K-1 Fiance(e) Visa Process & ProceduresGreetings Visa Journey Peeps

1. Send in application

^^^ Yes, you sent in an I-129F, Petition for Alien Fiancé(e).

2. They receive it and send NOA1 and then send to appropriate service center. In our case, (I live in Seattle) I am assuming that it will be the California center.

^^^ Yes, your petition most likely will end up at the California Service Center (CSC).

3. Then they review the application and that takes like 5 months or so?

^^^ Right.

4. Once that is approved, they send NOA2 and from there it goes to NVC or CV something?

^^^ Yes, once the USCIS approves your petition, they send it to the National Visa Center (NVC).

5. Then they send my application to Manila. (my fiancee is Filipina) Then she gets some sort of approval number? Then she can schedule the medical and interview online?

^^^ After the NVC assigns your petition an MNL case number, they forward your approved petition to the U.S. Embassy Manila. Once the Embassy receives your case file, they send a letter to the beneficiary informing them that they are eligible to schedule an interview. The letter also details the interview preparation instructions.

However, you should not wait around to receive the letter because it will set you back a month or more. Some people never receive the letter. Instead, you should start calling the NVC about a week or so after the USCIS approves your petition, and keep calling until you get your MNL case number from them.

Once you have your MNL case number, you can pay the visa application at BPI, schedule an interview either online or by phone, and complete the medical. This will speed things up a lot.

You can read the Embassy letter here.

6. Then I send her some money to pay for the medical and a hotel in Manila for 2 nights so she can stay for medical. Are the medical exams and interview at the same time? Can you schedule it that way?

^^^ The medical usually takes two days. However, if you come in early enough and St. Lukes is having a slow day, you may get the medical completed in one day.

Many people complete the medical a week or two before the Embassy interview. Some people complete the medical much earlier because they want to get a head start in case they have to undergo an eight-week TB culture at St. Lukes. A few people push the limits and complete their medical a couple of days before the interview. Some of those people have even hand-carried their medical results to their Embassy interview because St. Lukes could not deliver them in time for the interview.

My wife, Chinook, is from Bacolod City, Negros Occidental. She spent two weeks in Manila to complete her medical, complete her Embassy interview, and attend the Commission on Filipinos Overseas (CFO) seminar. Then, after she received her visa and returned to Manila on her way to the U.S., she stopped by the CFO main office to get the CFO sticker attached to her passport. Your fiancée will need a CFO sticker in her passport in order to board a flight to the U.S.

7. Then at some point she has to attend a class to leave to get a sticker on her passport?

^^^ Yes, she has to attend the CFO seminar and get a CFO sticker attached to her passport. There are two ways to do this. She can complete the CFO seminar before she has her visa. Then, once she has her visa, she will have to return to the CFO to get the sticker. Or, she can wait until she gets her visa and then attend the seminar and get the sticker at the same time.

8. Then they send her the visa? And this happens within a month of the interview/ medical?

^^^ Once she passes her interview, she'll receive her visa usually in a week or two...sometimes more and sometimes less.

9. Then she comes here. How do you know when to book a ticket? It seems like there is not a lot of advance notice.

^^^ Book the ticket when she has her visa in hand.

10. Then we marry and live happily ever after. ;)

^^^ That's the plan! :star:

What can I do to speed things up? I have heard that I can schedule the class she has to take before she does the medical/ interview.

^^^ See #5 and #6 above.

She already has a passport and a clean police report. How close to the interview does the police report need to be?

^^^ In my opinion, she should get her NBI clearance and her CENOMAR within one month before her interview.

Is it really going to take around 9 months no matter what I do? I want to do everything possible to get her here asap.

^^^ It could take that long, or it could take less time if everything falls into place.

It will take a lot longer if St. Lukes finds any abnormalities on her chest x-ray. In that case, it'll take about nine extra weeks to complete a TB culture. If the culture is positive, then she can look forward to a minimum of six months of treatment.

Thanks in advance for any info.

^^^ Walang anuman...and best wishes for a smooth and speedy visa journey! :star:

Peace,
Jason

K-1 Fiance(e) Visa Process & Proceduressome question about what to bring on interview

hello... i just want to ask if i need to bring the first packet too.in the interview day at manila usem? if so how will i put dates in there.. the present date or the date when we sent the first packet.... thank you

Bring everything to your interview.

