Sorry, I misread what you wrote about question #8. It appears that you are the beneficiary and you have two children with your petitioner. Is that correct?

Your petitioner fills up the I-134. For question #8, the petitioner includes all of his unmarried children under 21 and anyone else who is financially dependent on him. However, it does not include the beneficiary (you).

For question #11, the Embassy in Manila likes to see that the petitioner intends to support the beneficiary. The petitioner should write a simple sentence saying that he intends to marry you and provide room, board, and any other needs for you and your children.

I would get a second opinion on this. My family is from a different country as well, where back in the days they used to give a TB vaccine (it was mandatory) and because of that vaccine my father had to get a TB test here in the states and it came out positive. His job requires he does medical tests every year. Needless to say every year his test comes out positive on TB, yet when they investigate further they realize it is because of that vaccine he had when he was young. However before they investigate and he gets to see the specialist, they recommend he takes the medicine for TB. THe medicine they give for TB is very strong and can damage your liver. I would as I said get a second opinion before taking strong meds for 6 months. She may also have had that vaccine when she was young. My father had his tests done at a prestigious hospital in NYC and they were wrong.

OP...I hope you recommend to your fiancée that she go to St. Lukes for her medical as soon as possible. If she has an abnormality on her chest x-ray, she needs to have the smear tests and the culture. If the smear tests are positive for TB, I believe they sometimes start the medication right away.

My Fiancee had a mild case of TB 6 years ago and was treated by her physician (she brought all documentation of treatment with her to medical) but from what I understand and what people are recommending here is that you should go to ST Lukes for treatment. If you don't, what will happen is that you will undergo 6 months of treatment at her local physician to then go to St Lukes who will then perform the SMEAR test (3 days) and SPUTUM test (2 months) on top of the 6 months of treatment. Why? St Lukes is responsible to make sure that you are TB cleared and if they didn't do the treatment than they won't trust the results provided by an outside agency. If you use your local physician you could be looking at up to 8 months total process time where if you use St. Lukes it will be completed after 6 Months.

I agree that it would be faster to skip the local doctor and, instead, go to St. Lukes for treatment.

Also, I believe that it is important to go to St. Lukes for diagnosis. The reason I say this is because I have seen cases here on VJ where the local doctor based their diagnosis on a chest x-ray and a skin test. It is my understanding that this method of diagnosis is not a good way to diagnose Filipinos for TB since most of them had the BCG vaccine when they were young. Having had the BCG vaccine will almost always give a false positive on the skin test. The x-ray, combined with the smear tests and the culture is a much more accurate way to determine whether she has TB.

I don't necessarily agree with what you said about St. Lukes trusting an outside agency. My understanding is that St. Lukes will accept an outside diagnosis and treatment if it was done by a reputable clinic/hospital and it is well-documented. However, St. Lukes will still require a chest x-ray, and if they see any abnormality, they will require the smear tests and the culture.

Kudos for a well researched answer. Unfortunately, in this case I think it's beating the wrong horse. The bank is only following the instructions they got from the consulate. You could probably show them all the DoS rules and regulations you want, but until they get different instructions from the consulate then I doubt they're going to change how they do things. Trying to argue this matter with the bank is also likely to take longer than just providing the form and paying the fee. The OP's problem, at this point, is not the form but the lack of time.

I think Old Dominion has a reasonable plan. USC goes to the bank, and applicant goes to the consulate. In all likelihood, the applicant will still be waiting for the interview when USC arrives at the consulate with the visa fee receipt.


It should be noted that Steve and Merly have not yet tried to submit a DS-360, and the DS-160 is an online form.

There is a recent report in the Philippines forum by VJ member "oldlipa" where they submitted their DS-160 online to the U.S. Embassy in Manila, and they received a return email informing them that a DS-160 is not required for K-1 fiancée visa applicants. The Embassy told them to use the old forms instead. Click here for the link to that thread.

I'm wondering whether Steve and Merly will receive the same message from their Embassy when they submit their DS-160. If they do, then what?

I believe that the bank is wrong. The DS-160 is not required for K-1 applicants. It says so on the Department of State web site. Read "Frequently Asked Question" #13. Here is the wording:

13. When I apply for a nonimmigrant visa using the online DS-160, are additional forms required?
No, with two exceptions. When applying at a U.S. Embassy or Consulate that is using the new DS-160, Online Nonimmigrant Visa Application, you will use only one (1) form. For Embassies and Consulates that have converted to this new process, the DS-160 has replaced all of the following forms: DS-156, DS-157, DS-158, and DS-3032, which are no longer necessary.
NOTE: The exceptions are Fiancé(e) Visas (K-1/2) which still require use of the forms DS-156 and DS-156K, and the Treaty Trader/Treaty Investor visa application, which is explained in #14 below.

