If you can fog a mirror and write a check that won't bounce, you can apply for employment authorization.

Actually, that seems to be sufficient to get hired at a lot of places! Minus the check writing part. ;)

No offense meant to you but I think you should be really careful when giving advice to make sure that you have your facts correct. Especially when someone is asking a questions that can be so critical to their application. [/quote]

The passport photo I have to have for my interview.....is there any requirement on how recent it has to be?Can it be the same one I submitted with the I-130. I havent changed any. Maybe a few extra grey hairs lol but I've got them covered :P

Lorelle, On the sheet we got "Immigrant Visa Photo Requirements" it says "The photos must be unmounted, full face photo, as described below, and must have been taken within the last six months."
I had to have one too for the I-130 and I made the guy take several so I could have a choice

I've been lookin' over so much paperwork I must of missed that lol Thanks Sadie

Know what you mean about paperwork, lol. Yesterday, the security guard at the Embassy took one look at my accordian file and said: have a few forms do you? Just a few, lol. And I took out some of the stuff before we went down there.

Do we need to take the x-rays?

Nope. Just have them in your luggage when you fly out. At my medical they wrote this on the front of my x-ray "Take to the US, not to interview"

Don't know what POE you are entering and the procedures there, but we have decided to put my DAH's xrays in a mailing tube & in the carryon bag as we are going to LAX and normally you have to clear immigration before you get your luggage there. That's in the unlikely event they ask for his xrays too, I don't want to be digging in six suitcases by myself, lol.

US Embassy and Consulate DiscussionI-134 and real estate

First of all you do not need to disclose your assets unless you are using them to meet the 125% of poverty level requirements. Most of us qualify using our income alone (It's only $16,500 a year for 2 people!) Check here http://aspe.os.dhhs....06poverty.shtml
Second - if you are using your assets e.g. homes to qualify then you can do one of two things
1) Use the property tax statement to establish the value (yes its understated on those) and your mortgage statement (we get this annually for filing income taxes) to establish your debt - the difference is your equity.
Or 2) Get an appraisal done and submit that for the market value and then subtract the mortgage owed for the remaining equity.
Ah! How much will you need to establish? The rule of thumb is 5 times the annual requirement so $82,500 worth of equity for 2 people. Good Luck

For value of property, you can also use an Opinion of Value letter from a real estate agent, would be less costly than an appraisal. (Mine was free as I knew the agent and he had seen my condo)
If your income is less than $16,500, say for example you make $15,000 annually, you would need to show assets of 5 times $1500 It is five times the difference between your income and the $16,500. Read the Evidence of Assets section in the instructions for the I-864.

I told him not to worry about it, because no, its not open enough to get paper in or out. Its not easy for him to get back there. Hed have to hop on a train at 4 in the morning and its alot for him to get there. I told him not to worry about it, because the opening isnt big and he should be fine, but if he wanted to fix it, to go to the embassy the day hes in Bucharest to get on his plane (by train schedual he has to be there 1 day early and sit around the airport anyway) to go ahead and take it back to be resealed since he will have a whole day.

According to their website, the applicant can also call the Consular Section. There are also instructions if calling from the US. Maybe your fiance should try calling and then if he can't get an interview, you could also call. This is from their website:

SCHEDULING APPOINTMENTS
Prospective applicants for immigrant visas or special parole receive application packets through the mail (either Packet Four or "superpacket"). Once the applicant has assembled all required documentation, including a medical examination, Cuban police certificate, and Affidavit of Support (Note: Only Form I-864 can be accepted for family-based immigrant visa cases, and only Form I-134 can be accepted for Diversity Visa cases, Fiancée Visa cases, and all parole cases. Please see U.S Department of State Bureau of Consular Affairs Visa Services for more information), the applicant should contact the consular section's public information unit to schedule an appointment. The telephone number for the public information unit is 834-4400 (callers from the U.S. should first dial 011 and then the country/area prefixes, (53)(7). Appointments for immigrant visas only can also be made online at here (English or Spanish)
Appointment availability varies with seasonal demand. Generally, appointments for immigrant visa applicants are available within three to six weeks. Appointments

Does anybody know why the embassy in Bulgaria is not even listed in the list of the all of Embassy around the world????

Do you mean on visa journey?? Is it possible that they do not process immigration visa's.? Some smaller countries go through another country's consulate...

Or, no one has filled in a review for it.

Here are the people the have recorded that they are going through Bulgaria on a K1, this is why filling in your timeline is extremely important.

OMG ashe still hasnt filled her timeline in !

Is the Police Certificate a World wide document? Does each country have a standard Police Certificate? or is it just a statement from the police departement that there is no record? because the beneficiary has no record.

Hi there, if you go to this website you can find reciprocity tables for each country. Here:
http://travel.state....ocity/index.htm

Click on the letter of the country you are looking for and you will find instructions on how to request documents from that country, including policy certificates. Each country has a different form unique to that country.

Well.. it IS necessary... I got an e-mail from the consulate and they say they need the last year's one... so... it will be needed... sigh....now he will have to call the IRS and request it... I just hope it gets here in time since my interview is in 15 days...