Your fiancé should send you a photocopy of the I-129F packet he sent to the USCIS. It should include original receipts. Bring it to your interview.

There is no issue with dates because everything that needed dates is already dated.

I've heard of next-day visas at the U.S. Embassy Manila, but that was quite a while ago. I seem to remember that they were requested at the time of the interview, and occasionally the request was granted.

You might want to check with the IV Unit at the U.S. Embassy Manila and see what they say. Here's a link to the email address:

Greg...Here is the U.S. Embassy Manila letter which tells your K-1 beneficiary that she's eligible to schedule an interview and gives instructions on how to prepare for the interview: USEM Manila link.

Make sure that she doesn't wait around for the Embassy to send that letter because it takes a long time to arrive. Sometimes it never arrives.

By the way, they each have to pay a $240 visa application fee, for a total of $480.

K-1 Fiance(e) Visa Process & ProceduresK-1 visa--90 days expiring soon
Her visa expired when she arrived in the U.S. When she arrived, she was issued an I-94. Her I-94 is the document that allows her to stay 90 days in the U.S. Her I-94 expires on February 13.

Shortly after she files to adjust her status, the USCIS will send her a letter saying that they received her application. That letter is the legal document that allows her to stay in the U.S. until she gets her conditional green card.

The consular officers in Manila like to look at photos. Don't worry about not having a time stamp on the photos. Just write the info on the back of the photos. However, bring all of the other evidence you have. You'll be fine without snail mail and phone calls.
TahomaMalePhilippines2013-01-04 11:56:00
K-1 Fiance(e) Visa Process & ProceduresGot CONFUSED about NOA! :(
When the USCIS receives your petition and sends you a response, people usually refer to that response as the NOA1. When the USCIS approves your petition and sends you a NOA, people usually refer to that NOA as their NOA2.

However, the petition-approval notice really should not be referred to as the NOA2 because in some cases the USCIS sends a NOA which is an RFE (Request for Evidence). That makes the RFE NOA a NOA2, which makes the petition-approval NOA a NOA3. You can see where this is going...

A NOA is a NOA is a NOA. The petition-approval NOA is not always a NOA2 and really shouldn't be referred to as such.

Hopefully, your second NOA is an approval notice...and not an RFE.

K-1 Fiance(e) Visa Process & ProceduresPositive TB Culture - How to extend NOA 2?

In reference to the expiration of the VISA approval notice, I had been advised to have my fiance contact the embassy and submit the re-affirmation of intent to marry which contained the following sentence: "I am also requesting that the expiration date of the K1 Fiancée Visa approval notice be extended."

^^^ I agree with emailing a request to the Embassy. However, you should have requested that your approved I-129F, Petition for Alien Fiancé(e) be revalidated (extended), not "a visa approval notice."

All you need to do for the extension is call the embassy and let them know what's happening. It shouldn't be any problem at all.

I can't make a guarantee, but that's all we had to do. Our's was about to expire in a month too. I was worried just like you are now, so I called and told them it was about to expire and their reply was pretty much, "okay, we'll extend it." It really was that easy. Hope your experience will be the same.

Normally, St. Lukes will notify the Embassy that a person is undergoing TB treatment and the Embassy will routinely revalidate the petition. However, a phone call to the Embassy is a good idea too. If it were me, I would email the Embassy. Either way, the Embassy will revalidate the petition for another four months. The Embassy will continue to revalidate a petition for up to one year.

You do not have to wait for the letter from the US Embassy. It is the same as the one you downloaded.

1. Yes, you can now pay at the BPI for the K1 visa fee (Php 10,080). Bring your passport and the printed receipt. After payment, you can schedule your interview online. Ask your fiancee for your MNL case number and priority date (date USCIS received your petition). You will need those. Schedule your interview here: http://www.ustraveldocs.com/ph/

2. No need to send documents to the embassy. Bring them on your interview.

Good luck! :)

K-1 Fiance(e) Visa Process & ProceduresPapers Needed for Petition

My fiancé is a Filipina currently living in the United Arab Emirates, where we met. Since she is not physically in the Philippines now, it is taking a while to get some of her required documentation. So my question is, do I need all of the supporting documentation to be filed with the petition, i.e., police reports, birth certificate, annulment papers? Or can I submit the petition without all the supporting documents, and have her provide them when she files the visa application?

