K-1 Fiance(e) Visa Process & ProceduresInitial I-129F Package Questions!
Sounds like you have lots of evidence of meeting... if you have any, boarding passes are better evidence than copy of your e-ticket as they prove that you did actually travel. Also dont forget to keep a copy of everything you send. Best of luck with your journey.
Just so everyone knows before we begin, there is a new DS-156 Form as of June 2011. I can't seem to find any accompanying instructions for it. Here is the link to the actual location of the new form.

Hi, can you post the link to the new DS-156, thanks.

Go online to someone like Expedia who will give you alternatives on different carriers and cost differences to look for the best deals. Often it is cheaper to buy a return fare than a one-way, and of course you will want to be flying back on the same carrier as your fiancee. Don't know what city you are flying from but others may have alternatives that offer the best deals out of your city.

You can check on your Embassy's site to see what they will be sending for Packet 3 so you can make a start on it before you receive the packet from them.

Will do, thanks again, We're holding off on the application until we have all of the information, and she's got her job status settled!

Good idea... yep it seems a bit tricky initially - and people will tell you to follow the guides etc and they are right.. just takes getting your head around the jargon etc and you'll be fine. If you keep a check on the posts and have any questions check in the search (top right of this screen) for similar threads it doesn't take long to be familiar with the process. Good luck with it all.

Brilliant, about a year or so, but well, when you know you know (we've not picked an engagement ring yet as she has thin fingers and we want to do it together, this annoys me since I wanted to be all gentlemanly and surprise her... DOH)
Aww cute!...

Hey also, boarding passes are good to prove you (or she) actually travelled, together with passport stamps, hotel receipts showing both names preferably or other tickets/receipts with names on. As secondary evidence, photos of you together. You only need evidence of having met in the past 2years at this initial stage. For the interview later on you will need evidence of ongoing relationship so you can then use record of communications, chat logs etc - but just examples of them every so often.

All the best for your journey.

You pay in local currency in each instance.

So the petitioner pays for the I-129F in USD.
Just keep following the K1 Guide in principle, then when it comes to the UK side, you follow the instructions in the Embassy Info (top of page) it gives you an updated version of what is required at their level.. so you pay GBP for whatever is done in the UK.

You must sign Form I-134 in your full name. (Note: Signing Form I-134 is under penalty of perjury under U.S. law). For this reason, it is not necessary to sign Form I-134 before a notary, nor to have your signature notarize after you sign it.

So you're saying it doesn't have to be notarised then..?

Have you had a look at previous posts on VJ about similar cases? I just had a quick look and it seems that most people got a doctor's certificate to explain the situation. I just did a search under 'antidepressants'. There are few cases which sound similar.

K-1 Fiance(e) Visa Process & ProceduresShould I include A DVD with Skype video calls?

Oh yes indeed I will include all those as well but I also wanted to go all out about it.

So far nobody has provided a link with documentation on providing video evidence of relationship on a DVD. (Digital Media)

Jim mentions it on this post and sounds as though nothing has been presented to date that stipulates one way or another on this issue. If you look on guides regarding how to present your petition etc, it is mentioned that it is a good idea to keep your documents clearly set out with the info easily accessible to them. I'm inclined to agree that they wouldn't look at it.

K-1 Fiance(e) Visa Process & ProceduresShould I include A DVD with Skype video calls?
Are you talking about evidence of having met within the last two years (as needed for the initial petition)? You can use things like boarding passes, copies of receipts showing both names (hotel etc), as well as photos together, (dated, though photos are considered secondary evidence). Anything that shows you were in the same place at the same time. This is probably easier than what you are considering.

K-1 Fiance(e) Visa Process & ProceduresAre employment gaps OK in application?
So long as you don't leave gaps... any periods of unemployment or being a student etc. need to be listed as such in between with dates - so that there are no gaps.

K-1 Fiance(e) Visa Process & Proceduresrequest for evidence
They really need proof of meeting within last two years. My fiance and I first knew each other when we were little kids at school, but that doesn't really count. It is our meeting again three times in 2010 that counts for the K1.
Sounds like you have enough evidence with what you have within the last two years. Best wishes..
AndieFemaleNew Zealand2011-06-20 00:43:00
K-1 Fiance(e) Visa Process & Proceduresrequest for evidence
Yes...

