K-1 Fiance(e) Visa Process & ProceduresSo many questions RE Fiance Visa

You don't think that it is rude to refuse to give me answers because you feel that it is not okay for me to be gathering information at this point? As I have clearly stated, my husband moved out nearly a year ago. Our relationship is over. All that is left is formalities and those formalities are taken care of. It is a waiting game at this point. I want to know what is expected of me now, not when it is late. YOU are the one who is telling me that it is simply not acceptable for me to be asking these questions because YOU are making judgments you are not entitled to make.

I would think that someone who had to go through this- who knows that the laws can be inconvenient and make people who love each other very much wait a long time to be together would be a little more gentle in their approach. I don't need to be told I am not allowed to find out what I need to do NOW, and I don't need people posting little ding ding ding emotes. I feel like I've been trolled, frankly.

Cercy...A belated welcome to VJ!!! :star:

I hope you got the info you needed from this thread so that you can work through your visa journey as smoothly and as quickly as possible.

Nevermind Tim's comments. He's not a troll. He's a good-hearted guy who is going through the visa process and is trying to be helpful in his own way. Like any of us, sometimes he gives good advice and other times he has reading comprehension problems and a blind insistence on doing things his way.

Best wishes.

K-1 Fiance(e) Visa Process & ProceduresMedical

Hi all, just looking to see if the is some info out there with regards to the scheduling of Fiance medical, such as when can it be scheduled.

Complete the medical as soon as you have your NOA2 from the USCIS and your MNL case number from the NVC.

I understand that immunizations are a big part of it, wondering what else. Also with regards to shots what if any shots that might have been given are counted, and what kind of documentation does she need to provide with regards to any she might have already had?

The immunizations will be given on an age-appropriate basis. Chinook had two or three. The chest x-ray is a much bigger issue. If they find any irregularities on the x-ray, the beneficiary will be required to undergo a three-day sputum collection and a two-month TB culture.

One of her local Docs told her she can get a Hepa screening, i am wondering why when that shot is one of the ones given at the medical. Anyway kind of broad questions, but any help as always would be appriciated Thanks.

She won't get a Hepatitis A shot at her St. Lukes medical. If she wants to get that done, she'll need to do it privately.

I just want to ask, whats inside the packet 3 and 4? do I really need to wait for it before I schedule my interview?

your reply is highly appreciated...

God Bless!

Scott already linked you to Packet 3. There is no packet 4.

If you have your NOA2 and your MNL case number, you can pay the visa fee at BPI and also complete the medical. You will be able to schedule an interview once the Embassy receives your physical case file from the NVC and the Embassy has entered it into their system. This takes a couple of weeks or so after your physical case file leaves the NVC. You will know when your case has been entered into the Embassy's system because you will be allowed to set an interview appointment either online or by phone.

Thank you all for the responses!

What is 221g? ya i don't understand why US Em in PI doesn't approve co-sponsors and for that we are skeptical in getting one but my fiance is gonna get his mom or brother as cosponsor. His priority is to be able to reach poverty guideline. How much $$ should he have on bank to put us in safety net with all this financial #######? sorry just getting stressed out now...

and yes we are now waiting for manila case# but right now im not that enthusiastic about that coz of this financial stuff

The American Embassy in Manila sometimes accepts cosponsors for K-1erz. It's worth a try. One thing I would do if I were in your shoes would be to submit an I-864 from your cosponsor along with your cosponsor's I-134. It would show the consular officer that you most likely will have a cosponsor available when you adjust your status in the U.S. This worked for a friend of mine.

Your fiancé can also use assets like cash in the bank to offset the income requirement. I think the ratio is three dollars of assets equals one dollar of income.

Also, in my opinion, I believe it would help if your fiancé attended your interview. Then he can make a personal appeal to the consular officer. I have seen that work before.

Best wishes... :star:

I have my interview on Wednesday in London, I am having my future father in law co-sponsor me. I e-mailed the consular to discuss this and they told me to bring 3 years worth of his tax returns.

Anyone have any experiences of co-sponsor in London? The whole thing is freaking me out, not getting much sleep :crying: :help:

You might have more luck getting responses to your question if you started a new thread in this forum, or in the UK forum.

I think the Currant Year is more important that last year also. I have read: The Philippines wants to go back 3 years.

