income and it sure isn't based off your net income after you claim your tax exemptions... that's pretty odd. Your income after tax exemptions is just for tax purposes and I've never seen anyone use that info in regards to their income claim. Not for loans, needs benefits assessments, or anything..... just trying to understand if that's what you meant, that you want to put what you are putting for line 22 on your 1040 as your annual income for line 18 in the I 864EZ??
That's most definitely NOT right.

IR-1 / CR-1 Spouse Visa Process & ProceduresTax Returns versus pay stubs
Also verifying that you pay and file taxes brings you up to useful responsible citizen status. If you are going to let a new person into your highly taxed country you would like to know that they are responsible upstanding citizens and nothing speaks louder to the government here than the almighty tax dollar.

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestions on I-864
Also wanted to add that YES you do include your non-filing letters, as I've seen quite a few people get asked to bring those for verification after their interview. Yes it holds up the process to not have all the necessary papers already sent in.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Assembling Instructions
I just used a paper clip and put the photos in a plastic baggy. I hadn't been on VJ before I sent my i130 so I didn't think to include a cover letter with mine, however it seems like a very good idea for the ease of the USCIS reviewer.
I think generally you just list all the documents and proof you have included in whichever logical order you feel like putting them.

Like:

Date

To whom it may concern at USCIS,

For your consideration, I have included the following documents in this I130 package for petition of my alien spouse/relative:

    I130 and copy
    Original marriage certificate and copy
    Marriage certificate translation and copy
Copies of Passports for petitioner and beneficiary

    so on and so forth

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much time is good enough for NVC case complete after sending IV and AOS papaper?
I wanted to add that NVC told us that he could send a copy of his PCC and bring the original to the interview. So he scanned it once he recieved it and sure enough they requested his original when handing over his medical package and the passport. Maybe you want to call NVC if this applies for your embassy as well, but it did save us the time of mailing from Jordan where even express takes 7 days!

IR-1 / CR-1 Spouse Visa Process & ProceduresHow much time is good enough for NVC case complete after sending IV and AOS papaper?
The are usually completing the case within 1 week of submitting the final papers. However, I've read of some Mumbai embassy people having difficulty adjusting their scheduled K3's to CR1 interviews, I believe they generally just have to wait for the CR1 to be scheduled. Of course let the embassy know that you intend to follow CR1.

I guess I don't need to join the group since my hubby has received his visa, but I just wanted to say welcome and I hope you get yours soon.
Where does your husband live? My husband's parents are from Gaza City, so he got the Gaza refugee stamp in his Jordanian passport even though he was born there. Sure it seems good that he dealt with Amman embassy as I think it's so hard for the Palestinian to move inside Israel.
Anyway, I would be happy to add you to my msn if that's alright, I'm not so big on Facebook.

AVR isn't always updated, but the operator should be able to tell you that it was received... strange. Also, our interview was scheduled at the end of the month so I wouldn't necessarily think you would have to wait longer if it isn't finished in time, besides... it's not may yet. Maybe they couldn't tell you because someone was reviewing it as you called.....?

Rehana, it's hard to say how long it will take. I would consider it a good sign that they kept his passport, also, there have been articles that say Department of State and FBI are working harder to clear the name checks faster than before so hopefully it will not take so long.

IR-1 / CR-1 Spouse Visa Process & ProceduresPassport issue
I don't really know what you are asking or telling. You have to have at least 6 months of validity on the beneficiary's passport at the time of getting the visa. So if you don't have that then you should definitely update your passport through the proper methods.
What you are telling about 'default' I have no idea where nvc 'gave' you this status, if that's what it is... I don't even know if you are the petitioner or the beneficiary. Please could you explain with a few more descriptive details?

I'm pretty sure it said on dept of state website that the applicant can have his mother make a sworn affadavit of where and when he was born.... not sure about that.

I wanted to add a question about birth cert. My father is I 864 joint sponsor and can't find his birth cert. and doesn't have a passport. What other options do we have to prove citizenship?

There is also a 'last updated' column with a date, if this date changes then you received what VJers refer to as a 'touch'. It means that someone at USCIS accessed your file for whatever reason. If you filed your application following the instructions to a T, then you most likely won't get an RFE. Either way it can be addictive to check the site. Best wishes on a speedy process.
