K-1 Fiance(e) Visa Process & ProceduresLength of time between I-129F and I-134?

Thanks Tahoma...

I will start talking to a CPA about back-filing, to see if it's possible and/or necessary as far as the IRS is concerned.

I would love to attend the interview with her in Manila if possible...do they allow the guy to sit there with her? I will have to see how the job & finances are at that time to see if I can make it work.

What did you mean by letter "CO"?

I will definitely do your letter idea....and provide copies of my bank statements from my US bank, showing me here in the Philippines making puchases at local stores and buying airline tickets that match Passport Stamp dates, etc. Those bank statements also show me making purchases in the US on the short 2-3 week visits home that I did during my two year stay here, so everything matches and just makes sense.

Did you guys do everything yourself or through an agency or Attorney? At first I was really tempted to hire Olvis or similar, but I am thinking we can do this by ourselves.

Thanks again.

J

Yes, the U.S. Embassy Manila will allow you to sit in on the interview. "CO" is an abbreviation for consular officer, the person who will be conducting the interview.

We did everything ourselves. An attorney or a visa service only slows things down and adds unnecessary expense. If you read the guides here on VJ and ask questions in the forums, you can do it yourself too.

Besides, even if you hire someone to help you, you will still be the one who fills out the forms and provides the proof of meeting in person and the evidence of a relationship. You will give it to the attorney and it will sit on his desk until he puts a stamp on it and sends it in. My advice is to work on your visa journey together with your fiancée.

K-1 Fiance(e) Visa Process & ProceduresLength of time between I-129F and I-134?
I like your plan of having a few paycheck stubs under your belt before the interview because the consular officers seem to look at current sustained income and annualize it. That means that you don't have to rely on a 2010 or a 2011 income/tax return to fulfill the income requirement. You just need to be working at a job which pays enough to fulfill the income requirement in order to prevent your fiancée from becoming a public charge in the U.S.

However, the missing tax returns are still a concern. Can't you back-file tax returns for the last two years even if you had no income? I'm not sure how that works. I'm just thinking it would be good to have something to show to the consular officer. You could also write a letter CO explaining your situation. Better yet, attend the interview and explain your situation in person.

At the Embassy interview, how do you/your fiancée plan to show the consular officer a current sustained income that exceeds 125% of the poverty level for your household size?

Are you counting on using a cosponsor?

K-1 Fiance(e) Visa Process & ProceduresMANILA

well come to find out after calling Washington dc manila lost our visa packet

Who says the Embassy doesn't lose things? Not Chinook and me.

Welcome to the club. The Embassy didn't lose my entire packet. However, a USEM caseworker lost my I-134 and all of it's accompanying documents. He lost it after Chinook's interview. She went back to the Embassy the same day that she found out they lost the documents and she submitted copies. She had her visa in hand six days later. By the way, the caseworker ended up finding the "misplaced" documents by the time Chinook received her visa.

If they can't find your packet within a few days, why don't you find out if your fiancée can submit her own copy of the packet. That might speed things up.

hi tahoma. thanks for your quick reply. Let's just say I lost it cause I've been looking everywhere and it's my 3rd time to look everywhere yet nothing shows up. What to do?? I mean I can replace my passport yes, but what about the visa? and the cfo sticker? :crying:

If your passport is really lost, I think I would follow moomin's advice. You need to get busy working on replacing it. You can also replace the I-94 by going to moomin's link. I don't know how you replace the visa, but I can't think of where Chinook needed it after she arrived in the U.S. Maybe she needed to send a copy of it in with her AOS packet.

I wouldn't worry about the CFO sticker because you won't need it for anything.

K-1 Fiance(e) Visa Process & ProceduresDates Question

Are you as stupid as you look? How exactly am I ordering people around? In case you cant tell, I'm just asking questions which is generally what people do on forums such as this. But obviously you're an uneducated fool so I'll just let this rest. :bonk:
Either way, do me a favor and dont reply back to any of my inquiries. You're not the only person on this board. Dont give 2 cents what you've got to say.

^^^ Uh-oh...another order.

And since you are obviously reading-comprehension challenged, I posted your orders below. These are orders, am I right?

K-1 Fiance(e) Visa Process & ProceduresDates Question

It DOES say originals when it comes to the forms so that's another thing that worries me.

I've many times dated something much more current than when I actually signed the form, and dont ever remember that being an issue, so why should this right?

It's amusing watching you try to talk yourself out of doing what you know you should do.

But have you also tried USPS International Express?

K-1 Fiance(e) Visa Process & ProceduresDates Question

What do you mean? I've never lied on anything, and if i DO tell the truth on the 2 forms by putting the date that she actually signed it, then it's going against what you all recommend so that's why I'm a lil confused...

If you never lie on anything, why would you be asking about what to say? You would know to simply tell them the truth. If you had to ask, then there must be more than one answer swirling around in your mind.

By the way, where did I recommend dating the document a different day than you signed it?

Okay so I'm thinking of just putting a month or a couple weeks ago.... they wont know if I sent it to her then she just signed it then sent it back to me anyway, right?

It seems we have come full circle. Since you don't lie, if they ask about the document, tell them the truth about your fraud. It's as simple as that. Right?

At your sweetheart's interview, the consular officer (CO) will want to see her CENOMAR, NBI clearance, and a few photos. The CO more than likely won't ask for letters, cards, and receipts.

If she's still worried, she can show the CO her flood photos. Also, you can email her some photos for the interview so she has a few of you two together.