You should submit your fiancée's annulment finality along with your I-129F packet because it will help fulfill the USCIS requirement that she's free to marry. You might want to include her annotated marriage certificate too. She will also need a copy of her annulment papers for her medical at St. Lukes and again when she attends the CFO seminar.

Your fiancée will submit her UAE police report at her Embassy interview. Also, she will submit her NBI clearance at her Embassy interview.

Here's the letter the U.S. Embassy is supposed to send your fiancée once they receive your approved petition. It tells the beneficiary that they are eligible to schedule an interview and it gives them interview preparation instructions: USEM letter.

...when I read the instructions for I-129, the police reports were shown as documents required.

I can't find anything on the I-129F or it's instructions where it mentions the beneficiary's police report. Where did you see that?

It's only been five business days since your interview. Most K-1 visas take longer than that at the U.S. Embassy Manila. It can take up to three weeks. The average time probably is about 7-10 days.

K-1 Fiance(e) Visa Process & ProceduresWhen do we pay visa fee?
Here's how it works for K-1'ers in Manila:

1. As soon as you have your MNL case number, the beneficiary can pay the visa application fee at BPI. Do not wait for the Embassy to send the beneficiary a letter. The letter takes a long time to arrive. Sometimes it never arrives. If you want to read the letter, click here.

2. About 4-24 hours after paying the visa application fee, schedule an Embassy interview appointment either online or by phone. If scheduling online, print out two copies of the appointment confirmation page. If scheduling by phone, print out the email confirmation.

3. Use the appointment confirmation page to be admitted into St. Lukes for the medical. Complete the medical a week or two before the Embassy interview. The St. Lukes medical is on a walk-in basis only. They do not accept appointments. However, it will save time on the day of the medical if the beneficiary pre-registers on St. Lukes website and brings the filled-out form with them on the day of the medical. St. Lukes website.

K-1 Fiance(e) Visa Process & ProceduresWhen do we pay visa fee?

You pay the visa fee at the embassy, just before your interview. It takes a bit of time until you get your packet 3 from the embassy so just hang in there. You collect the doc needed, as requested in the packet ( which is really nothing more than a letter), send the letter back indicating you have everything ready, and then packet 4 comes, which is your interview date.

^^^ That's not how it works at the U.S. Embassy Manila.

What do you mean by "denied again?"

Without knowing anything about the "denial," I would say that the applicant should attend the interview. If the consular officer won't accept the police clearance, the consular officer will issue the applicant a 221g which will tell them that they have to submit an updated police report before a visa can be issued.

K-1 Fiance(e) Visa Process & ProceduresFew questions before doing medical and interview! Help!!

According to St. Luke's Medical, YOU MUST HAVE a "hard copy" of the mnl letter with the number on it before they will schedule an interview for you..,.,.I have my MNL number.,.,.,but cannot do anything until I get the "hard copy" and forward it to the Visa company handling my petition in the Philippines.,.,..St. Luke's web site says the same thing, MUST have letter or e mail with MNL number on it!!! I asked for mine Monday, requested both snail mail and e amil!!! Do not know which will get here first!

You do not need a hard copy of the "mnl letter" (the letter from the NVC with your MNL case number on it). St. Lukes website does not say that you need it. St. Lukes website wants K-1'ers to bring their Embassy interview appointment letter you print out when you make your interview appointment. I believe the "instruction letter from the NVC" is for people who applied for a spousal visa.

Here is what St. Lukes website says:

Appointment letter from the Embassy or Instruction letter from the National Visa Center (NVC), if available.

St. Lukes link

As a side note, the letter from the NVC which is sent to K-1'ers can also get you admitted into St. Lukes for your medical, but it is not the document St. Lukes prefers for K-1'ers. A few VJ'ers have reported that they were admitted for their medical without their interview appointment confirmation printout and without a printout of their letter from NVC which has their MNL case number on it. They simply told St. Lukes their MNL case number.

K-1 Fiance(e) Visa Process & ProceduresFew questions before doing medical and interview! Help!!
I see that your I-129F petition was approved by the USCIS on December 19. Now it seems that you have received a letter from the NVC. Does that letter have your MNL case number on it? If so, then your fiancée should pay her visa application fee at BPI, then schedule an interview online, then complete her medical.

If you have not received your MNL case number from the NVC, then you should call them and get it.

