IR-1 / CR-1 Spouse Visa Process & ProceduresI 864 w Joint Sponsor and now we're stuck....
Ok so I'm filling out my I 864 and getting my mom to fill out I 864 for joint sponsorship. She made about 20k, unfortunately I forgot that I added my brother to her tax return for 07 so she could file HOH. He is 24, and had a part time job, but didn't pay her rent and so forth. So now they will see that on her 07 return and assume that it will be that way again this year. Obviously, that isn't enough for a 3 person household of her, my brother, and immigrant. sad.gif

I just can't find anything written anywhere on what to do, and oh yes, I can't find my brothers w2's they are for sure lost in the ozone.
I don't know when she will get her w2 for this year, and I could see about her filing single, but I rather didn't want to wait so long, maybe I have to. Any suggestions?

The affidavit needs only one signature. The affiant (someone who signs an affidavit) is affirming the contents of the affidavit. The affidavits are intended to affirm what the affiant knows about the bona fides of your relationship, not simply to affirm they attended a wedding. Marriage certificates take care of proving you got married. An affidavit would potentially be helpful if it spoke of what the affiant personally observed about the evolution of your relationship over time. Affidavits from people who know no more about the relationship than they attended a wedding are a waste of time.



Oh, ok thanks. My secondary affiant's were, the brothers wife, my brother (for my mom's), and the landlords son, they all knew the exact same thing as the original affiant who was writing the paper, they just happened to be there to make the second signature. But anyway I know I've gotten a sworn statement from someone with someone else to witness their signature who wasn't there to witness what the person was swearing, this was accepted by a judge as evidence enough to throw a case out... unless the judge used a different basis.....

I'm not sure what you have to tell immigration upon arrival... I do know you shouldn't lie, but it's not the kind of information that needs to be offered up for entering under a work visa is it? Once you are both back in US I believe you'll have to apply for adjustment of status on the basis of marriage to USC, there is a forum for adjustment of status you might want to ask there about the procedures.

Really, this is one of the best threads ever on VJ. It's nice to hear about the sweet things, and also reassuring that everyone has moments of stress, fighting, and doubts. Sometimes it's easy to imagine that everyone else has the perfect relationship and yours must be wrong. But all and all, with the lines of communication still open, and the remembrance of what commited you to your spouse to begin with, combined with a little hope should help us outlive the distance and seperation.

It's very important in our relation to contact every day, he likes me to wake him up for work, and I like him to call me and put me to bed during his first break. And then we try to do video/voice chat on msn every day, but some days work schedules don't allow... somedays I have blamed him, but it always feel horrible to hold a grudge against him and I just can't feel better until we talk. That's how it's been when we had a horrible fight and did the pride thing...of you must contact me first. Anyway, I'd just like to thank all the people who shared their successes, it's really lovely to hear about all the real love going on around here smile.gif

Also, my husband had to fight his father hard, and after that, when his family was still surprised that I really came to marry him as we agreed, his father tried to .... kick him out of the family home. Luckily, his father couldn't hold his grudge against him too long. Finally, his father said he thinks I'm a pretty nice girl, but quickly added that I could be his daughter if I prayed..... which ..... is a long shot for me to get into a religion again. But anyway, good luck. Things will work out exactly as they are supposed to.

I am by far no way knowledgable about this aspect of immigration, but I've read that you might be able to mail in your I130 with proof along with your Adjustment of Status so that you might be able to stay here and not go back. If you do go back to Canada, then you won't be allowed to return to US.
As far as not being honest when you first went through... does US issue any stamps in the Canadian passport? I don't remember getting any in my US passport when I visited Canada for less than a week. Maybe they won't know that unless they read it here....

It would help if your timeline was completed. You didn't mention if you got the NOA 2 for your I130 petition. If not you need to start getting the cival and financial documents for NVC in order. The medical won't be until after you are finished with phase 2 (processing at NVC), and then your case is sent to the embassy where you will get a packet to arrange the medical exam and receive your interview date.

