Your e-file document and confirmation should be fine by themselves. However, in my opinion, you should also send your tax transcript.

If you submitted only your e-file tax return and the confirmation and , for some reason, it was not accepted, you could email your fiancée your tax transcript and she could submit it to the Embassy via 2GO. However, that probably would delay her visa a week or two.

That being said, there's no reason you can't email your tax transcripts to your fiancée before her interview.

By the way, never send your immigration documents to the Philippines via USPS. Always use FedEx or another private carrier. You've been warned!

Jan1962...I think it's a good idea for a fiancé(e) to attend the interview if their income is close to the poverty guideline. Also, if you believe the Embassy may question whether your relationship is bona fide, it would be a good idea for your fiancé(e) to attend the interview.

The Embassy won't care if you are jobless. However, they may be interested in your potential employability in the U.S. This could come into play if your fiancé(e)'s income is near the poverty guideline.

just wondering in regards to the income of the petitioner (I know theres a certain amount you have to make to be able to support the beneficiary too I think it has to be more than 15 or 16k yearly not exactly sure) but my question is the embassy in manila looking for a certain abount $$$ the petitioner has to make a month so they can say you can support the fiance while shes not working or theyll just look at the W2?

For those petitioners who work for an employer, generally speaking, the U.S. Embassy Manila (USEM) looks at these things:

> The current income tax return: Until April 15, 2013, the current income tax return is the 2011 income tax return. After April 15, 2013, the 2012 income tax return will be required. However, it's OK to submit the 2012 income tax return before April 15, 2013.

> The current W-2: If the petitioner works for an employer, the employer is required to send the employee a W-2 wage statement by January 31. The W-2 wage statement, among other things, shows the employee's gross income for the previous year. For 2012, the employer must send the wage statement by January 31, 2013. When the employee receives the 2012 W-2 wage statement, then the employee can file their 2012 income tax return (1040/1040A/1040EZ). For the USEM, until April 15, 2013, the current W-2 is the 2011 W-2. After April 15, 2013, the current W-2 will be the 2012 W-2. However, it's OK to submit the 2012 W-2 and the 2012 income tax return before April 15, 2013.

> Current paycheck stubs: The current paycheck stubs are important because, as you can see, a 2011 income tax return and a 2011 W-2 is not going to be helpful to the consular officer in determining the petitioner's current sustained income. A 2012 income tax return and a 2012 W-2 is more helpful, but it's not enough. The consular officer wants to know what the petitioner's income is today. Current sustained income is how much income the the petitioner makes at the time immediately before the interview. When a consular officer looks at the current paycheck stubs, they can determine how much income the petitioner is likely to make in 2013. The projected income for 2013 needs to exceed 125% of the poverty guidelines for the petitioner's household size.

The official poverty guidelines are just there.

> Employer's letter: It's helpful to submit a letter from the petitioner's employer. The letter can state the basics, such as the petitioner's hourly wage or salary, their length of employment, etc.



@MeggieStevie: Since your petitioner is self-employed and probably receiving mostly cash for his work, he needs to find a way to document his current income. You have a good chance of visa approval if you can submit documentation of his current sustained income. If I were in you shoes, I would also submit his 2012 income tax return and his 2012 W-2 (if any). I would also submit his 2012 tax transcript.

I would also submit an I-864 and it's supporting documents from his joint sponsor. Manila may say they don't accept joint sponsors for K-1'ers, but they actually do accept them maybe 50% of the time. It wouldn't hurt your case to include the joint sponsor's papers along with the other documents.

We are still waiting for the Embassy to send us the letter which tells Chinook that she's eligible to schedule an interview and gives instructions on how to prepare for the interview (you can call it packet 3 if you prefer). After waiting almost four years for that letter, you can imagine how blue our faces are getting from holding our breath that long! :jest:

As for the name correction, I wouldn't worry about it. You spelled it correctly on your I-129F and the Embassy will know it because they will have your I-129F sitting right there in front of them. They'll have her G-325a too. The NVC screwed up, not you.

If I were in your shoes, I would go ahead and pay the visa application fee at BPI and schedule an interview. It's time to roll.

Your affidavit of support will be four or five months old by interview day. Your plan won't work anyway because the consular officer will be looking for some of your current paycheck stubs, and you won't have any.

A friend of mine petitioned his fiancée through the U.S. Embassy Manila. She was denied because her CENOMAR (CEMAR) showed that she was still married to another Pinoy.

She thought her marriage to the other Pinoy was not valid because the other Pinoy was still married to yet someone else. She needs to get an annulment from the other Pinoy.

My friend did not know about her marriage until after her denial. Imagine his shock when he found out about this mess.

Thank you for all of your responses. Better to be informed than not, right? Another question: Will the CO give us the thumbs up at the end of the interview? I know that we have to wait for the actual visa to arrive in the mail, (as mentioned above.) I'd hate to have to wait for an actual decision.

They may or may not tell you whether you we're approved. However, if they don't, just ask them.

Also, if they keep her passport, it's a safe bet that she was approved.

The visa is sent to the address you designate at the interview, including any 2GO office. It usually takes anywhere from three days to three weeks after the interview for the visa to be delivered.

Thank you for the information. After my fiancee completes her medical exam at St. Lukes can she get the rest of her vaccinations at a different clinic/hospital in the Philippines? Then bring the proof that she got those vaccines with her when she comes to America? Because I think she needs all required vaccines before she apply for adjustment of status. I want her to get all required vaccines in the Philippines because I think its cheaper compared to America. Thank you :)


On the second day of her medical at St. Lukes, she will receive all of the vaccinations she needs in order to fulfill her visa requirements and also to fulfill her AOS requirements. More shots are not necessary.

Also, when she goes for her medical, have her take a ball pen, because she will need it. Also take a coat because it's cold in there. And wear some comfortable shoes because she will be going up and down the stairs a lot. She might want to take something to read too. And make sure she takes a snack in her purse, because she may get hungry...manang guard will not check her purse. And go to St. Lukes in the early afternoon when the crowd thins out. One o'clock pm is just fine. It's not necessary to get there early and fall in line.

Start calling the National Visa Center every day until they give you your MNL case number. Once you have your MNL case number, you can pay the visa application fee at BPI and then schedule your interview. Then you can complete your medical.

Bank statements don't do anything for you, unless you are trying to show periodic deposits as proof of income, for instance, you were collecting disability, or annuity payments.

Also, bank statements could help if your income fell short of the guidelines and you had a wad of cash in the bank that would make up for the shortfall.

If your income exceeds 125% of the poverty guidelines for your household size, then you won't need to submit any bank account information. Instead, you will submit your latest federal income tax return, your latest W-2, your current (at the time of the interview) paycheck stubs, and a letter from your employer.

It's probably a good idea anyway to open up a new account in your name only.

You should start calling the National Visa Center every day until they give you your MNL case number. Once you have your MNL case number, you can pay the visa application fee at BPI and then schedule your interview. You can complete your medical too.

The alternative is waiting for the NVC to send your case to the U.S. Embassy Manila, and waiting for the Embassy to send you a letter via PhilPost telling you that you are eligible to schedule an interview. I don't recommend waiting for the Embassy letter because it could be a very long wait.

Your fiancé needs to send the I-129F packet to the U.S.

The USCIS in the U.S. processes petitions for fiancé(e) visas.

However, you can have your Embassy interview in Dubai if you want to.



Is he in Dubai?If he is,He should go back to States and petition you there.

The petitioner does not need to be in the U.S. to petition her.
