hello guys! its me once again...we are going into our 3rd month of patiently waiting our NOA2(God bless our love, i hope there's no RFE or other hindrances, hope its approved.)im in the process of gathering documents in case the interview is up ahead soon.

my question is: is it really necessary to have another EXACT copy of the petition/I-129F package??? because she only stayed for a short time here in the Philippines that we only got enough time to assemble one copy (the one that we submitted)

1. will this make or break our petition? No, it won't make or break the petition. However, it could delay your visa. An Embassy caseworker lost my I-134 and all of it's supporting documents. Thank goodness Chinook had copies with her.

2. our original petition would be sent back here in the Philippine Embassy anyway right? or will it be sent straight back to me and not go through the Embassy? The original petition will be sent to the Embassy.

3. i read that we need the copy of petition once the NOA2 arrives...is it important to have a copy eventhough the original one would be sent back here in the Philippines? It's not absolutely necessary to have a copy of the petition. However, it is a good idea to have a copy. The copy should include original receipts. The consular officer can ask you to submit them.

4. should my fiancee send the requirements for my interview (the financial support forms, new letter of intent etc.) after the NOA2 arrives or before? After.

What's the maiden name of your fiancée's mother? You will be asked that question at your CFO seminar. If you don't know, you will find the correct answer on your fiancée's G-325A. I hope you have a copy of her G-325A with you.

Yeah...it's a good thing Chinook got a lot of passport photos while she was still in 'Pinas.

She's going to apply for citizenship next month, and I think she'll need yet another passport photo (or two) for that!

I've lost count of how many she's needed throughout our journey, but it's at least a dozen. :o

Really? I knew someone before who paid something inside the embassy. she was told to go at some counter to pay a fee.. alhtough she forgot how much exactly that was 2years ago.

Two years ago you would have had to pay for the Air21 visa delivery fee at the Embassy after your interview.

Now, the 2GO visa delivery fee is included in your visa application fee that you already paid at BPI.

Correction: She can leave the U.S. before she has her AP or her green card. However, if she leaves before she has her AP or her green card, she won't be allowed back into the U.S. on her K-1.

PS...Play it safe and complete the CFO process as soon as she has her visa. Doing the CFO at the last minute is taking a big gamble.

If your fiancée will be interviewing at the U.S. Embassy Manila, I would recommend that you front-load your I-129F petition to the USCIS. That means including proof of an ongoing relationship with your I-129F petition.

Then, when she interviews at the Embassy, she should bring along more (updated) proof of an ongoing relationship.

It's a high fraud country, so play it safe, kaibigan.

So I have a few questions regarding the Fiance Visa and Process.

  • My American fiance is here in the Philippines and is scheduled to go back home in August 2012, the Visa proceedure states that the application must be made to the nearest USCIS where the American citizen lives at, are there other options? Does she have to be there in person?
  • It says that the American citizen should be able to provide the necessary papers to support the Foreign fiance, but last November 2011she was diagnosed with an illness that made her unable to go to work and eventually lost her job and soon after she decided to visit me here in the Philippines for 3 months. I have an uncle living in the US that will be able to provide and sponsor for us if it comes down to that. What are our options?

The I-129F packet is sent to the Dallas lockbox address, just like it says in the I-129F instructions. She can send it from 'Pinas if she wants to. She doesn't have to be in the U.S.

Here's the short answer to your question about joint sponsors: The U.S. Embassy Manila often does not accept joint sponsors for K-1 cases. If you don't want to risk being turned down for a visa because the Embassy won't accept the joint sponsor, one of your options is to get married in 'Pinas and file for a spousal visa. In spousal visa cases, the National Visa Center (NVC) accepts joint sponsors. However, I've seen a spousal case or two here on VJ where the Embassy would not accept the joint sponsor even though the NVC did accept the joint sponsor. But your chances are much better with a spousal visa.

The other option is for your fiancée to get a job that puts her over 125% of the poverty line for her household size.

He sent all originals including the deed to his house and now he feels really stupid why he did that.

Why did he send the deed to his house?

1. Has anyone sent documents through USPS to Manila (First Class) and how long did the recipient get it? I’ve read that there are some which are stolen at PH customs but this aint a package of goodies just really important documents, well who knows?

Once the package arrived in Manila, it was turned over to the Philippines Postal Service for delivery. That can be bad news. The package may arrive some day. On the other hand, it may never arrive.

2. He sent the NOA1 & NOA2 hardcopy, even if I won’t have them we should still be fine since we already have our Manila case number right? I also have the original letter from the embassy anyway with my Manila case no.

You most likely won't need the NOA1 or the NOA2.