When scheduling an interview online, print out the appointment confirmation. That's the document she needs to be admitted into St. Lukes for her medical, and she also needs it for her Embassy interview.

The only thing the Embassy sends to K-1'ers is a letter notifying the beneficiary that they are eligible to schedule an interview and giving the beneficiary instructions on how to prepare for the interview. However, don't wait around for the Embassy's letter because you will waste a lot of time waiting for it. Sometimes it never arrives. Instead, get your MNL case number, pay the visa application fee, schedule an interview, and complete the medical.

If you want to read the Embassy's letter, click here.

K-1 Fiance(e) Visa Process & ProceduresI134 Question1 - is it multiple choice?

Hi - the topic says it all really. I've resided in the US since 1996 and became a citizen in 2007. Obviously part 1a applies to me, but does part 1d too? I have an 'A' number.

I filed the I129F last month so i'm just trying to get all the information i can filled in for the next step and this is the last thing i'm unsure of. I did a search but didn't find any topic answering this question specifically.

Thanks in advance for any useful help!

K-1 Fiance(e) Visa Process & ProceduresSt. Lukes Vaccination Sheet marked incomplete
Some people submit their St. Lukes vaccination sheet and are fine. Others get RFE's. It's safer to have a civil surgeon transcribe your vaccination sheet onto an I-693. That's what Chinook did. It took about 15 minutes at the civil surgeon's office and cost about $35-40.

Edit: Chinook's vaccination sheet from St. Lukes was just like yours...some vaccinations were marked as not medically appropriate and some were marked as not enough time interval. Technically, your vaccinations are complete for AOS purposes even though the form is marked as incomplete.

K-1 Fiance(e) Visa Process & ProceduresK1 VISA QUESTIONS
There is no document in the U.S. which is equivalent to a CENOMAR, and there is no requirement to provide one in order to get your visa. However, if he's been married before, he needs to submit his divorce papers to the USCIS along with his I-129F petition. Also, you would need to submit his divorce papers at your interview and at your CFO seminar too.

Since your fiancé is Pinoy, it's a good idea to get his CENOMAR from the NSO. The CFO people may ask for it. It's possible that the Embassy could ask for it too.

K-1 Fiance(e) Visa Process & ProceduresK1 VISA QUESTIONS

Hi all VJers..

I was reading all the guidelines here and am trying to digest everything as I can. After a couple of days reading about this site I could say it is very much helpful for a new members like me. I had already posted some of my questions before and thank you to all VJers who have responded my query. As a result, after rereading the guides and some helpful tips somehow reduce the anxiety I feel. But for some reasons I still have situations that I couldn't find an answer and I don't have anyone to ask but you guys. This is how it goes:

1. My fiance will have his naturalization interview this month (He is a Filipino, he decided to apply for citizenship last July of 2012 after being in the US for 20 years). If he will get his certification after this month he will file a K1 visa for me. My question is..Is that okay? Does the USCIS will not question about it?

2. I had an I140 , IMMIGRANT PETITION FOR ALIEN WORKER filed last 2005 I think, and the status is still for initial review since March 4, 2010 and I haven't follow up with the employer since then. Does this I-140 will give a conflict for my petition of K1 visa?

3. I worked in KSA for 3 years from 2008-2011. It says that if you were able to live in other countries for more than 6 months you need to secure a Police Clearance. I read in the reciprocity guidelines of USCIS that police clearance is no longer required for third countries nationals who no longer resides in the Kingdom. I read in some post that they are required which makes me confused now. Is there someone who had already their interview and were able to work in KSA and provide Police clearance for K1 visa requirements? I just wanted to make it sure if US Embassy Manila didn't asked for it.

4. Does my Filipino fiance (soon to be US citizen) needs to file his Birth certificate along with the I-129F petition aside from a copy of the passport?..If so, does it need to be certified copy with the red ribbon at DFA?

5. When is the best time to gather the Affidavit of Support? What are the list of supporting documents that needed to be prepared for I-134? Does I-134 needs to be notarized?

6. My fiance using the address of his Aunt for mails and notices (coz that's where he lived before and not able to update yet) Can we used the current address where he lives now(in his own house)?

7. And lastly about CENOMAR (Certificate of No Marriage) Is both of us (petitioner and beneficiary) need to file this and include in I-129F app to prove that we are single? Or it is just need in US Embassy Manila for interview?