1. If you can provide copies of passport showing stamps, boarding passes and also photos (secondary evidence) of you together, just put location and date on the back (it is good to have a few examples of evidence)

2. Both complete a letter of intent.

Good luck!
AndieFemaleNew Zealand2011-06-19 15:55:00
K-1 Fiance(e) Visa Process & Proceduresrequest for evidence
Proof of having met in the last two years needed to be sent with the petition. That means boarding passes for travel, passport stamps showing when you were there, hotel receipt with both names, photos showing you together. In other words proof that you were in the same place together during the last two years. Later, at interview stage, you have to provide proof of ongoing relationship which is when you can give copies of chat logs, some copies of emails since you last were together etc. showing you have an ongoing relationship.

If you did send proof of having met within last 2 years, then it may be a missing signature or some question that has not been answered or something similar. You will not know until you receive the RFE. But at least they are looking at your file and it is making progress.

what form is this? and is there a fee for this stuff?

Are you the petitioner or the beneficiary? If the child was included in the original K1 petition and you are preparing for the interview you need to look on your Embassy website and follow what requirements they have for medical and forms for the interview. There should be details of costs for medical and interview.

It is probably enough since you have phone records, so long as the evidence you have covers a range of months to show that it proves an 'ongoing' relationship, continuing between visits and since you last saw each other. No birthday cards, notes sent, chat messages at all?

[1quote name='demio' timestamp='1308587712' post='4733755']
OK. Well waht matters is his own job; you said he is unemployed at the moment, how is he going to take care of you? I am assuming that he is getting a co sponsor for the affidavit of support for you.I am not sure your job has any significant bearing on his support but I will advise not to quit till you get your visa
Agree that while whether you have a job (as beneficiary) has no impact on the K1, no doubt the visa process is putting extra strain on you... and if you can hold on a bit longer, the extra $$ will come in handy. (just my opinion)

Someone may have other suggestions on what is possible as evidence of him returning and I think it sometimes depends on the person at immigration on arrival whether they accept your situation or not. In a sense it is illogical that they think your fiance is going to overstay in view of the fact you are going for a K1 but sometimes they do.
If you are not going to get any refund on the ticket he could either risk it or what about meeting in a third country, e.g.Canada? (just a thought).
I know how tough this is to be apart and wish you all the best.

They will require evidence that he is returning to his own country such as return tickets, proof of job, ongoing education, property ownership. Previous posts I have seen also mention that despite that there is still a possibility of the beneficiary being turned back. From what I understand at least two of the above would be necessary (in other words not just return tickets). Is there any chance of you visiting him?

K-1 Fiance(e) Visa Process & ProceduresRequest for addittional Information Question
Not necessarily. A touch can mean the file has been moved from one desk to another (every action is scanned), whether the touch is important or not. Many people get their NOA2 without their status showing any progress whatsoever, so its not an entirely reliable source of what is going on with your file. Things with VSC seem to be moving quicker lately so it may not be as far off as you expect. If you want to be there for the interview then you would be better to wait until you get the NOA2, as it takes up to a couple of weeks for them to send details through to the embassy. I don't know how long it takes to get an interview appointment in Peru. Needs a bit of guess work I'm afraid.

K-1 Fiance(e) Visa Process & Proceduresneed additional information
You need to look at the Guides (top of this page on blue line) to see how the K1 process works.

You need to be legally available to be married
Have met within the past 2 years
Able to provide valid proof of such
Prepared to marry within 90 days of arrival in the U.S. following approval of your K1 Visa.

This is a great site with lots of information and people prepared to help, so you need to have a look around it and familiarise yourself with what there is to know.

It starts with the I-129F, which your fiance needs to complete and submit to the USCIS. (All details in the info at the top of page.... examples of completed forms are there too).

Anything you don't understand just keep asking questions here and read the forums to keep in touch with things you may need to know.

K-1 Fiance(e) Visa Process & ProceduresGot REF, need some help...

Sorry for making you confused...I got my U.S. citizenship on Feb 15th 2011. What I mean is that I used the Chinese passport went back to China last year(2010). And they do stamp Chinese passports whenever you go in or out of Chinese border.

By the way, I keep one airline ticket stub from my last trip. However, the flight is one-stop flight and the stub is used for travelling from Shanghai to Guangzhou. The flight number is exactly the same as the receipt I got from the travel agent.

Maybe you need to resend the copy of stamps in your Chinese passport and give an explanation of why you travelled on that passport with information about your US Citizenship only occurring in February 2011. In other words providing a timeline of events with attachments of copies of itinerary showing all flights (attach ticket stubs for those you have) and send dated photos with details of where they were taken etc. People in the photos (fiancee's family etc). Could be that they want clarification of the information and are confused by what you have sent? Build an explanation and case from the ground up.

