what if I don't call them? Will I receive the number eventually in one of the packets? Do people call nvc in order to obtain the number only because it speeds things up for them or it's mandatory part of a process? Also, do you guys know whether my son has to go with me to the inteview at the embassy? He was born in the US, has dual citizenship, US passport and was listed on the petition but not as a beneficiary. Thanks.

It can take at least a week or two for the NVC to receive your case.  Start calling them anytime.  Call them every day until they give you your MNL case number.  

 

Once you get your MNL case number, you can get rolling on paying the visa application fee at BPI, scheduling the interview appointment, and completing the medical.

I'd really like to attend the interview, but not sure if I can swing it with vacation time from work.  I'm heading to Philippines for 2 week visit on 5/24.  And then I need to save some time for accompanying my fiancée and her kids on the trip to the states once we have visa in hand.
 

Have you thought about having them travel on their own, and using your time off for when they arrive in the U.S.? That's what I did and it worked out great.

Yes, if your income easily surpasses the I-864P guidelines for your household size, you should be good to go with only your 2012 federal income tax return, W-2's, a few recent paycheck stubs, and your employer's letter.

I had the impression that each embassy is different.  The Phillipines seem to be follow your outline, but Thailand does not. I am under the impression we must wait for packet to come to her- and then we must wait for appointment- we do not make an appointment.

Chad...Listen up...here's what to do:

 

1.  Your I-129F petition just got approved by the USCIS.  In about a week or so, start calling the National Visa Center (NVC) every day until they give you your MNL case number.  You have to talk to a human at the NVC in order to get your MNL case number.  

 

2.  Once you have your MNL case number, your fiancée can pay the visa application fee at BPI.  

 

3.  4-24 hours after paying the visa application fee at BPI, either of you can schedule her Embassy interview appointment.  You can schedule the interview appointment either online or by phone.  Print a couple of copies of the interview confirmation.

 

4.  Once you have scheduled an interview appointment, your fiancée can complete her medical at St. Lukes.  Most people complete the medical a week or two before the interview.  St. Lukes runs on a walk-in basis only.  Pre-register online on their website and take a couple of copies of the pre-registration form to the medical.  To be admitted for the medical, bring along the Embassy interview appointment confirmation printout from scheduling online.  If you scheduled the Embassy interview appointment by phone, bring along the confirmation email.

 

5.  Don't wait around for the Embassy to send your fiancée a letter telling her that she's eligible to schedule an interview and giving her instructions on how to prepare for the interview.  If you wait around for this letter, it will cost you a month or more.  Instead, follow the above steps and it will speed up the process.  You can read the Embassy instruction letter and start getting prepared for the Embassy interview by clicking here:  http://photos.state....on_rtf2_005.pdf

You don't need the Embassy letter for anything except to help you prepare for your interview.  The Embassy sends the letter to the beneficiary by snail mail via PhilPost.  You are wasting time waiting for the letter.  Some people never receive the letter.  Redvelvet posted a link to the letter and you should read the letter, but you don't need to submit it to anyone.

 

Since you have your MNL case number, you should go to BPI and pay the visa application fee. Then you can schedule your Embassy interview appointment.  Don't worry, your papers will arrive at the Embassy in plenty of time for your interview.

The NVC is a busy place.  You'll have to wait your turn to get your MNL case number.  Right now, the only thing you should do is to call the NVC every day until they give you your MNL case number.  You should be able to get your MNL case number malapit na.

PS...In order to schedule an Embassy interview appointment, you don't have to wait for notification from the Embassy that they received your case.  You can schedule an interview appointment as soon as you get your MNL case number from the NVC and pay the visa application fees at BPI.  Appointments are running about three weeks out right now.  YMMV.

 

PSS...St. Lukes does not make appointments.  They are on a walk-in basis only.  Pre-register on their website and bring two copies of the pre-registration form to the medical.  Most people complete their medical a week or two before their interview.  Since there are children involved, I would complete the medical two weeks in advance due to the time it takes to complete the TB skin test.

 

PSSS...You probably should wait for the passport.  I don't know how to expedite the birth certificate, but I'll bet the local civil registrar knows how...whistling.gif

In theory, copies are fine.  They work fine 99% of the time.  Maybe I'm worrying too much about the 1%.

However, be aware that there have been a few K-1 cases over the years at the U.S. Embassy Manila where the pre-screener/consular officer has required the applicant to submit their petitioner's 1040/W-2 despite submitting tax transcripts/W-2 transcripts.  The most recent case that I remember from here on VJ is where the petitioner's income was near the poverty guideline.

Tahoma, I think I understand your questions.........We haven't even gotten to the Embassy stage yet, this is simply the NOA2 allowing us to proceed with the interview etc.  We very well could face A/R in the future.  Hopefully that will not happen though, we have solid evidence, multiple visits documented and of course mounds and mounds of the traditional substantiating evidence as well.  Only time will tell of course but we hope it is smooth from this point forward.

Did your fiancée's previous petitioner end up ever withdrawing his petition?  When did he originally file his petition?

Congressman, Senator, Ombudsman, Tier 2, Infopasses.............Don't know if any of those actually helped or not..........I kind of think USCIS uses it's own protocol and time frame for cases such as ours. Everything I did kept me from going crazy though even if they didn't really help.

Did the Embassy send your case back to the USCIS and the USCIS reaffirmed it and sent it back to the Embassy?  Or, did your case remain at the Embassy in administrative review?

Ya I guess there was a snag. My fiancee' had been previously petitioned for. The relationship ended shortly after he filed but he never withdrew the petition and never responded to an RFE from USCIS. So I guess we were on the hit list because of this.

I have some friends who also were approved for a fiancé visa in Manila by using a joint sponsor. The petitioner had zero income and zero assets.

At the interview, the Filipino pre-screener told the beneficiary that Manila does not accept joint sponsors for K-1 cases. The consular officer approved the visa.

For those K-1ers who are interviewing at the U.S. Embassy Manila, here's what to do in order to speed up the visa process:

1. Wait a week or ten days after your USCIS petition approval, and then start calling the NVC every day until they give you your MNL case number.

2. Once you get your MNL case number, pay the visa application fee at BPI.

3. Once you pay the visa application fee at BPI, wait 4-24 hours and then schedule an Embassy interview appointment either online or through the call center.

4. Then complete the St. Luke's medical. Note: Use your interview appointment confirmation printout (from scheduling your Embassy interview online) or your email confirmation printout (from scheduling your Embassy interview through the call center) in order to be admitted into St. Luke's for your medical.

5. Complete the CFO seminar. Then, after you get your visa, return to the CFO and get a CFO sticker affixed to your passport. Note: You can complete the CFO seminar and get the CFO sticker affixed to your passport all in one day if you wait until you have your visa.

6. Throw a barangay party, say your goodbyes, and fly into the loving arms of your sweetheart.