It's not required to submit three years of tax returns. They are going to look at your current sustained income.

We received our NOA2 last June 24, 2011. You're just one day ahead from us since you received it by the 23rd.
We are also patiently waiting from NVC :( My fiance called up the NVC two weeks after we received our NOA2, but they don't have it yet.
He was advised to send the scanned copy of NOA2 through email and we are waiting for another week before he will call again to inquire.
I know how you feel, but we just have to be patient and wait. Both of us can't wait to be with someone we love.

Don't wait a week to call the NVC. Call every day!

K-1 Fiance(e) Visa Process & ProceduresCase Number
By now, your case likely has been forwarded from the National Visa Center (NVC) to the U.S. Embassy Manila (USEM). Instead of waiting for the USEM to send you a letter telling you that you are eligible to schedule an interview, you should call the NVC, get your MNL case number from them, and then complete your medical, pay the visa fee at BPI, and schedule your interview.

If you are interested in reading the eligibility letter which the USEM will eventually send to you, please click here.

my fiance is with me during my interview, before he flew to Manila we have already plane ticket to US. Just tell the Consul that if the visa is approved tell her/him that you want an immediate pick up for visa. tell them that you cant stay longer because of your work, the consul will give you the purple card, from my interview it took two days wait for me and then i have my visa in hand. The same as my friend too, she just have an immediate pick up in USEmbassy Manila

I'm glad you and your friend were able to get your visas quickly.

It has been reported more than once here on VJ that the Embassy stopped their practice of allowing K-1 visa pickup at the Embassy. I wonder why the Embassy allows some people to pick up their visas at the Embassy and they don't allow other people to do the same.

Hello. What do you mean by approved? Did you receive the first I-797C or 2nd? Just asking as I received my first I-797C in May and am now waiting for the Interview which I assume is next.

"Approved" means you received your second Notice of Action (NOA-2) from the USCIS telling you that your petition has been approved. I think the form number is the one you mentioned...the I-797.

After the USCIS approves your I-129F petition, they send it to the NVC where the NVC will assign it an MNL case number and then forward it to the U.S. Embassy Manila (USEM).

After the USEM receives your I-129F packet and they enter it into their system, they will send the beneficiary a letter telling the beneficiary that they are eligible to schedule an interview.

The beneficiary pays the visa fee at BPI and then an interview can be scheduled either online or by phone. Either the beneficiary can schedule the interview or the petitioner can do it.

K-1 Fiance(e) Visa Process & ProceduresInterview In 2 Days - Need All Your Advice Please
Proof of ongoing relationship: the consular officers in Manila usually don't pay much attention to proof of an ongoing relationship, but they do like to look at your photos.

Psych evaluation questions: they probably won't ask about your psych evaluation since you passed your medical already. If they ask a question about your psych evaluation, just answer it honestly. You really shouldn't worry too much about your psych evaluation. If the doctor thought there was something wrong with you, the doctor would have required a psych test....but they didn't require a psych test.

Fraud interview at the USEM: if the Embassy suspects fraud, they will interrogate you for hours in another room. You will be interrogated by both Pinoy and 'Kano Embassy personnel. They will try to intimidate you and threaten you unless you sign a document admitting fraud. Never sign anything. Always defend yourself. Never give up.

The typical K-1 interview at the USEM lasts five minutes and is a breeze.

I hope you will share your good news with us.

Clarification: the cosponsor should be a close family member of the petitioner.
TahomaMalePhilippines2011-07-27 11:52:00
K-1 Fiance(e) Visa Process & Proceduresco-sponsor
Your petitioner is your sponsor, and is required to submit their I-134 and it's accompanying financial documents. However, if your petitioner does not meet the income requirements, then they can try to use a cosponsor in order to meet the income requirements. In that case, both the sponsor and the cosponsor will be required to submit an I-134 and its accompanying financial documents.

The cosponsor should be a close family member. An aunt might be OK.

The U.S. Embassy Manila sometimes allows cosponsors. A friend of mine successfully used a cosponsor at the U.S. Embassy Manila.

I would suggest that if your petitioner uses a cosponsor, have the cosponsor also supply an I-864 along with their I-134. The beneficiary can attempt to submit both forms at their interview. This will show the consular officer that you will have someone to cosponsor you when you adjust your status here in the U.S.