3. He still has one copy of the employment letter, printed on the company letterhead but it looks like it was electronically signed and then printed out, is this ok?

The employment letter should be fine.

4. Can the free transcript requested from IRS be submitted in lieu of the 1040 and W2s? Ive read it takes a long time to get an original copy of w2?

Most people submit the federal income tax return and the W-2. Some people submit the federal income tax return, the W-2, and the tax transcript. Some people submit only the tax transcript. However, if you submit only the tax transcript, the consular officer may require you to submit the federal income tax return and the W-2. You can proceed with the tax transcript but, if you want to play it safe, your fiancé should order a copy of his federal income tax return and his W-2 from the IRS. You might need it.

5. We won’t have a copy of the supporting documents anymore from the original package for the petition like receipts of the hotel (during his visit to me in Manila), engagement and wedding ring, etc. I told him we should still be ok since he has a stamped passport and we still have a copy of our domestic flights when we spent a vacation in Bohol. The rest can be reproduced, pictures, hotel vouchers, etc. are we still good?

Again, to be safe, you should have as much of the packet as you and your fiancé can reproduce. In my opinion, the most important thing are the photos. And even though the consular officers usually don't ask for more proof of an ongoing relationship, such as chats and phone calls, it's good to have it...just in case. Also, you could need some of it for your CFO seminar.

6. If the original package he sent me didn't arrive this week, we agreed to build another set. My petition is valid until August, is it wise to go with the medical now without having the exact date of the interview? until when is the medical valid prior to the interview? I am looking into a 2-week gap before but now i don't really know.

First, pay the visa fee at BPI. Then, schedule your interview. Then, complete your medical. Your fiancé has enough time to gather/FedEx/email the documents you need for the interview because your interview won't be for another three or four weeks or so.

If it takes your fiancé a little longer to put together another packet and get it to you, all you have to do is make an interview appointment before your petition expires. The Embassy automatically extends the petition if the case is active. Your actual interview can take place after the August expiration date. You simply need to set the appointment before your petition expires. Also, even if you don't make an interview appointment, you can always email the Embassy and ask for a four-month extension of the petition. The Embassy routinely grants a four-month extension. You can even get an extension of the extension if you need it. No worries!

About your medical: When you receive your visa, you will notice the visa is valid for six months from the date of your medical.

I think she will give the Embassy the address where she wants her visa packet delivered when she has her interview. I'm not sure, but I think there will be a form to fill out at the Embassy. I hope someone chimes in about this.

1. Concerning final divorce decree: I have my papers from the divorce, it is the absolute judgement of divorce.. however it is not signed by the judge.......will it automatically get a rfe.. should I just pay now and wait until I get a certified copy from the court and ask that its signed?

3. My fiancee lives in a remote mt area 40 miles from Bacolod, she is living in a boarding house with no mail access.. If she gets a mailbox at the post office in bacolod, will that be acceptable to immigration or will they insist on a residential address.. 3. Never ever send your documents via the U.S. Postal Service/Philippines Postal Service. You will be sorry if you do. Instead, send them via FedEx or DHL. They will find her. Does she have someone's address in her village she can use? Does she have any relatives in Bacolod? Hopefully, you will need to send her only one packet of your documents, and it will be close in time to her interview. Other than that, she will be able to pick up her passport/visa/visa packet at the 2GO office of her choice. She probably should designate the Bacolod 2GO office as her choice.

You might as well send him an updated I-134 because you're going to have to send him some current paycheck stubs anyway.

Manila accepts cosponsors on a case-by-case basis. It' has been my experience here on VJ that the U.S. Embassy Manila, more often than not, accepts cosponsors for K-1ers. Also, I personally know someone who successfully used a cosponsor for a K-1 in Manila.

The consular officers are supposed to look at the totality of the circumstances when deciding whether to approve a visa. However, it's up to you to build the best financial case possible in order to convince the CO that the beneficiary won't become a public charge in the U.S.

If I were in your shoes:

> I definitely would attend the interview in order to personally explain my circumstances and to make my case. A personal appearance also sends a powerful message to the consular officer...that you are serious about your relationship and that you care enough to be there. I believe that it makes it more difficult for the CO to say no.

> At the prescreening/interview, I would attempt to submit my cosponsor's I-134, I-864, and their supporting documents. Yes, try to submit an I-864. My friend did exactly that. It shows the CO that you will have a cosponsor when the beneficiary adjusts status in the U.S. Having a close relative as your cosponsor is a plus.

> I would try to submit a letter which explained the "big picture" -- fresh college graduate-- low expenses because you're living at home-- cosponsor-- history of employment-- fiancée's education or work history-- etc.