It is important to check the Embassy or Consulate website where you will apply for your nonimmigrant visa for information on the application process in place. Embassies and consulates worldwide will transition one-by-one to the DS-160. Therefore, those Embassies which have not yet converted to the new DS-160 online form continue to require all application forms, as necessary.


Based on the latest reports from VJ members in the Philippines forum, we also know that the U.S. Embassy in Manila is not accepting the DS-160 from K-1 visa applicants The U.S. Embassy in Manila web site contains a discussion of the DS-160 which has a link to the "Frequently Asked Questions" on the Department of State web site.

Print out the DOS info and also take the links with you to the bank on Tuesday morning. Maybe this will help.

Also, submit an online DS-160...just in case. However, when oneK-1 VJ member did this, they were emailed back saying that it was not necessary, and to simply submit the regular forms...DS-156 etc.

Hi! My fiance and I are now preparing the documents for K1 visa filing and would need your help & suggestions on some documents.
1. Do I need to have my "letter of intent to marry" to be notarized here in the Philippines? Should I sign it on black ink or blue ink?

Your "Letter of Intent to Marry" does not need to be notarized. Sign everything in blue ink so that the document can be easily identified as an original document, and not a copy.

2. What is the size of the picture that I have to send to my boyfriend? I know I have read it somewhere in this website but I cannot find it anymore.

I forget the actual size of the required passport photos. If you go to a company who specializes in passport photos, they will know the correct size, and also they will know the correct background color. Also, you (the beneficiary) will discover that you need many passport photos as you work your way through your visa journey. I forget how many we needed, but it was a lot. Passport photos are needed for the K-1 application (3?), the medical exam at St. Lukes (2?), the CFO (2?), and your AOS (2?). The petitioner will also need a lot of passport photos.

3. In the G-325 form, I had several positions in my present company, should I still itemized each position?

After the U.S. Embassy in Manila receives your packet from the NVC, and the Embassy enters your packet into their system, the Embassy will notify you. The Embassy will probably notify you in less than three weeks. Then you can make your interview appointment, and complete your medical exam.

Both USPS and FedEx are good. But aren't there different addresses to send your I-129 packet to depending on which carrier you use?

Also, if you ever send anything to the Philippines, do not send it via USPS. The USPS turns over your package to the Philippines Post Office once your package arrives in the Philippines. We all know what that means! :whistle: Instead, use FedEx or DHL.

hi there, i am in dallas fort worth area...my fiance now my husband did not wait for 2 years to file the fiance petition, we meet online of feb.2009,,meet in person march 2009 file the petition april got approved in USEM october 2009.

when my husband visited me in the philippines he already brought along with him the Letter of Intent to Marry and the biographic information for me to affix the signature. He also get my NSO birth certificate, 2 x 2 passport size. This are the things that my husband needed for me when he submitted the petition.


Thanks roseTX...you just reminded me about the beneficiary's biographic information. I think the document is called a G-325. Correct me if I'm wrong, but I think he will need three original G-325's to include in his I-129 packet.

You should get started on your I-129 packet. She can collect everything she needs in the Philippines while your I-129 packet is processing at the USCIS.

The only document you need from her right away, so that you can include it in your I-129 packet, is her "Letter of Intent to Marry."

Later on, she will need a passport which does not expire for at least six months after her interview at the USEM. She will also need a CENOMAR, her birth certificate, an NBI clearance, and at least a dozen official passport photos. Make copies of everything...just in case.

I'm just going by memory, so I hope I didn't leave anything out. Good luck on your visa journey! :star:

You did not mention whether you have ever met your boyfriend in-person within the two years prior to filing the I-129F packet. snickers450...Please tell your fiancée not to waste any time looking for the "philippine embassy" in Manila, since there isn't one. Her interview will be at the United States Embassy Manila. :P

You still have to pay it. One of the things you need to pay it online is the barcode generated from your DS-156, which is necessary for the interview. I wasn't too happy either when I heard about this :\

Beneficiaries in the Philippines can not pay the visa fee online. They pay for it in-person at the Banco de Oro (BDO). The DS-156 is not necessary for the visa fee payment. The beneficiary only needs to bring their ID and their NOA2. Also, the beneficiary should bring their interview appointment confirmation email from the Embassy just in case.

And don't forget the medical fee, cost of the CENOMAR, NBI, birth certificate, police certificates (if needed), CFO seminar and visa stamp, plane ticket back to USA and AOS after you get married. It seems to add up after a while, but from what I've read here it is all worth it. I will soon be finding out for my self.

