IR-1 / CR-1 Spouse Visa Process & ProceduresOUR AP =(
Sorry about the AP. I know how stressful it can be. I also got the white slip after my interview last February 2009. The CO requested that we submit again the 3rd page of the I-129F petition. I submitted it to the Embassy after 3 days.

The next day, they called me and informed me that our I-134 and other financial documents were missing. I argued with him that I had already submitted the originals and told him that the photocopies I have with me are incomplete.

Anyway, I submitted my incomplete photocopies of the financial documents the same day. My fiance also made a call to the embassy within the hour that they called me. He told them that it is their responsibility to find the missing financial documents. He must have scared them because I got my visa after 3 working days.

Don't give up. Keep calling the embassy every 3-5 days. Know the reason why they put your husband on AP.

At that point, the Consul Officer required my fiancée to submit another original page 3 of my I-129F before she received her K-1 Fiancée Visa...only this next time with an "X" in the box asking whether or not I had ever been convicted of any felonies (nope, no crimes). Apparently, the Consul Officer didn't care about all of the other unchecked boxes. I guess the CO (correctly) assumed that I was male.

I like how he also assumed (correctly) that you are not a Nazi war criminal or whatever other stupid questions were skipped.

Hi Mike B....

I thought it was strange also. I just now looked at my I-129F again. Here are some of the questions that were left unanswered:

> male or female

> My marital status

> How my citizenship was acquired

> Have I ever filed for another fiancée visa

> My fiancée's marital status

> Has my fiancée ever been to the U.S.

> Is my fiancée related to me

> Have my fiancée and I met within the last two years

> Did my fiancée and I meet through a marriage broker

> Have I ever been convicted of the following crimes...

> Mitigating circumstances regarding crimes committed

I swear to you that this petition made it all the way to the U.S. Embassy in Manila, and all the way through my fiancée's interview, up until the final minute, when they asked her to simply provide another page three (with an answer to the question about any crimes committed).

Dave...I wouldn't worry too much about your middle name vs. your middle initial. But, just to be on the safe side, you might want to send your fiancée a corrected copy of that page...just in case. You never know what the CO is going to want!

K-1 Fiance(e) Visa Process & ProceduresOOPS!!!!!

Dave...

My guess is that you'll be OK. I say this because I sent my I-129F to USCIS without a single box being checked with an "X". I filled out my I-129F online and printed it out. It didn't print out a single "X" in any of the boxes. I don't know why. So much for double checking things!

I never received an RFE. As a matter of fact, it was never an issue until the very end of my fiancée's interview at the American Embassy in Manila.

My fiancée had a great interview up until that point. She wasn't too happy about having to make another trip to the Embassy to submit one single piece of paper, but she did enjoy another three days of vacation in Manila. As for me, I was a bit embarrassed by my oversight. On top of that, it cost me a forty dollar bill to FedEx express that single piece of paper so that it would be in my fiancée's hand in three days. She received her visa the next week.

I think you'll be OK. If not, it's an easy fix. Hang in there!

K-1 Fiance(e) Visa Process & ProceduresWhat is the nature and content of "evidence of domicile"?

I petitioned my then-fiancée using a K-1 visa, and we did not have to provide "Evidence of Domicile.

My guess regarding the "Evidence of Domicile" issue is that the other VJ petitioner may be applying for another type of visa, and not a K-1 visa. For example, a petitioner who applies for an IR-1 / CR-1 through Direct Consular Filing would need to provide "Evidence of Domicile."

However, I'm not sure if a normal IR-1 / CR-1 would require the same evidence. I don't know about this requirement for a K-3 visa either. But, neither the petitioner nor the beneficiary will need it for a K-1 visa.

K-1 Fiance(e) Visa Process & ProceduresNeed help in picking a firm to help prepare K1 VISA
I never used an attorney nor an online visa service. However, I had it pretty easy. My wife (then-fiancée) read the VJ guides and figured out everything for us ( :star: muahhh).

Don't worry about your fiancée's interview at the U.S. Embassy in Manila. The American Consul Officers who conduct the interviews are fluent in Tagalog and can conduct her interview in Tagalog if she wants to. The pre-screeners are Pinoy and she can speak Tagalog with them too. Even the guards are Pinoy.

