It looks like we are good for 30 days, she can practice driving in our area ......apply for the SS card right away, plan for the test as soon as possible when the SS card has been received.
 
I still plan on going to DMV to try and verify this path.

You shouldn't have any problems. Chinook went to the DMV in Seattlle before her I-94 expired and got a Washington State ID card. An ID card has the same identity requirements and SSN/residency requirements as a driver license.

So, when they go back across the border, who's going to do those jobs? You can't get people here to do them, and there certainly aren't enough work permits available to put a dent in the resulting labor shortage.

I know. The crews priced themselves right out of a job, which is why the grower in my area went to grapes. Plus, he is contracted to a major wine producer. All he has to do now is wait for those checks to show up in the mail. No more negotiating with migrant crews.


The crews don't set the price of labor, the growers do. There's no negotiating. The apple pickers get paid by the bin. The minimum they get is the state's minimum wage. And who do you think is going to work the vineyards?

In some ways they are. Apples are leaving California being replaced by grapes. Almost all the apple production has moved up to Washington state. The largest grower in my region sold all his interest to his foreman, and turned all his own land into grapes. There is only one processing plant left in the area. The next nearest one is two hours away.


Bill, I'll give you one guess about who picks the vast majority of apples in Washington State.

And the apple growers usually can't get enough of them.

You conveniently forgot to mention the millions of undocumenteds who work those jobs. There aren't anywhere near enough work permits for them, let alone for those who are still south of the border and want to work here...which brings us back to the conclusion that you didn't understand the Washington State residency requirements in the link I posted.

Not sure what insurance agency you refer to.  I've been all over the US, as well as several foreign countries, and never had an issue. 
 
Now, you might edit that to say, "the driver must be a licensed US driver to be covered on a policy".  Cuz if I move to WA from AK, and bring my AK drivers license, I am still a legal, licensed driver, and I can still be covered on the policy, even though my license is not from WA.  I can add ANY US-licensed driver to my policy, regardless of what state they are licensed in.  Technically, I don't even have to add them; as long as they have my permission to drive, and I esnure they are legal, they are covered while driving my car.  (Having said that, my insurance company IS one of the best out there, so this may not apply to some of the smaller companies, which may be more restrictive).

Wow !!! If this is all true.......that is a pretty tight window of time to deal with to be able to legally drive after 30 days of setting foot on WA State soil...
 
Land at SeaTac....establish residency, get a SS number, get ready for the drivers test and then take the test, all in 30 days....again, WoW !!!

No they won't. That law pertains to driver licenses that will be "accepted by the federal government for official purposes." All she wants to do is to legally drive.

As a side note, Washington State residents already have the option of getting an "enhanced" driver license, which complies with the REAL ID law.

State residency is not the same as having a green card. Each state has their own standards. However, as soon as she arrives in the state of Washington with the intention to live there, she becomes a resident of the state of Washington as far as the DMV is concerned. She is eligible for a SSN as soon a she arrives in the US. Most states support the REAL ID Act, so she will probably not be able to obtain a driver license until she at least has an EAD in hand. So, if it's thirty days, that's it until she gets her EAD or green card, unless the state of Washington will issue her a temporary license.


She doesn't need an EAD or a green card.

In Arizona, DMV required my wife have her EAD or green card, and the expiration on her license is the same date as on her green card.





She doesn't have to have filed for AOS in order to establish residency in Washington State or to get a driver license. And it's not as simple as getting married either. All of the requirements are clearly spelled out on the Washington State DOL website.

She simply has to declare her intent to become a resident. The day she arrives in Washington is the day she intends to become a resident. Therefore, her Philippines driver license is good for 30 days from the date she arrives in Washington. After that, she can use her Washington State driver license.

In this case, you are required to submit the vaccination record and page 1 of Form I-693.

No need for an I-693 if it's under a year since the PI exam, Tahoma.  Never filled out an I-693 and still got ours.

Hi Dave...I agree with you that a K-1er shouldn't have to submit an I-693. That's how the instructions read.

However, there have been enough reports over the years here on VJ where K-1ers have received RFE's for the I-693 that I advise people to play it safe and spend the $40 for the transcription. That's what Chinook did.

I guess it boils down to whether the person is feeling lucky (and whether they can find a reasonably-priced civil surgeon!).