I definitely would get the passport replaced because the Embassy won't put a visa in a damaged passport.

K-1 Fiance(e) Visa Process & Proceduresadvice for medical exam and my fiance

Can someone tell me exactly what they check and what examinations they do for the Medical screening.

It's almost certain that the doctor at St. Lukes will see the lump. I don't know if her condition will cause a delay regarding her medical clearance. However, there was a recent thread here on VJ where St. Lukes required a patient to get treatment for eczema before they would give her a medical clearance.

I hope she sees a good doctor right away in case her condition is something dangerous.

K-1 Fiance(e) Visa Process & Procedurespychological incapacity annulment
Hi again...

It's good to hear that you completed the psych exam. In a week or two you can get your immunizations at St. Lukes and finally be done with the medical. Then St. Lukes will reschedule your interview. Don't worry about your Notice of Approval expiration date because the Embassy routinely extends the date if you are actively working toward a visa...which you are.

As for your interview, I would not recommend showing any documents to the Embassy on which you are using your fiancé's last name. The consular officer may think you are already married to your fiancé, and that will only complicate things. Besides, those documents won't be needed anyway.

Keep on rolling...and you will be back into your fiancé's arms malapit na! :star:
TahomaMalePhilippines2012-01-23 16:42:00
K-1 Fiance(e) Visa Process & Procedurespychological incapacity annulment
:star: Congratulations for jumping through the first hoop! :star:

Now that you have completed the psych evaluation, you can prepare to jump through the next hoop...the psych test. The psych test will cost P3000 and it will take up most of a day. Then, a couple of weeks later, you can complete the immunizations and be done with St. Lukes.

After that, you can go to your rescheduled Embassy interview, and you don't have to worry because the consular officers are all 'Kano and they understand that the Philippines does not allow divorce, and they understand that getting an annulment is just like getting a divorce in the U.S. They really don't have a problem with it. The doctors can try to scare you all they want but, like I said, I've never seen the Embassy deny a visa because of annulment.

I wish I could find the thread where the OP gave a detailed account of the psych test. From what I remember of the story, the psych test included a lot of written stuff like true/false questions and multiple choice questions. I don't remember if there was an evaluation with a psych doctor. If you have to undergo another evaluation, I hope the doctor isn't as grumpy and confrontational and intimidating as your St. Lukes psych evaluation doctor was.

But...hey...that's how they play the game. You just have to keep things in perspective...they are just doing their job. They are testing you to find out whether you are a danger to yourself or a danger to others. Just understand that...and keep your cool. B-)

When you complete your psych test, maybe you can post your story here. I would appreciate reading it, and I think others would appreciate it too. I think it would help people who have to undergo the psych test in the future.

Best regards to you and your hubby. Always keep you eyes on the prize! :D

K-1 Fiance(e) Visa Process & Procedurespychological incapacity annulment

...my atty said thats the easiest way get my annulment done.

...just tell the truth...

Yup...just tell the truth. Besides, your lawyer knows the truth, you know the truth, I know the truth, Filipinos know the truth, and the doctors at St. Lukes certainly know the truth. The truth is that Filipinos get annulments because there is no divorce in the Philippines, and an easy way to get an annulment is to claim that one or both parties are "psychologically incapacitated." It's as simple as that. That's why it's a good idea to tell the truth...everyone already knows the truth.

Because you have had a couple of annulments, the doctor at St. Lukes will simply do her job and refer you to the psychologist at St. Lukes. Then you will pay the P1000 fee and talk to the psychologist for an hour or less. By the way, the psychologist knows the truth already, so you have nothing to worry about. The psychologist may ask you some difficult questions, but they are simply doing their job. They just want to make sure you're not crazy. So, be confident and tell the truth.

The psychologist can give you the OK to complete your medical, or they can refer you for a psychological exam. If they refer you for a psychological exam, you will simply pay the P3000 and take the exam. When you pass the exam, you can complete your medical and move on to your Embassy interview.

Once you complete your medical, you will have nothing to worry about at your Embassy interview because the consular officers generally don't care about annulments. They know why Filipinos get annulments. Your consular officer will see that you passed the medical and they won't deny your visa because of your annulments.

By the way, I've never seen a report here on VJ by someone who flunked the medical because of an annulment...and I've never seen a report here where someone was denied a visa because of an annulment.

There's a saying here in the U.S., "third time is a charm." I hope it's true for you! :star:

Here's one way to do it:

Step 1: Get your MNL case number from the NVC:

For the NVC:

1-603-334-0700

Press 1 for English
Press 5 for an operator

Step 2: Read this. It's the snail mail that you eventually will receive from the Embassy. Don't wait for it to arrive. Continue moving forward.

Step 3: Pay the visa fee at BPI.

Step 4: The next day, begin trying to schedule an Embassy interview. Keep trying every day until the online system allows you to schedule an interview.

Step 5: Once you have scheduled an interview, fly to Manila. Complete the medical and complete the CFO seminar.

Step 6: Return to Manila to complete your interview. Then fly home and wait for your visa to arrive.

Step 7: When your visa arrives, pack your bags and say your goodbyes. Return to Manila and go to the CFO main office to get the CFO sticker affixed to your passport. Then fly into your sweetheart's waiting arms! :star:

It's a good sign if the Embassy did not return her passport to her at her interview. Then her visa should be forthcoming in a week or two. If the Embassy has further suspicions about your relationship, it could take much longer.
