K-1 Fiance(e) Visa Process & ProceduresCan my girlfriend visit me under VWP? Will be her first time coming to USA

The main issue is to show that she has sufficient ties to her country.. job.. property or lease..

The first visit may be fine. but after that they look at things more closely.  If she has strong connections then its not going to be a problem.

All the best for you both..

K-1 Fiance(e) Visa Process & ProceduresGeneral K1 Guides and Info

I was wondering if my fiance need to sign the G325A form and the letter of intent before I can send out the 129f package? please advise.

Thanks!

I don't know that the instructions specifically ask for an original signature but I have read posts where an RFE has been sent requesting an original signature. I read somewhere it is dependent on the adjudicator and it is therefore better to send an original signature and also on the Letter of Intent. It is also better to either sign in blue ink or with a pen that makes an impression and does not look like like a photocopy, because you have no way of knowing who is going to be dealing with your petition and how 'picky' or informed they are.

K-1 Fiance(e) Visa Process & ProceduresDoes my fiance (the petitioner) need to submit Affidavit of Support when he files the petition I129F?

Dear everyone,
Currently I am waiting for the NOA2 of my K1 visa. I have a question that bothers me so much. Does he need to submit Affidavit of Support when he files the petition?
In fact, he didn't.. But is there a way to fix that if it turns out that he needs to? For your information, I live in Jakarta, Indonesia.
Thank you.

Best,
Agnetta

You can check on your local Embassy site to see what is required by them for Packet 3 if you want to start organising your documents early and save some time while waiting.

K-1 Fiance(e) Visa Process & ProceduresNOA 2 Approved BUT....

Hello VJ friends,

Finally got NOA2 on Sept 13, case approved and states it was sent to the consulate. Is it possible for the case to be sent directly to the consulate without being sent to NVC first? I contacted NVC and was asked to contact the consulate about my case. Due to time difference I am not able to contact the consulate until monday. Just joined the group and looking forward to hear from VJ friends...

Yes, all good ! This is the process, you don't deal with NVC, just the local embassy. Congratulations!

K-1 Fiance(e) Visa Process & ProceduresInterview requirements and docuements
You both need a divorce certificate if you have both been married.

You are both required to have proof of legal name change if you are not applying under your birth name. So if the fiancee (female) has been married before she would need a copy of the marriage certificate to show that her birth name was changed by marriage to her married name.
But you would have needed to supply that for the initial petition anyway.

http://www.visajourn.../content/k1flow

Check out the k1 flow chart as to the process. If you want to prepare in advance you can check the details found on your local embassy site as to what will be included in Packet 3 and can then go ahead and get ready what you will need for Packet 3 and can also get things ready for the interview stage. Hope this answers what you are wanting to know.

K-1 Fiance(e) Visa Process & ProceduresVSC or CSC or NONE?!

I was giving the K-1 petition some final touches and I notived all letters of intent and cover letter are advised to have the

United States Department of Homeland Security
U.S. Citizenship and Immigration Services
[ADDRESS
OF YOUR
SERVICE CENTER]

My question is: lately a lot of people are having their cases sent to the service centers regardless of their address. Should I leave my letters without the Service Center address?! If not, what service center should I put since my fiance's address is in Texas?

Thank you very much and have a smooth VJ!

Just send it to the Dallas Lockbox - you don't need to worry about the specific Service Center.

http://www.visajourn...content/k1guide

The USCIS Dallas Lockbox

For U.S. Postal Service:

USCIS
P.O. Box 660151
Dallas, TX 75266

For Express mail and courier deliveries:

USCIS
Attn: I-129F
2501 South State Highway 121 Business
Suite 400
Lewisville, TX 75067

and put in the G-1145 for confirmation of receipt and action. They will let you know where it has been sent to.
Best of luck with your petition.

