For K-1ers, most of the time the U.S. Embassy Manila will be looking for a current sustained income above 125% of the poverty guidelines for the petitioner's household size.

If your petitioner has any minor children, they must be counted as part of the household size, regardless of whether they are living with the petitioner or not.

To better your chances of approval, I would suggest that your petitioner attend your interview, and prepare a joint sponsor. However, I would guesstimate that the USEM accepts joint sponsors for K-1ers less than 50% of the time.

Or, he can get a second, part-time job in order to increase his current income.

You should be ok.  Just make sure that the filipino pre-screener and the consular officer are aware that your current income is well above the poverty guidelines.  You should also submit a letter from your employer detailing your hourly wage, etc.

 

 I believe it would help your case if you attended the interview with your fiancée.

At your fiance's interview, the U.S. Embassy Manila will require her to submit, among other things, your I-134 Affidavit of Support, your 2012 income tax return, your 2012 W-2, and your current paycheck stubs.

The consular officer will use that information to determine whether your fiancée is likely to become a public charge in the U.S. Normally, your current sustained income for a household size of two must exceed about $19,000 annually.

If your 2012 income did not exceed $19,000, often the consular officer will then look at your current paycheck stubs to find out if your annualized 2013 income will exceed 125% of the poverty guidelines for your household size. If either of you have minor children, they will be counted as part of your household size, and it will increase the income requirements.

You are allowed to use liquid assets to make up any shortfall in income. For every $1000 you are short in income, you will need $3000-5000 in liquid assets to make up for the shortfall.

If your income is below the guidelines, you can also try to use a joint sponsor. However, the U.S. Embassy Manila doesn't always accept joint sponsors from K-1ers.

You are the sponsor, and you must submit an I-134 along with your 2012 tax return, W-2, current paycheck stubs, and employer's letter.

If you plan on using a joint sponsor, your joint sponsor also must provide an I-134 (or, better, an I-864), a 2012 income tax return, W-2, and current paycheck stubs.

Keep in mind that the U.S. Embassy Manila accepts joint sponsors for K-1 cases, at best, maybe 50% of the time.

The OP just had her K-1 visa interview at the U.S. Embassy Manila and received a 221g from the Embassy. The USCIS does not interview K-1 visa applicants and does not send out RFEs for income.

You don't need to call the Embassy. You need to wait a couple more weeks for your I-797. Often times they arrive after your NVC notification. If it doesn't arrive in the next couple of weeks, call the USCIS and talk to a supervisor. The call center operators are mostly useless. By the way, did you check your spam box?

In the meantime, move forward with your visa journey.

The U.S. Embassy Manila will require you to submit your petitioner's I-134 and your petitioner's 2012 income tax return and W-2. It is usually acceptable to submit a tax transcript instead of a tax return and a W-2.

Most likely, the U.S. Embassy Manila will also require you to submit a few of your petitioner's current paycheck stubs.

The chance of the U.S. Embassy accepting a K-1er's joint sponsor is somewhere less than 50%.

Your 2012 income, plus your 2012 employment insurance, plus your 2013 W-2, plus your proof of your 2014 current sustained income should put you over the top.

However, my advice is to play it safe and to build the best financial case that you can. If you can't submit your 2013 income tax return, here's what I would attempt to submit:

1. 2010 / 2011 / 2012 income tax returns.
2. 2010 / 2011 / 2012 / 2013 W-2's.
3. Proof of 2012 employment insurance income.
4. Proof of 2014 income (pay stubs, etc).
5. Employer's letter.
6. Bank statements.
7. I-134.

You likely won't have to go so far as submitting proof of equity in your home.

Also, tax transcripts are optional, but if you submit tax transcripts in place of the tax returns and the W-2's, make sure you have the tax returns and W-2's available to submit.

You could also have your joint sponsor's documents available, but there is probably somewhat less than a 50/50 chance that they would be accepted. Have your joint sponsor fill out an I-864 instead of an I-134.

In my opinion, attending the interview would give you an edge.

As you are aware, an approved fiancée (K1) nonimmigrant visa petition is only valid for four months from the date of its approval. Consular officers may revalidate the petition several times. Each revalidation is good for an additional four months.

The petition is routinely revalidated provided the officer concludes that the petitioner and the beneficiary remain legally free to marry, and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.

However, if the officer is not convinced that the U.S. citizen petitioner intends to marry the beneficiary, including instances where no action has been taken on the application for a year (i.e., a visa interview for the applicant and submission of required documentation), the petition may be returned to the approving U.S. Citizenship and Immigration Services office.

In my experience, the USEM accepts co-sponsors for K-1ers less than 50% of the time. I've noticed that a co-sponsor is more likely to be accepted by the USEM when the couple is Pinoy, the co-sponsor is a parent or a close family member, and the couple is young and educated.

Chinook and I personally know a young, educated Pinoy couple who tried to use a parent as a co-sponsor because the petitioner was in nursing school and had zero income. As a matter of fact, the petitioner had never had a job. The Filipino pre-screener told the beneficiary that the USEM does not accept co-sponsors for K-1ers, and did not accept the co-sponsor's documents. Yet, the visa was approved anyway.

We also know another young Pinoy K-1 couple where the petitioner fell quite a bit below 125% of the poverty guidelines. At her interview, the beneficiary received a 221g due to the petitioner's low income. They subsequently submitted an I-864 from the petitioner's brother. The visa was approved.

Here is what I would do:

Go to your interview. Submit an I-134 which is dated before he lost his job. Submit his 2012 tax return and 2012 W-2. Submit his most recent paycheck stubs. The Embassy usually doesn't ask for an employer's letter. You just may get approved.

If, for some reason, the consular officer asks about your fiance's current job, tell the truth. The worst thing that will happen is that you will be issued a 221g, which will give you one year to correct the income problem. That way, you would be able to complete your interview and your fiancé would have time to get another job.

It is totally within their discretion to deny a visa if they detect a faint hint of fraud, even if there is none. My woman came the the USA from the Philippines on a k1 visa. She did not marry the sponsor. Her k1 expired yesterday.
Now we have met, we want to get married. She is living with me in the USA. She will stay less than 6 months so she does not incur a 3 or 10 year ban. We want to apply for a new K1 visa. Can we do that while she is still in the USA? We know that she will have to return to the Philippines for the consular interview.


Her K-1 visa expired the day she entered the U.S. Her I-94 allowed her to remain in the U.S. for 90 days. If her I-94 expired yesterday, then she is now an overstay. She has no way to stay in the U.S. and adjust her status because she did not marry her petitioner.

She needs to leave the U.S. She also needs to have her petitioner withdraw the petition. Once the petition is withdrawn, then you can petition her. Your petition is going to get the stink eye at the Embassy because of her back-to-back petitions and because of her overstay.

I haven't looked at the I-864EZ, but it's possible that the co-sponsor could use it. It would be better than using the I-134.

You stand a good chance of approval because the consular officer will place weight on your fiance's current sustained income.

You and your fiancé are both young and educated, both of which are factors in your favor.

Your fiance's co-sponsor is a close family member, another plus.

If he's Pinoy, that would help too.

> Submit letters from both you and your fiancé detailing your educational background and any special skills you have that would make you more employable in the U.S.

>. Have your fiancé attend your interview.