I think you have this pretty well figured out! :lol: But don't forget the domestic travel costs and the hotel stays if the beneficiary is from the province. And what about her going-away party for the barangay? :lol:

Hey snickers450, I tried to reach you on another post you made about the confusion between the petition fee and application fee. Use this attachment please! This was sent to a couple after their petition was approved on May, 2010. It is a step-by-step instruction on what the beneficiary will need or do for the Manila Embassy. The CENOMAR, the visa fee($350), the medical, the interview, the forms,etc. If you are the petitioner, and you are going to be responsible for the visa fee, you need to either wire the money to your fiancee or pay for it yourself at a bank in the Philippines. It has to be paid for before you attend the medical and the interview. Yes, it is the VISA FEE...it covers your forms and passage to the interview and medical. There is going to be a seperate medical fee. Please, download this attachment. I am sure it will really help your confusion. Good luck!

You don't need another medical nor anything else other than a civil surgeon's transcription services. We called many civil surgeons before our AOS, and I can tell you that most of them are not familiar with the AOS process. Many require a full medical exam and/or immunizations. You simply need to find a civil surgeon who knows the drill. We found one who performed the simple transcription in 15 minutes for about $35 or $40.

We sent our package to California Center on August 9. We didnt know about this change. Now we have to wait and see. But I still believe sending to the regular Service Canter is better. Our pack was received. Were waiting for NOA 1.

Sending your packet to your regular Service Center is better only if you think delay is a good thing.

Please read your link again.

They did not file for AOS "the following week." She got her EAD at JFK on July 7. They are filing for AOS the week of September 13.

Also, she did not have a Social Security Card nor a Social Security Number when she arrived at JFK, so there was nothing to stamp.

You can get a work permit (EAD) a couple of months after applying to adjust your status (AOS). When you file your AOS packet, it is free to include the EAD form in your AOS packet.

You legally can't work until you get your EAD. If you apply for your EAD when you apply for your AOS, you will receive your EAD in a couple of months.

Hello, i'm trying to prepare the initial k-1 visa package. I will be using a cosponsor which is my mom. I keep reading that manila doesn't accept cosponsors... but they do make exceptions if you are a student etc.

I've noticed that Manila accepts most cosponsors, especially if the petitioner is younger and is a college student or has just graduated. Also in your favor is the fact that your mother is cosponsoring you. Manila likes to see cosponsors who are close relatives.

I'm currently unemployed and i won't be a full time student until next semester. I'm looking for a job and plan to be a full time student and have work by the time that she will be interviewed by the manila embassy...

Manila will look at your gross income for either 2009 or 2010 depending on when your fiancée has her interview. If she has her interview after April 15, 2011, I believe that Manila will want to see your income tax return for 2010. Manila will also want to look at your current sustained income during 2011, so you will want to send your fiancée several current paycheck stubs. If your current sustained income for 2011 does not put you on a trajectory to earn 125% of the poverty level for 2011, you will definitely need a cosponsor.

will the proof of financial support be required when i send the initial package? or will my fiance need to show that in the interview 6 months to a year down the road?

No, don't send the proof of financial support with your initial package. Your fiancée will submit your I-134, your cosponsor's I-134, and all of your supporting financial documents at the time of her interview at the Embassy. You can send those documents to her a couple of weeks before her interview. When the time comes, send the documents via Fed Ex or DHL...don't send them through the post office.

Also, i noticed in the visajourney guides that for the initial k-1 visa package i need to have a passport style photo of her taken within 30 days.. will i need to submit that? or will it be on her end when she goes to the interview? I don't know how i could possibly get one from her without having her mail it taking weeks.

Yes, you will need to submit two or three (I forgot how many) of her passport photos with your K-1 visa package. You will also need to submit your passport photos with your K-1 visa package. She will need to send you her passport photos that you need for your K-1 visa package. Don't ever send anything relating to your K-1 through the mail. It may take months, or it may never arrive at all. Always use Fed Ex or DHL.

Also, make sure your fiancée gets a dozen or more passport photos. She will need them during every step of her visa journey. She will need two or three when she gets her medical. She will need a couple more at interview time. She will need more when she attends the CFO seminar. And she will need a couple more after you guys get married and adjust her status (AOS).

You likely will have your interview about a month after you receive your NOA2. You will receive your visa about a week after your interview.

It took five and a half months from the time we filed our K-1 packet with the USCIS until Chinook arrived here in the U.S.

It can't hurt to try. I just read of someone who has to have surgery on their shoulder and their expedite request got approved because the recovery period is 6 months and they didn't have anyone else to help take care of them. They just submitted a letter from their doctor.

And his fiancée is a nurse!!! :thumbs:

Maybe you can have someone call the USCIS for you and ask them whether your fiancée's visa can be expedited.
