but i still did't get the i-797c and iam wondering why if there is ppl just filed they cases in july and they already got this form so whats wrong with my case iam waiting for this i-797c forever so i can file the i-129f .

my question is :

can i file i-129f without this i-797c ?????

how much the fee for i-129f i have to put in the check now as i already filed the i-130.???

Sorry but i am quite confused with your statement - you mean to say you received I-130 or did you submit it on the date you specified? Also, I-797c's is the same as Notice of Action (NOA)...if you haven't received one yet then you'll have to wait for it to be sent to you by the Service Center where you file your I-130. You will need to attach this to your I-129F form.

i already payed 190$ for the i-130 and soon i will file the i-129f thats mean after 30 july so how much i have to pay then for the i-129f.

Yeah, eternity seems to be the right word if you're waiting for replies from the Service Centers :D. Anyways, im crossing my fingers that we get our NOA1 before the week ends or before the month ends. As you know, come August the fees will increase - we'd like to be able to file our I-129F before the deadline so we can pay the old fee.

I took a peek at your timeline and i did not see you fill up the timeline for your I-129F...have you submitted your I-129F since you got your NOA1 already? Will you push thru with your K-3 Visa or just wait for your IR-1/CR-1? Here's a bit of advice though - IR-1/CR-1 is cheaper but it will take you longer to get your visa. Advantage of this is you already get your green card upon entry to the US. K-3 visa will enable you to enter US earlier but upon entry, you'll have to file AOS which is about 1010 USD come august...

Joined this very helpful site a couple of weeks back and i became an addict instantly with all the info you can get here! :D Anyways, just would like to ask if there are people here who filed a K-3 Visa Petition (we got married in the Philippines just this May 2007) just this July? My wife filed our I-130 last July 11, 2007 (Pacific Standard Time) at CSC and based on from what i read here, it will take at least an average of 10 days before we get our NOA1 (although it seems like an eternity hehehe!). Is this true? It seems processing is much slower this month... :wacko:

Another thing, does CSC work on Saturdays and Sundays? Does it mean that i should not include weekends in my total count of days upon my filing of our I-130?

Can also someone share their timelines too (CSC/Manila, Philippines)?

Lastly, how long does it usually take for us to get our K-3 Visa?

Welcome to Vj MariEnMichelle. The average for a K3 visa through CSC and Manila is around 218 days. Remeber this is only an average and each case has its own timeline.

I noticed that when we received our NOA1 for I-129F it says that the fee was waived. I know for a fact that this was due to the fee increase when filing I-130 and I-129F. However, we filed our I-130 prior to the fee increase which was 190 USD at that time (I-130 is now at 355 USD and I-129F for Fiancee Visa is 455 USD). We also issued a check for 170 USD for the I-129F.

Will this affect our application? In what way?

Will we need to pay additional in the future since we only paid 190 USD for I-130?

By the way, the money was not encashed.

Hi Mari,

If you read the new fees for those forms, you will see that the I-130 cost 355 US$ and the I - 129F is free for the K3 visa.This come cheaper than before, is just the bigger amount at one time. :thumbs:

Yeah, i read that too. However, we filed our I-130 prior to the fee increase which was 190 USD at that time. And our check for the I-129F was returned to us. So all in all we just paid 190 USD - 255 USD short of the new fee. :wacko:

Anyways, we'll probably call up CSC about this and ask whether this will affect our petition or not.

We got a mail from CSC a day after receipt of our I-129F NOA1 which contains the check we issued for our I-129F. It also says that they will proceed with the processing of our application. Hopefully everything turns out well despite we paid only 190 USD for our I-130.

Or i which got me thinking, if we proceed with the CR-1/IR-1 route, will we be then asked to pay the new fee?

I don't think this should affect your petition in any way. They should've cashed your check since your petition was postmarked before 7/31/07. They may still cash it though.

What i meant by "encashed" was that the check we issued for the I-129F was not withdrawn (hope i using the right word now :D) by CSC. I'll have to check with my wife again later if it did was encashed since she has access to her checkbook account.

Hey there!

Congratulations on your marriage! Anyways, i too did not have much knowledge on how to file for our K-3 until i was introduced to this site. I am also thinking of hiring a lawyer but you and your wife will basically do all the work and all you have to do is just read on the flowcharts and forums here and you'll learn a lot. Also, if you think your case is pretty straightforward then i suggest just DIY -> saves you a lot of money. Remember you'll still have to pay $1010 for the AOS if your wife enters US with a K-3 visa.