My advice: make three complete copies of your K1 visa package...one to send to USCIS, one for your fiancée, and a spare one for yourself (just in case).

Now, go get your fiancée busy reading the VJ guides! :)

is there a fee after the interview for visa processing?

There is no fee for visa processing. The only fee after the interview is for Air21's visa delivery service. That will cost around five or six dollars.

delivery for your visa is a part of you visa processing!!! ]if you will not pay the AIR 21 fee, the visa will not come to you!!!! SO do you agree that AIR21 fee is a part of visa processing??????otherwise it will not arrive to you...just like when you buy something shipped to you....agree?

No, I don't agree. The USEM processes the visas. Air21 simply delivers the visas. Air21 charges a delivery fee. It's as simple as that. However, you are welcome to define "processing" however you want to. I don't want to play word games. Why does this matter anyway?

Your fiancee will need 3pcs of 2x2 photos with a white background for her medical at SLMEC. They will take a digital photo of her after she fills up her PDS form. Tell her to bring the email confirmation letter, passport and to take note of her Manila Case Number as well as the interview date because they will ask for it.

Good luck! :)

K-1 Fiance(e) Visa Process & ProceduresPreparation for the VISA Interview (Manila PH)

UPDATED: Fiancee To Do List

1. Visit NSO (Birth Cert & Cenomar)
2. NBI Clearance
3. Apply for passport

^ This should be number one on your list.

4. Take passport style photos (3 total) (2 for interview & 1 for medical)

^ The petitioner and the beneficiary are going to need a lot more passport photos than that! The beneficiary will need more than that just for the medical, not to mention a couple of them for the CFO and a couple more for the AOS. I can't even remember how many...but get plenty of them! You too.

5. Fill out DS-156, DS-157 and DS-156K forms (2 copies of each)
6. Pay Visa Fee $350 (equivalent to PHP)
7. Medical Exam at St. Lukes, Manila $213.35 (equivalent to PHP)
8. Schedule Visa Interview

^ This should be #5.

9. Pay Air21 fee (for K1 Visa delivery)

^ This is done immediately after the beneficiary's interview.

10. Commission on Filipinos Overseas (CFO) class (passport sticker)

^ Complete the CFO Seminar at the same time as the medical. Then, after the beneficiary receives her passport and visa from the USEM, go to the CFO office and get the CFO sticker.

Does this look about final now?? Thanks for the responses!

^ Now it's final.

it is correct you can call for the interview here in the usa for $18 and get it set for her just leave time for the medical and interview and do not forget the cfo after she has the visa in hand

At step # 5 you also need to complete the DS-160.
http://manila.usemba...niv1.html#Step1

K-1ers do not file a DS-160. The USEM web site is misleading because their article about the DS-160 starts out by saying that everyone is required to submit one.

However, when you get down toward the bottom of the article about the DS-160, and you click on "frequently asked questions," you are linked to the Department of State page that talks about the DS-160. Read frequently asked question #13. K-1ers are one of the exceptions to the DS-160 requirement.

I did schedule my interview lately they said DS 160 is not required for K visas. still have to use DS 156,156k,230

Hi Steve...thanks for your reply.

It's interesting that the Embassy emailed you a barcoded confirmation page. There is one K-1 VJ member who reported that, upon submitting her DS-160 online, the Manila Embassy emailed her back saying that she did not need to use the DS-160 and, instead, to use the DS-156 etc.

Good luck tomorrow...and let us know what happens.

K-1 Fiance(e) Visa Process & ProceduresNot Able to Pay for Visa Appt App in Advance -- Now What???

Thanks, everyone. Your suggestions are very helpful, but the one that seemed most promising by Old Dominion is not doable. My fiancee needs to be present at the bank at the time of payment. The bank actually marks her passport with a receipt of some kind. So the idea of me handling the payment while she stands in line at the Embassy is not possible.

At this point, I think our best hope is arriving early and pleading for a waiver or time to go to the bank based our understandable confusion over payment procedures. The bank who denied us suggested that we explain or situation and ask for a 2-day fee waver. The outdated instructions on the Embassy website only tell you to bring 2 copies of your DS-156 form as proof of your appointment, etc.

