I wish you best of luck on this journey. It also would not hurt to ask USCIS in writing to expedite this case. I know, I know... there going to be some people writing "USCIS will not expedite for this reason..." and such... :) But just write about your previous application denial, explain your situation, and mail it by express or similar mail. Write in bold letters "EXPEDITE REQUEST" on envelope. There is nothing to loose, except money for postage. If it doesn't get expedited - it will proceed with normal course, but at least you will know, that you tried.


Yes I think it is probably impossible then. It was going to be close anyway... we didn't discover VJ until after we sent the petition and didn't know the time frames of the process. We will do all we can. Thanks again you have been very helpful... all the very best with your journey also.

Hi. I'm in the same situation with K2. What I've learned so far - it will be very tough. She needs to enter USA before 21st birthday, her visa will expire on that day. Embassy will issue a visa up until 21st birthday. If date passes by, and she reaches age of 21 - visa will not be issued (and in my personal opinion, even tourist visa will be almost impossible to get, because of earlier application for K-2). There are only few avenues after that. One of them is for her mother to petition for her.
If, by chance, she enters USA on K-2, even on day of her 21st birthday, she CAN adjust. Don't listen to anyone here, telling you differently. Even if USCIS local office rejects adjustment, courts (and BIA) most of time overturn this decision, and let person to adjust.


thanks for your reply... I'm the mother and beneficiary. I knew about the arrival before 21st birthday but we had a problem with our petition and it was denied owing to lack of some information (no RFE). We wondered if they would still process our new petition prior to her birthday and issue a visa even though she will age out before she arrives. So are you saying she will not be able to enter the US on the K2 if she has turned 21. We thought there was a possibility of her being able to stay the 90 days but not adjust status.

If the petition for a K1/K2 goes to USCIS before the 21st birthday of the K2 (who is soon to age out), will USCIS approve the K2... assuming all documents are okay?

Will the Embassy issue the visa regardless of the birthdate?

I'm wondering if it is possible for the K2 to be approved under these circumstances and be allowed to enter the US for 90 days since by the date of travel she will have aged out and whether she would therefore be able to enter the US but not be able to adjust status and instead leave before the 90 days is up?

At interview stage you just need to provide proof of ongoing relationship as far as the relationship is concerned. Chat logs, emails etc. and take any photos you have together... the once only meeting is ok. You'll be fine.. best of luck!

I've visited my fiance 4 times in the last 16 months, I stayed 1 month, returned to the UK for 6, then flew back and stayed 3mths, came back to the UK for 3, flew back for 3 again, came back to the UK for 3, just returned now from another 3 month trip.

My fiance wrote such a letter, the gentleman at PoE didn't want to see it. I just explained that I had return tickets for August 6th and I was visiting to gain proof of our relationship to present at the Embassy back in England in accordance with our K1 Fiance Visa filing.

There is no guarantee that you'll be allowed in, you just got to hope you get a nice officer there. Take copies of bank statement if needed, a letter from him and proof of return tickets at a minimum, copy of your I-129F is a good thing to have too. I am in the same situation as you are, I have no job and I stay with my parents when I'm in the UK. So I can't show ties.

Yes this is a tricky one.. my case was very similar to the above and just trying to return to spend more time with my (now) fiance. I was held up for 5 hours at immigration and allowed to stay but told to apply for a B visa next time. I was denied the B visa owing to lack of ties. I think it depends on who you are dealing with. I had proof of more than sufficient funds to support myself and being a freelance writer have no immediate employer. You can only chance it - there are no guarantees.

Yes, the results of one that I looked at on VJ recently reflected a total of just over 50% being online meetings which were made up of game, dating or other social sites.

Oh, ok... did they give you the opportunity to supply more evidence of the ongoing relationship?
Otherwise I think you need to wait until next week as there may be a possibility of doing that. You wont know until you find out more from them.

The NOA2 is valid for 4mths. There will be an expiry date on the written form when you get it, and if there are no interviews available until later, they will extend it to fit the available date. :thumbs:

(I would contact them when you arrive back to arrange an interview date).

If the reverse side is blank on the original then essentially your photocopy of the front side, with the back blank, shows both sides of the original - some birth certificates have a number or barcode or a place for changes etc. If yours doesnt then you dont need to send a copy of a blank page.

Yep... 5 months is considered average. There are various reasons for the time frame - sometimes its just that the person processing the pile you are in is slower. The waiting gets difficult at this point but its just the way it is... best of luck with your petition. :thumbs:

Lots of petitions don't ever show as having been touched and are then just approved. Sometimes a touch can just mean your petition has just been moved from one desk to another - it doesn't mean any specific action has been taken and the notification of a touch seems to be inconsistent in that sometimes it is notified and other times it isn't. In other words it is unreliable and doesn't mean no one is looking at your file. So don't let it worry you. :pop:

Yeah I'll chime in here and say, the chances are that you won't get through the whole process in time. Less than 6 months from petition to wedding was really being blindly optomistic as just the first step can take that long. Unfortunately you have 2 choices. You can reschedule the wedding (I wouldn't even set a date until you have visa in hand) or you can get married and then restart the process as a CR-1. The second option is only possible if CBP lets your SO enter for the wedding, there is the very real possibility they may look at everything and say they are intending to immigrate so they can't enter.

Wish one of us had some good news for you, but there really isn't any in this case.

They can answer with approval with RFE or denial.



Agree. In many cases there is no change to case status at all, so it tends to make people nervous. Its not reliable so dont worry about it.

The 5mths is flexible and depends on each case and who has your file. If they are slower, then it might mean yours is going to take a little longer.

You will be denied if you do not meet in person. You have not mentioned any reasons which would even be considered for a waiver of this condition.

The really bad news is you would probably not be denied outright. They would accept your petition for procersssing and you would wait 5-6 months, then you would get an RFE for evidence that you have met in person BEFORE you filed the petition. You would not be able to answer the RFE and 2-3 months later you would be denied, wasting nearly a year.

Go to Algeria or some other country where you can meet in person (it does not have to be in Algeria)

In a nutshell: my fiance has been studying in france for a year. He is going home in about a week to do his medical and interview in his home country. He will be staying with friends/family while there, since the process is supposed to be pretty fast there (they don't process many K1 visas) and it doesn't make sense for him to rent anything.

My question is, what do I put down on the I-134, where it asks where he presently resides? I don't think I can put down his address in Paris as he will be no longer residing there at the time of the interview. And most homes don't have street addresses in this city, so I can't put down his family's steet address, just their neighborhood and city. For the g325a, we just gave the neighborhood and city for his previous residences, and attached a google map showing where he lived. Can we do this for the I-134 or do they need a more formal street address? Help!

IMO if that is the address where he is residing I dont see how you can do anything else. As you have already used it on the g325a it matches information they already have. I would do the same again with a google map and a brief explanation. Some properties (farms etc) only have a name and not a specific street address. If anyone has been in this situation they may want to reconfirm this.

I am sure it is because you sent a form in Russian. USCIS specifically states that all documents submitted have to be transalated into English. That includes birth ceriticates, marriage certificates, Cenomar and Divorce certificates. You do not have to sent the original but have it available for the interview.

The initial petition requests proof that you have met with in the previous two years.
At the interview you need to supply evidence of an ongoing relationship. This could be in the form of proof of a visit since the initial petition, and/or proof of ongoing communications since then. Yes, and then after that it is not consistent - a touch just means it has been scanned but it could just show that it has been moved from one desk to another. As has been said, some people go right through to approval and the system shows it is still in initial review, so its not really reliable. By all means check from time to time but don't stress if there is no update shown.
