Occasionally, at the U.S. Embassy Manila, a consular officer will ask the visa applicant to submit a document from the petitioner's USCIS packet.  For example, they may ask her to submit original documents from airline flights or hotel stays.  Or, as occasionally happens, the Embassy may lose documents and ask her to submit replacements.  

 

Also, she may need to refer to your USCIS petition packet when she attends the CFO seminar.  For example, the CFO may ask her for your mother's maiden name.  If she doesn't know the answer, she could refer to the G-325A in the petition packet.

Emailing the Embassy and requesting that they revalidate the petition is a safe thing to do.  However, since you booked an interview appointment before the petition expired, it's not necessary to ask for the petition to be revalidated.  It doesn't matter that the interview date is past the petition's expiration date.  The U.S. Embassy Manila automatically revalidated the petition when they saw that you had  booked an interview appointment.  Booking an interview appointment shows that you are making progress with your case, and that's what Manila is looking for.

When you file the I-129F you will have to include payment of $340.  That is the initial processing fee.  When your fiance (the foreign beneficiary) goes to her interview later on down the road, she will have to pay another fee at the interview of $240.  

If the beneficiary is going to interview at the U.S. Embassy Manila, the $240 visa application fee must be paid before an interview can be scheduled.

^^^  Send copies of receipts to the USCIS.  Take the originals to your interview.

 

Note:  In my opinion, front-loading a petition to the USCIS is a good idea for those who are going to interview in Manila.

The U.S. Embassy Manila approves nurses all the time.  My wife, Chinook, is a nurse and her visa was approved.  Chinook's friend is a nurse and a K-1er.  She was approved also.  

 

The good thing about being a nurse is that you are unlikely to become a public charge in the U.S.  That's a good thing.  

 

More good news:  the NCLEX-RN is less expensive in the U.S. than it is in 'pinas.  It only costs $200 here in the U.S.

At your interview, you will need to submit your petitioner's current federal income tax return and his current W-2.  You will also need to submit your petitioner's current paycheck stubs.

 

If you interview in 2013, make sure the consular officer sees that your petitioner's current sustained income (based upon annualizing his current paycheck stubs) is more than his income on his 2012 income tax return, and that his current sustained income surpasses 125% of the poverty guidelines for his household size.

 

If you interview between January 1, 2014 and April 15, 2014, you have the option of submitting either his 2013 income tax return and his 2013 W-2, or his 2012 income tax return and his 2012 W-2.  In your case, you would want to submit his 2013 documents.  After April 15, 2014, you will have to submit his 2013 income tax return and 2013 W-2  (as well as current paycheck stubs).

I don't agree with you question being moved out of the Philippines forum..   but that is my opinion.

 

Being that at this stage of the process requirements are embassy specific... and they are dealing with USEM... this is not generic a K-1 question.

 

Some countries police clearances can not be obtained (except in person), which USEM is aware of, thus does not require them for those countries.

 

I imagine that the other U.S. Embassies/Consulates are aware of the fact that some countries require you to appear in person in order to get a police clearance.

How nice, K-1 approved.  So on to readying new documents.
 
Oops... question arises:  Do you have any relatives in America?
 
Gee...gosh, we do a sister (half-sister) who travels back and forth from RP (Philippines) to America.  But when queried as to what visa she has we get a blank stare. So something stinks here. 
 
Now I find that having a sister here in America is grounds for denial of the K-1?
 
Gosh...when someone gets a speeding ticket do we haul brothers, sisters, mothers, fathers into Court as being guilty by association?
 
We do everything by the book--honest in all things, at all times and now, what I am hearing is--we're screwed and will be denied.
 
How many millions of illegals do we have in America and we welcome them regardless of their felony record and here, simply because a relative is here legally or illegally--our K1 will be denied?
 
I suppose it makes sense, Obama gives amnesty to a few million and guess what--he's got a few million votes.

But you do need to understand that it wasn't your K-1 which was approved. It was your I-129F.

How about providing some links to people who were denied a K-1 visa at the U.S. Embassy Manila because their relative was TNT.

While you're at it, why don't you provide some links which show the warm welcome being given to all the undocumented felons in the U.S.

And maybe you wouldn't mind explaining how a path to citizenship (and the right to vote) which would take more than 15 years would increase the vote count of someone who has already had his final election.

You stand a better chance of selling shaving cream to the Taliban than you do of having your joint sponsor being approved by the U.S. Embassy Manila. Even if the Embassy allowed you to submit your joint sponsor's documents, your joint sponsor wouldn't qualify due to lack of current sustained annual income.

However, you could get a part-time second job in order to meet the income guidelines. You would want to do so rather quickly because you'll need a couple of pay stubs under your belt before your fiancée's interview, which should be coming up soonish.

Or, your fiancée could go to her interview and take her chances with your current sustained income. What's the worst that could happen? The Embassy would issue her a 221g which would give her one year to submit proof that you meet the income guidelines. That would give you more time to find a job, increase your income, and send her a few paycheck stubs.

If you already filed an I-129F petition, the USCIS likely will reject it outright because your fiancée is not free to marry due to the fact that the finality of her annulment has not been registered with the NSO, so you could not possibly have included her finality document with your I-129F submission. In a nutshell, she's not free to marry because she's still married. Of course, in that case, an expedite would be impossible.

The U.S. Embassy Manila accepts joint sponsors in K-1 cases about 50% of the time. In my experience, a Pinoy couple has a better chance of gaining approval using a joint sponsor than does a FilAm couple.

I personally know one Pinoy K-1 couple who were approved using a joint sponsor despite the petitioner having no income whatsoever. I know another Pinoy K-1 couple who were approved using a joint sponsor where the petitioner's income was several thousand dollars below the poverty guideline for their household size.

The following factors will work in your favor:

> Both petitioner and beneficiary are Pinoy.

> The joint sponsor is a close family member of the petitioner, especially if the petitioner is living with their parents and using one of the parents as a joint sponsor.

> You are a younger couple.

> One or both of you are college graduates.

> You have special training or skills.

> The petitioner attends the interview.

At your interview, the U.S. Embassy Manila (USEM) will require you to submit your fiancé's I-134. However, the USEM will use the guidelines from the I-864. Therefore, he will need to list his two minor children, and his income will need to exceed 125% of the poverty line for a household size of four.

Since his income falls below the guidelines, some options are:

> Make up the difference in income with liquid assets at a 3:1 ratio.

> Increase his income before your interview. Get a better-paying job, or a part-time job.

> Take the risk of trying to have a joint sponsor accepted at the USEM which, at best, is a 50/50 proposition.

> He can attend your interview. I believe it helps.

You should be fine because the consular officer looks at current sustained income. In your case, it's a very good idea to submit current paycheck stubs, an employer's letter, and current bank statements to prove your fiance's current sustained income.

However, if I were in your shoes, I would also have your joint sponsor's documents available to submit...just in case.

Also, I recommend that your fiancé attend your interview with you.

It's not an issue.

The Embassy already will have your fiancé's Social Security number by the time you interview. It's on his I-129F and it's on his G-325a.

Also, at your interview, you'll submit his income tax return and his W-2, both of which contain his SSN.

Even if the Embassy didn't have his SSN, they could get it in a nano-second if they wanted it.