I looked up info about it on Jordans embassy website, they didn't list panel physicians. So I sent them an email, and they said they won't give me that info until they get our packet from NVC.
My research is showing that all you have to do to prepare for that is prepare any documentation of your current doctors medical evaluations or treatments if you have any health issues, and if not, then you just need to have a passport photo available to take to the examination for the Dr to copy onto the papers he fills out for the beneficiary to take to the embassy interview.
If there any history of TB then I would definitely take the proof of your successful treatment for that and subsequent tests showing INACTIVE TB. They are mostly concerned with current contagious diseases of public health risk. TB, AIDS, and drug addictions or mental behaviors.

Just thought that it was interesting to note that there were only about 27 thousand new arrivals on CR1 visa in 2007.
BTW does anyone know what is the difference between CR1 and IR1 visas?

Another weird thing I gleaned from this 2007 Yearbook of Immigration Statistics, is that almost all who immigrated from Jordan were CR1's smile.gif Feel free to post any interesting facts you noted from this department of homeland security document I found on the web.

You have to keep bugging USCIS to resend or send out a NOA1, until then it is relatively useless to send in any updated papers. You and they have no way of specifying to which file it is going.... really good luck. Maybe you want to contact a congressman to send an inquiry on how to get a NOA1 or receipt copy.
Maybe they are planning to reject your papers. I had my I129 rejected (because I sent it in same package with my I130 instead of waiting for the NOA1) and it took quite a few months until I got it sent back as rejected. Now I'm thankful for that because it appears it would have taken longer for it to get processed if I had gone that route. My I130 NOA1 receipt came literally within a week from sending the papers.

The USCIS expected wait time for processing is 6 months. In reality that is +/- 1 to 3 months. They tell you that if you've gone past 6 months then you can start contacting them to ask for expedited processing. But you are not to the 6 month point yet.... maybe you could try for a visit with your spouse...?

Ok in that case I would do as Jurod recommended and resubmit with corrections and an explanation of the miscommunication, AND I would have her attend to getting a police clearance for that address as well, since I'm guessing they are good for a year...
I wouldn't worry about resubmitting the pictures unless you have an excess, you'll need 2 more for NVC and 2 for the embassy portion as well.

I'm wondering if it was a significantly different address? I mean, was it out of the country, or out of the jurisdiction of the police authority that you'll have to apply for a police certificate from wherever the different address is?
I just ask because although my husband lived in the same place his whole life, in Amman, they don't have post delivery to house numbers, just to post office boxes so there is no way to verify different addresses unless they moved to a different town or country.
I know that doesn't answer your question.... sorry.

Thanks everyone and I think USCIS might have attended this faster because really he's not Jordanian but a Gaza refugee, but I didn't file refugee status as he lived in Jordan all his life but he isn't allowed to leave with no 'country' to go back to as Gaza is not even a country let alone on the list to pick here in VJ sad.gif It could have been a consideration, and sadly, my husband said he was only 50% happy because the rest of his heart is bleeding like his family left in Gaza.

smile.gif I'm so excited, our case got transferred from VSC to CSC today too!! I hope the one month thing rings true even though my NOA1 is Oct 1st and seems like most of those transferred were July... ?

By the way, how do you know when you got touched, I am registered for email on the uscis website and they sent an email to let me know of the transfer but every time I check it on the site it just says the same thing until now when it says it was transferred. Do you get emails saying 'touched' too?

They received them into AVR the 5th too and I feel my anxiousness levels running so high, I should have more to do... but I find myself here now hunting info on the medical exams. You can pay them both, in seperate transactions. I would pick AOS bill first just since it's the natural order. It will take about a day for them to read as status paid, then you can print the cover sheet from each one to mail on your respective packages.
I paid mine within 3 minutes of each other and I mailed my packages in the same overnight envelope.

I got the form from the net, filled it in and took a screenshot so DH could fill it in correctly, had him print it and then fill it in and then scan it to me where I then copied and pasted the barcode I made with our case number per the barcode wiki instructions . Then I emailed the scan as a JPG attachment.
And yes if it says beneficiary was sent a notice that is that they sent the DS 3032. So you could email it by simply sending from her email, some statement that reads with your case number, name and DOB, her name and DOB and like the statement on the 3032 that she is choosing ?you? as her agent. And as mommy suggests you can truly mail a copy if you had her send a scanned one you print. You can overnight any document to NVC through USPS for 17.50.

