Hi all, 

just ANOTHER Nebraska filer here .. PD Jan 2,2014 ..  I recently sent a service request in hopes to find some sort of clarity in all of this. But of course more confusion. Basically it said that we had not met the required security checks and they had no idea when it would. 
Gotta love USCIS. So insightful..

 

Hoping to hear something in the next month.

Holy geez...there are so many of you at NSC with December and January PDs (according to Igor's List).  That's really pathetic!  None of the other service centers have a backlog that big.  I realize that each case is different, and that for some, security checks take a bit longer than for others...but really??

 

I really hope someone lights a fire under their collective arses over there to level the field somewhat.  There is no excuse for this utter nonsense.

I called today to check the status of my petition with a PD of Jan 27. We attempted to complete a service request and was not allowed to do so because the system is still showing that they have not past our PD.... I was told to give them 14 more days. This has been the 3rd time I've been told that.

Yeah...they won't let you do that until 6 months has passed, so I have read.  Lots of action with the petitions that were transferred from NSC, so this SHOULD mean things will speed up now, right?  I would like to think so...

Yeah I'm gonna tell my husband to contact the senator and the ombudsman, or can i do that as the beneficiary? It might really just be the stupid security checks, just did a quick google search and realized that there are some sex offenders and convicts out there that have the same name as my husband...

Yes, unfortunately that is all it takes - a name or a birth date that corresponds with a felon's and you are red flagged and need more security checks.  Sending prayers and good vibes your way that they approve you soon.

Yup definitely feels like it... What do you mean by making noise? We've filed a service request, tried contacting our congressman (never got a reply), called...what else can we do? Kinda wanted to wait till we get a response to our service request but it doesn't feel like that is ever gonna happen.

 

 

Haven't gotten a response yet, which is really weird. I really think they've lost our petition....

That's right!  I remember you now...gosh I wish I knew what else you can do.  I guess just keep hounding them.  Senator, ombudsman, keep on the congressman.  I wish you luck, and I really hope they approve you soon.

I'm really happy for everyone who got approved but I'm also starting to get mad. I keep thinking that, if we had filed later, I could have my approval right now. Since we haven't gotten a RFE it must be the background checks right? I seriously don't know what the problem could be....

I am feeling the same way as you are.  I am beginning to think NSC is stuck in a time warp.  You should be at the point where you can start making some noise, alreadytaken.   I am thinking that NSC grabbed the petitions at the top of the pile and sent them off to CSC and TSC, leaving themselves to deal with the older ones.  And those, they are being done at random...JMHO. :(

I received a letter on 07/09/2014 from the Department of Homeland Security Lincoln NE (Form I-797C, NOTICE OF ACTION) that my I130 petition for alien relative that was receipt date of 02/28/2014 which I thought was being processed at the NEBRASK Service Center was no being transfered to the California Service Center.  i called the National Customer Service Center to see why and they said that there was a backlog at the Nebraska Service Center and that my case was being tranfered to the Calfornia one to be expedited.  I don't know if this is because I am a retired military veteran or is the National Customer Service Center blowing smoke about it being expedited.  I called them out about the normal processing time being around 5 months and why did they wait until I was 2 weeks away from the 5 month mark to transfer my case.   Anyone have similar circumstances like me?


I could be wrong, but I doubt being a military veteran had anything to do with it. My husband is US military veteran (also retired) and we are going on month 6 of waiting for NOA2 (PD 02 Feb 2014). They seem to be moving lots of petitions from mid February, so obviously NSC has a backlog they are trying to clear up. Hopefully the transfer will mean your petition will be adjudicated soon, but I am thinking they may be throwing the word "expedited" around a little freely.

I'm a Feb 2014 filer and was routed directly to Nebraska.  NOA1 was Feb 4th and I am not expecting that the husband will hear anything for months...unless they decide they need something and send an RFE.  If anything  happens I will update all the appropriate VJ threads, but my expectations are way low judging from what I have been reading here.

I'm definitely not posting from experience but from what I have read here on VJ, this sort of thing is discouraged for exactly that reason. I am guessing that it would also depend on the person adjudicating your case whether they believe a wedding took place, but it is something they may well decide they need to look at closer, and that may cause a delay in your case. I don't think USCIS assumes anything.

