If that had been the case, your petition would not have expired. The Embassy would have extended the validity of your petition for up to one year, especially since they see progress being made in your case.

The validity of the visa will be the shorter of the period of 6 months from the date of the interview and visa issuance OR to the one year expiration of the medical. SInce MOST people have the medical done and then the interview the validity of the visa is 6 months from the issue date after the interview. So you could post-pone the interview to give you additional time if your medical is recent. Once you receive the visa it is a good idea to see when it expires so you enter the US before that date. For us the wife had her interview and picked up the visa two days later, the expiration date was 6 months after the interview date when they approved her visa as she did her medical 2 weeks before the interview. So unless you did a very early medical or are placed in a long period of AP, your visa should be good for 6 months after the interview which would mean you could wait until February to enter the US. If you should post-pone the interview and arrive in teh US and then when you do the AOS the medical is more than 1 year ago, you will be required to do another medical with a US Civil Surgeon in the US, but I would not let that determine your course of action now. Do whatever is required to meet the family obligation and then get yourself to the US and deal with the immigration issues as they come up.

Why don't you simply delay your interview? The USCIS-approved petition can be extended for up to one year. All you have to do to extend the petition is to keep the Embassy informed of your intentions.

You haven't proven anything yet. That happens at the interview.

At your fiancée's K-1 interview, the Filipino pre-screener and/or the consular officer will ask your fiancée to submit your recent paycheck stubs. Since she won't have any of your recent paycheck stubs, the consular officer will issue her an MNL-IV-22 (221g). The MNL-IV-22 will require her to submit your recent paycheck stubs which prove that your current sustained income qualifies.

Do you think that's a better time to tell your fiancée (and the Embassy) you lost your job? You seriously don't want to open that can of worms!

Besides, what makes you think that your current sustained income won't qualify? How much income are you going to make this year if you add together the income from your job plus your income from employment insurance for the rest of the year?

if your current sustained income falls short, could you qualify on income plus liquid assets? If not, I'd strongly suggest that you plan on attending the interview with your joint sponsor's paperwork in your hand. Either that, or find a job soon.

If all else fails, keep in mind that you and your fiancée have one year from the date the MNL-IV-22 was issued to satisfy the requirements of the MNL-IV-22. That should give you plenty of time to get a job and gather a few pay stubs.

We have called and all they said is we are processing the paperwork and I have to do nothing . I have said what do you need and said nothing it just under review. I have called the embassy main number (214) 571-1600, is there anthor one to call. I just have spoken to call center. How do I get past that?

The medical exam at St. Lukes Medical Extension Clinic (SLMEC) takes two days for most people. The Embassy recommends that you complete your medical one week before your interview. You will need your NOA approval and your MNL case number to be admitted for a medical. There are people who have completed their medical in as little as one day before their interview. Many people complete their medical as soon as they get their NOA petition approval from the USCIS and their MNL case number from the National Visa Center (NVC) because they want to save time in case their chest x-ray shows abnormalities and they have to undergo TB smear tests and a two-month TB culture.

The medical costs about $213, but you pay for it in pesos when you go to SLMEC for your medical.

When you have completed your medical, SLMEC will return your passport to you along with your x-ray CD. They will inform the Embassy that you passed your medical.

You can pay for your IV bill (visa fee) at BPI once you have your MNL case number from the NVC. You can make an interview appointment after you pay the visa fee.

It may take some time to transfer your case from Saudi to Manila.

The consular officer will be looking at your current sustained income. Your employer's letter will not be enough evidence. You need also to submit several of your most recent pay stubs.

If your current sustained income is still flirting with the poverty guidelines, then you should consider attending your fiancée's interview.

Fil-Am, I'd bet that your petitioner's disability income was well North of the $7k income this petitioner has. That is waaaay below federal poverty guidelines. Anything below 100% of FPG is denied as likely to be public charge. The consulate doesn't have to take an additional sponsor on K visas because the I-134 is not legally binding and the consulate cannot accept the I-864 for a non-immigrant visa like the K1 visa.

Of course, they can always attempt to overcome the deficiency by showing 5 times the deficiency in liquid assets.

My K-1'er friend's fiancée submitted an I-864 from my friend's joint sponsor and the U.S. Embassy Manila accepted it. Other VJ'ers in Manila have done the same thing.

I think you are knowledgable enough to know that if you get married in the Philippines your K1 will be abandoned, and you will have to start all over again with the CR1, if you are planning to bring your bride to the USA, unless there is something about this that I don't understand, which is entirely possible. I think you can travel to the USA on the K1, get married, then file for Advanced Parol, then travel to the Philippines, get married there in a full ceremony, then travel back to the USA, and adjust status. I hope that is correct information?

She must receive the advanced parole before she leaves the U.S., otherwise she won't be allowed back into the U.S.

She can file for advanced parole along with her AOS packet. It does not cost extra. She will receive the advanced parole before she receives her conditional green card.

Your situation is the same as mine. I was interviewed last May 13, 2011 and was refused to issue a visa and was given a white paper (221g) and until now Im still waiting. No document needed but they only checked the box "Wait till I can hear from them". I dont want to discourage you, Just be strong and maybe prepare yourself as well. WE have different cases, some cases will take long time and some case will take only short time then APPROVE. Just keep strong and hold on to each other. And dont forget to email the embassy once or twice a week to inquire about your case. Good luck to all of us. Hope we will receive our VISA APPROVAL soon.

My wife was sent a letter and the time for the interview is posted on it. They give you quite a bit of notice. I think ours was about 2 months so you have time to make travel plans if you want to be present. If you do not like the time they give you may be able to call to get it changed but it might end up being later.

^^^ K-1'ers don't work like CR-1'ers do. K-1'ers have a different process.

K-1'ers have to schedule the interview themselves. Once they get their MNL case number from the NVC, they pay the visa application at BPI, and then they schedule the interview either online or by phone.

Thank you! I just have some more questions:

1. Should the co-sponsor's (i.e. my fiance's father) I-134 state his INDIVIDUAL income or can he put there their JOINT income as his parents? Because the INcome tax return they provided is a JOINT income tax return, with only a page in the back there stating each parent's individual income. But, They have also provided W-2 for each parent's income.

2. Is it a good idea to have 2 co-sponsors -- his mom and dad? Or only the parent with the highest qualifying income?

How I wish my fiancé could be present with me during the interview but since we're trying to save right now, he has opted to stay in the US. Thank you for all your help! :star:

You must submit the petitioner's I-134.

I would also submit an I-864 and a W-2 from one of his parents (the parent with the highest qualifying income). The W-2 will show the individual income. Also, submit a copy of the parents' 2011 federal income tax return.

A letter from the parents would be good too. They could show support for your marriage and promise to support you.

Most importantly, I would have the petitioner attend the interview.