The two-day fee waiver sounds like a great plan. That way, it will buy you time to take care of this messy business with the DS-156 / DS-160.

By the way, when you submitted your DS-160 online, were you able to print out a confirmation page? Does the bank require the confirmation page, which I understand has a bar code on it?

When you submitted your DS-160 online, did the Embassy email you about it? If so, what did they say?

Please keep us posted.

K-1 Fiance(e) Visa Process & ProceduresNot Able to Pay for Visa Appt App in Advance -- Now What???

Then they play it safe it prepare both the DS-160 online, and bring the DS-156/DS-156K/DS-157 to the interview. This isn't a matter of arguing which forms are correct. This is a matter of a time crunch. They might have had time to argue with the bank about the forms a month ago, but now they have only an hour or two on Tuesday morning to get this resolved. They should give the bank whatever they want, even if it's not technically required by the consulate, just so they can get the visa fee receipt in time for the interview.

I agree that they should give the bank whatever they want since they are under a time crunch. However, my concern is that the bank will want a DS-160 confirmation which, as I understand it, the Embassy is supposed to email back to the beneficiary after the beneficiary emails the Embassy the DS-160. In other words, if the beneficiary does not have a printout of the Embassy's DS-160 confirmation, the bank won't accept payment. What a dilemna!

K-1 Fiance(e) Visa Case Filing and Progress ReportsDoes my fiance need to revisit ?

It's true that it can be beneficial to have the USC present at the interview. What is better evidence?

I can't remember any K-1'ers who were turned away at the U.S. Embassy Manila when their fiancé(e) attended the interview. On the other hand, I remember plenty of solo K-1'ers who were denied or who received a 221g (including Chinook).

How strong is your evidence of a bona fide relationship? How strong is the petitioner's affidavit of support? Is your paperwork in order? Were you introduced by someone in the two families? Does your case have any red flags?

Is avoiding the hit to your house fund more important than risking your loved one's visa? Are you feeling lucky?

Im wondering if my fiancée will need the original copy of the I-129F petition and all supporting evidence when she goes for her interview and, if so, how many copies? thanks for your help

Your fiancée should take one copy of your I-129F petition with her to her Embassy interview and also to her CFO seminar.

Her copy of your I-129F petition should include original receipts and photocopies of everything else.

In addition to the I-129F petition, she should also take these documents to her Embassy interview and to her CFO seminar.

Hi to all, this morning I received a call from my love of my life, informing me that his petition I-129F was approved April 8, 2013, I am so happy and worried also what need for me to bring for interview or what step I have to do, if anyone there can suggest what step I have to do I will be grateful for your help.

Congratz on your approval! :star:

Here's what to do:

1. A week or so after your K-1 petition approval, start calling the National Visa Center (NVC) every day until they give you your MNL case number.

2. Once you have your MNL case number, pay the visa application fee at BPI.

3. 4-24 hours after you have paid the visa application fee at BPI, schedule an Embassy interview appointment either online or by phone. If you schedule online, print out some copies of the confirmation sheet. If you schedule by phone, print out some copies of the confirmation email.

4. Complete your medical at St. Lukes a week or so before your interview. You can use your MNL case number, your interview appointment confirmation sheet, or a copy of your interview appointment email in order to be admitted into St. Lukes for your medical.

5. Attend your Embassy interview.

6. Complete the Commission on Filipinos Overseas (CFO) seminar and get a CFO sticker attached to your passport. You can complete the seminar either before your interview or after you have received your visa packet from the U.S. Embassy Manila. However, you can get a CFO sticker attached to your passport only after you have your visa.

Read this letter from the U.S. Embassy Manila. However, don't wait around to receieve this letter from the Embassy because you don't need it for anything and because it may take a month or more to receive it. Sometimes it never arrives. Instead, read it and follow the instructions on how to prepare for your interview.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCrying so hard

I appreciate this so much! I definitely will do this. I have read that some require the medical to be the same day as the interview? Is this information valid? Also, to clarify, I have to wait for the packets and letter of approval, fill it out, pay the fees (if there is any) and then send it to my fiance in the Philippines, right? Until I do that he's not allowed to be interviewed without a copy of an I129F packet and proof of ongoing relationship etc. Anyone know where I can print all the documents I need to fill out?

