I don't know the answer to your question. However, I don't think it will be a problem.

If you don't get an answer here on VJ, you might want to make an infopass appointment and talk to the USCIS in person.

I imagine that your K-1 petition has been considered abandoned. Maybe the USCIS will ask you to write a letter of explanation regarding the circumstances surrounding your K-1 petition, and include that letter with your CR-1 petition.

Your case is probably in AP. Call the NVC and ask them specifically if your case is in AP. Sometimes they won't tell you that your case is in AP unless you ask them about it. If you have no luck with the first person you talk to at NVC, insist on speaking with a supervisor.

I sent my fiancée a copy of the same packet that I sent to the USCIS. Along with everything else, it included originals of all of the receipts. In addition to that, I sent her:

> My I-134.
> Income tax returns from the past three years.
> Income tax transcripts from the past three years.
> W-2's from the past three years.
> Paycheck stubs from the past three months.
> A letter from my employer.
> A letter reaffirming my intention to marry my fiancée.
> Selected copies of emails.
> The first page of selected chats.
> A screen shot of our chat log.
> Phone bills showing our calls to one another.
> Everything that demonstrated an ongoing relationship.


And do you recommend that I go there and go to the interview with her, or do you think she will be fine on her own and to fly here alone?

There are many good reasons for you to attend her interview, and I'm sure you already know what they are. If you do not attend the interview with her, she should be just OK anyway. She will simply have to put on her big girl pants and do what needs to be done. Love is a powerful motivator. :)

...how long does it take for the packet to go to manila from California office and then once they get the packet how long til they contact my fiance in the philippines...

Your packet could easily take three weeks or so from the time it leaves USCIS until the time it arrives at the United States Embassy Manila (USEM), and the USEM enters it into their system. One of the reasons it takes so long is because the USCIS sends your packet the National Visa Center (NVC). Then, the NVC sends your packet to the USEM. Then, it takes some time for the USEM to enter your packet into their system.

After the USEM enters your packet into their system, they will inform your fiancée that she can make an interview appointment. Then, you, or your fiancée, can call and make an interview appointment.

If you want to move things along a little faster, once the NVC has your packet, you can call the them and get your MNL number. Then, keep calling the NVC to find out when they sent your packet to Manila. Once your packet has left the NVC, wait about a week or ten days for your packet to arrive at the USEM and for the USEM to enter it into their system. Then, call the Call Center and make an interview appointment for your fiancée using your MNL number. If the Call Center asks whether your fiancée has received notification from the USEM...just tell them YES!


and also I read on here that if you bring in writing that you request the visa issued same day because I was going to fly there and attend with her and then hope to both fly back together.

You had better be careful here. I would never buy a plane ticket without having a visa in hand! There is little to no chance that you will be able to pick up a visa on the same day as the interview, and there is no assurance that the consul officer at the USEM will allow the visa to be picked up at the USEM the next day either. There are many reports here on VJ where people pick up an expedited visa after a day or two or three at the USEM, but it's not a sure thing.

I know I have to pay for the exam which is like $350-$500

The medical exam at St. Lukes Extension Clinic (SLEC) costs $213 and change. Your fiancée will pay for it at SLEC when she goes for her exam.

I read somewhere on here that I have to pay an entry fee once here in the usa, I am not sure what its called but I think its around like $1000 can anyone verify that?

After your fiancée arrives here in the U.S. and you get married, that is the time she will file the papers to adjust her status (AOS). At that time, you will need to include a check for $1010. (gulp!) with her AOS packet.

This is not true. Manila allows cosponsors for K-1erz on a case-by-case basis. My friend is a K-1er and used a cosponsor in August. His fiancée received her visa and is here in the U.S. now. They are getting married next week. Please do not spread misinformation.

Chazzie's fiancé, Dex, passed his interview on December 1. He reported that the Embassy no longer issues the famous pink slip when you pass the interview.

No you do not need to submit pay stubs (they are not even listed in the requirements), those are optional, same as the employer letter is optional...  not required.  Nothing wrong with including copies of pay stubs, but for sure they are not required.

If you'll notice, the USEM's instruction letter for K-1ers that you quoted doesn't list any evidence of support as "required."

That's why, as you know, when it comes to evidence of support, I recommend building a strong case in order to demonstrate to the Embassy that a K-1 visa applicant won't become a public charge in the U.S., and recent paycheck stubs are part of that strong case. That's where the "need" comes in.

The U.S. Embassy Manila will not require you to submit a 2013 income tax return until after April 15, 2014. Until then, the 2013 income tax return is optional. You will be fine if you submit the 2012 income tax return and W-2.

However, you need to submit several of his most recent paycheck stubs. Those paycheck stubs will show his current sustained income. If you have a copy of his 2013 W-2, you should submit it. Also, submitting an employer's letter is a good idea.

I am using a 1.5 inch binder that is completely full, and it has lots of pages and sheet protectors that make it weigh down but I think it will be like 2.5 to 3 pounds, I need to find someone cheap, 112 dollars is hurting me especially when i have to dish out another 215 for medical soon.

To save money, get rid of the binder and the page protectors. She can get that stuff in the Philippines far cheaper than you can send it to her.

FedEx has always worked well for me. I just sent one, took 5 days to get to Malaybalay City, although it left FedEx's hands once it reaches Manila (not sure who that courier was).

I think FedEx still uses Air21. In any case, they are reliable.

If my husband goes home to the Philippines using the AP and his K-1 visa on his passport expires February 2014 is it still safe to travel. My husband thinks that I should accompany him on his trip to the Philippines just in case he has trouble re-entering. We have read that he can travel with AP as long as he was never out of status upon filing the AOS. 


His K-1 visa expired when he entered the U.S. It's his I-94 that allowed him to stay 90 days in the U.S. and remain in status. Now his I-94 has expired and it's his AOS letter that is keeping him in status. Since he doesn't have his conditional green card yet, it's his AP which would allow him to re-enter the U.S.

I don't know if it would help if you traveled with him.

If I were in your husband's shoes, I would definitely go.  I've never seen a case here on VJ where someone with AP was denied entry into the U.S.  Of course, there's also that big world outside of VJ where things happen that I don't know about.  But, I'd still go, and if possible, I'd bring back a copy of grandma's death certificate (just in case).