Keep shopping for a civil surgeon who knows the K-1 drill. You shouldn't have to pay more than about $40 to have her DS-3025 transcribed onto her I-693.

When your fiancée's eight-week culture comes back negative for TB, she'll want to reschedule her interview as soon as she can.  She can reschedule it herself or St. Lukes can do it for her.  She should be able to interview a week or two after her culture results and her immunizations.  When she gets her visa, the visa's expiration date will be printed right on the visa.  The expiration date is usually six months from her original medical exam (not from her sputum collection nor from her culture results).

 

If her culture comes back positive, she can look forward to at least six months of TB treatment, followed by another medical exam (which she has to pay for again).

I just got off the phone with my contact at the Department of State. She said that she spoke with the Manila consular office. They told her that they had reviewed the additional information you sent in, approved it and will be issuing the visa soon (if not already).

Let?s hope it is smooth sailing from here on out!

Made a note for future reference... co-sponsor NEEDS to be family with the K-1 to even have a chance of acceptance, still just a chance.

So how did your friend satisfy the support requirements?  co-sponsor?

My friend's petitioner didn't satisfy the support requirements.  My friend tried to submit his petitioner's joint-sponsor documents, but the Filipino pre-screener told him that Manila doesn't accept joint sponsors for K-1ers.  The consular officer approved his visa anyway.  

 

Their backstory:  The petitioner is a Pinoy who is a naturalized U.S. citizen.  Both the petitioner and the beneficiary are in their early 20's.  They've known each other since childhood.  At the time of the interview, the petitioner was studying nursing and was about to graduate from college here in the U.S.  She lived with her parents and had no income and no assets.  The beneficiary had graduated from college in the Philippines and was working there in his field.  The petitioner did not attend the interview.

I'm surprised that you weren't approved at your interview, especially since your fiancé attended the interview with you.

 

I've seen many Manila K-1ers approved who had more difficult circumstances than your circumstances.  Just last year, a friend of mine was approved despite the fact that his petitioner had no income whatsoever, and no assets either!

 

At this point, given the circumstances, I think you've made the best financial case possible.  Since the Embassy has something "ready" for you, I think you'll get your answer soon.  I hope the consular officer looked at the "totality of the circumstances" and approved your visa.  Good luck.

For some reason can't copy/paste to this thread...but if you go to the military section of USCIS and find FAQ you'll see that question/answer the 4th question down.  Basically says that if your spouse is deployed during AOS interview to bring evidence of the deployment (orders or letter from his commander) along with all the other req'd items you would normally bring.

Got a letter today from US Embassy Manila , I think it's an instruction letter with my fiancé's I-129F attached to the letter with "Approved" stamp. I cancelled my interview last month because of this sputum thing, hoping that everything will be alright. I still need to fill up DS-160 though biggrin.png, I'll do that after I get my result from St. Luke's in January 20. And also my approved petition will expire in January 17, but I think they will just extend my petition without my DS-160.

Yes, your petition will be extended.  The Embassy knows that you are in the process.

 

A friend of mine just recently went through the K-1 visa process with his fiancée.  His fiancée in the Philippines received the Embassy instruction letter after her Embassy interview.  My friend received the instruction letter about a week later.  Chinook and I are still waiting for our instruction letter.

Your honey wasn't asked to submit her birth certificate at her POE.  She submitted her visa packet, which had her birth certificate inside.  See the difference?

 

If she had followed my advice and brought an original with her, you would have saved a C-note.  

 

Hank had his wife bring six original birth certificates with her, five of which were an unnecessary expense, and they're all still sitting there gathering dust while he pretends that they may be needed some day.

As for me, I never claimed they needed a certain number of copies... I merely suggest that they bring extras.. they are cheap and easy to acquire while in the Philippines.

and submitted that 1 into the IV Unit.

The IV Unit put it into the Visa Packet.
She handed the Visa Packet over to the CBP goon at the POE.

Chinook is from Bacolod.  She completed the CFO seminar in Manila right after completing the medical, and a few days before her Embassy interview.  She wanted to get as much done as possible while she was in Manila for her medical and her interview.

 

Then, after she received her visa, when she returned to Manila for her flight to the U.S., she got the CFO sticker affixed to her passport.
