K-1 Fiance(e) Visa Process & ProceduresQuestion 10 in the I-134 Affidavit of Support

Have him scan a new one to you. Put that with the incorrect doc. It would help if you gave more info such as where you are.

She's in Manila.

I recommend sending an original I-134, not a scanned one. Any document with a signature should be an original document.

Yes, your name is supposed to be on #10. Have him send you a new one, but don't send it through the post office because it won't get there on time.

K-1 Fiance(e) Visa Process & Procedureswhat to say

And those are all very efficient and run smoothly and quickly with no wasted money, right?

I'll let you decide...

Medicare's overhead is 7%.

The typical private health insurance company has an overhead of 20-35%.

The VA uses their buying power with Big Pharma to get up to 40% off.

You pay full retail for your drugs.

You pay for the multi-million dollar salaries, benefits, and bonuses for your private health insurance execs.

Not even the President of the U.S. makes that kind of money..

Any questions?

Jimbo...

Mary Jean can complete the CFO seminar at any time. The seminar itself takes only a few hours. There are two places in the Manila area that give the seminar, and one in Cebu. However, in order to get the sticker attached to her passport, she has to have her visa first.

The CFO seminar is pretty easy, but be warned...the CFO people can ask for any kind of paperwork they want to. So, it's a good idea to take every scrap of paper from this entire process with her to the seminar. She'll need a copy or two of the bio page of her passport if the Embassy still has her passport. She may also need your divorce papers if any. And they might ask her your mother's maiden name...I'm not kidding! Just take everything.

Check out the CFO web site too. If you have any questions, you can google the info on VJ...there's hundreds of threads about it...or you might want to post your questions in the Philippines regional forum.

Best wishes for a smooth and speedy visa journey. :star:

we did this as well as 3 other couples and they told us we had to wait until they get their green cards this was done before the 90 days wife got her green card on the 2 and went and they told her it would take 4 weeks

You should have talked to a supervisor at the Social Security office. Also, I believe they won't issue a SSN if you are in the final two weeks of your I-94.

K-1 Fiance(e) Visa Process & Proceduresplanning to start fiancee visa

I am a Muslim Filipina would it be a problem at the interview?

It should not be a problem.

i just got my birth certificate last year it is late registration, would that be a problem too? i mean would it be questionable too?

It should not be a problem.

i met my fiance tru internet last august 2009 and he was still married that time he just got divorce last july 2011 and his ex-wife is still living with him because she asked for her to stay till my fiance and his kids leave to US, he is in US military and his ex-wife is a japanese, she didn't file it yet on japanese side about their divorce, but on the American side my fiance already did everything and also at Military side, his status is single, but would it still be a problem when i go for an interview if she didn't do it yet on japanese side?

No problem...you are both single.

as a muslim i don't have also the medical record and i am nervous about the vaccination because i don't have any record, will the doctor/hospital tell me what vaccines should i get?

You don't need any medical records or vaccination records for your medical at St. Lukes. St. Lukes will give you the necessary age-appropriate vaccinations. The cost of the vaccinations are included in the medical fee.

he sent me packages since 2009 till now can i use that too as a proof our relationship? we have pictures too, we met 3 times already, i still have our E-ticket on my email from last year when we went for a vacation can i print it out and used proof too? we have emails too can i print it out and use as a proof?

That is a good start. First, you want to prove you met within the past two years from when you filed the I-129F packet. I sent copies of: boarding passes, baggage claim stubs, the Philippines stamp in my passport, hotel and restaurant receipts, visa statements showing the charges, photos, etc.

You will also want to show a continuing relationship: email, chat, phone bills, snail mail, etc.

if we get married here in the Philippines what are the things we need to do? will it make him easy to get me to be with him? i want to have a clear my mind before we start out plans for now i am still so nervous, i am hoping you can help me... thank you so much....

If you get married in the Philippines, you will file for a CR-1 Spousal visa instead of a K-1 Fiancée visa. The spousal visa usually takes a little longer. Getting married in the 'Pinas takes a lot longer too.

K-1 Fiance(e) Visa Process & Proceduresco-sponsor for fiance visa
Each Embassy can have different requirements. Most of the people here in the Philippines regional forum are going through the U.S. Embassy Manila.