You don't complete the medical the same day as the interview. Normally, people complete the medical a week or two before the interview. At the very least, you should complete the medical a couple of days before the interview, but that's cutting it pretty close.

Your beneficiary does not have to wait for a packet or any letter of approval from the Embassy. Instead, you guys can shortcut the process by following the steps I listed above. However, if you want to wait for the Embassy to send him a letter via PhilPost, it will cost you guys a month or more. Instead, you can read the Embassy's letter here. The letter will give both of you instructions on how to prepare for the interview.

Your fiancé can pay the visa application fee at BPI and schedule an interview as soon as you guys get your MNL case number from the NVC. He doesn't have to wait for the Embassy's letter.

As the petitioner, one document you'll need to fill out and send to your fiancé is the I-134. You can get this form on the USCIS website here.

For the I-134 affidavit of support, it doesn't need to be me. Is that correct? Can his aunt be his sponsor since she is more financially secure?

You will have to submit an I-134 because you are the sponsor. In addition to your I-134, you can try to submit an I-134 or an I-864 from a joint sponsor, but the U.S. Embassy Manila accepts joint sponsors from K-1ers on a case-by-case basis. At best, I would estimate that Manila accepts joint sponsors maybe 50% of the time.

The joint sponsor should be a close family member of your (the petitioner's) family.

If everything goes right, here's my estimate:

> Two weeks: The time it will take to get your MNL case number from the NVC. In about a week to ten days, start calling the NVC every day until you get your MNL case number.

> One day: As soon as you get your MNL case number, your fiancé can pay the visa application fee at BPI in the morning, and then schedule the interview appointment in the afternoon.

> Three weeks: Your fiancé should be able to schedule an interview appointment about three weeks out from the time the visa application fee is paid.

> Your fiancé will complete the medical before the interview.

> Your fiancé can complete the CFO seminar before the interview.

> Ten days: The average amount of time it takes to receive the visa packet from the U.S. Embassy Manila after the interview.

> One day: After the visa packet arrives, your fiancé will return to the CFO to get the CFO sticker affixed to the passport.

> One day: Fly to the U.S.

Total time = Seven weeks.

Best wishes for a smooth and speedy visa journey! :star:

Actually they are telling you that after BPI you need to wait 4 to 6 hours before scheduling. We had to wait 5 hours.

It depends on what time of day you pay the visa application fee. If you pay late in the day, you'll have to wait until the next day to schedule the interview appointment. But it sure beats waiting seven months!

Call them EVERYDAY until you get your NVC case number. Don't sit on your hands. Once you get your "MNL" number you are now in the "driver's seat" for a change. You have real control over how long this process can take from this point on. Time was a factor for us, so we're not playing around. We waited 7.5 months for the freaking NOA2 and now it's time to rock and roll! lol Once you get your NVC case number, that says two things: One-NVC received your packet from USCIS. The processing takes like 2 to 3 days and then off to the US Embassy. Second-you can NOW begin timing things regarding your visa interview, when to take the medical and so forth. YOU now have control. We received NOA2 on April 19th. Got our NVC case number on the 29th and are scheduled to interview in Manila on the 16th of May. NBI clearance, NSO, CENOMAR and medical will all be done of course by then. We'll attend CFO seminar  after the interview (when she gets her passport back), get the stamp, then head home, hopefully by the end of May. That's OUR plan! Good luck guys!

^^^ Bravo! That's how you get things done!

Call them every day.

^^^. This!

what if I don't call them? Will I receive the number eventually in one of the packets? Do people call nvc in order to obtain the number only because it speeds things up for them or it's mandatory part of a process? Also, do you guys know whether my son has to go with me to the inteview at the embassy? He was born in the US, has dual citizenship, US passport and was listed on the petition but not as a beneficiary. Thanks.

^^^. I don't know how they do things at the U.S. Embassy in Poland.