And where are all these petitions headed?  To NVC, that's where.  And do you think that all these expedited petitions may be creating a backlog in NVC?  I think they might.

 

I'm not passing judgement on the situation, just making a supposition.  I have been reading the forums and following timelines, watching the expedites, and yeah...I'm a little jealous that someone who has filed months after me has been approved.  I am human.  I wish everyone here the best of luck on their journeys.  If my petition get adjudicated within USCIS's posted 5 month timeline, then fine...I am content to wait.  If it drags on much longer than that, well let's just say people are going to hear about it.

 

The effects of a typhoon the size that hit Phillipines in November can last a very long time.  Heck, Louisiana is still feeling Katrina...we just don't hear about it.  We don't really know the criteria USCIS is using to expedite those petitions, so I am not going to waste my energy and emotion worrying about someone else's journey.  I will just pray there won't be a backlog at NVC when I finally get there.

It pretty much goes on a case by case basis.  Some are held up for whatever reasons and others just breeze through, from what I have learned.  There are other factors also, such as whether you choose to use EP or snail mail for NVC, and how many civil docs you need to send for them to review.  If you have lived in lots of places like me, it may take more time too.  From what I have been seeing on here, it was taking 4 or 5 months from NOA2 to interview.  I am guessing for myself around 6 months for my visa, and I just got started in the system at NVC.  They have a backlog there, but they are changing some of the process to hopefully make things go quicker.  So if I get done more quckly, that would be great.

 

Canada doesn't seem to be any quicker than other countries for some people.  I really believe it is a case relative thing, but you can probably bank on at least 5 months.  I also know that it can take up to a month after case complete for them to book an interview for you.

I live in Bc and my husband lives in Washington and I visit him every other week or so. If I drive over they don't really seem to care much and only ask when I am returning. If I bus I bring lots of stuff to show I am returning to work and usually a letter from my boss. It isn't that bad and you just need to be prepared for the worst (although it hasn't happened to me yet! Fingers crossed). You should be fine.

Hi all,

 

Well, we did it!   We tied the knot early in the new year during our visit with my mom and step-dad in Texas.   NOW...the husband (USC) is working on the filing part but he is also on the road lots with his job.  Anyway, needless to say at this writing we have not filed yet.   I would like to go down to see him this weekend as he will be away for six weeks working in the oilfields in western ND starting next week.

 

My question is : I have a certified copy of our marriage certificate, and my bank statements and employment position summary (perm position).   Do you guys think it will be enough to convince them that I have strong ties in Canada?  The thing is I have been going down every weekend since summer time, they photograph my car every time.   I won't lie to them and say that I am visiting my "boyfriend" when it's really my husband I am visiting.   I am just worried that they will turn me away now that my status has changed.   Thoughts please??

Hi everyone!

 

As I am reading through the latest posts, a question pops into my head.  I am pretty sure it's not anything to worry about, but I am going to ask mainly for reassurance.

 

We submitted the I-130 petition and it has been received (USCIS cashed the check).  On one of the forms I remember them asking for my passport number.  No problem.  Now, since then I have surrenderred that passport for a new 10 year Canadian passport in my married name.  I am hoping I didn't jump the gun, as that passport did not expire for almost two years.   

 

This won't make a difference, will it?

I have been down to visit my husband several times since our wedding.  We just filed with USCIS.  Just make sure he brings lots of proof of ties to Canada (lease agreement, employment letter, I bring bank statements too...anything that proves you need to be back in Canada).  I have never been turned away as yet.  

 

Always be truthful to the border guys.  Only provide them with what they ask for, no more.  Look them in the eye and be polite.  Works for me every time.

Thank you! Hey did you all see that, they changed the processing times for Nebraska service centre and now it is 5 months dancin5hr.gif . Does that mean, 5 months from now, or 5 months from the priority date? 

 

I wouldn't get too excited about this.  I am guessing they are factoring in the Phillippine expidites and such.  I am in Nebraska and following it also, but I am only cautiously optimistic because those numbers can be affected by so many factors.   It is good to hear that Congresspeople are this helpful.  Maybe if more of us went through them, more would be done to force those who manage the immigration process to be more efficient and fair.