If you are petitioning someone in Afghanistan, you might want to post your questions in the Asia: South regional forum. That way, you are more likely to get help from someone who has experience with the U.S. Embassy Kabul.

You also might want to check the website of the U.S. Embassy Kabul.

K-1 Fiance(e) Visa Process & ProceduresI-134 - HELP

Ok, if I should wait for his paycheck from his new job mean I have to reschedule my interview...my interview is on the 27th and he will start his new job on the 19th of this month. But he will provide me tho the written contract stating the name of the employer and pay..and other info..plus told him to make a written explanation, which I am not sure f it might help..just trying to prepare.

You don't need to reschedule your interview. You will have your fiancé's contracts and his written explanation regarding his new job. You should be fine.

I am glad this are all ok...but another point of concern again. My fiance signed it in BLUE ink...will it be ok? and the answer he made ( computerizes ) were not all in capital letter. Do you think this is already acceptable?

It's all OK. You will be fine.

He had sent me his latest pay stubs good until this August. however, for personal reason he needs to resign and accepted a 6 months contract job which pays more than what he was getting from previous job. He is still eligible for reinstatement. This is so confusing because the job is super new, he even had not go his first pay check hence he will just be starting on the 19th of this month.

He is an independent contract assessor/auditor of 2 prestigious company in the US that is also internationally known. His current work now is an additional to those two.

It's not confusing. You have explained it very well to me. The consular officer will understand your fiancé's situation.

I have to ask him about that, but we are running out of time ..my interview is fast approaching but just in case, I already asked my sister as a co-sponsor and if they need more I have 2 co-sponsor. The W2 from those company may not be necessary as of this time since it is new ( correct me if I am wrong). if they ask for his 3 years ITR and W2, it is good to go knowing that its annual income are in 6 figures as reflected in his tax return which included the year 2008-2010.

You don't need the W-2's from his new companies. You already have your fiancé's 2010 income tax return and his 2010 W-2 showing that he made a six-figure income. You also have his recent paycheck stubs showing that he has had a sustained income in 2011 which would probably be enough by itself to qualify him. To complete the picture, you will have a copy of the contract for his new job.

Since your fiancé had a six-figure income in 2008 and 2009, I would recommend submitting those income tax returns and W-2's also.

I'm not sure why you are talking about a cosponsor. Why do you believe a cosponsor may be necessary even though your fiancé made a six-figure income last year, and probably made at least half of that amount this year already?

Ok I just read the 2 contracts he has as an independent assessor / auditor .. it's not W2, it's just new and his first project will be in October. the other one, I forgot when it was...not sure of the rate. His current one which is for 6 months, that I dont know if it has w2, the contract had not been made yet and I don't have it, I have to ask him if it is W2 since it is also new, but he is being paid more than 10K a month. He btw has retirement income derived from the navy and is also being paid every month with disability ( both from the social security but from the veterans ) so between his disability and retirement if I am not mistaken it is about 20K annual. Since I am not yet taking my children with me, it will be 3 member in his household.

He could almost qualify with his retirement income alone! I don't see any problems with your case.

I am confused of this..some says use a direct family member as a sponsor...and you said not :( He cant get any co-sponsor from his family coz his parents are both dead and no siblings :( would they allow our USC friends?

You don't need a cosponsor. Your fiancé makes far more than is necessary to qualify on his own. My suggestion to both of you is, if you are uncomfortable in any way about qualifying financially, make sure your fiancé attends your interview so he can personally explain it to the consular officer.

Thanks guyz...this is kindda freaking me out...tho with the ITR and W2's I know that those are so much OK..its just that he currently left his old work and will start a new job.

Just make sure you take the information about his new job with you to the interview in case the consular officer asks you about it. You should have information regarding the name of his new employer and the employer's address and phone number. You might want to have some paycheck stubs from his new job.

K-1 Fiance(e) Visa Process & ProceduresI-134 - HELP

Hello "Dean_De", I think Q-7 in I-134 refers to fiance's gross income derived from 2010 and this should be supported with 2010 ITR. Then, we also need to submit recent copy of pay stubs to establish evidence of steady / continuous income. In Q-11, my Fiance answered "intend to permanently provide food, shelter, clothing, and money to me and my kids". I hope this helps. :D I'm not really sure if this is a perfect answer, but, that is what my Fiance stated and I do think it is right. Few more weeks we will have our interview (me and my kids). Hope and pray we have a smooth interview. Good luck to us ! :)

K-1 Fiance(e) Visa Process & ProceduresCo-sponsor -US Embassy in MAnila

Ok, I do have a sister living in the same states and I know his income is more than the 125% poverty guideline. however, she is currently in an LPR status. I am not sure if I can use my cousin tho, they are also USC already and is having a stable job residing in the US. Do they have to write a letter certifying co-sponsorship or the I-134 and pertinent documents are already ok?