K-1 Fiance(e) Visa Process & ProceduresHelp with G-325A

Hi, I am new to the site but I am trying to get help with the paperwork for K-1. My fiance is in the Philippines and I am trying to figure out the G-325A form. I have read that she has to sign one copy but what does she do with it? Does she send it to the embassy in Manila or send it to me? What about supporting documents such as copies of her birth certificate and passport? Does she send those to me as well? I can't find any clear answers and I am hoping someone can help. Thank you.

K-1 Fiance(e) Visa Process & ProceduresInterview tomorrow!!

Exactly 7 months after we started this process and now I have my interview tomorrow at 8am...............I am feeling excited and a little nervous although I am sure by tomorrow morning that my stomach will be churning! I have all my documents ready and together and I'm going in with $69,968.51 in savings praying they will accept this for self-sponsorship through the London embassy (Dam exchange rate means I have way less than I did a month ago)! I will make sure I post the result so anyone in a similar situation to me can get some more info about this option. There isn't an awful lot of information out there and I'm sure this is an interesting topic for those from the UK who are in fact the principal provider in the relationship rather than the US-Citizen (my husband-to-be is a student and supports himself with a mixture of grants, loans, parents outside the US and me but we are not able to include any of those on the I-134). Please note that this won't apply to you if you are from a different embassy as far as I know the UK is the only embassy that allows this. Anyway it has been a long tough journey and hopefully it is almost complete. Keep your fingers crossed for me fellow VJ-ers!!!

Yes, I'm sure it has been stressful putting it all together - and you're right about the ROE, our dollar is looking pretty sick lately too. All the best for your interview - I hope it all goes well. (F)

K-1 Fiance(e) Visa Process & Procedurespetition for fiance visa

hi everyone:)
this is my very first post so please bare with me!
i just became engaged to my boyfriend of 1 year. i'm a US citizen and he's a citizen of nicargua who currently resides in costa rica.
To my knowledge, i've filled out pretty much all of the required forms. the following are questions that i still have, and i want to get them figured out before i mail the petition! UCIS recommended i get a lawyer because they were unable to answer these questions. thanks for your help!

1) "Other names used" only pertaining to last name? Any you use in a formal capacity
2) I HAVE INCOMPLETE INFO ABOUT MY ESTRANGED FATHER (who's now deceased) You may want to attach an explanation to this.
3) Costa Rica has very strange addresses and i want to know if it is acceptable for the forms (but I don't think i have any other options!) For example: "Across the street from the cemetary, San Carlos, Costa Rica." Or "200 meters south, 50 meters west of the school, la tigra, costa rica" Yes, they also recommend you draw a brief map.
4) Do I have to write N/A or NONE in every single box? also, is SAME AS ABOVE allowed? n/a or none (dont use same as above)
5) Can I use testimonies of mutual friends about our relationship? for interview
6) Do I just mail the petition to Dallas? yes Do I need to see anyone in person or go to consulate in my hometown?
7) the form G-325 seems like it only pertains to the beneficiary. what exactly do we need to fill out? are we supposed to leave blanks? you both need to complete a G325-A (see the k1 guide)
8) what if he doesn't have an alien registration number?? (put NONE - this is issued when I-129F is approved)
9) What info should i get from him while i'm still here with him in costa rica? blank pages with his signature just in case i have to retype it? what else? Go through the K1 guide and read everything together - check that you have everything

K-1 Fiance(e) Visa Process & ProceduresNOA 1

Yes that is NOA1. If you haven't already, you can now go to the USCIS website and set up the alerts for your case. You can add email and/or text alerts and then anytime there is an update you will be notified (not foolproof by any means).

A bit of advice if I may. This step can make you crazy and you will want to check the website every day to see if something new has happened and/or call USCIS after a few weeks or a couple of months. Don't do it as you will just get frustrated. Set a reminder in your calendar for about 4 1/2 months from now and try not to worry about NOA2 as much as possible. It is a maddeningly slow process and in about 3 months you'll be climbing the walls with frustration if you don't. If you just can't resist, try to check the website once a week or so. In the meantime, read up on the next step of the process and start gathering the documents you needed. Saving check stubs, bank statements, tax transcripts, chat logs, emails etc.