I read that the photos need to have a light background so as not to interfere with passport, I would hope light blue is ok, but DH's were white... so good luck. And yes the Invoice ID Number comes with the AOS package.

MMW, I did email mine that early as you can see, and they accepted mine about a week later and generated the AOS and IV fee bill on the same day apparently. I had to wait to get my AOS fee bill in the mail so that I could pay them online, both at the same time (seperately) if you know what I mean. biggrin.gif

I'm here, waiting for my fee bills to show as paid, and waiting for the birth certificate to arrive in the mail smile.gif But as I'm filling out the I 864 (I have joing sponsor too) but I just don't know what to put for the line 23 as annual income. Last year I was a student until June and then I went to Jordan, got home in Sept, and Started working in Oct. From Oct 20 til year end I made only $5940. But I'm an hourly employee only assured of 50 hrs biweekly, but I've been working full time hours with bonuses and incentives. So my weekly pay is making me out to earn about 28,000 in 12 months... however that's not what I'm guaranteed. So I have no idea what to put..... HELP!

PS. when I called NVC today they told me that I have to send the original birth cert for DH but I can send a scanned copy of his PCC. It's so ridiculous that they want to handle the original documents.....

When are you leaving, it is sort of bad timing if you wanted to go fast through NVC you might need to take some things with you and you could mail your packages from PI then.
The DS 3032 will be generated and sent to your spouse, but at the same time they will generate the AOS fee bill and send it to you, that's how you'll get your INN so you can pay online (I believe). Then after they approve your payment you send in your completed I 864 package. I believe after the AOS is paid they will generate the IV bill too and after you pay that, you can send in the DS 230 package. When are you leaving? I'm stressed too since I'm leaving in one month I have to finish at NVC before then and I'll have to wait maybe a week for my husband to get his police clearance certificate and I don't know how long it will take for the original to come in the mail. You might want to have your wife go about getting her police certificate now if you haven't done that already. I know my process is going to be delayed for this time until I get his original documents... wahhh.

Ohh, they said my case just got in the building so give them a few days to process it for a case #
And I got the DS 3032, DS 230, Birth Certificate, and Passport copies from DH now we have to pray for the Police Report to be speedy, the guy at the place he has to get it said it can take one week. I'm really thinking to try to mail some scanned copy of it and if they give me and RFE about it, it should get here just soon enough to satisfy it quickly. It's probably going to be in Arabic anyway.....

Ok I heard you that I need to send originals, I did manage to find some VJ'ers who said their PC was accepted scanned but I won't risk it. Anyway, now another stupid questions, I put in some supporting evidence of co-mingling of assets in a joint bank account, but I only got one copy specially printed from the bank. I included it without copying it into my I130 package.... my question is, does all of my package make it to the embassy for his interview? Or is the reason I have to send in so many repeat documents with the IV papers because that evidence is not forwarded through?
I just want to know this so I can know to send my DH to get this evidence again for his interview when that happens, or if I should even try to get him to send it to include with the IV.
There are more, I have three third party affirmed affadavits that weren't copied. I really didn't imagine for one minute that the papers would be lost or not forwarded, quite a large leap of faith I guess after I read these forums more thouroughly.

Oh yah, second question. When you email the DS 3032 obviously you have to copy and paste the barcode, I can do this in paint, but how to save the file? JPG or does it have to be a word file?

Does anybody else know if they would accept scanned copies of birth certificate and PCC?

woohoo, we just got NOA2 approval email (waiting hard copy) on 1/12/2009 and I'm so excited. I told DH that he needed to print DS2032 and sign and mail it along with his PCC, birth cert, another 2 passport photos (I already have 2 extra), and photocopy of his bio page from passport. Did I forget anything? That way we can try to speed it up through NVC when we get there. I think I had a heart attack to see we got approved so quickly, it was a shock really. And wow doesn't it feel awesome to make this progress!