Just in case he doesn't get it from IRS, he can order the tax transcript from Accuverify. I did this after trying to get my transcripts for weeks and weeks. It cost me $20 but I got them in 24 hours by email. I finally received the IRS ones about 6 weeks after my husband's interview

US Embassy and Consulate DiscussionNeed help
Not sure if this will help you but in our case, I (the USC) did not quite meet the 125% income so in addition to my income, I used assets of bank and house. The ConOff looked at all my docs for the I-864 (we were DCF in NZ) and the only thing she asked was how much I would net if I sold my house. I had a letter from a real estate company giving Opinion of Value and I own it outright-no mortgage. That was all they asked about. You could use your house valuation minus mortgage along with your income and perhaps an explanation of your other assets. They may not ask for assets but if you are borderline on income, they might. It never hurts to be over prepared

Hiya Mew
Take a look at the Brazil Embassy website's Instruction for Fiance Visas:
http://www.embaixada...dfs/instk1e.pdf
Sounds like to me that his H&R copies would be ok. If you are worried, perhaps you could contact the Embassy and ask them if they will accept the ones he filed or if they want the IRS transcripts or he could just go ahead and order the IRS transcripts. They are free. You can also get the IRS transcripts from Accuverify.com--$20 if time becomes a factor.
Good luck

US Citizenship General DiscussionDoes US recognize original citizenship?

I read that but it doesn´t say anything about which to use. I heard you can´t present both passports ´cus while in Brasil, you´re brazilian only, and while in US, you´re american only.
Does it make sense?

The way I am reading it, it says you must use your Brazilian passport to enter & leave Brazil.

"U.S. Citizens also possessing Brazilian nationality will not be issued Brazilian visas and must obtain a Brazilian passport (from the Brazilian Embassy or Consulate nearest to their place of residence) to enter and depart Brazil"

I would check with the Brazilian Embassy before traveling with two passports. Seems I've read other threads where this caused problems in other countries.

US Citizenship General DiscussionDoes US recognize original citizenship?

Hello, with all this talk of dual citizenship I have a question nagging on me.

Brazilian laws state that brazilians acquiring a new nationality will loose the brazilian one, except if the country whose nationality you´re acquiring recognizes your original nationality, and another exception that doesn´t apply to our forum.

My question is just that. Does US recognize my original nationality? Or by taking the oath do I have to give up my own?

This is on the US State Dept. website about Dual Nationality - Brazil:

http://travel.state....s/cis_1072.html

Scroll down a little ways for the section on Dual Nationality & visas/passports.

Yes... but then you would have to pay for them... usually at inflated prices...

If you can get them done at your General Physician, I would do it there. Or better yet, you should get antibody titres done to see what you are immune to...

My DH had a blood titre test to see if he needed to be vaccinated for Measles, Mumps, Rubella, Varicella or Hepatitis B (which he didn't) so he will only need the rest and was told he could get the ones he needs all at one time. Now just getting him over his fear of the needle  :D

IR-1 / CR-1 Spouse Visa Process & ProceduresPolice clearance

Hello everyone,

knowing how long CSC is and eventually the NVC, I want to be as prepared as possible when I receive my approval and need to send back all the docs for DS-230. I understand that the applicant needs to supply police clearances from countries in which they lived in for more than twelve months. Since I lived in England for 18 months I will need to supply NVC with a police clearance, however, from what I understand, the clearance is only valid for 40 days from the date it is issued (I could be wrong here). If anybody has any knowledge or advice when I should order my police clearance or know how long it takes for it to arrive, it would be extremely helpful. :help:

IR-1 / CR-1 Spouse Visa Process & Procedurestax information

Ok, another question. Just sitting here reading some of the threads and have noticed question in regards to tax returns/w-2's. My problem is that I haven't worked in the past 2 years. So I will not have a tax return filed for this year, but I have a joint one done from when I was married. HOw do I legally get a copy of that? Do I need my ex husbands permission to get copies?

Thanks

Laura and Ian

According to the instructions on the IRS request forms (4506 & 4506-T) copies of jointly filed returns may be furnished to either spouse, only one signature is needed. So you don't need your ex's permission to access it. HTH

IR-1 / CR-1 Spouse Visa Process & ProceduresNeed info about DS-230

14. Maiden or family name? what i should write here.

3. If your are male you need not to write anything. For married woman, it would be their Name before marriage, but I never write any thing where they ask to write Maiden name. I had always wrote N/A

Could someone really pin this down? I have seen several different answers and it is confusing. On the DS230, Number 14-Name of Spouse (Maiden or family name). If the immigrant is male would that question's answer be his wife's maiden name or her current married name if that is what she uses on her passport, driver's license, etc.?
Thanks for any clarification.

Err, I don't see: Respondent anywhere on DS-230 part 2, What question number would that be?
UK Citizen is Visa Applicant and US Citizen is Petitioner. Look in the sample forms and you can get a good idea of what goes where. :)

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion for those who filed for ITIN..

Hi, my wife is not present in USA. Seems w7 form needs to be filled
I have two questions

1. in 1040, what should I put in spouse's SS#? should i leave it empty or put ITIN TO BE REQUESTED?

2. when filling out form W-7, can my wife put in my mailing address (in USA although she isnt here)? I want her ITIN number mailed to me as it takes a long time t o get mail in her country(and its not reliable also)

#1 Leave it empty as Yodrak said. I put "ITIN requested" & IRS whited that out.

Also, please read the instructions carefully of the W7 as she can use other means of ID besides notarized passport. (I certainly wouldn't take the chance of her mailing her original passport with the mail as you say it is in her country) If you decide to use a notarized copy of her passport, some countries are part of The Hague Convention & you can use local notaries and it will be accepted by IRS, that's what we did here in New Zealand Google for that info.