But again, if you want to speed up the process and if you can afford one then why not?! biggrin.gif

Hi Guys,

We filed our I-130 and I-129 separately last July (I know, this is for August - see our signature below biggrin.gif). However, I noticed that there has not been much difference between the wait time for a K-3 or IR-1/CR-1 visa lately (see my timeline). Some will still opt for K-3, others the IR-1/CR-1 route - this will depend on your priorities and choices. We are still going for the K-3 but there's still this chance that both your I-129F and I-130 can get approved at the same time or the I-130 to follow a couple of weeks later. If this happens, you can opt to do the I-130 interview instead of the I-129F and enter U.S. with a IR-1/CR-1 visa (am i correct? wacko.gif).

No. The $190 fee you paid is only for the I-130. You need not pay the old $170 fee for the I-129F if you filed after July 30 (or if it reached your Service Center after July 30) as per USCIS if you are opting for the K-3 visa (filing I-129F after I-130 or filing it together as some have done will automatically mean that you are filing for K-3). I guess what it really means is that I-129F is free if you are under K-3.

We called up CSC and asked if this will affect or petition and they said NO. Hopefully it does not...or else, hehehehe! biggrin.gif

We have the same experience (see my timelines) and we are also expecting to be together by December. You can always check on the average timelines on the "Timelines" page (http://www.visajourn.../stats.php?cfl=) biggrin.gif. Seems like the processing time did not change last December and stayed above 200 days wacko.gif. But again, this will give you only an idea on how fast the processing is and is case to case basis.

As i've said in my previous posts, hopefully the fee increase will speed things up.

I noticed that there were changes on the USCIS Processing Times specially on the "Processing Timeframe" column as follows:

Correction, there is no packet three in the Philippines that needs to be turned in for interview scheduling. You will receive packet IV and all documents will be taken to the interview. The interview will be scheduled after the petition is forwarded to the Manila Embassy (USEM). Interview dates can be checked on the Embassy website under IV Interview link on the immigrant visa page.

It'll be just the 2 of us...although we will be living with her parents and her sister for the meantime until we get our own place. We don't need to support her parents and her sister though and my wife earns well above 21K (last year she earned more than that annually and she will earn more than that this year now that she works full time).

I thought it was just 17K++ as per the poverty guidelines posted here in this forum?

Any more advice or any one with a similar situation???

Hi Guys,

Need your expert opinion on filing Affidavit of Support...

Affividavit of Support requires the petitioner to submit his/her ITR's for the past 3 years. My wife's annual income during the past 2 years was below the 125% poverty line requirement - this was because she was still studying. However, her last and this year's income is way above the requirement. She works full time as a Nurse and is earning 20+ USD an hour. We also do have savings amounting to around 1K++ USD. Do you think this is enough to cover for everything? Do you think we still need a co-sponsor?

Any advice will be appreciated...

Got our Hardcopies today and it read..." beneficiary is currently residing in the States" on the I-130. So looks like were stuck with the K-3...

Anyways, we'll just keep you posted if we decide to "kickstart" the I-130 in the middle of the processing.

One last question though, If we "kickstart" the I-130, do we forfeit the I-139F???

Things are much clearer now guys! Thanks for your comments! Looks like we're stuck with the K-3...unless both I-130 and I-129F reach NVC...nevertheless, i think what matters is that we're now approved and one step closer to being together! biggrin.gif

Thanks for the quick reply! biggrin.gif We'll go ahead and take a look at the I-130 wording once we receive it.

In case both our I-130 and I-129F are forwarded to the NVC, does this mean we will have 2 case numbers for each? Does this also mean that we will have separate interviews for each once it's forwarded to the Manila Consulate? Can we just "waive" the K-3 and just take the I-130 interview instead? I've read in the guides that we can do this...(http://www.visajourn...page=i130guide1)

Hi Guys,

Our I-130 and I-129F were approved on the same day (Dec. 11, 2007) and we'd like to go the CR-1/IR-1 route instead of taking the K-3 visa since its more practical with all the expensive fees (AOS, EAD) and stuff...

How do we do this? Who do we need to call to inform the immigration guys that we'd like to pursue the I-130 application instead of the I-129F?