I have a question for you knowledgeable VJ Members.  I am not even quite sure which forum to post this, so please feel free to move it if need be.  I will try to condense this as much as I can and still give you the big picture, but the circumstances are very personal and long past, and I was a child at the time.

 

The DS260 apparently asks for every single address I have lived at since I turned 16.  When I was 16 our family fell apart.  Here are the facts :

My biological father left my mother and me when I was an infant.  We lived in Canada with my grandparents until my mother met the man who raised me (the man I thought was my father my whole life until?).  We moved to the US with him and lived as a family, and I have three half siblings.

 

My parents split around the time I was 16 and we kids stayed with my dad because mom couldn?t afford to support us.  Around a year or so later (give or take) my dad sends me to live with my mom and we return to Canada.

 

During the time I lived with my dad I went under his last name (education and medical records, everything).  After returning to Canada my mom and I took her maiden name back.  I had no idea that I was Canadian until he arranged to send me to live with her.

 

Now for my question : I did not list my ?father?s? last name in the I130 petition (didn?t even think to, it was so long ago I didn?t think it would be relevant).  I listed my birth father?s, as that is the name I joined the military under, and is the name on my birth certificate.  Now I have to list one address I lived at in the US when I was 16, the rest are in Canada.  I know I can?t omit that time.  How do you think I should report the name?  How do you think it will affect the outcome of our petition.  It is just so long ago, it confuses me just thinking about it.  I am just afraid it is going to complicate things.

 

I never thought that the decisions my parents made way back then could bite me now when I am in my 50s.  Please tell me what you think, and thank you in advance.

Wells Fargo put me on my husband's account and I have linked that account to my US RBC (Royal Bank of Canada) account. I do not live in the US yet and told them so, and they did not have an issue with that fact. I am guessing that it depends on the bank and on the country where you are a resident

I hope I am posting this in the correct place, but I am not at NVC yet so this was logical to me  :).

 

I don't anticipate needing this for quite a while yet, but I am in the process of collecting all the necessary documents that NVC may require when the time comes to process me.   I am working on police checks and certificates and should have the Canadian and German certificates within the next several weeks. 

 

Here is my question... When I was in my teens I lived with my step dad in Connecticut for about a year (I was 16).  Do I need to get a police certificate from there?  I tried to find where I read (at least I thought I read it) in one of the VJ forums that it wasn't necessary because they will run background checks on every name I have used anyway, but I don't want to omit a key document if it actually is required.

 

Could someone clarify this for me?

From what I have been reading it is taking an average of 6 months to process at all the service centers.  The 5 month timeline that USCIS likes to tout is pretty much a myth.  Unless you have been expedited or are one of the lucky random ones that are processed in a timely fashion (and there are not very many of those), best to count on 6 months and if you haven't received your NOA2 by then, start with the calling.  Calling before 6 months is up nowadays seems to be a waste of time.  USCIS is telling folks to wait another month after the 5 month mark.

As previous posters have said, the process has nothing to do with your mom.  I'm sorry you have to go through this.  Your mom is being the selfish one, and I really do hope, for your children's' and your sake that she does come around...especially with the rest of the family on your side.  Maybe once all is said and done and you have moved and things progress smoothly, she will calm down and accept the situation.  You are fortunate to live only 2.5 hours away...it could be across the country.  I wish you the best of luck on your journey and hope your mom comes around soon!  :)

I think it just means that they are working on both petitions, but where is the I-130?  I think it depends on which is approved first as to which visa you will get.  And the majority of the time the I-130 will cancel out the I-129.  Someone with more knowledge can probably explain it better that I, but this is how I understand the process from what I have read here.   Good luck!  :)

Hang in there...NSC is still going through older petitions and they are still adjusicating February.  They are (from what I have been reading) transferring some petitions again to alieviate their backlog, so hopefully yours will come soon.  My PD was 04 Feb and I just got approved yesterday.  Lots of newer ones were approved before mine, which tells me that they are now doing some older ones (ours?).  I hope yours will be approved in a few days.  Good luck :)

My husband texted me this morning to tell me he got a text saying that USCIS received our packet, and the I-797 is on its way.  It has been a rough week for me here so this was great news to receive..especially on a payday Friday.   That only took 8 business days from when it was sent, and I am taking that as a good sign.

 

Now, if I understand things correctly, that comes to me (beneficiary), right?  Happy day!!  :)