K-1 Fiance(e) Visa Process & ProceduresGot REF, need some help...

Recently, I got the REF mail as following:
"REQUIREMENT THAT PETITIONER AND BENEFICIARY HAVE MET IN PERSON: It mus be established that the petitioner .
Last Personal Meeting-Submit evidence of meeting the beneficiary in person within the two-year period preceding the filing of the petition (3/32/2009 TO 3/23/2011). Primary evidence may include airline ticket stubs and receipts (that indicate month, day, and year), copies of passport pages that show the identification page and admission stamps, military order(s), letter from Commanding Officer, or any evidence that will help the USCIS to determine that the petitioner has met the beneficiary with the two years. Secondary evidence may include film-dated photographs of the petitioner and beneficiary together. The following DOES NOT constitute evidence of meeting: disc, videos, emails, letters, phone bills, and greeting cards. "

I have several questions:
1. I did submit the copies of passport pages which show the identification page and admission stamps. However, I got my citizenship on February 2011 and I used my Chinese passport for traveling. Do I need to do notary for it?
2. I did not keep the airline tickets stubs and all my tickets were booked by travel agents. They sent me the receipts and e-tickets via emails. Can those receipts and e-tickets be counted as evidence? Not as good as the actual boarding stubs as they proved you actually travelled, but I would send them anyway.

3. My fiancée and I did not take many photos together. In some of the pictures(took when we visited SHANGHAI EXPO last year), she was wearing sunglasses. Can those photos be counted as evidence? Yes send photos as secondary evidence
4. Last question... During the time I visited my fiancée, She and I had a 3-day trip in China. I saved the hotel and the airline ticket receipts. I did not do translation for those receipts and I am going to do word-for-word English translations. Do I need to do notary for the translations?

I am kind of nervous and I keep calling uscis but do know which option shall I choose...
sorry guys...I have so many questions...If you can help or give me some advice, I really appreciate it.

Sorry, I don't know about the notary, but I would send as much proof as you can... you have plenty, but now just give them as much to fill in any gaps as possible to build a picture of your visits. Best of luck.

K-1 Fiance(e) Visa Process & ProceduresREF help, do I need to include that receipt?
Get the travel agent to send you a receipt showing the dates of travel, hotel dates etc. They can probably print a copy of your hotel voucher. Explain what you need, agents keep a lot of information on file. You need to put a timeline or copy of your itinerary with all receipts, vouchers, and boarding passes that you still have attached to the relevant places on your itinerary. Even if you don't have all boarding passes and copies of everything this gives an entire representation of your trip.

K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2

Hrrm.. so I see that a VWP would be a more certain path;

However, how long are we talking about (on average) until she actually needs to be in the UK for the medical/interview.

Also, will her applying for a B2 (and possibly being denied) cause her to have a red flag or whatever?

The problem with VWP is that there is still a chance that she could be turned back on arrival in the U.S. I went through a similar situation at the end of 2010 and was held up for 5 hours in immigration. I was eventually allowed in but advised to apply for a B2 next time. It was a very unpleasant experience to say the least. A B2 denial doesn't reflect on your K1.

Your K1 is going through CSC which is likely to be reasonably quick based on current timelines, especially for UK. You could well have your NOA2 in 3 months from the NOA1. I don't know the waiting time for the interview, someone on the UK thread could help with that and may also have had experiences going to the US as you are planning for your fiancee.
AndieFemaleNew Zealand2011-06-23 00:09:00
K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2
I think a shorter length of time staying with you would be more likely. Someone on this site came through no problems within the last couple of days but they were only planning to stay for 2 weeks.
About the University applications... she would not be going ahead with this once she gets the K1 though I'm assuming. It is a difficult time because if the beneficiary is going through the K1 process, they are gradually reducing their ties to their own country, so unless they are working and plan to return to their job after a short stay, it is difficult to prove.
AndieFemaleNew Zealand2011-06-22 20:59:00
K-1 Fiance(e) Visa Process & ProceduresTo B2 or not to B2
The main issue is that she needs to be able to show proof of ties to the UK. She needs return tickets, a job (which if she is planning to be away for 3months she probably doesn't have), a house or rental agreement etc. It could be tricky establishing that she plans to return even though she obviously she needs to return for her interview. Many others have had this same problem.