Hang in there and good luck.

I don't think I've seen this explained so accurately.

(Sometimes the status never moves, even right through to approval and long after - so don't let it worry you)

Best of luck!!

You need to call them about your issue. That is more serious than a case that is not updated on status.

Agree. I would call about the I-130 I-129F issue. There is some confusion going on there, so you need to clarify it with them.

K-1 Fiance(e) Visa Process & ProceduresK1 visa case status

It hasn't even been a week since they told us to wait for their call. I am still wondering if our case is under AP or not because they didnt tell us anything like that. They kept his passport and said that they will call him when his visa is ready. wouldnt they tell us if we were under AP?

You could call them but it sounds like if they didn't say anything then it is just following the normal process and time it takes to issue the visa at your embassy. If they said they kept the passport and said they will call when the visa is ready then I would just expect to hear from them when it is issued.

My Case Status
Sign-up for Case Updates
USCIS Customers (applicants or petitioners) and Representatives (such as lawyers, charitable groups, or corporations) who require regular access to status information about multiple cases can create an account to more conveniently access this information. The services provided to both account types are identical, except Representatives may also enter their own internal office tracking number with each receipt number.

In addition, USCIS Customers and Representatives can choose to receive automatic case status updates, which will be sent via e-mail. A new pilot program provides the additional option to receive a text message notification that a case status update has occurred, which will be sent to a United States mobile phone number. USCIS Customers and Representatives that select the option to receive the text message notification acknowledge that Standard Messaging Rates or other charges related to these notifications may apply.

Is this really any help?

Or, just more frustration?

Good question.. It gives you something else to do while you are waiting for approval of your I-129F, so long as you keep in mind that it is not always kept updated and in fact many people on this site have found that their Case Status has still shown "Initial Review" long after they have had their petition approved. So it is not entirely accurate.

Just popped the question to her on 10-2-2011 while in Gran Canaria Spain))))))). Now I get to start the K-1 jorney. I am in the prosses of getting things together but am stil on the wall on wether I should do it myself or hire an imigration attorney. Part of me just wants the peace of mind to let sombody else handle all the paperwork. Any imput would be helpfull. Thanks.

K-1 Fiance(e) Visa Process & ProceduresEngland to USA, K-1 Visa
Sounds like you are pretty well prepared so far in advance with photos etc. Passport stamps and boarding passes (rather than copies of e-tickets, as these don't prove you actually travelled, whereas boarding passes do) together with photos of the two of you together and also with family are also good. You don't need mountains of stuff, just proof of having been together within the 2years prior to your petition. Proof of ongoing relationship comes up at interview time, so good to have cards, (e.g. birthday cards etc, handwritten letters, chatlogs etc and more photos if you have them). Difficult for you to do much else in advance without the information being outdated at the time of petition/interview.

Just follow the K1 guides, check on your embassy site as to what they will require for packet 3 and interview and keep reading this site - it becomes addictive anyway  , and note any pitfalls that your own UK community may encounter.

All the best with your journey !

offering to give the CO a ring might actually be seen as bribery i think

..........

If the beneficiary is the fiance (male) he's not likely to be wearing an engagement ring so I don't see it as relevant.

The engagement party photos may well have more to do with the fact that there were other family in the photos, showing they approved of and witnessed the couple were together. If you follow the guides and take sufficient proof of an ongoing relationship, then you've got it covered.

K-1 Fiance(e) Visa Process & ProceduresNOA1 7/27, No Status Updates Since
'Touched' really only means scanned anyway and this can occur when your petition is just moved from one desk to another so is of no real significance. An update of status doesn't seem to be a priority for them so many petitions go right through to approval and beyond without the status moving from 'Initial Review'. If yours is updated that's all fine but don't worry if nothing happens to it - it is not a reliable measure of what is happening to the status of your petition. Best of luck with the waiting.