I believe the cosponsor must be a U.S. citizen, and I believe the cosponsor should be related to the petitioner, not the beneficiary.

Cosponsor's don't have to write letters, they simply need to provide the appropriate documents. I believe they also have to provide proof of citizenship.

However, I posted in your other thread that you don't need a cosponsor because your fiancé's income is well over 125% of the poverty line.
TahomaMalePhilippines2011-09-11 12:23:00
K-1 Fiance(e) Visa Process & ProceduresCo-sponsor -US Embassy in MAnila
The U.S. Embassy Manila accepts cosponsors for K-1ers on a case-by-case basis. There are no guarantees. They tend to accept cosponsors for those who are young and educated. The best cosponsor is an immediate family member.

To use a cosponsor, the beneficiary should submit an I-134, and its accompanying supporting documents, from the petitioner as well as from the cosponsor. Of course, the cosponsor is required to have a gross income which exceeds 125% of the poverty for the cosponsor's household size. The cosponsor's household size would include, among others, the beneficiary. Also, I believe the cosponsor must be a U.S. citizen.

K-1 Fiance(e) Visa Process & ProceduresSo WORRIED =(
From the U.S. Embassy Kabul website.

Most visa applications in Kabul require an average of 60 to 90 days after the interview for required administrative processing. When processing is complete, the Consular Section will contact you. The Consular Section is open for pickup on Sunday, Tuesday and Thursday from 1 to 4 p.m., and you must bring the visa card that you were given following your interview when you come to pick up your visa. Please note that the Embassy is closed on all U.S. and Afghan holidays as listed here:

The U.S. Embassy strongly recommends that you NOT make travel arrangements before having a visa in your possession. The U.S. Embassy Consular Section accepts no responsibility if you make travel reservations before you have received your visa. We will not expedite visa processing because you have fixed travel dates or have already purchased a ticket.

K-1 Fiance(e) Visa Process & ProceduresI-864, gifting money- is this going to work?!

I'm sorry I keep saying 'suing', I see it as my responsibility to claim government welfare and therefore I would be the one making the decision to put my in-laws in trouble.

I have also been informed that it is my responsibility to make the government aware that my co-sponsor isn't filling their financial obligations and that I could sue them for the outstanding amounts (If I possessed absolutely no moral grounding whatsoever!)

What outstanding amounts? Sue who? What are you even talking about?

Anybody can sue anybody for anything. However, any lawsuit of yours regarding the cosponsor's affidavit of support would have no standing in court. Once again, the affidavit of support is between the cosponsor and the U.S. government. You are not a party to that contract.
TahomaMalePhilippines2011-09-04 18:01:00
K-1 Fiance(e) Visa Process & ProceduresI-864, gifting money- is this going to work?!

It is tricky- I would obviously never in a million years even begin considering suing them

if I was sadistic I could at some point sue them out of house and home.

You have a basic misunderstanding about the affidavit of support. It's between the inlaws and the government. Your lawsuit would go nowhere.

K-1 Fiance(e) Visa Process & ProceduresSputum Test, BCG, Family History, Very Worried

So if you have had a family member that has had TB, yet have been tested. Is it ur opinion that by just saying yes to family history question puts you at risk for a possible spetum test? If thats so, is it still the best thing to do to answer that question yes? Ihave also seen people talking about bringing a recently taken xray with them to the interview does that mean anything to st Lukes?

When Chinook had her medical at St. Lukes, they didn't ask her anything about being exposed to TB. Like everyone else, they gave her a chest x-ray.

By the way, why in the world would anyone not divulge their exposure to TB if asked? If the person actually had TB, they could spread it to others.