I know it is a bit long guys. But I hope you could help me to ease some anxiety and to clear my thoughts so we could file this coming Feb *_*

I know I should be posted in Philippine forum about this but can't find it. Sorry But any opinion, suggestions are welcome and it would be a huge help for us starters.

Thank you and God bless us all!

1. Yes, it's OK for your fiancé to file an I-129F petition for you after he is naturalized.

2. I don't know if an I-140 will conflict with his I-129F petition and your K-1 visa application, but my instincts tell me that it won't be a problem.

3. The U.S. Embassy Manila will not ask you for a KSA police clearance since you no longer live there and you are not able to get one.

4. According to the K-1 visa guide here on VJ, here are the options for your fiancé:

Copy of the Birth certificate (front and back) for the US Citizen or a copy of ALL pages of the US Citizen's passport issued with a validity of at least 5 years or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

VJ Guide link.

During the fiancé(e) visa process, you only need NSO birth certificates, no red ribbon birth certificates.

5. The best time for your fiancé to send you his income tax return, W-2, paycheck stubs, employer's letter, I-134 Affidavit of Support, updated letter of intent to marry, and proof of an ongoing relationship is shortly before your interview...about three to six weeks before your interview. The I-134 Affidavit of Support does not have to be notarized.

6. Yes, he can use his current address. He needs to send the USCIS a change-of-address form. I forgot the number of that form.

7. I think it's a good idea to include both CENOMARs along with his I-129F petition. Also, you will be required to submit your CENOMAR during your Embassy interview. It's a good idea to have your fiancé's CENOMAR available at your interview. You should also have have copies available for your CFO seminar.

The Philippines forum is just there. :)

K-1 Fiance(e) Visa Process & ProceduresI am in need of advice for Co-sponsorship
Will she interview in Bahrain, or will she interview in Manila? I don't know much about Filipino K-1ers interviewing in Bahrain. However, sometimes the U.S. Embassy Manila (USEM) allows cosponsors for K-1ers and sometimes they don't.

> A Pinoy friend of mine was about $5000 under 125% of the poverty line, but his Filipina fiancée still got her K-1 visa from the USEM. At her interview, the consular officer gave her an MNL-IV-22 (221g) because of his lack of sufficient income.

About one week after her interview, he sent her both an I-129 and an I-864 from his cosponsor. He also sent the the cosponsor's supporting documentation for those forms. She submitted them to the Embassy and she received her visa a week ot two later.

He is a Pinoy who is in his mid-twenties, was born and raised in the Philippines, and is now a U.S. citizen who is living in the U.S. His cosponsor is his brother. My friend was not a student at the time and he is not a college graduate. He was living at home with his mother (in the U.S.). His fiancée is not a college graduate.

> I also know a Pinoy guy who is in his mid-twenties and who went to his K-1 interview at the USEM and was approved despite the fact that his Pinay petitioner lived at home with her parents, was a college student, had no job, and had no income whatsoever. He himself was a college graduate.

The Filipino pre-screener told him that the Embassy didn't allow cosponsors for K-1ers. However, the consular officer accepted the cosponsor (her parents) and he received his visa a week later.

> If you don't have adequate current sustained income, or you don't have about $60,000 in liquid assets, then it's going to be hit or miss at a USEM interview. As was mentioned previously, the consular officer looks at the totality of the circumstances when deciding whether a K-1 applicant is likely to become a public charge in the U.S.

...also who qualifies to be a sponser on the I-134?

You are the only one who can sponsor your fiancée. A few weeks or so before your fiancée's interview at the U.S. Embassy Manila, you need to send her your completed I-134 and it's supporting documents. She will submit them at her Embassy interview.

If your income is below 125% of the poverty line for your household size, your fiancée can attempt to submit, along with your I-134, a cosponsor's I-134 and it's supporting documents. The cosponsor should be a close immediate relative of yours, like a parent or a sibling.

The U.S. Embassy Manila sometimes accepts cosponsors for K-1ers. Often they don't.

K-1 Fiance(e) Visa Process & ProceduresQuotas on fiancee visas for the Philippines?

Administrative Processing. There is a whole section on the forums for this. Have a search. This happens to a lot of people not just people from the Phils. They could ask for more evidence or just say you have to wait till they contact you.