Reallly? For Manila? I have never heard of this being an issue for Manila. Maybe things have changed. Its funny, I attended my then fiancee's interview and they did not ask for or look at any of our evidence of an ongoing relationship. I guess we just looked like we were made for each other. :D

You guys must be golden! :star:

Both the Filipino pre-screener and the consular officer looked at our evidence of an ongoing relationship. There was another poster in this thread that said the pre-screener looked at their evidence of an ongoing relationship. Also, I've read this many times before here on VJ that they looked at this type of evidence.

It's also very likely that the consular officer already looked at the evidence before the interview. I have a feeling it's one reason why most interviews go so quickly in Manila.
TahomaMalePhilippines2011-07-26 10:57:00
K-1 Fiance(e) Visa Process & ProceduresLet me get this straight

This advice is technically correct, but it can lead to potential disaster if the beneficiary will later be dealing with certain "problem" consulates (in Ecuador, for one of several). In brief, the consulates are not to ignore "evidence of bona fide relationship" that USCIS has seen (and has passed to the consulate). Don't risk the consulate's refusing to accept evidence that's brought to the interview. This has happened. Accordingly, "front-loading" the petition may be prudent.

In order to offer the most meaningful advice, we need to know which consulate the OP will be dealing with.

Hi TBone...It's always an honor to be in the same thread as you and, as usual, you make an excellent point.

I would advise K-1 petitioners who will have their petitions going through the U.S. Embassy Manila to front-load their I-129F petition. This means that the petitioner should include evidence of a bona fide relationship in the petition that is sent to the USCIS.
TahomaMalePhilippines2011-07-26 10:38:00
K-1 Fiance(e) Visa Process & ProceduresLet me get this straight

Now, am I right in saying we should now copy our entire package TWICE?

Then, I, the foreign fiance, should keep this safe and take it with me to my interview in a few months? Correct?

Yup...the petitioner should have a copy of everything, the beneficiary should have a copy of everything, and the USCIS will have a copy of everything.

The USCIS's copy will include the original I-129F, the original G-325s, and the original letters of intent to marry. It's been a while, so I hope I didn't forget anything.

The beneficiary's copy will include original receipts because the consular officer can ask for them at the interview.

The I-134, which is sent to the beneficiary just before the interview, will be an original, as will the updated letter of intent to marry.

For those who are going through the U.S. Embassy Manila, it can be helpful for the beneficiary to take the entire I-129 packet to their required CFO seminar because you never know what they will ask for. This is important because if you don't get a CFO sticker in your passport, you will not be allowed to board your flight to the U.S.

After Chinook's interview, the U.S. Embassy Manila lost my I-134 and its accompanying financial documents. Fortunately, Chinook had copies of everything, so we were OK. She simply submitted the needed documents...after she made copies of them!

Never give out your last copy of anything. Always have a spare.

K-1 Fiance(e) Visa Process & ProceduresInterview for K1 visa next week, any last minute tips.....

The consular officer notifies the foreign fiancé(e) of a scheduled interview once the initial process of checking the submitted documents is complete. The alien fiancé(e) is issued a visa and allowed to enter the US. This visa is valid for 90 days within which the couple needs to get married. Subsequent to that, the alien spouse needs to apply for an adjustment of status to conditional permanent residence status with the USCIS. A joint petition to remove the conditions on the residence must be filed after two years of marriage.

Good luck guys..

I don't know how it works at other Embassies but, at the U.S. Embassy Manila, the consular officers don't notify anyone about their interview. Instead, the petitioner or the beneficiary schedule the beneficiary's interview either online or by phone through the call center.

Also, the K-1 visa allows the beneficiary to enter the U.S. within six months. After the beneficiary enters the U.S., the K-1 is no longer valid. The beneficiary is issued an I-94 at their POE. The I-94 is valid for 90 days.

K-1 Fiance(e) Visa Process & ProceduresI-864 or I-134
The U.S. Embassy Manila does not always accept cosponsors. However, it's worth a try. I would suggest that you have your cosponsor fill out an I-134 and an I-864. It worked for a friend of mine. It shows the consular officer that you'll have a cosponsor when the beneficiary adjusts their status.

Another thing...since you are planning to use a cosponsor, you definitely should attend the interview. I believe it helps in cases like yours.