St. Lukes will look at x-rays you bring to the medical for comparison purposes, but they (and their x-ray) have the final word.
TahomaMalePhilippines2011-09-13 13:08:00
K-1 Fiance(e) Visa Process & ProceduresSputum Test, BCG, Family History, Very Worried

We could understand and deal with this all a whole lot better if we were really given all the information instead of some little slip of paper and the words of a receptionist. There is really only one person in her family that had TB and that was over 10 years ago, and I very seriously suspect that her mom may have been diagnosed and treated incorrectly because by the time her lung cancer was determined, she was in stage 3 or stage 4. There are also blood tests that produce results much quicker than waiting 8 weeks for a culture to "maybe" grow.

I am certainly most concerned about Eve's health and I certainly wouldn't want to expose anyone to something like TB simply because we didn't want to wait for some test. My biggest problem with the whole thing is that they aren't doing what is in the best interest of the patient. This is the U.S. government doing this, not the Philippine government. Using better testing methods that produce results in reasonable times are possible and not being used. The U.S. is a "super power" and one of the most advanced countries in the world, but we are subjecting people to this kind of treatment? While I am very thankful that up until this point our processing has gone quicker than normal, I honestly feel like by trying to do the right thing we are being punished by a mountain of paperwork and red tape while people who illegally flood our borders everyday seem to get better treatment. How many thousands of illegal aliens are in the U.S. without any of the right medical exams, tests, and vaccinations, yet when someone tries to do the right thing and follow all the rules they lose years of their lives to what everyone on this forum sees everyday.

--Jim

St. Lukes uses the best testing methods for TB; smear tests followed by a culture. Blood tests for TB are unreliable and are not recommended by the World Health Organization.

So true!

Not.
TahomaMalePhilippines2011-09-13 12:58:00
K-1 Fiance(e) Visa Process & ProceduresSputum Test, BCG, Family History, Very Worried

1) Since she had the BCG vaccine, what are the chances of her needing to be treated for TB?
2) What if anything should we be doing between now and her scheduled test?
3) I know that there are test results that come back after 3 days or somthing from the sputum test, what if those are possitive?
4) What do we need to do from a paperwork point of view? The NOA2 says it is valid from 8/16/2011 to 12/15/2011 and this delay could push the timeline beyond 12/15/2011, so do I need to file for some sort of extension?
5) What about all the other supporting paperwork like NBI and CENOMAR, will any of that expire and need to be redone?
6) I know there are some pretty bad worst case timelines, but what is the best case for this kind of delay?
7) Is there any way to get a copy of the X-Ray that St. Lukes is using so that her private doctor could take a look? What about any of the blood test results?

1) That's a good question. I don't know the answer.
2) I can't think of anything you should be doing between now and the sputum test.
3) St. Lukes will let her know the results of her three smear tests shortly after the sputum collection. I'm not sure what the threshold is for treatment, but it seems that some cases with positive results on the smear test go straight to TB treatment. Other cases with positive results seem to wait for the two-month culture before treatment.
4) Don't worry about any paperwork, and don't worry about your NOA2. St Lukes will inform the Embassy about your situation, and the Embassy will cancel your interview. They will also keep your case open because they know you are still trying to move forward with it.
5) I don't know whether you should update the NBI or the CENOMAR. If her two-month culture turns out negative, then she will have her interview shortly thereafter, and her NBI and her CENOMAR will be about three months old. I think it will be OK, but I hope others chime in about it.
6) The best-case scenario is that her smear tests and her two-month culture are negative, and she has her interview a week or so after she receives the results from her two-month culture.
7) It doesn't matter what her doctor says. St. Lukes has the final word. What blood test results are you talking about? On a side note, I believe there's a blood test for TB. St. Lukes does not use it, but you could probably have it done privately. I don't know how long it takes to get results from the blood test, but I doubt if it would take as long as the two-month culture.

St. Lukes seems to "see something" on a lot of people's chest x-rays. However, most of those smear tests and cultures turn out negative for TB. Best wishes. :star:

Sometimes the Embassy loses things. They lost my I-134 and it's accompanying documents.

Maybe you can call or email the Embassy and tell them that you talked to St. Lukes, and that St. Lukes said they already sent your medical results. Ask the Embassy to request your medical results from St. Lukes.

The important thing to know is that, the K1 visa goes with 100% poverty guideline and not 125%. The later comes into play when adjusting status when the i-864 form would be needed for 125% poverty guideline..

Most consulates use the 125% figure with the I-134.
