@pigmonk, thank you! I am hoping for that...because I had read in some forums that also applied for a K1 and a nurse too wasn't able to passed the interview. But we hope it is different in our case though.

Chinook is a nurse and she had no problem getting her K-1 visa. Chinook's friend is also a nurse and she had no problem getting a K-1 visa. There have been many Pinay nurses here on VJ who had no problem getting their K-1 visas. I believe that being a nurse may be an advantage for you because the consular officers at the U.S. Embassy Manila know that you won't become a public charge in the U.S.


How about the I-140 application?..Do we need to cancel it or just leave it?.

I don't know whether you should cancel it or not. I don't think it will interfere with your K-1 process. However, you probably don't need it since you will coming to the U.S., passing the NCLEX-RN, and getting a job.

If you want to speed things up, you don't have to wait until your case file reaches the U.S. Embassy Manila.

Here's what you can do right now:

1. Once you have your MNL case number, pay the visa application fee at BPI.

2. 4-24 hours after you have paid the visa application fee at BPI, schedule an Embassy interview appointment either online or by phone. If you schedule online, print out some copies of the confirmation sheet. If you schedule by phone, print out some copies of the confirmation email.

3. Complete your medical at St. Lukes a week or so before your interview. You can use your MNL case number, your interview appointment confirmation sheet, or a copy of your interview appointment email in order to be admitted into St. Lukes for your medical.

4. Attend your Embassy interview.

5. Complete the Commission on Filipinos Overseas (CFO) seminar and get a CFO sticker attached to your passport. You can complete the seminar either before your interview or after you have received your visa packet from the U.S. Embassy Manila. However, you can get a CFO sticker attached to your passport only after you have your visa.

Read this letter from the U.S. Embassy Manila. However, don't wait around to receieve this letter from the Embassy because you don't need it for anything and because it may take a month or more to receive it. Sometimes it never arrives. Instead, read it and follow the instructions on how to prepare for your interview.

It's unclear from your posts whether you are the petitioner or the beneficiary. No matter. For Manila-bound petitions, here's what to do when the I-129F petition is approved:

1. A couple of weeks after the petitioner receives USCIS approval of the I-129F petition, the petitioner should start calling the National Visa Center (NVC) every day until the petitioner gets their MNL case number.

2. When the petitioner and the beneficiary have their MNL case number, the beneficiary can pay the visa application fee at BPI.

3. Four to 24 hours after paying the visa application fee at BPI, either the petitioner or the beneficiary can schedule an Embassy interview appointment. The interview appointment can be scheduled either online or by phone.

4. Don't wait for the Embassy to send the beneficiary a letter telling them that they are eligible to schedule an interview and giving them interview preparation instructions. The wait for this letter will set you back a month or more. Some beneficiaries never receive the letter. Instead, just get the MNL case number from the NVC, pay the visa application fee, and schedule an interview.

5. Once the interview is scheduled, the beneficiary can complete the medical at St. Lukes.

The petitioner and the beneficiary can prepare for the interview by reading the Embassy letter. Here's the link.

Do I really need to acquire one? The problem is, I don't live with my parents. They're residing in Japan. So I have no idea how to ask it from them. Can another relative do it for me instead? 1.  Since you are 23 years old, the CFO could require you to submit a parental advice form.

 

2.  You can send your parents a parental advice form, have them get it notarized, and have them send it back to you.

 

3.  If your parents will not sign the parental advice form, your lawyer can legally arrange for one of your relatives to have the power of attorney over you.  Then your relative who has the power of attorney over you can sign the parental advice form.

 

4.  Your fiancé (the petitioner) does not need to submit a parental advice form.

as long as you have that, you will not need to send in any W2's because the tax returns show the amounts.

 

^^^  For K-1ers, Manila wants only the current income tax return.  Also, Manila almost always asks for a W-2 to accompany an income tax return.

 

 

 

No need for 1040s and/or W-2s if submitting ITRs

Let's see what the U.S. Embassy Manila says about the matter in their interview preparation instructions for K-1ers: 

 

EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner?s ability to be financially responsible for you. You should also submit your petitioner?s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134.

I work for / through a Staffing Agency and I just learned from a company rep that they usually do not do any letters concerning their employees . I am thinking of just sending the Form I - 134 to my fiance along with photocopies of all check stubs since I have been on my job since February 2012 and  IRS 1040 for a few years back and of course for Tax Year 2012 will show this job and also 2 photocopies of my last  2  payroll checks w/ a letter from me stating that I am a full time employee and the check stub will show that . If Manila Embassy does not approve of that while my Fiance is at her interview , they will just send me an RFE and not make her do interview again ....is this correct ? Thanks ............Terry

^^^  The U.S. Embassy Manila version of an RFE is a 221g (an MNL-IV-22).  They issue them to the beneficiary at the end of the interview.  You have one year to satisfy the requirements of the 221g.

 

 

It's ok without the employment letter. Just send latest 1040, W2 and few months of current paystubs to support your I-134. Good luck!

I am also trying to figure out the NVC stage too. I am 4/20 NOA 2 recipient. 
 
I am totally confused about us calling the NVC to get a case number etc etc as a way of speeding up the process. I have a lawyer who says to sit and chill and the NVC will shoot the package to the embassy. Also, the stats on this site do not show a big hold up at the NVC stage/


Your lawyer's advice to chill is fine...if you want to add an unnecessary extra month or more to your visa journey after the USCIS approves your I-129F petition!!!

So we finally got our NOA2 on April 8th, however I called the NVC center April 30th and they have yet to get the papers. I gave them my case number and get "sir we dont have anything by that case number yet". Its almost been a month and the NOA2 has a 4 month validity window valid through 8/7/2013. I dont want to take the chance that it would expire before she arrives, the mail in the Philippines specifically Mindanao is quite slow. Should i just wait longer for the NVC center to get their stuff together? Am i missing something? Is this window going to be a issue? HELP ME PLEASE IM FREAKING OUT!


You don't have to worry about your petition. The U.S. Embassy Manila will revalidate it for another four months.

By the way, you should plan on sending your important papers to your fiancee via FedEx or LBC, not USPS / PhilPost. You've been warned!

Keep calling the NVC every business day. Ask for a tier two rep.
