K-1 Fiance(e) Visa Process & Proceduresuscis account?

Actually.. if you get a letter from them with a NO1, you are in the system.

Yes, and then after that it is not consistent - a touch just means it has been scanned but it could just show that it has been moved from one desk to another. As has been said, some people go right through to approval and the system shows it is still in initial review, so its not really reliable. By all means check from time to time but don't stress if there is no update shown.

K-1 Fiance(e) Visa Process & ProceduresPlanning K1 Filing in Advance
If you check out your local embassy site it should tell you what they will send in Packet 3 (after you get your approval from USCIS). Also, realise you have just joined but if you complete your timeline and profile details as to country of embassy etc it helps for VJ members to give you a more precise response as to what applies in your case. Best of luck with this process..

K-1 Fiance(e) Visa Process & ProceduresUncommon situation
You have six months to enter the US on the K1 once issued before the K1 expires.

You have 90 days from the date of entry to the U.S. on the K1 within which you have to marry.

The key difference being, we'll be together. Keeping paperwork, records, even paying fees, I don't really care once she's here.

K-1 Fiance(e) Visa Process & ProceduresHas Anyone Waited OVER 5 Months For Their NOA2?

Hi maning, hang in there the best you can. You're dealing with a faceless bureaucracy here. The USCIS has zero accountability. Applications come in, they take your money quickly, then things just sit in boxes until someone can process them (there are detailed descriptions elsewhere on this site). There is no one to hold them to any standard. They have no reason to care, they have no reason to be productive, nor do their managers have reasons to improve their processes (which I suspect is the real productivity killer). They're getting paid well and a great pension regardless of how they work.

But, eventually, you will get your NOA2.

K-1 Fiance(e) Visa Process & Proceduresk1 relationship requirement

As in all our cases, the burden is to provide PROOF that is convincing that you are truly a couple (in love) and with the intent to remain together after the foreign partners entrance into the US.

Whether that love is 1 month old or 10 years old matters little (except that the longer relationship has more tangible evidence if they have visited one another).

You could have met in person the day before filing. The only technical requirement is to have met within the 2 years prior to filing, but you need to be able to show that you have genuine intention to remain together as a married couple, with evidence to prove this and evidence of communication to support your genuine relationship.

Best of luck with your petition.

K-1 Fiance(e) Visa Process & ProceduresWhile Waiting For NOA-2
To fulfil requirements of K1 visa petition, you only need to have met once in the past 2 years. Proof of ongoing relationship for the interview does not necessarily require a visit. So yes, it's up to you.

K-1 Fiance(e) Visa Process & ProceduresIs this a possible RFE? Opinions please.
If your birth certificate is blank on the back then the front that you have sent will have a blank back - so it is an accurate copy of your birth certificate (both sides) - you don't need to send a blank page as proof of a blank back of your birth certificate. Mine has a serial number on the back so I had a double sided copy printed.

K-1 Fiance(e) Visa Process & Procedureswhat service center?
Just a point on the Status... many people have been approved and their status still shows as in "Initial Review". It doesn't seem to be a priority for USCIS to update this, so you can't rely on it as an accurate reflection of what is happening with your petition. Hope you hear something soon.

K-1 Fiance(e) Visa Process & Proceduresalmost ready to submit the I-129F....a few more Q's
With the address, yes use the one you are living at as it is the only address you have and you will probably be there initially anyway.

The two jobs - can you put one underneath the other and put Start date/till present for both?

The packet sounds rather elaborate. You only need to show proof of having met in the past 2 years at the initial petition stage. (e.g. Copies of passport stamps, copy of air tickets and boarding passes especially, photos showing the two of you together). The proof of ongoing relationship occurs during the interview stage.

best of luck..

IMO I would contact them to let them know - then there wont be any confusion (in theory), about whether the stolen passport has knowingly been used to initiate a petition.

K-1 Fiance(e) Visa Process & ProceduresDifferent Checklist VJ and USCIS

Not to worry, everyone gets nervous when so much is at stake.

You want to check and recheck your petition before mailing it. 2-3 times to make sure you have everything completed and also cross check the different forms to ensure it all matches.
Also, once you mail your initial petition, start looking into the next steps (after NOA2, interviews, etc) and past that (AOS). The name of the game here is preparation and knowing ahead of time what you will need because often getting documentation can take days or weeks. Last thing you want is to find out you need that one document that can delay your case by 2-3 weeks.
You don't need to rush but you want to be be a couple of steps ahead; this will save time and $$$ on a process that is already lengthy and costly.

K-1 Fiance(e) Visa Process & ProceduresRenewed "Intent to Marry Letter" be in typerwritten or in handwriting?

It would much more professional if typed or printed from computer, yes, it is part of the I 129f application.. Good luck
From what I have read it is not required for the interview.

No, its not a requirement for interview but I have read several times of people using an updated copy at the interview to show their commitment to the ongoing relationship.

Hello, a question... the Intent to Marry Letter should be part of the I-129F package right? I did not remember bringing one during my embassy interview...

Initially with the I-129F, but good to take it to the interview with updated date as part of proof of ongoing relationship.

K-1 Fiance(e) Visa Process & ProceduresK-1 papers: Photocopy or Original?

Some folks here got an RFE for not sending letters/forms/documents that that doesn't show their original signature.

Sorry if that was confusing... originals of certificates are not required... original signature on G-325A and I-129F are required but I don't think they are always RFE'd for that. I have seen threads that have discussed this and I wouldn't send those forms without original signatures in blue ink as there are sometimes problems with black ink looking like a copy.

There's no real system in place to facilitate something like that.

RFEs aren't really a big deal. Once they receive it back they'll approve you straight away, so it'll only really delay your case a couple of weeks.

Thank you that's very helpful .... I also wondered if there is any point in sending the other information earlier or if it is better to wait until receiving the RFE as this could cause a delay? Or whether the other information will never connect with our original I-129F application and get lost somewhere?

We sent the I-129F leaving some information out of the pack. Is there any point in sending the additional information to Texas or on to Vermont where the file is now.... or just wait for the RFE? We just want to do what is going to avoid any delays but wouldn't want to lose the additional supporting documents if it doesn't connect with our original I-129F application which they already have.

You don't need the Proof of Relationship at this stage. Just proof that you two have met within the last two years.

What qualifies as having seen each other in the last two years as opposed to proof of relationship?

K-1 Fiance(e) Visa Process & ProceduresDecember Filer receives RFE after sending in 75 pages of documents and supporting evidence
we didn't discover this website until the I-129F and some docs had been sent, and as I notice others have, were misdirected by other websites which didn't give such complete information. The worst of it being that we had all docs available but understood from info we had already received that these weren't required until later in the process. There seem to be many inconsistencies with timing etc but I am now glued to VJ. Did you send your following docs direct to California?

K-1 Fiance(e) Visa Process & ProceduresDecember Filer receives RFE after sending in 75 pages of documents and supporting evidence

My initial filing was December 22, 2010. I only send the I129F form, I-134(not required) with supporting evidence, G135A with photos, my birth certificate, copy of passport entries showing travel to the Philippines, copy of my divorce order. Not too many items were missing like letters of intent from both of us, proof of meeting and possibly ongoing relationship items and her husbands death certificate. I highly recommend studying this website concerning your needs and following it exactly. There is a lot of knowledge to be gained here. Experience is everything during this journey and some here have a lot of it. Use that experience, because I did not and it cost me so much in aspirin. I sent the missing documents to the CSC which is reviewing my case. I don't think sending them caused the early review because other December filers have sent me private messages stating their petitions were reviewed and they have received RFEs.
