It might work, but I'd guess it will create future problems. They're already acting entitled, how much worse are they going to be when they start deciding how much money can get picked off the American money trees? How many times have we seen problems here when the family in the Philippines is demanding more money than a couple can afford and creating conflict between husband and wife because she's feeling guilty? I foresee this as a future issue already with her family, why start raising expectations in her family?


No matter how the parental advice issue plays out, Mariel is going to go to the U.S., and her parents are going to have greater expectations when she's in the U.S. It will always be up to Mariel to manage those expectations.

@Tony...How much does Mariel support her parents? P3000/month? Can you afford P3500/month? Or P4000/month? Does Mariel plan on getting a job in the U.S.?

Tony...Mariel's parents fear that their daughter will forget about them and they will lose their support when she goes to the U.S. How much monthly support does Mariel now provide? Perhaps you and Mariel could convince them that their monthly allowance would actually increase if Mariel goes to the U.S. You could get this ball rolling by sending this month's (increased) allowance to them yourself. That might help ease their fear.

Practical solution: Your fiancée may be able to convince her parents that the only way she will be able to support them is to go to the U.S and marry you.

Impractical solution: Your fiancée could petition the court to grant the power of attorney to one of her cooperative aunts or uncles. Then, the aunt or uncle could sign the parental advice form.

Gambler's solution: Your fiancée could take her chances at the CFO seminar without the parental advice form. It seems that, since the CFO has taken over putting on the seminar, they aren't as strict as PRISM and St. Mary's were about parental advice. This could be a good option for someone who is confident and assertive, but it's probably not a good idea for the shy types because the CFO picks on them.

Mark...Fatima also may wish to change her middle name to her maiden last name (Filipino style). That's fine too. That's what Chinook did.

If Fatima does not change her middle name, then, if she renews or amends her Filipino passport, or if she reacquires Filipino citizenship, her middle name on her Filipino documents will be her maiden last name. In order to reconcile the difference in names, Fatima can get a document from the Filipino authorities known as an affidavit of "One and the Same Person."

And per what Hank_ said, he's correct that it is automatic in the Philippines for wives to aquire their husband's surname.

It's not "automatic." Wives can use their maiden name if they choose to.

Mark...Fatima can change to her married name simply by filling out her I-751 in her married name. When she receives the letter from the USCIS which acknowledges receipt of her application, it will be in her married name. Her permanent green card will also be in her married name.

Along with the other documents in her I-751 packet, she should include a letter explaining that she wants to change to her married name, and she should include a copy of your marriage certificate.

The USEM can, and sometimes does, ask for the original divorce decree. Just because the USCIS was ok with a copy doesn't mean that the USEM will be ok with it. There have been many on this forum who learned the hard way. Assuming that all cases are the same is foolish.

Best practice: Go to your interview fully prepared.

It may not say "in transit" as ours did not. Also, it never showed in transit on the 2Go website. Just a phone call from 2Go to come to their office and pickup the visa's and that happened just after we read on CEAC "issued".

Remember, with so many expedited cases, USEM is working hard to keep the visa process moving. Remember this is a game of wait. It will be one of the hardest things you will do but it will be worth it. Hang in there.

I would be interested to know if the U.S. Embassy Manila accepts your fiancé's co-sponsor.  The Embassy doesn't always accept co-sponsors for K-1ers.

Your priority date is the "received date" on your USCIS NOA-1. Also, it should be on the email from the NVC.

Two or three weeks in administrative processing is not an unusually long time at the USEM. However, by all means, call or email the USEM to get an update.

Sorry to hear that her son aged out. It seems odd that the consular officer would request a CENOMAR for a17 year old. At 17, I don't think they can get married in the Philippines. Maybe there are different rules for Muslims...I don't know.

Skeeter...Once your fiancée submits her certified divorce decree to the USEM, I believe the presumptive death decree will not stand in the way of her visa approval. The USEM has the authority to make that happen.

As a side note, the I-129F that I submitted to the USCIS did not have any of the tick boxes filled out. None of them. I never received an RFE from the USCIS. At her K-1 interview, Chinook was given a 221g which directed her to submit a fully-filled-out page three of my I-129F. Only page three. This was good enough for the USEM.

Regarding your case, the one thing I would be apprehensive about would be whether the CFO would require your fiancée to get her divorce recognized through the Filipino court. Your fiancée should ask her aunt about it. I would certainly be interested in what her aunt has to say about it.

By the way, if you feel the need to talk to someone at the USEM, you could always call the Immigrant Visa Unit and talk to your Filipino case worker. Chinook and I both did that.

Usually, K-1ers have to make their own interview appointment with the USEM. I haven't heard of the NVC making an interview appointment for a K-1er at the USEM. Were you expedited or something?

Hi, can anyone help me pls. my sis in law and her 2 kids that is 20 yrs old daughter and 21 yr old son was interviewed last 04/28/11.. she said everything was ok but they need to submit addtl affidavit of support, which we did submit on may 4th. on may 17th my sis in law got her visa only, but the other 2 kids are not. we are still waiting for their visa until now we have not heard from embassy? anyone knows to ease out my curiosity. their status is IR2.

The chance that your case isn't going to be at the USEM in time for the interview is infinitesimal. If you were worried about it, you could always call the Embassy a couple of days before your interview and ask them if they had your case. If they didn't have it, you could always reschedule your interview without an additional charge.

There recently was a Filipina who rushed things too much and was turned away at her interview as her file had not arrived from NVC.  If you allow 4 weeks or so between when you get your MNL # and when you schedule the interview the file should be at USEM by then.


Do you have a link for that case? If it's true, it would be the first time I've seen it happen in the thousands of cases I've seen pass through here.
